8. The copyright status <strong>of</strong> <strong>legislation</strong> and <strong>of</strong> <strong>the</strong> layout <strong>of</strong> <strong>the</strong> <strong>of</strong>ficial<br />
gazette<br />
There is no copyright protection for <strong>legislation</strong> <strong>in</strong> 22 Member States; only Ireland and<br />
<strong>the</strong> United K<strong>in</strong>gdom have such protection, and <strong>in</strong> <strong>the</strong> United K<strong>in</strong>gdom <strong>the</strong> reuse <strong>of</strong><br />
<strong>legislation</strong> it subject to waiver. Practically, this difference is <strong>of</strong> no importance, because<br />
<strong>in</strong> <strong>the</strong> United K<strong>in</strong>gdom <strong>the</strong> waiver is handled very liberally.<br />
Concern<strong>in</strong>g <strong>the</strong> copyright protection <strong>of</strong> <strong>the</strong> layout <strong>of</strong> <strong>the</strong> <strong>of</strong>ficial gazette, <strong>the</strong>re seem to<br />
be very different views and respectively some uncerta<strong>in</strong>ty <strong>in</strong> <strong>the</strong> Member States. If<br />
<strong>the</strong>re is no explicit regulation concern<strong>in</strong>g <strong>the</strong> copyright protection <strong>of</strong> <strong>the</strong> layout, it is<br />
pr<strong>in</strong>cipally uncerta<strong>in</strong> if <strong>the</strong> layout <strong>of</strong> <strong>the</strong> <strong>of</strong>ficial gazette reaches <strong>the</strong> level <strong>of</strong><br />
‘orig<strong>in</strong>ality’ usually asked by <strong>the</strong> national copyright <strong>legislation</strong>. Eleven Member States<br />
say that <strong>the</strong>y have no copyright protection for <strong>the</strong> layout <strong>of</strong> <strong>the</strong> <strong>of</strong>ficial gazette.<br />
Copyright protection for <strong>the</strong> layout <strong>of</strong> <strong>the</strong> <strong>of</strong>ficial gazette exists <strong>in</strong> eight Member<br />
States and an additional three Member States have a copyright protection with a<br />
compulsory licence. Three Member States have different solutions (see footnotes 1, 3<br />
and 5 <strong>in</strong> Table 8).<br />
