3.5.1. Social State Practices<br />
It is expected that “welfare state” c<strong>on</strong>sidered toge<strong>the</strong>r with “social state<br />
governed by <strong>the</strong> rule <strong>of</strong> law” and priorities <strong>in</strong> <strong>the</strong> practices <strong>of</strong> <strong>the</strong>se state govern<strong>in</strong>g<br />
systems should be realized <strong>in</strong> a way <strong>of</strong> tak<strong>in</strong>g precauti<strong>on</strong>s about decreas<strong>in</strong>g <strong>the</strong><br />
<strong>in</strong>equalities <strong>in</strong> social structure. The orig<strong>in</strong> and legitimacy <strong>of</strong> <strong>the</strong> existence <strong>of</strong> this type <strong>of</strong><br />

for <strong>the</strong> most reliable operati<strong>on</strong> <strong>of</strong> market mechanisms and social structure with <strong>the</strong> least<br />
c<strong>on</strong>flict.<br />
In <strong>the</strong> practices with<strong>in</strong> <strong>the</strong> state <strong>of</strong> law or with<strong>in</strong> <strong>the</strong> absolute rule <strong>of</strong> law, <strong>the</strong><br />
state takes its legitimacy not from <strong>the</strong> decrease <strong>of</strong> social <strong>in</strong>equalities but ei<strong>the</strong>r from <strong>the</strong><br />
authority <strong>of</strong> <strong>the</strong> dom<strong>in</strong>ant legislator or from <strong>the</strong> maximizati<strong>on</strong> <strong>of</strong> freedom. If <strong>the</strong> rights,<br />
freedoms, <strong>in</strong>terests and equality which are provided by <strong>the</strong> laws <strong>in</strong> such a “rule <strong>of</strong> law”,<br />
base <strong>on</strong> <strong>the</strong> acceptances <strong>of</strong> <strong>the</strong> dom<strong>in</strong>ant authority, <strong>the</strong> legitimacy problem will ei<strong>the</strong>r<br />
base <strong>on</strong> <strong>the</strong> acceptances <strong>of</strong> this authority or will never come out because <strong>of</strong> <strong>the</strong><br />
authority. If it takes <strong>the</strong> <strong>in</strong>crease <strong>of</strong> freedoms as a base, ec<strong>on</strong>omic <strong>in</strong>equalities will be<br />
accepted legal because <strong>of</strong> <strong>the</strong> priority <strong>of</strong> freedom before equality. This type <strong>of</strong> state as<br />
<strong>the</strong> c<strong>on</strong>troller <strong>of</strong> freedom will come out with<strong>in</strong> <strong>the</strong> “m<strong>in</strong>imal state” (night watchman<br />
state) which is def<strong>in</strong>ed as an acceptable state by Nozick and <strong>in</strong>equalities will be out <strong>of</strong><br />
