leather casing containing a magazine and inside that magazine was
fourteen (14) rounds of 9mm ammunition.
[21] The passenger of the Proton GEN-2 was also examined
physically and on him SP15 found a wallet containing one identity card and
cash in the sum of RM48.00. The name of the passenger was Zulkifli bin Ali
and he has since died – hereinafter referred to as the “deceased”.
[22] SP15 handed all the exhibits seized from the appellant and the
deceased to SP16 and this was witnessed by both of them – referring to
the appellant and the deceased.
[23] SP15 proceeded to examine the Proton GEN-2 motorcar
witnessed by the appellant and the deceased and SP15 found the following
items:
(a) a pistol, type Styer, bearing serial number 031096 located
underneath the seat cover of the driver’s seat containing 12
rounds of 9mm ammunition;
(b) one hand guard casing at the right side door of the said motor
car;
(c) one 9mm ammunition found underneath the mat of the driver’s
floor board;
(d) one grey coloured crash helmet carrying the brand name
“Magnum” found at the back centre seat of the said motorcar;
