4.5.1. Development <strong>of</strong> <strong>the</strong> Events and <strong>the</strong> Claims <strong>of</strong> <strong>the</strong> Parties<br />

The Master Plan with <strong>the</strong> scale <strong>of</strong> 1/5000 which covers <strong>the</strong> area under litigati<strong>on</strong>,<br />

was approved <strong>on</strong> 21.9.1998. In <strong>the</strong> c<strong>on</strong>cerned Master Plan, <strong>the</strong> area that also covers <strong>the</strong><br />

lot under litigati<strong>on</strong>, was planned as “Urban Work<strong>in</strong>g Area”. The implementati<strong>on</strong> plan<br />

under litigati<strong>on</strong> was approved by <strong>the</strong> Balçova Municipality Assembly <strong>in</strong> 21.2.1995.<br />

Claims <strong>of</strong> <strong>the</strong> Pla<strong>in</strong>tiff Party:<br />

1. The development plan prepared for <strong>the</strong> area and <strong>the</strong> subdivisi<strong>on</strong> plan no. 62 <strong>on</strong><br />

which this plan is based, are focused <strong>on</strong> private <strong>in</strong>terests ra<strong>the</strong>r than public <strong>in</strong>terests.<br />

2. Dur<strong>in</strong>g <strong>the</strong> stages <strong>of</strong> preparati<strong>on</strong> <strong>of</strong> this plan (<strong>on</strong> 7.9.1994) <strong>the</strong> plots that were<br />

owned by Migros A. . were purchased, and before <strong>the</strong> preparati<strong>on</strong> <strong>of</strong> <strong>the</strong> plans, <strong>the</strong><br />

c<strong>on</strong>structi<strong>on</strong> <strong>of</strong> a huge shopp<strong>in</strong>g mall that occupies a covered area <strong>of</strong> 7,000 m2 was<br />

c<strong>on</strong>structed <strong>on</strong> <strong>the</strong> basis <strong>of</strong> a provisi<strong>on</strong>al license. In this respect, <strong>the</strong> plan that has been<br />

developed serves <strong>the</strong> <strong>in</strong>terests <strong>of</strong> <strong>the</strong> Migros-Koç Group, and not that <strong>of</strong> <strong>the</strong> land<br />

owners. As <strong>the</strong> outcome <strong>of</strong> <strong>the</strong> realizati<strong>on</strong> <strong>of</strong> this plan, title deeds divided <strong>in</strong>to shares<br />

will be <strong>of</strong>fered, and <strong>the</strong> lots will be sold at prices lower than <strong>the</strong>ir actual values as <strong>the</strong><br />

outcome <strong>of</strong> <strong>the</strong> legal acti<strong>on</strong>s to be <strong>in</strong>itiated aga<strong>in</strong>st this partnership.<br />

3. S<strong>in</strong>ce subdivisi<strong>on</strong> plan no. 62 will be impracticable <strong>on</strong> behalf <strong>of</strong> <strong>the</strong> land owners<br />

due to <strong>the</strong> magnitude <strong>of</strong> <strong>the</strong> plot; hence, it will be sold to <strong>the</strong> land speculators, and those<br />

who purchase <strong>the</strong>se lands will generate substantial pr<strong>of</strong>its <strong>in</strong> <strong>the</strong> l<strong>on</strong>g run.<br />

4. In this <strong>process</strong>, <strong>the</strong> land speculators shall generate unfair pr<strong>of</strong>its.<br />

5. S<strong>in</strong>ce <strong>the</strong> regi<strong>on</strong>s that lie bey<strong>on</strong>d <strong>the</strong> area under litigati<strong>on</strong> have been planned as<br />

residential areas for upper <strong>in</strong>come groups, <strong>the</strong> c<strong>on</strong>cerned regi<strong>on</strong> should also be<br />

designated as a residential area.<br />

6. There exists an adequate number <strong>of</strong> tourism and recreati<strong>on</strong> areas, Moreover, <strong>the</strong><br />

c<strong>on</strong>cerned neighborhood also has an adequate supply <strong>of</strong> shopp<strong>in</strong>g centers, and <strong>the</strong>re are<br />

no demands for more shopp<strong>in</strong>g malls.<br />

7. Should <strong>the</strong> neighborhood be planned as a residential area, <strong>the</strong> landowners are ready<br />

to separate <strong>the</strong> comm<strong>on</strong> grounds and erect c<strong>on</strong>structi<strong>on</strong>s <strong>on</strong> <strong>the</strong>se lots.<br />
