Social state which takes place <strong>in</strong> <strong>the</strong> relative equality approach presented by <strong>the</strong><br />
progressive model enters <strong>in</strong>to a new period with privatisati<strong>on</strong> policies <strong>on</strong> public services<br />
like educati<strong>on</strong>, healthy, etc. and with decreases <strong>in</strong> <strong>the</strong> enterprises. (Keyder, 2000, 34-<br />

3.4. Gecek<strong>on</strong>du (Squatter Settlements) and Legal Arrangements<br />
Fact <strong>of</strong> gecek<strong>on</strong>du began to be seen <strong>in</strong> Turkey at <strong>the</strong> end <strong>of</strong> 1940’s as <strong>the</strong> result<br />
<strong>of</strong> rapid urbanizati<strong>on</strong> and <strong>in</strong>tense immigrati<strong>on</strong>. Soluti<strong>on</strong> taken for <strong>the</strong> problem <strong>of</strong><br />
hous<strong>in</strong>g requirements <strong>of</strong> <strong>the</strong> populati<strong>on</strong> who migrated to <strong>the</strong> cities and who could not<br />
meet <strong>the</strong>ir hous<strong>in</strong>g needs <strong>in</strong> legal ways is called as “gecek<strong>on</strong>du”. Gecek<strong>on</strong>du formati<strong>on</strong><br />
<strong>process</strong> even though is a way <strong>of</strong> meet<strong>in</strong>g <strong>the</strong> needs <strong>of</strong> shelter from 1940’s to today also<br />
represents a very different social structur<strong>in</strong>g. Accord<strong>in</strong>g to K<strong>on</strong>gar, <strong>in</strong> <strong>the</strong> development<br />
<strong>of</strong> this social structure, gecek<strong>on</strong>du formati<strong>on</strong> <strong>process</strong> as “own<strong>in</strong>g house <strong>in</strong> illegal ways”<br />
also started two o<strong>the</strong>r <strong>process</strong>es, which developed with itself. First <strong>on</strong>e is speculati<strong>on</strong> <strong>on</strong><br />
plots and <strong>the</strong> sec<strong>on</strong>d is <strong>the</strong> degenerati<strong>on</strong> <strong>in</strong> local and central policies. These two<br />
<strong>process</strong>es which started with gecek<strong>on</strong>du formati<strong>on</strong> <strong>process</strong> took strength from it as<br />
streng<strong>the</strong>ned it. This trio gecek<strong>on</strong>du formati<strong>on</strong> <strong>process</strong>, speculati<strong>on</strong>s <strong>on</strong> plots and<br />
political degenerati<strong>on</strong> began to affect <strong>the</strong> general urban pattern <strong>of</strong> <strong>the</strong> country and<br />
c<strong>on</strong>sequently <strong>the</strong> general urban pattern <strong>of</strong> <strong>the</strong> country and c<strong>on</strong>sequently <strong>the</strong> general<br />
structure <strong>of</strong> it (K<strong>on</strong>gar; 1998, 563-64). It is possible to detect <strong>the</strong> reflecti<strong>on</strong>s <strong>of</strong> <strong>the</strong><br />
determ<strong>in</strong>ati<strong>on</strong>s <strong>of</strong> K<strong>on</strong>gar <strong>on</strong> legal <strong>process</strong>, too.<br />
Gecek<strong>on</strong>du Law No.775 which came <strong>in</strong>to effect <strong>in</strong> 1996 is <strong>the</strong> most<br />
comprehensive law about gecek<strong>on</strong>du s<strong>in</strong>ce 1948. In <strong>the</strong> first article expla<strong>in</strong><strong>in</strong>g <strong>the</strong><br />
c<strong>on</strong>tent <strong>of</strong> this law it is stated that; “decisi<strong>on</strong>s <strong>of</strong> this law will be practiced about<br />
subjects like improvement, elim<strong>in</strong>ati<strong>on</strong> <strong>of</strong> exist<strong>in</strong>g gecek<strong>on</strong>du, prevent<strong>in</strong>g build<strong>in</strong>g new<br />
gecek<strong>on</strong>du and <strong>in</strong>volves measures that will be taken for this purpose.” The def<strong>in</strong>iti<strong>on</strong> <strong>of</strong><br />
