Subject: recommendation
Rob
Bill just left you a voicemail regarding this recommendation. At this point, Alvin has sufficient documentation to believe
Rio Pluma has violated their discharge permit in the following two major ways:
}> changing the TSS sampler code and accessing the TSS sampler; and
» collecting and storing TSS samples themselves versus the permit requirement that only the City and certified lab
control the chain of custody .
Thus, the data from Rio Pluma is not reliable or valid, as documented in City acquired grab sampling. Routinely, Rio
Pluma has exceeded their discharge limit of 200 mg/l for TSS. This week the City has again locked down the sampling
equipment and has taken control of their chain of custody.
In order to protect the City from potential violations of the City's discharge permit and possible fines, we recommend that a
Notice of Violation be issued to Rio Pluma as soon as possible. This will serve three main purposes:
» it will show the RWQCB that the City is doing everything it can in order to comply with the City's discharge permit;
» it will form a basis for documenting any future expenses incurred by the City to deal with the excess sludge at the
WNTP that should be reimbursed by Rio Pluma; and
}> it will give Rio Pluma an opportunity to work with the City as well as on their own to solve this problem in the best
manner, without any RWQCB fines or City surcharges.
In an effort to get a cost estimate for the removal of the accumulated solids, a representative from Synagro is in the area
today and t have recommended to AI that he stop by to help develop an estimate. We are also looking at getting
additional estimates from other responsible solids handling companies.
