Contributions and any o<strong>the</strong>r contributions <strong>of</strong> <strong>the</strong><br />
above-referred three (3) employees <strong>of</strong> <strong>the</strong> 2 nd<br />
Respondent resident <strong>in</strong> Kuala Lumpur; AND<br />
(7) That this Honourable Court may declare that <strong>the</strong><br />
2 nd Respondent has breached its fiduciary duties<br />
not to act <strong>in</strong> conflict with its duty to <strong>the</strong> Petitioner<br />
and aga<strong>in</strong>st <strong>the</strong> Petitioner’s <strong>in</strong>terest <strong>in</strong> that <strong>the</strong> 2 nd<br />
Respondent had abused its power by us<strong>in</strong>g <strong>the</strong> 1 st<br />
Respondent’s money to pay <strong>the</strong> salaries <strong>in</strong>clud<strong>in</strong>g<br />
bonuses, <strong>in</strong>come taxes, employee provident fund<br />
contributions and any o<strong>the</strong>r contributions <strong>of</strong> <strong>the</strong><br />
above-referred accounts staff <strong>of</strong> <strong>the</strong> 2 nd<br />
Respondent work<strong>in</strong>g <strong>in</strong> its Lawas store; AND<br />
(8) That this Honourable Court may declare that <strong>the</strong><br />
3 rd Respondent has breached <strong>the</strong> fiduciary duty she<br />
owed to <strong>the</strong> 1 st Respondent as <strong>the</strong> director<br />
responsible for implement<strong>in</strong>g, allow<strong>in</strong>g or<br />
permitt<strong>in</strong>g <strong>the</strong> breaches <strong>of</strong> fiduciary duties stated<br />
<strong>in</strong> paragraphs (5) to (7) above; AND<br />
(9) That <strong>the</strong> 3 rd Respondent may be ordered to pay<br />
damages for any damage or loss susta<strong>in</strong>ed by <strong>the</strong><br />
1 st Respondent because <strong>of</strong> <strong>the</strong> 3 rd Respondent’s<br />
conduct; AND<br />
(10) That <strong>the</strong> 2 nd Respondent cause its subsidiary or<br />
related company Maestro Products Sdn Bhd to<br />
withdraw and cancel all <strong>the</strong> unlawful <strong>in</strong>terest, bank<br />
and penalty charges charged on <strong>the</strong> 1 st Respondent;<br />
AND<br />
(11) That <strong>the</strong> 2 nd Respondent render restitution to <strong>the</strong> 1 st<br />
Respondent <strong>of</strong> all <strong>the</strong> payments <strong>of</strong> salaries<br />
<strong>in</strong>clud<strong>in</strong>g bonuses, <strong>in</strong>come taxes, employee<br />
provident fund contributions and any o<strong>the</strong>r<br />
contributions paid for and on behalf <strong>of</strong> <strong>the</strong> abovereferred<br />
three (3) employees <strong>of</strong> <strong>the</strong> 2 nd Respondent<br />
resid<strong>in</strong>g <strong>in</strong> Kuala Lumpur; AND<br />
