<strong>in</strong>to c<strong>on</strong>siderati<strong>on</strong>. This <strong>process</strong>, which is def<strong>in</strong>ed as rel<strong>in</strong>quishment pr<strong>in</strong>ciple, <strong>in</strong>dicates<br />

<strong>the</strong> importance <strong>of</strong> <strong>the</strong> problem regard<strong>in</strong>g who rel<strong>in</strong>quishes, from what and <strong>in</strong> which<br />

scale. In this pattern needs, priority and <strong>justice</strong> criteria should be re-discussed for <strong>the</strong><br />

residences <strong>in</strong> return for <strong>the</strong> paid value (m² unit price) <strong>of</strong> <strong>the</strong> property and equality <strong>of</strong> <strong>the</strong><br />

distributi<strong>on</strong> <strong>of</strong> public <strong>in</strong>terest are <strong>the</strong> ma<strong>in</strong> discussi<strong>on</strong> subjects. 74<br />

nciraltı and Bahçelerarası quarters <strong>in</strong> Balçova County and Sahilevleri quarter <strong>in</strong><br />

Narlıdere County.<br />

Transacti<strong>on</strong>s caus<strong>in</strong>g acti<strong>on</strong>: Accord<strong>in</strong>g to <strong>the</strong> pr<strong>in</strong>ciple decisi<strong>on</strong>s <strong>of</strong> zmir No.1<br />

CPCNH dated 14.07.1998 / numbered 596 and dated 12.03.1999 / numbered 641;<br />

follow<strong>in</strong>g decisi<strong>on</strong>s were taken <strong>on</strong> 01.07.1999 by <strong>the</strong> committee:<br />

1. Decisi<strong>on</strong> No.8049 <strong>in</strong>clud<strong>in</strong>g Sahilevleri quarter <strong>in</strong> Narlıdere county<br />

2. Decisi<strong>on</strong> No.8050 <strong>in</strong>clud<strong>in</strong>g nciraltı and Bahçelerarası quarters <strong>in</strong> Balçova<br />

county<br />

3. Decisi<strong>on</strong> No.10168 dated 17.12.2002 <strong>in</strong>clud<strong>in</strong>g <strong>the</strong> same quarters <strong>in</strong> Balçova<br />

County.<br />

By above menti<strong>on</strong>ed decisi<strong>on</strong>s, zmir Çakalburnu Dalyan area has been<br />

registered as Natural Site by <strong>the</strong> committee. Objecti<strong>on</strong>s <strong>of</strong> property owners to <strong>the</strong><br />

registrati<strong>on</strong> <strong>of</strong> <strong>the</strong> area as First Degree Natural Site c<strong>on</strong>stitute <strong>the</strong> subjects <strong>of</strong> acti<strong>on</strong>s.<br />

151 acti<strong>on</strong>s through 153 acti<strong>on</strong>s <strong>in</strong> total c<strong>on</strong>sist <strong>of</strong> <strong>the</strong> objecti<strong>on</strong>s to Decisi<strong>on</strong>s No.8050<br />

and No.10168 <strong>in</strong>side boundaries <strong>of</strong> Balçova County. Rema<strong>in</strong><strong>in</strong>g 2 acti<strong>on</strong>s are <strong>the</strong><br />

objecti<strong>on</strong>s to Decisi<strong>on</strong> No.8049 <strong>in</strong>side boundaries <strong>of</strong> Narlıdere County. One <strong>of</strong> <strong>the</strong>se<br />

74 Delay <strong>in</strong> <strong>the</strong> payment <strong>of</strong> expropriati<strong>on</strong> value and low prices are some <strong>of</strong> <strong>the</strong> claims <strong>of</strong> <strong>the</strong> pla<strong>in</strong>tiff<br />

parties. In <strong>the</strong> <strong>in</strong>terviews realized with <strong>the</strong> headmen <strong>of</strong> <strong>the</strong> quarters, pla<strong>in</strong>tiffs have been tried to be found<br />

out and reached but no <strong>in</strong>formati<strong>on</strong> could be obta<strong>in</strong>ed. Headmen <strong>of</strong> <strong>the</strong> quarters stated that, property<br />

owners have move to o<strong>the</strong>r quarters as tenants.<br />
