4.2.4. General Evaluati<strong>on</strong> Results <strong>of</strong> Proceeded Acti<strong>on</strong>s<br />

As acti<strong>on</strong>s that are reflected <strong>on</strong> judicial c<strong>on</strong>trol <strong>in</strong> case study area has been<br />

exam<strong>in</strong>ed, <strong>in</strong>tensity <strong>of</strong> <strong>the</strong> objecti<strong>on</strong>s <strong>in</strong>clud<strong>in</strong>g decisi<strong>on</strong>s and implementati<strong>on</strong>s<br />

regard<strong>in</strong>g spatial subjects can be observed. These objecti<strong>on</strong>s c<strong>on</strong>cern <strong>the</strong> decisi<strong>on</strong>s <strong>of</strong><br />

municipalities, General directorate <strong>of</strong> Highways and zmir No.1 Committee <strong>of</strong><br />

protecti<strong>on</strong> <strong>of</strong> Cultural and Natural Heritage, as applicati<strong>on</strong> authorities, by us<strong>in</strong>g<br />

necessary authorizati<strong>on</strong>s def<strong>in</strong>ed by laws. 68 Basic demand <strong>in</strong> <strong>the</strong>se objecti<strong>on</strong>s is <strong>the</strong><br />

detailed def<strong>in</strong>iti<strong>on</strong> <strong>of</strong> “appropriateness” <strong>of</strong> authority, task and resp<strong>on</strong>sibility <strong>of</strong><br />

applicati<strong>on</strong> authorities with “law and regulati<strong>on</strong>s” dur<strong>in</strong>g implementati<strong>on</strong> <strong>process</strong>. In<br />

ano<strong>the</strong>r words, pla<strong>in</strong>tiffs apply to legal <strong>justice</strong> <strong>in</strong> order <strong>the</strong>ir rights <strong>on</strong> urban space can<br />

be defended dur<strong>in</strong>g legal applicati<strong>on</strong> <strong>process</strong>. Proceeded acti<strong>on</strong>s c<strong>on</strong>trol <strong>the</strong><br />

appropriateness <strong>of</strong> <strong>the</strong> implementati<strong>on</strong>s and decisi<strong>on</strong>s <strong>of</strong> authorized government <strong>of</strong>fice,<br />

which have <strong>the</strong> arrangement authority <strong>of</strong> urban space, with law and acts and <strong>the</strong>y also<br />

present <strong>the</strong> expectati<strong>on</strong>s <strong>of</strong> defendant and pla<strong>in</strong>tiff parties from urban space. In this<br />

extent, numbers and subjects <strong>of</strong> acti<strong>on</strong>s represent <strong>the</strong> <strong>in</strong>dicators <strong>of</strong> c<strong>on</strong>flict<strong>in</strong>g urban<br />

spatial demands.<br />

General <str<strong>on</strong>g>evaluati<strong>on</strong></str<strong>on</strong>g> results <strong>of</strong> acti<strong>on</strong>s, <strong>in</strong>clud<strong>in</strong>g all spatial problems without<br />

mak<strong>in</strong>g any adm<strong>in</strong>istrative/juridical differentiati<strong>on</strong>, are as follows:<br />

1. Number <strong>of</strong> c<strong>on</strong>flicts/disagreements regard<strong>in</strong>g spatial subjects are c<strong>on</strong>siderably high<br />

<strong>in</strong> number. Through 1215 acti<strong>on</strong>s <strong>in</strong> total proceeded between 1992-2003, number <strong>of</strong><br />

spatial subjects is 965 and number <strong>of</strong> objecti<strong>on</strong>s <strong>in</strong>clud<strong>in</strong>g tasks and o<strong>the</strong>r<br />

transacti<strong>on</strong>s <strong>of</strong> municipalities is 250. Number <strong>of</strong> <strong>the</strong>se acti<strong>on</strong>s through grand total,<br />

as <strong>in</strong>terventi<strong>on</strong>s c<strong>on</strong>cern<strong>in</strong>g <strong>the</strong> aim <strong>of</strong> arrang<strong>in</strong>g urban space, <strong>in</strong>dicates <strong>the</strong> reacti<strong>on</strong>s<br />

<strong>of</strong> pers<strong>on</strong>s to plan mak<strong>in</strong>g and approval <strong>process</strong>es.<br />

If pla<strong>in</strong>tiff parties <strong>of</strong> 965 spatial acti<strong>on</strong>s are exam<strong>in</strong>ed, follow<strong>in</strong>g results are<br />

go<strong>in</strong>g to be found; 811 acti<strong>on</strong>s (84,04%) by private pers<strong>on</strong>s, 63 acti<strong>on</strong>s (6,53%) by<br />

<strong>of</strong>ficial <strong>in</strong>stituti<strong>on</strong>s, 57 acti<strong>on</strong>s (5,91%) by companies, 19 acti<strong>on</strong>s (1,97%) by zmir<br />

Chamber <strong>of</strong> Commerce, 12 acti<strong>on</strong>s (1,24%) by cooperatives, 1 acti<strong>on</strong> (0,10%) by<br />

foundati<strong>on</strong>, 1 acti<strong>on</strong> (0,10%) by camber <strong>of</strong> pr<strong>of</strong>essi<strong>on</strong>s (TMMOB Central Office <strong>of</strong><br />

68 Development Act No.3194, Act <strong>of</strong> Municipalities No.1580, Act <strong>of</strong> Development Amnesty No.2981,<br />

Act <strong>of</strong> Expropriati<strong>on</strong> No.2942, Acts <strong>of</strong> Protecti<strong>on</strong> <strong>of</strong> Cultural and Natural Heritage No.2863.<br />
