and Development Plans That It’s Based On: Development <strong>of</strong><br />

<strong>the</strong> Process and Results 71 – (Balçova)<br />

Defendant parties <strong>of</strong> <strong>the</strong> acti<strong>on</strong> are General directorate <strong>of</strong> Highways, Greater<br />

Municipality <strong>of</strong> zmir and Municipality <strong>of</strong> Balçova. All <strong>of</strong> <strong>the</strong> pla<strong>in</strong>tiffs <strong>of</strong> all 181<br />

acti<strong>on</strong>s are private pers<strong>on</strong>s and total numbers <strong>of</strong> pla<strong>in</strong>tiffs are 315. Situati<strong>on</strong> <strong>of</strong> <strong>the</strong> plots<br />

which are subjects <strong>of</strong> acti<strong>on</strong>s and <strong>the</strong> present built-up residential area exist<strong>in</strong>g <strong>in</strong> <strong>the</strong><br />

highway z<strong>on</strong>e are shown <strong>in</strong> Fig: 4.6.. As also seen <strong>on</strong> <strong>the</strong> map, different acti<strong>on</strong>s were<br />

proceeded by different flats exist<strong>in</strong>g <strong>in</strong> <strong>the</strong> same apartment house <strong>on</strong> <strong>the</strong> same plot. (See<br />

Fig.: 4.6 and Fig.:4.7)<br />

Subject <strong>of</strong> acti<strong>on</strong>s is <strong>the</strong> annulment <strong>of</strong> expropriati<strong>on</strong> decisi<strong>on</strong> dated 11.02.1993<br />

and numbered 6 regard<strong>in</strong>g <strong>the</strong> expropriati<strong>on</strong> <strong>of</strong> <strong>the</strong> plots exist<strong>in</strong>g <strong>in</strong> highway z<strong>on</strong>e for<br />

<strong>the</strong> c<strong>on</strong>structi<strong>on</strong> <strong>of</strong> zmir R<strong>in</strong>g-Road/Aydın Expressway (Part 2.1A,2.1B) and <strong>the</strong><br />

development plans scaled 1/5000 and 1/1000 that <strong>the</strong> expropriati<strong>on</strong> decisi<strong>on</strong> based <strong>on</strong>.<br />

It’s not known if 25 <strong>of</strong> <strong>the</strong> pla<strong>in</strong>tiffs had lawyers or not. On <strong>the</strong> o<strong>the</strong>r hand, 156<br />

acti<strong>on</strong>s were defended by 3 different lawyers. 2 <strong>of</strong> <strong>the</strong>se lawyers were <strong>the</strong> counsels <strong>of</strong> 2<br />

acti<strong>on</strong>s (1 acti<strong>on</strong> for each) and counsels <strong>of</strong> 153 acti<strong>on</strong>s were <strong>the</strong> same. Thus, statements<br />

<strong>of</strong> counsels <strong>of</strong> <strong>the</strong>se 153 acti<strong>on</strong>s have been evaluated.<br />

4.3.1.2. Claims <strong>of</strong> Parties <strong>in</strong> Litigati<strong>on</strong> Process<br />

Claims <strong>of</strong> Pla<strong>in</strong>tiff Parties:<br />

In <strong>the</strong> 12 paged applicati<strong>on</strong> text <strong>of</strong> pla<strong>in</strong>tiffs parties’ lawyer, it was stated that,<br />

expropriati<strong>on</strong> decisi<strong>on</strong> and development plans that it was based <strong>on</strong> were not appropriate<br />

exam<strong>in</strong>ati<strong>on</strong> <strong>of</strong> court files. However, <strong>in</strong> such a c<strong>on</strong>centrated litigati<strong>on</strong> <strong>process</strong>, it has been noticed that,<br />

mostly, <strong>the</strong>re has been no difference <strong>in</strong> <strong>the</strong> statements <strong>of</strong> lawyers’ petiti<strong>on</strong>s, defenses <strong>of</strong> parties, expertise<br />

reports or court decisi<strong>on</strong>s.<br />
