Acti<strong>on</strong>s <strong>of</strong> nullity regard<strong>in</strong>g <strong>the</strong> expropriati<strong>on</strong>s and related development plans<br />

were proceeded between 1995-1997 and c<strong>on</strong>cluded between 1998-1999. As a result <strong>of</strong><br />

<strong>the</strong> acti<strong>on</strong>s, c<strong>on</strong>structi<strong>on</strong> <strong>of</strong> exist<strong>in</strong>g zmir-Çe me Highway c<strong>on</strong>necti<strong>on</strong> was c<strong>on</strong>cluded<br />

and it is be<strong>in</strong>g used today.(See Fig.:4.7)<br />

4.3.1.3. General Evaluati<strong>on</strong><br />

As litigati<strong>on</strong> <strong>process</strong> is evaluated accord<strong>in</strong>g to legal <strong>justice</strong>, it can be said that, it<br />

is realized <strong>in</strong> a fair <strong>process</strong> through procedures accepted by law. In general <str<strong>on</strong>g>evaluati<strong>on</strong></str<strong>on</strong>g><br />

<strong>process</strong>, c<strong>on</strong>clusi<strong>on</strong> <strong>of</strong> follow<strong>in</strong>g litigati<strong>on</strong> procedures have been observed; parties have<br />

submitted <strong>the</strong>ir claims and experts, which were appo<strong>in</strong>ted by <strong>in</strong>dependent courts, have<br />

evaluated <strong>the</strong>se claims <strong>of</strong> parties. In <strong>the</strong> transacti<strong>on</strong>s applied <strong>in</strong> <strong>the</strong> court decisi<strong>on</strong>s that<br />

were made accord<strong>in</strong>g to expertise reports, decisi<strong>on</strong>s have been produced as <strong>the</strong>re has<br />

been no c<strong>on</strong>tradicti<strong>on</strong> aga<strong>in</strong>st acts and regulati<strong>on</strong>s. Objecti<strong>on</strong>s aga<strong>in</strong>st local court<br />

decisi<strong>on</strong>s have been exam<strong>in</strong>ed aga<strong>in</strong> <strong>in</strong> legal framework and approved also by <strong>the</strong><br />

Council <strong>of</strong> State. In this legal-procedural <strong>process</strong> “<strong>justice</strong>” decisi<strong>on</strong>s have been<br />

c<strong>on</strong>cluded.<br />

If claims and c<strong>on</strong>tents/substance <strong>of</strong> <strong>the</strong>se claims are discussed, a different<br />

<str<strong>on</strong>g>evaluati<strong>on</strong></str<strong>on</strong>g> can be possible. Basis <strong>of</strong> <strong>the</strong> expropriati<strong>on</strong> procedure, which has been<br />

realized by <strong>the</strong> General Directorate <strong>of</strong> Highways, is “public <strong>in</strong>terest”. In <strong>the</strong>se<br />

procedures, public <strong>in</strong>terest is def<strong>in</strong>ed as expropriati<strong>on</strong> transacti<strong>on</strong> and m<strong>in</strong>imizati<strong>on</strong> <strong>of</strong><br />

highway c<strong>on</strong>structi<strong>on</strong> costs. In this c<strong>on</strong>diti<strong>on</strong>, public <strong>in</strong>terest will necessitate <strong>the</strong> use <strong>of</strong><br />

territorial resources for m<strong>in</strong>imum loss/cost and maximum benefit. In this po<strong>in</strong>t <strong>of</strong> view,<br />

it is accepted that, realized procedures and decisi<strong>on</strong>s have maximum “public <strong>in</strong>terest”<br />

c<strong>on</strong>tent. On <strong>the</strong> o<strong>the</strong>r hand, similar <str<strong>on</strong>g>evaluati<strong>on</strong></str<strong>on</strong>g> exists <strong>in</strong> <strong>the</strong> expertise reports. Besides, it<br />

is stated that, m<strong>in</strong>imum expropriati<strong>on</strong> cost has been provided <strong>in</strong> this regi<strong>on</strong> through all<br />

highway route alternatives. Fur<strong>the</strong>rmore, plan decisi<strong>on</strong>s have been marked <strong>on</strong> <strong>the</strong> maps<br />

appropriate with plann<strong>in</strong>g technics. However, problem <strong>of</strong> rel<strong>in</strong>quishment balance, as<br />

lawyers <strong>of</strong> pla<strong>in</strong>tiff parties has stated, is very important <strong>in</strong> this extent. In ano<strong>the</strong>r words,<br />

“greater happ<strong>in</strong>ess <strong>of</strong> <strong>the</strong> greater number” approach is accepted with <strong>the</strong> pr<strong>in</strong>ciple <strong>of</strong><br />

maximizati<strong>on</strong> <strong>of</strong> public <strong>in</strong>terest <strong>in</strong> country scale. As a result <strong>of</strong> this acceptance,<br />
