Locati<strong>on</strong>s <strong>of</strong> <strong>the</strong> proceeded acti<strong>on</strong>s <strong>of</strong> objecti<strong>on</strong>s regard<strong>in</strong>g demoliti<strong>on</strong> decis<strong>on</strong>s<br />

are shown <strong>in</strong> Fig.4.6. It can be seen <strong>in</strong> <strong>the</strong> figure that, acti<strong>on</strong>s regard<strong>in</strong>g demoliti<strong>on</strong><br />

decisi<strong>on</strong>s <strong>in</strong> Balçova settlement c<strong>on</strong>centrate <strong>in</strong> first and sec<strong>on</strong>d degree geo<strong>the</strong>rmal<br />

protecti<strong>on</strong> z<strong>on</strong>es and <strong>in</strong> Korutürk, Teleferik, Onur quarters <strong>in</strong>side residential area<br />

boundaries. In nciraltı and Bahçelerarası quarters, <strong>the</strong>re is not any exist<strong>in</strong>g acti<strong>on</strong><br />

regard<strong>in</strong>g demoliti<strong>on</strong> decisi<strong>on</strong>. As a result <strong>of</strong> <strong>the</strong> land use work<strong>in</strong>g and <strong>the</strong> <strong>in</strong>terview<br />

from <strong>the</strong> municipality departments, it was seen that most <strong>of</strong> <strong>the</strong> demoliti<strong>on</strong> decisi<strong>on</strong><br />

taken by <strong>the</strong> courts do not applicated.<br />

4.3.4. The Demand C<strong>on</strong>cern<strong>in</strong>g <strong>the</strong> Cancellati<strong>on</strong> <strong>of</strong> <strong>the</strong> Subdivisi<strong>on</strong><br />

Plan<br />

Article 18 <strong>of</strong> Law No. 3194, is acknowledged as <strong>on</strong>e <strong>of</strong> <strong>the</strong> important<br />

<strong>in</strong>struments <strong>in</strong> <strong>the</strong> implementati<strong>on</strong> <strong>of</strong> <strong>the</strong> subdivisi<strong>on</strong> plans. The Subdivisi<strong>on</strong> <strong>process</strong><br />

that is applied pursuant to this article, which regulates <strong>the</strong> Improvements that are Made<br />

<strong>on</strong> Lands and Lots, can be def<strong>in</strong>ed as <strong>the</strong> <strong>process</strong> <strong>of</strong> separati<strong>on</strong> <strong>of</strong> <strong>the</strong> lands and lots that<br />

are <strong>in</strong>cluded with<strong>in</strong> <strong>the</strong> borders <strong>of</strong> <strong>the</strong> development plan <strong>in</strong> accordance with <strong>the</strong> cadastre<br />

and/or development subdivisi<strong>on</strong>, without hav<strong>in</strong>g to receive <strong>the</strong> c<strong>on</strong>sent <strong>of</strong> <strong>the</strong> owners <strong>of</strong><br />

<strong>the</strong> property. The authorizati<strong>on</strong> to execute and approve <strong>the</strong> subdivisi<strong>on</strong> <strong>process</strong> with<strong>in</strong><br />

<strong>the</strong> borders <strong>of</strong> a given municipality, bel<strong>on</strong>g to <strong>the</strong> c<strong>on</strong>cerned municipality. Subdivisi<strong>on</strong><br />

plan <strong>in</strong>volves <strong>the</strong> acquisiti<strong>on</strong> <strong>of</strong> a porti<strong>on</strong> <strong>of</strong> up to 35% <strong>of</strong> <strong>the</strong> real property under private<br />

ownership without expropriati<strong>on</strong>, for purposes <strong>of</strong> utilizati<strong>on</strong> as public areas.<br />

In Article 18 <strong>of</strong> <strong>the</strong> C<strong>on</strong>structi<strong>on</strong> Law, and <strong>in</strong> <strong>the</strong> “Regulati<strong>on</strong> C<strong>on</strong>cern<strong>in</strong>g <strong>the</strong><br />

Pr<strong>in</strong>ciples Relat<strong>in</strong>g to <strong>the</strong> Improvements <strong>on</strong> Lands and Lots to be Applied Pursuant to<br />

Article 18 <strong>of</strong> <strong>the</strong> C<strong>on</strong>structi<strong>on</strong> Law, which was put <strong>in</strong>to effect <strong>in</strong> 1985, it is stipulated<br />

through a provisi<strong>on</strong> that provided that it does not exceed a proporti<strong>on</strong> <strong>of</strong> 35%, privately<br />

owned real property may, for <strong>on</strong>e time <strong>on</strong>ly, be allocated to <strong>the</strong> use <strong>of</strong> general services<br />

that are needed <strong>in</strong> <strong>the</strong> rec<strong>on</strong>structed areas, such as roads, squares, parks, park<strong>in</strong>g lots,<br />
