4.4.1.1. The Claims <strong>of</strong> <strong>the</strong> Parties <strong>in</strong> <strong>the</strong> Acti<strong>on</strong>s C<strong>on</strong>cern<strong>in</strong>g <strong>the</strong><br />

Development Plan for <strong>the</strong> Light Industry Site<br />

4.4.1.1.1. First Phase <strong>of</strong> <strong>the</strong> Acti<strong>on</strong><br />

Claims <strong>of</strong> <strong>the</strong> Pla<strong>in</strong>tiff:<br />

1. The area that was designated as <strong>the</strong> Light Industry Site is a piece <strong>of</strong> land c<strong>on</strong>ta<strong>in</strong><strong>in</strong>g<br />

olive trees and p<strong>in</strong>e trees, with a slope <strong>of</strong> 55-60%. With <strong>the</strong> c<strong>on</strong>structi<strong>on</strong> <strong>of</strong> <strong>the</strong> Light<br />

Industry Site, <strong>the</strong> olive trees and <strong>the</strong> p<strong>in</strong>e trees <strong>in</strong> <strong>the</strong> area will be cut down and this<br />

beautiful pastoral landscape will be destroyed.<br />

2. Access to <strong>the</strong> regi<strong>on</strong> o<strong>the</strong>r than <strong>the</strong> Balçova ma<strong>in</strong> artery, is impossible. The traffic<br />

that will be created due to <strong>the</strong> places <strong>of</strong> bus<strong>in</strong>ess to be located <strong>in</strong> this area, will result <strong>in</strong><br />

<strong>the</strong> occurrence <strong>of</strong> an unmanageable traffic jam <strong>in</strong> <strong>the</strong> Balçova area.<br />

3. The plann<strong>in</strong>g that has been developed implicates very serious drawbacks from <strong>the</strong><br />

standpo<strong>in</strong>t <strong>of</strong> city plann<strong>in</strong>g. The area <strong>in</strong> questi<strong>on</strong> must be designated and planned as<br />

residential are with gardens.<br />

4. Prior to <strong>the</strong> approval <strong>of</strong> <strong>the</strong> development plan with a scale <strong>of</strong> 1/1000, Balçova<br />

Municipality has <strong>in</strong>itiated <strong>the</strong> expropriati<strong>on</strong> procedures. The work<strong>in</strong>g mach<strong>in</strong>es have<br />

already begun <strong>the</strong>ir operati<strong>on</strong>s <strong>in</strong> <strong>the</strong> land, which means that Balçova Municipality is<br />

determ<strong>in</strong>ed to put <strong>the</strong> plan <strong>in</strong>to practice.<br />

The Defendant: Balçova Municipality Management<br />

1. When this area located between <strong>the</strong> Mithatpa a Road and <strong>the</strong> zmir - Çe me<br />

Highway was allocated for o<strong>the</strong>r purposes as <strong>the</strong> result <strong>of</strong> <strong>the</strong> development plan 81 that<br />

was put <strong>in</strong>to implementati<strong>on</strong>, <strong>the</strong> car repair shops, carpentry workshops, and blacksmith<br />

shops that were located <strong>in</strong> <strong>the</strong> area, were decided to be demolished. The regulati<strong>on</strong><br />

under litigati<strong>on</strong> was formulated <strong>in</strong> order to prevent <strong>the</strong> suffer<strong>in</strong>g <strong>of</strong> c<strong>on</strong>cerned small<br />

merchants from ec<strong>on</strong>omic losses. The topographical structure <strong>of</strong> <strong>the</strong> c<strong>on</strong>cerned land is<br />

not suitable for residential purposes. Moreover, <strong>the</strong> plan has been developed for public<br />

<strong>in</strong>terests. It is also c<strong>on</strong>sistent with <strong>the</strong> z<strong>on</strong><strong>in</strong>g and city plann<strong>in</strong>g rules.<br />
