3.5.2.1. Hous<strong>in</strong>g Right<br />

Accord<strong>in</strong>g to Kabo lu; even though settlement freedom and hous<strong>in</strong>g right are<br />

organized under different titles <strong>the</strong>y are actually two human rights str<strong>on</strong>gly l<strong>in</strong>ked with<br />

each o<strong>the</strong>r. Hous<strong>in</strong>g right as a human right is a realizati<strong>on</strong> degree <strong>of</strong> o<strong>the</strong>r rights and<br />

freedoms and to own a house is a social right for <strong>in</strong>dividuals. Hous<strong>in</strong>g right is <strong>the</strong> lowest<br />

human right for protect<strong>in</strong>g <strong>the</strong> human h<strong>on</strong>or and it represents <strong>the</strong> measure <strong>of</strong> realizati<strong>on</strong><br />

<strong>of</strong> o<strong>the</strong>r rights and freedoms. Freedom <strong>of</strong> select<strong>in</strong>g and settl<strong>in</strong>g wherever <strong>the</strong>y wish to is<br />

just an abstract freedom for <strong>the</strong> <strong>on</strong>e who cannot f<strong>in</strong>d an opportunity to own a house.<br />

Hous<strong>in</strong>g right is necessary but not sufficient for right <strong>of</strong> settlement (Kabo lu, 2000, 59).<br />

Kabo lu describes <strong>the</strong> relati<strong>on</strong> between social state governed by law and<br />

hous<strong>in</strong>g right as: “social state governed by law is a state form that organizes <strong>the</strong><br />

ec<strong>on</strong>omic and social way <strong>of</strong> life by an efficient plann<strong>in</strong>g, decreases <strong>the</strong> social<br />

<strong>in</strong>equalities and protects <strong>the</strong> rights <strong>of</strong> disadvantaged groups by decreas<strong>in</strong>g <strong>the</strong> social<br />

<strong>in</strong>equalities and by creat<strong>in</strong>g opportunity equality... If hous<strong>in</strong>g right is <strong>the</strong> lowest <strong>of</strong> all<br />

human rights, is also <strong>the</strong> m<strong>in</strong>imum measure <strong>of</strong> social state governed by law” (Kabo lu,<br />

2000, 62).<br />

In <strong>the</strong> realizati<strong>on</strong> <strong>of</strong> hous<strong>in</strong>g right which is <strong>the</strong> m<strong>in</strong>imum measure <strong>of</strong> social state<br />

governed by law both <strong>the</strong> accepted laws (Development Law No. 3194, Mass Hous<strong>in</strong>g<br />

Law, Gecek<strong>on</strong>du Law) and <strong>the</strong> organizati<strong>on</strong>s formed by <strong>the</strong>se laws are <strong>in</strong>sufficient.<br />

Never<strong>the</strong>less, it is also obvious that <strong>the</strong>re is no <strong>in</strong>tegral policy about <strong>the</strong> shelter<strong>in</strong>g and<br />

hous<strong>in</strong>g rights and <strong>the</strong> planned <strong>in</strong>vestments are <strong>in</strong>sufficient <strong>in</strong> <strong>the</strong>ir organizati<strong>on</strong>s and<br />

practices about <strong>the</strong> groups which own this right. When c<strong>on</strong>sidered this way, it is<br />

impossible to say that <strong>the</strong> m<strong>in</strong>imum measure <strong>of</strong> social state governed by law has<br />

successfully accomplished its aims. C<strong>on</strong>trarily, with <strong>the</strong> existence <strong>of</strong> privatizati<strong>on</strong><br />

policies, such a measure ga<strong>in</strong>ed a property that should be discussed.<br />

Even though house has a mean<strong>in</strong>g <strong>of</strong> be<strong>in</strong>g an <strong>in</strong>dividual property and s<strong>in</strong>ce<br />

liv<strong>in</strong>g <strong>in</strong> a healthy and balanced envir<strong>on</strong>ment is accepted as a right, it is a matter<br />

expressed that <strong>the</strong>re is a need for a new legal frame about provid<strong>in</strong>g <strong>the</strong> rights <strong>of</strong> macro<br />

scale public <strong>in</strong>terests and <strong>in</strong>dividual rights <strong>in</strong> a balanced way (Erkun, 1991, 59).<br />

However, it is evident that firstly new arrangements are needed to be d<strong>on</strong>e <strong>in</strong> ec<strong>on</strong>omic<br />

and political fields about <strong>the</strong> approach <strong>of</strong> social state governed by law which gives<br />

priority to equality.<br />
