decisi<strong>on</strong> and related development plans was demanded. Fur<strong>the</strong>rmore, it was also stated<br />

that, <strong>the</strong>re were 450 households liv<strong>in</strong>g <strong>in</strong> E itim quarter where <strong>the</strong> highway existed and<br />

expropriati<strong>on</strong> <strong>of</strong> built-up areas did not have any public <strong>in</strong>terest pr<strong>in</strong>ciple. It was<br />

emphasized that, public <strong>in</strong>terest pr<strong>in</strong>ciple was taken <strong>in</strong>to c<strong>on</strong>siderati<strong>on</strong> dur<strong>in</strong>g locati<strong>on</strong><br />

stage <strong>of</strong> <strong>the</strong> highway’s route and a participated plann<strong>in</strong>g <strong>process</strong> had not been realized.<br />

Previously planned highway route had been more agreeable because <strong>of</strong> pass<strong>in</strong>g through<br />

public lands and undeveloped lands. In additi<strong>on</strong> to development plans, it was also stated<br />

that, expropriati<strong>on</strong> payments realized <strong>in</strong> 1995, over <strong>the</strong> expropriati<strong>on</strong> value determ<strong>in</strong>ed<br />

<strong>in</strong> 1993, was not fair. Public <strong>in</strong>terest, plann<strong>in</strong>g <strong>process</strong> and <str<strong>on</strong>g>evaluati<strong>on</strong></str<strong>on</strong>g>s c<strong>on</strong>cern<strong>in</strong>g<br />

expropriati<strong>on</strong> transacti<strong>on</strong>s, which were exam<strong>in</strong>ed <strong>in</strong> detail by <strong>the</strong> counsel <strong>of</strong> pla<strong>in</strong>tiff<br />

parties, have been discussed <strong>in</strong> above menti<strong>on</strong>ed generalizati<strong>on</strong>.<br />

Claims <strong>of</strong> Defendant Parties:<br />

In <strong>the</strong> claim <strong>of</strong> M<strong>in</strong>istry <strong>of</strong> Public Works and Settlement General Directorate <strong>of</strong><br />

Highways, it was stated that, appraisement procedures were realized <strong>in</strong> 1993 accord<strong>in</strong>g<br />

to <strong>the</strong> “decisi<strong>on</strong> <strong>of</strong> commencement <strong>of</strong> expropriati<strong>on</strong> transacti<strong>on</strong>s”, payments would be<br />

effected to bank <strong>in</strong> a m<strong>on</strong>th and necessary notificati<strong>on</strong>s were sent to property owners.<br />

Later, it was added that, payments were effected to bank by a delay <strong>of</strong> two and a half<br />

year because <strong>of</strong> <strong>the</strong> delay <strong>in</strong> payment d<strong>on</strong>e by General Directorate <strong>of</strong> Public F<strong>in</strong>ance to<br />

General Directorate <strong>of</strong> Highways.<br />

In <strong>the</strong> defense <strong>of</strong> Greater Municipality <strong>of</strong> zmir, it was declared that, maps <strong>of</strong> <strong>the</strong><br />

development plan related to highway c<strong>on</strong>structi<strong>on</strong>, which was planned by General<br />

Directorate <strong>of</strong> Highways, were sent to Greater Municipality <strong>of</strong> zmir for approval<br />

purpose (<strong>in</strong> order to mark <strong>the</strong> highway route <strong>on</strong> <strong>the</strong> development plan) by Sec<strong>on</strong>d<br />

Regi<strong>on</strong>al Directorate <strong>of</strong> Highways with <strong>the</strong> <strong>of</strong>ficial letter dated 14.05.1992/ numbered<br />

16700 and this <strong>in</strong>formati<strong>on</strong> was accepted by <strong>the</strong> decisi<strong>on</strong> <strong>of</strong> municipal council dated<br />

27.10.1992. It was also expressed that; “Plans and projects, which are realized by public<br />

<strong>in</strong>stituti<strong>on</strong>s <strong>in</strong> country and regi<strong>on</strong>al scale accord<strong>in</strong>g to c<strong>on</strong>temporary urban plann<strong>in</strong>g<br />

approach, have to be accepted as a superior data for development plans and this is a<br />

legal obligati<strong>on</strong>”. It was claimed that, <strong>the</strong>re was not any c<strong>on</strong>tradicti<strong>on</strong> <strong>in</strong> <strong>the</strong>se decisi<strong>on</strong>s,<br />

which were c<strong>on</strong>sidered as superior data for development plans, aga<strong>in</strong>st plann<strong>in</strong>g<br />

pr<strong>in</strong>ciples, urban plann<strong>in</strong>g essentials and public <strong>in</strong>terest.<br />
