Expert Report:<br />
1. The purpose <strong>of</strong> <strong>the</strong> city plann<strong>in</strong>g discipl<strong>in</strong>e is to ensure that <strong>the</strong> urban activities, that<br />
entail urban land use, are positi<strong>on</strong>ed <strong>in</strong> <strong>the</strong> most appropriate locati<strong>on</strong>s and magnitudes,<br />
<strong>in</strong> <strong>the</strong> available physical space, and to ensure an effective and efficient transportati<strong>on</strong><br />
and communicati<strong>on</strong> system am<strong>on</strong>g such activities. The pr<strong>in</strong>ciples <strong>in</strong> <strong>the</strong> selecti<strong>on</strong> <strong>of</strong><br />
space identified for this for this purpose, c<strong>on</strong>sist <strong>of</strong> <strong>the</strong> pr<strong>in</strong>ciples relat<strong>in</strong>g to <strong>the</strong> slope <strong>of</strong><br />
<strong>the</strong> land, capability <strong>of</strong> <strong>the</strong> ground, endemic plantati<strong>on</strong> <strong>of</strong> <strong>the</strong> area, ownership structure,<br />
<strong>the</strong> compatibility-<strong>in</strong>compatibility <strong>of</strong> <strong>the</strong> land for o<strong>the</strong>r types <strong>of</strong> utilizati<strong>on</strong>, <strong>the</strong> vic<strong>in</strong>ity-<br />
remoteness <strong>of</strong> <strong>the</strong> area, <strong>the</strong> magnitude <strong>of</strong> <strong>the</strong> land and its potential for development, its<br />
distance to <strong>the</strong> exist<strong>in</strong>g and planned transportati<strong>on</strong> systems, etc. The objectives <strong>of</strong> such<br />
criteria, are to ensure <strong>the</strong> objective, efficient and effective plann<strong>in</strong>g, and to improve<br />
social welfare. These criteria enable <strong>the</strong> city planners to develop a healthy, safe and<br />
es<strong>the</strong>tic urban landscape and to protect <strong>the</strong> natural envir<strong>on</strong>ment.<br />
2. Based <strong>on</strong> <strong>the</strong> aforementi<strong>on</strong>ed criteria, <strong>the</strong> are that is <strong>the</strong> subject matter <strong>of</strong> litigati<strong>on</strong>,<br />
must be entirely disallowed for c<strong>on</strong>structi<strong>on</strong>s. It is an area that should be kept under<br />
protecti<strong>on</strong>, and that should be strictly disallowed for urban development. The plann<strong>in</strong>g<br />
<strong>of</strong> such a piece <strong>of</strong> land as urban area, shall c<strong>on</strong>flict with all plann<strong>in</strong>g rules and<br />
pr<strong>in</strong>ciples, as well as public <strong>in</strong>terest. The plantati<strong>on</strong> <strong>on</strong> <strong>the</strong> landscape should be<br />
protected for <strong>the</strong> avoidance <strong>of</strong> erosi<strong>on</strong> and floods.<br />
3. The slope <strong>of</strong> <strong>the</strong> land makes it unsuitable for its utilizati<strong>on</strong> as a residence area; <strong>the</strong><br />
utilizati<strong>on</strong> <strong>of</strong> this piece <strong>of</strong> land for small <strong>in</strong>dustry, would be <strong>in</strong>c<strong>on</strong>ceivable with regard<br />
to <strong>the</strong> rules <strong>of</strong> city plann<strong>in</strong>g.<br />
4. The projected utilizati<strong>on</strong> that is currently under litigati<strong>on</strong>, implicate a high risk <strong>of</strong><br />
fire and envir<strong>on</strong>mental polluti<strong>on</strong>. The utilizati<strong>on</strong> <strong>of</strong> such a landscape and <strong>the</strong> forest<br />
areas that are highly sensitive aga<strong>in</strong>st such risks, will be grossly <strong>in</strong>compatible with <strong>the</strong><br />
city plann<strong>in</strong>g pr<strong>in</strong>ciples and public <strong>in</strong>terests.<br />
5. The proposed area, does not <strong>of</strong>fer any expediencies with respect to access and<br />
transportati<strong>on</strong> <strong>in</strong> terms <strong>of</strong> city traffic. As a rule, such areas should be utilized for no<br />
o<strong>the</strong>r purposes besides green z<strong>on</strong>es.<br />
6. The fact that <strong>the</strong> shops located <strong>in</strong> <strong>the</strong> Mithatpa a Road are be<strong>in</strong>g demolished, shall<br />
not justify <strong>the</strong> plann<strong>in</strong>g <strong>of</strong> <strong>the</strong> area under litigati<strong>on</strong> as a light <strong>in</strong>dustry site.<br />
7. In <strong>the</strong> C<strong>on</strong>structi<strong>on</strong> Law and <strong>the</strong> relevant Regulati<strong>on</strong>, it is clearly stipulated that <strong>the</strong><br />
development plans must be <strong>in</strong> c<strong>on</strong>formity with <strong>the</strong> Master Plans with bigger scale. The<br />
