borders <strong>of</strong> <strong>the</strong> development plan, <strong>on</strong> <strong>the</strong> decisi<strong>on</strong> to be passed, and <strong>on</strong> <strong>the</strong> procedures<br />

and pr<strong>in</strong>ciples that will be taken as basis <strong>in</strong> <strong>the</strong> pass<strong>in</strong>g <strong>of</strong> <strong>the</strong> c<strong>on</strong>cerned decisi<strong>on</strong>.<br />

Never<strong>the</strong>less, <strong>the</strong> request c<strong>on</strong>cern<strong>in</strong>g <strong>the</strong> <strong>in</strong>vestigati<strong>on</strong> <strong>of</strong> this issue was accepted, for<br />

purposes <strong>of</strong> determ<strong>in</strong>ati<strong>on</strong> <strong>of</strong> whe<strong>the</strong>r or not <strong>the</strong> pla<strong>in</strong>tiff is authorized to <strong>in</strong>itiate this<br />

legal acti<strong>on</strong>. However, vis-a-vis <strong>the</strong> generally accepted case laws, it must be agreed that<br />

<strong>in</strong> disagreements aris<strong>in</strong>g from <strong>the</strong> implementati<strong>on</strong> <strong>of</strong> development plans and plans, <strong>the</strong><br />

pers<strong>on</strong>s who are residents <strong>in</strong> <strong>the</strong> area under litigati<strong>on</strong> shall be entitled to <strong>in</strong>itiate legal<br />

acti<strong>on</strong>.<br />

The Adm<strong>in</strong>istrati<strong>on</strong> <strong>of</strong> Balçova Municipality has submitted ano<strong>the</strong>r applicati<strong>on</strong><br />

to <strong>the</strong> council <strong>of</strong> state with a demand c<strong>on</strong>cern<strong>in</strong>g <strong>the</strong> repeal <strong>of</strong> <strong>the</strong> “<strong>in</strong>sistence decisi<strong>on</strong>”<br />

passed by <strong>the</strong> local court <strong>in</strong> December 20012. In its justificati<strong>on</strong> c<strong>on</strong>cern<strong>in</strong>g this<br />

applicati<strong>on</strong>, <strong>the</strong> adm<strong>in</strong>istrati<strong>on</strong> has asserted that <strong>the</strong> “<strong>the</strong> rais<strong>in</strong>g <strong>of</strong> a claim <strong>on</strong> grounds<br />

that an immovable that is <strong>in</strong> proximity <strong>of</strong> <strong>the</strong> approved borders <strong>of</strong> <strong>the</strong> development plan<br />

shall def<strong>in</strong>itely be affected from <strong>the</strong> development plan” <strong>in</strong> not c<strong>on</strong>sistent with <strong>the</strong><br />

fundamentals and pr<strong>in</strong>ciples <strong>of</strong> city plann<strong>in</strong>g.<br />

4.4.1.1.3. Third Phase <strong>of</strong> <strong>the</strong> Acti<strong>on</strong><br />

Dur<strong>in</strong>g this phase, while <strong>on</strong> <strong>on</strong>e hand <strong>the</strong> legal acti<strong>on</strong>s <strong>in</strong>itiated for <strong>the</strong><br />

cancellati<strong>on</strong> <strong>of</strong> <strong>the</strong> development plans were <strong>in</strong> progress, <strong>on</strong> <strong>the</strong> o<strong>the</strong>r hand, <strong>the</strong><br />

permissi<strong>on</strong> for <strong>the</strong> erecti<strong>on</strong> <strong>of</strong> light <strong>in</strong>dustry site was issued by <strong>the</strong> c<strong>on</strong>cerned<br />

municipality.<br />

The developments that took place dur<strong>in</strong>g this phase, were as follows:<br />

The applicati<strong>on</strong> submitted by <strong>the</strong> S.S. Balçova Light Industry Site C<strong>on</strong>structi<strong>on</strong><br />

Cooperative <strong>on</strong> 31.12.1998 for <strong>the</strong> receipt <strong>of</strong> a c<strong>on</strong>structi<strong>on</strong> license <strong>in</strong> accordance with<br />

<strong>the</strong> current development plan and regulati<strong>on</strong>s, was accepted by <strong>the</strong> Balçova<br />

Municipality, and a c<strong>on</strong>structi<strong>on</strong> license was issued to <strong>the</strong> Cooperative <strong>on</strong> 16.4.1999.<br />

However, up<strong>on</strong> <strong>the</strong> decisi<strong>on</strong> <strong>of</strong> <strong>the</strong> adm<strong>in</strong>istrative court c<strong>on</strong>cern<strong>in</strong>g <strong>the</strong> revocati<strong>on</strong> <strong>of</strong> <strong>the</strong><br />

plan (with<strong>in</strong> <strong>the</strong> c<strong>on</strong>text <strong>of</strong> <strong>the</strong> <strong>process</strong> expla<strong>in</strong>ed above), <strong>the</strong> Balçova Municipality<br />

Committee has decided <strong>on</strong> <strong>the</strong> cancellati<strong>on</strong> <strong>of</strong> <strong>the</strong> licenses granted <strong>in</strong> c<strong>on</strong>necti<strong>on</strong> with<br />

<strong>the</strong> light <strong>in</strong>dustry site. In <strong>the</strong> aftermath <strong>of</strong> this decisi<strong>on</strong>, Balçova Municipality<br />
