SECTION 1. In the interest of the service, it is hereby clarified that the respective
jurisdiction of the DTI-National Capital Region (DTI-NCR) and the DTI-Office of Legal Affairs
(DTI-OLA) in the administrative adjudication of pyramiding cases shall be as follows:
A. For pyramiding cases filed with the DTI-NCR by a consumer under the Consumer Act
(R.A. No. 7394), the delineation of jurisdiction shall be that provided under Section 3 of
Department Order No. 124, Series of 1992 as amended by Section 3 of Department Administrative
Order No. 3, Series of 1993, as follows:
1. mediation stage - under the jurisdiction of Consumer Arbitration Officers or
Acting Consumer Arbitration Officers of the DTI-NCR.
2. Hearing and deciding stage - under the jurisdiction of the Acting Consumer
Arbitration Officers of the DTI-OLA.
B. For pyramiding cases motu proprio filed by the Provincial Directors of DTI-NCR the
delination of jurisdiction shall be that provided under Department Order No. 13, series of
1989, as amended by D.O. No. 25, series of 1989, as follows:
1. mediation stage - under the jurisdiction of the DTI-NCRís Provincial Directors
(or their designees).
2. Hearing and deciding stage - under the jurisdiction of the Hearing Officers of
the DTI-OLA.
SECTION 2. The Director of the DTI-OLA shall continue to be the Consumer Arbitration
Appeals Officer for pyramiding cases commenced by a consumer under the Consumer
Act and its rules. He shall likewise continue to be the DTI Adjudication Officer and Appeals
Officer for pyramiding cases commenced motu proprio by Provincial Directors.
SECTION 3. This Order shall take effect after fifteen (15) days from publication in a
newspaper of general circulation.
