CITY ORDINANCE NO. <strong>544</strong><br />

June 22, 2011<br />

AN ORDINANCE ESTABLISHING DOG-OWNERS' RESPONSIBILITY,<br />

REQUIRING ENCLOSURES OR FENCED-IN YARD FOR PET DOGS AS<br />

PREVENTIVE MEASURE AGAINST OCCURRENCE OF RABIES INJURY,<br />

DAMAGE AND OTHER HAZARDS.<br />

WHEREAS, rabies is an infectious & viral disease considered threatening<br />

to health of the populace;<br />

WHEREAS, despite national & local programs to eradicate rabies the<br />

same remains among the major menace to health;<br />

WHEREAS, the health problem brought by rabies is seen in a number of<br />

patients seeking an ants-rabies vaccine;<br />

WHEREAS, there is a need for the <strong>City</strong> to come up preventive measures<br />

against rabies infection;<br />

WHEREAS, to address the danger/threat caused by rabies and other<br />

possible injuries or damage posed to the public, there is a need for the<br />

Sangquniang Panlungsod to pass an enabling law involving dog-owners.<br />

NOW THEREFORE, BE IT ORDAINED by the Sangguniang Panlungsod<br />

of the <strong>City</strong> of <strong>Bacolod</strong>, in session, that:<br />

Section 1. Title - This ordinance shall be known as Dog-Owners<br />

Responsibility <strong>Ordinance</strong>.<br />

Section 2. Definition of Terms.<br />

1) DOG-OWNERS - refer to any person keeping, harboring or having<br />

charge, care or control of dogs, including his/her representative.

2) RABIES - refers to a highly fatal disease caused by a Jyssa virus,<br />

transmitted mainly thru the bit of an infected animal and is characterized by<br />

muscle paraiysis, hydrophobia and earophobia, and other neurological<br />

manifestations.<br />

3) Republic Act 9482 - refers to An Act Providing for the Control and<br />

Elimination of Human and Animal Rabies, Prescribing Penalties for Viofation<br />

Thereof, and Appropriating Funds Thereof.<br />

4} Republic Act 8485 - refers to an Act to Promote Animal Welfare in the<br />

Philippines: Otherwise Known as, "the Animal Welfare Act."<br />

Section 3. Policy.<br />

a) The <strong>City</strong> of <strong>Bacolod</strong> recognizes that dogs are among a person's<br />

personal properties.<br />

b) <strong>No</strong> batangay in the <strong>City</strong> of <strong>Bacolod</strong> shall restrict or prohibit anyone to<br />

own a dog, provided that he or she shall provide enclosures or fenced-in yard for<br />

said dogs, and shall be responsible for its upkeep and maintenance;<br />

c) The <strong>City</strong> of <strong>Bacolod</strong> recognizes the right of the people to own a dog of<br />

whatever breed allowed under our laws.<br />

Section 4, Responsibilities of Dog Owners. Aside from Section 5 of<br />

Republic Act 9482, the following are also the responsibilities of dog-owners in the<br />

<strong>City</strong> of <strong>Bacolod</strong><br />

a) All dogs shall be securely contained within the owner's<br />

premises/property, without cruel restraint by tying.<br />

b) All dogs shall be securely leashed whenever taken out of the owner's<br />

premises, and, under the supervision of a person who is physically capable of<br />

controlling the dog.<br />

c) Parents who allow their child to lead a dog in public places, open<br />

spaces or parks, alleys or streets/roads shall assume the liability for any<br />

trespass, accident, harm or injury caused by their dog.

d) Dog-owners shall, upon demand by authorized persons, produce the<br />

immunization records of their dogs found at large as may be required by the<br />

Veterinary Office of Bacoiod <strong>City</strong>.<br />

e) Owners shall take all reasonable steps to ensure that their dog do not<br />

injure harm endanger, intimidate or cause distress to any person & other<br />

animals nor damage or endanger any property belonging to any other person.<br />

f) Confine dog to owner's property and preventing it from roaming or<br />

wandering around unattended<br />

g) Get an official permit and/or tag from the <strong>City</strong> Veterinary Office or any<br />

authorized agency<br />

h) Remove dog feces or wastes left in public places or open spaces.<br />

i) Secure the dog by property tying it when it is carried on. board a vehicle.<br />

j) Dog-owners shall insure that dogs are given the needed immunizations<br />

and/or vaccines to prevent spread of rabies and/or similar infections.<br />

k) Have their dogs registered in the <strong>City</strong> Veterinary Office.<br />

1} Assist dog bitten victim immediately, and shoulder medical expenses<br />

inclined & other incidental expenses relative to the victim's injury<br />

Section 5. Commercial Dog Breeders - Commercial dog breeders<br />

shaii secure business license from tne <strong>City</strong> for their business operation.<br />

However, operation of the same shaii be ban in residential or populous areas<br />

Section 6. Fines/Penalty - Violation of Section 4 hereof shall be fined<br />

based on the following:<br />

1st Offense - fine of Php 500.00<br />

2nd Offense - Fine of Fhp 1,000.00<br />

3rd Offense - Fine of Php 2,000.00

And dogs shall be placed at the dog pound in the <strong>City</strong> Veterinary Office for<br />

adoption Otherwise, it shall be exterminated humanely<br />

Section 7. Registration of Dogs. - Dog-owners shall register their pet<br />

dogs to the <strong>City</strong> Veterinary Office upon payment of Fifty Pesos (Php50.00) as<br />

Registration Fee) ip the <strong>City</strong> Treasurer's Office. Pursuant thereto. Section 10 of<br />

the <strong>City</strong> <strong>Ordinance</strong> 184, series of 1997 (An <strong>Ordinance</strong> Approving the Rabies<br />

Eradication, Prevention and Control Program of <strong>Bacolod</strong> <strong>City</strong>) shall be amended<br />

or modified accordingly.<br />

Section. 8. Implementing Rules & Regulations (IRR). - A Committee<br />

be constituted within Sixty (60) days from its passage, composed of the<br />

following:<br />

1) <strong>City</strong> Mayor or his/her designated representative,<br />

2) <strong>City</strong> Health Office,<br />

3) <strong>City</strong> Veterinary Office,<br />

4) <strong>City</strong> Agriculture office, and<br />

5) Chairman of the SP Committee on Health<br />

The Committee shall come up with Implementing Rules & Regulations (IRR), and<br />

submit the same to the Sangguniang Paniungsod within forty five (45) days after<br />

its passage for ratification.<br />

Section 9. Repealing Clause. - All ordinances that are inconsistent with<br />

the provisions of this <strong>Ordinance</strong> are hereby repealed, amended or modified<br />

accordingly.<br />

Section 10. Separability Clause. - If any provision of this ordinance be<br />

declared invalid other provisions which are not so declared shaH remain valid<br />

and shall be in full force and effect.<br />

Section 11. Effecttvity Clause - This ordinance shall take effect after<br />

fifteen (15) days after its publication in a newspaper of general circulation in the<br />

<strong>City</strong> of <strong>Bacolod</strong>.
