discussed s<strong>in</strong>ce 1995, have been chang<strong>in</strong>g. Litigati<strong>on</strong> <strong>process</strong> reflects <strong>on</strong>ly a part <strong>of</strong><br />

<strong>the</strong>se differentials.<br />

4.3.2.2. Acti<strong>on</strong>s Regard<strong>in</strong>g Özdilek<br />

In additi<strong>on</strong> to decisi<strong>on</strong>s <strong>of</strong> <strong>the</strong> committee, <strong>the</strong>re are two more acti<strong>on</strong>s that<br />

represent <strong>the</strong> dimensi<strong>on</strong>s <strong>of</strong> <strong>the</strong> c<strong>on</strong>flicts exist <strong>on</strong> <strong>the</strong> area. First <strong>on</strong>e is <strong>the</strong> acti<strong>on</strong><br />

regard<strong>in</strong>g annulment <strong>of</strong> <strong>the</strong> license <strong>of</strong> Özdilek Tourism Centre situated <strong>in</strong> <strong>the</strong> area and<br />

exists <strong>in</strong> <strong>the</strong> extent <strong>of</strong> committee’s decisi<strong>on</strong>s. Sec<strong>on</strong>d <strong>on</strong>e is <strong>the</strong> acti<strong>on</strong> regard<strong>in</strong>g <strong>the</strong><br />

annulment <strong>of</strong> <strong>the</strong> plan. This acti<strong>on</strong> was brought by Central Office <strong>of</strong> TMMOB Chamber<br />

<strong>of</strong> Architects aga<strong>in</strong>st <strong>the</strong> decisi<strong>on</strong> <strong>of</strong> Tourism Centre approved by <strong>the</strong> M<strong>in</strong>istry. (See<br />

Fig.: 4.7 &4.8). 80<br />

One <strong>of</strong> <strong>the</strong>se acti<strong>on</strong>s is <strong>the</strong> annulment request <strong>of</strong> Central Office <strong>of</strong> TMMOB<br />

Chamber <strong>of</strong> Architects regard<strong>in</strong>g <strong>the</strong> Master Plan Changes realized <strong>on</strong> <strong>the</strong> plots<br />

purchased by Özdilek Company. Sec<strong>on</strong>d <strong>on</strong>e is <strong>the</strong> objecti<strong>on</strong> acti<strong>on</strong> proceeded by<br />

Özdilek Company aga<strong>in</strong>st <strong>the</strong> decisi<strong>on</strong> taken accord<strong>in</strong>g to Committee’s Decisi<strong>on</strong><br />

No:8050 regard<strong>in</strong>g <strong>the</strong> annulment <strong>of</strong> C<strong>on</strong>structi<strong>on</strong> license <strong>of</strong> <strong>the</strong> build<strong>in</strong>g which was<br />

commenced before committee’s decisi<strong>on</strong>. Both two acti<strong>on</strong>s were proceeded <strong>in</strong> zmir<br />

Adm<strong>in</strong>istrative Courts. Chr<strong>on</strong>ologically this <strong>process</strong> has developed as follows:<br />

1. In 1991: By <strong>the</strong> decisi<strong>on</strong> <strong>of</strong> <strong>the</strong> Council <strong>of</strong> M<strong>in</strong>isters dated 13.08.1991 and numbered<br />

91/2137; a group <strong>of</strong> regi<strong>on</strong>s, <strong>in</strong>clud<strong>in</strong>g <strong>the</strong> area where Özdilek Company existed, have<br />

been announced as Tourism Area and Tourism Centre.<br />

2. In 1995: After announcement <strong>of</strong> <strong>the</strong> decisi<strong>on</strong> <strong>of</strong> <strong>the</strong> Council <strong>of</strong> M<strong>in</strong>isters, Özdilek<br />

Company had purchased plots <strong>in</strong> order to make tourism and shopp<strong>in</strong>g center <strong>in</strong> zmir-<br />

nciraltı regi<strong>on</strong>.<br />

3. In 1996: By <strong>the</strong> Master Plan Revisi<strong>on</strong> <strong>of</strong> Greater Municipality <strong>of</strong> zmir Scaled<br />

1/25000, <strong>the</strong> plot bel<strong>on</strong>g<strong>in</strong>g to Özdilek Company has been declared as Tourism Area.<br />
