een made by <strong>the</strong> pr<strong>in</strong>ciple decisi<strong>on</strong> <strong>of</strong> M<strong>in</strong>istry <strong>of</strong> Culture – Supreme Committee <strong>of</strong><br />

Protecti<strong>on</strong> <strong>of</strong> Cultural and Natural Heritage that has been established by <strong>the</strong> Act<br />

No.2863. However, <strong>the</strong>se decisi<strong>on</strong>s have <strong>of</strong>ten been changed. Accord<strong>in</strong>g to <strong>the</strong><br />

observati<strong>on</strong>s <strong>on</strong> <strong>the</strong> area and <str<strong>on</strong>g>evaluati<strong>on</strong></str<strong>on</strong>g>s <strong>of</strong> necessary documents, it has been noticed<br />

that, regard<strong>in</strong>g area has been occupied by commercial build<strong>in</strong>gs, touristic build<strong>in</strong>gs,<br />

educati<strong>on</strong> build<strong>in</strong>gs, highways, residences (villas and dwell<strong>in</strong>gs). Settlements have<br />

entered a functi<strong>on</strong>al alterati<strong>on</strong> <strong>process</strong> because <strong>of</strong> rapid and <strong>in</strong>tensive build<strong>in</strong>g demand<br />

and pressure. As <strong>the</strong> Act <strong>on</strong> Protecti<strong>on</strong> <strong>of</strong> Cultural and Natural Heritage No.2863<br />

(Decisi<strong>on</strong> Amendment No.3386) and related regulati<strong>on</strong>s are evaluated accord<strong>in</strong>g to<br />

pr<strong>in</strong>ciple decisi<strong>on</strong>s <strong>of</strong> Supreme Committee by c<strong>on</strong>sider<strong>in</strong>g public <strong>in</strong>terest, it has been<br />

noticed that, regard<strong>in</strong>g area has <strong>the</strong> characteristics <strong>of</strong> be<strong>in</strong>g a natural site accord<strong>in</strong>g to its<br />

ecologic elements and landscape structure like; topographic/geomorphic features, local<br />

climatic c<strong>on</strong>diti<strong>on</strong>s, hydrographic and natural flora as a whole. However, as a result <strong>of</strong><br />

site grad<strong>in</strong>g <str<strong>on</strong>g>evaluati<strong>on</strong></str<strong>on</strong>g> by c<strong>on</strong>sider<strong>in</strong>g socio-ec<strong>on</strong>omic and cultural needs <strong>of</strong> <strong>the</strong> urban<br />

area with o<strong>the</strong>r criteria, it has been decided that, related area does not have <strong>the</strong><br />

characteristics appropriate with <strong>the</strong> def<strong>in</strong>iti<strong>on</strong> <strong>of</strong> first degree natural site. Accord<strong>in</strong>g to<br />

this c<strong>on</strong>clusi<strong>on</strong>, <strong>in</strong> <strong>the</strong> c<strong>on</strong>diti<strong>on</strong> <strong>of</strong> chang<strong>in</strong>g site degree <strong>of</strong> <strong>the</strong> area that causes<br />

litigati<strong>on</strong>; it will be possible to c<strong>on</strong>t<strong>in</strong>ue and protect its natural site characteristics as a<br />

whole.”<br />

As a result <strong>of</strong> <strong>the</strong> studies <strong>on</strong> <strong>the</strong> area realized by c<strong>on</strong>sider<strong>in</strong>g public <strong>in</strong>terest,<br />

expert committee has decided <strong>in</strong> legal frame that “<strong>the</strong> area has <strong>the</strong> characteristics <strong>of</strong><br />

be<strong>in</strong>g a natural site, however, it is not a first degree natural site.” By <strong>the</strong> observati<strong>on</strong>s<br />

<strong>the</strong>y made <strong>on</strong> <strong>the</strong> area, expert committee also exposed <strong>the</strong> aimless land use and<br />

occupati<strong>on</strong> <strong>on</strong> <strong>the</strong> area. Although socio-ec<strong>on</strong>omic and cultural needs <strong>of</strong> <strong>the</strong> city have not<br />

been clarified, <strong>the</strong>y claimed that, site grad<strong>in</strong>g <strong>of</strong> <strong>the</strong> area for <strong>the</strong>se needs were not<br />

appropriate with acts and regulati<strong>on</strong>s.<br />

In <strong>the</strong> acti<strong>on</strong>s proceeded <strong>in</strong> Adm<strong>in</strong>istrative Courts <strong>in</strong> zmir, court decisi<strong>on</strong>s,<br />

which base <strong>on</strong> <strong>the</strong>se expertise reports, can vary. Two different decisi<strong>on</strong>s have been<br />

taken by <strong>the</strong> courts. First <strong>on</strong>e is <strong>the</strong> annulment <strong>of</strong> <strong>the</strong> procedure that has caused<br />

litigati<strong>on</strong>, which means <strong>the</strong> decisi<strong>on</strong> <strong>of</strong> acceptance <strong>of</strong> <strong>the</strong> acti<strong>on</strong> <strong>in</strong> favour <strong>of</strong> pla<strong>in</strong>tiff.<br />

These decisi<strong>on</strong>s claim that, natural site decisi<strong>on</strong>s are not appropriate with law. In sec<strong>on</strong>d<br />

k<strong>in</strong>d <strong>of</strong> decisi<strong>on</strong>s, courts have accepted <strong>the</strong> procedure caus<strong>in</strong>g litigati<strong>on</strong> as appropriate<br />

with law, and have rejected <strong>the</strong> acti<strong>on</strong> aga<strong>in</strong>st <strong>the</strong> pla<strong>in</strong>tiff and approved <strong>the</strong> decisi<strong>on</strong>s <strong>of</strong><br />

<strong>the</strong> committee. These courts, who decided <strong>the</strong> rejecti<strong>on</strong> <strong>of</strong> acti<strong>on</strong> aga<strong>in</strong>st pla<strong>in</strong>tiff, have<br />
