(d) enable the defendants to use the proceeds from the public <strong>of</strong>fering <strong>of</strong> YBM<br />

stock to further the fraudulent operations <strong>of</strong> the Network <strong>of</strong> YBM<br />

companies, and thereby conceal and continue the fraudulent scheme to<br />

defraud.<br />

4. As a result <strong>of</strong> the scheme to defraud, the defendants caused the defrauded<br />

shareholders <strong>of</strong> YBM to lose in excess <strong>of</strong> $150 million (all references are to U.S. dollars unless<br />

otherwise designated as Canadian dollars (CDN)) in funds invested in the purchase <strong>of</strong> YBM<br />

stock.<br />

5. As a result <strong>of</strong> their participation in the scheme to defraud, each defendant,<br />

either directly or through nominees, enriched himself with proceeds <strong>of</strong> the scheme to defraud,<br />

totaling at least the following approximate amounts, from the sale <strong>of</strong> YBM stock, and other<br />

compensation including salary, bonuses, stock options, commissions and personal loans:<br />

6. SEMION MOGILEVICH, a/k/a "Simeon Mogilevitch," a/k/a "Semjon<br />

Mogilevcs," a/k/a "Shimon Makhelwitsch," a/k/a “Seva,” was born in Kiev, Ukraine and holds<br />

Ukrainian, Russian and Israeli citizenship. At various times relevant to this Superseding<br />
