CITY ORDINANCE NO. 544

AN ORDINANCE ESTABLISHING DOG-OWNERS' RESPONSIBILITY,
REQUIRING ENCLOSURES OR FENCED-IN YARD FOR PET DOGS AS
PREVENTIVE MEASURE AGAINST OCCURRENCE OF RABIES INJURY,
DAMAGE AND OTHER HAZARDS.
WHEREAS, rabies is an infectious & viral disease considered threatening
to health of the populace;
WHEREAS, despite national & local programs to eradicate rabies the
same remains among the major menace to health;
WHEREAS, the health problem brought by rabies is seen in a number of
patients seeking an ants-rabies vaccine;
WHEREAS, there is a need for the City to come up preventive measures
against rabies infection;
WHEREAS, to address the danger/threat caused by rabies and other
possible injuries or damage posed to the public, there is a need for the
Sangquniang Panlungsod to pass an enabling law involving dog-owners.
NOW THEREFORE, BE IT ORDAINED by the Sangguniang Panlungsod
of the City of Bacolod, in session, that:
Section 1. Title - This ordinance shall be known as Dog-Owners
Responsibility Ordinance.
Section 2. Definition of Terms.
1) DOG-OWNERS - refer to any person keeping, harboring or having
charge, care or control of dogs, including his/her representative.

2) RABIES - refers to a highly fatal disease caused by a Jyssa virus,
transmitted mainly thru the bit of an infected animal and is characterized by
muscle paraiysis, hydrophobia and earophobia, and other neurological
manifestations.

3) Republic Act 9482 - refers to An Act Providing for the Control and
Elimination of Human and Animal Rabies, Prescribing Penalties for Viofation
Thereof, and Appropriating Funds Thereof.
4} Republic Act 8485 - refers to an Act to Promote Animal Welfare in the
Philippines: Otherwise Known as, "the Animal Welfare Act."
Section 3. Policy.
a) The City of Bacolod recognizes that dogs are among a person's
personal properties.
b) No batangay in the City of Bacolod shall restrict or prohibit anyone to
own a dog, provided that he or she shall provide enclosures or fenced-in yard for
said dogs, and shall be responsible for its upkeep and maintenance;
c) The City of Bacolod recognizes the right of the people to own a dog of
whatever breed allowed under our laws.
Section 4, Responsibilities of Dog Owners. Aside from Section 5 of
Republic Act 9482, the following are also the responsibilities of dog-owners in the
City of Bacolod
a) All dogs shall be securely contained within the owner's
premises/property, without cruel restraint by tying.
b) All dogs shall be securely leashed whenever taken out of the owner's
premises, and, under the supervision of a person who is physically capable of
controlling the dog.
c) Parents who allow their child to lead a dog in public places, open
spaces or parks, alleys or streets/roads shall assume the liability for any
trespass, accident, harm or injury caused by their dog.

d) Dog-owners shall, upon demand by authorized persons, produce the
immunization records of their dogs found at large as may be required by the
Veterinary Office of Bacoiod City.
e) Owners shall take all reasonable steps to ensure that their dog do not
injure harm endanger, intimidate or cause distress to any person & other
animals nor damage or endanger any property belonging to any other person.
f) Confine dog to owner's property and preventing it from roaming or
wandering around unattended
g) Get an official permit and/or tag from the City Veterinary Office or any
authorized agency
h) Remove dog feces or wastes left in public places or open spaces.
i) Secure the dog by property tying it when it is carried on. board a vehicle.
j) Dog-owners shall insure that dogs are given the needed immunizations
and/or vaccines to prevent spread of rabies and/or similar infections.
k) Have their dogs registered in the City Veterinary Office.
1} Assist dog bitten victim immediately, and shoulder medical expenses
inclined & other incidental expenses relative to the victim's injury
Section 5. Commercial Dog Breeders - Commercial dog breeders
shaii secure business license from tne City for their business operation.
However, operation of the same shaii be ban in residential or populous areas
Section 6. Fines/Penalty - Violation of Section 4 hereof shall be fined
based on the following:
1st Offense - fine of Php 500.00
2nd Offense - Fine of Fhp 1,000.00
3rd Offense - Fine of Php 2,000.00

And dogs shall be placed at the dog pound in the City Veterinary Office for
adoption Otherwise, it shall be exterminated humanely
Section 7. Registration of Dogs. - Dog-owners shall register their pet
dogs to the City Veterinary Office upon payment of Fifty Pesos (Php50.00) as
Registration Fee) ip the City Treasurer's Office. Pursuant thereto. Section 10 of
the City Ordinance 184, series of 1997 (An Ordinance Approving the Rabies
Eradication, Prevention and Control Program of Bacolod City) shall be amended
or modified accordingly.
Section. 8. Implementing Rules & Regulations (IRR). - A Committee
be constituted within Sixty (60) days from its passage, composed of the
following:
1) City Mayor or his/her designated representative,
2) City Health Office,
3) City Veterinary Office,
4) City Agriculture office, and
5) Chairman of the SP Committee on Health
The Committee shall come up with Implementing Rules & Regulations (IRR), and
submit the same to the Sangguniang Paniungsod within forty five (45) days after
its passage for ratification.
Section 9. Repealing Clause. - All ordinances that are inconsistent with
the provisions of this Ordinance are hereby repealed, amended or modified
accordingly.
Section 10. Separability Clause. - If any provision of this ordinance be
declared invalid other provisions which are not so declared shaH remain valid
and shall be in full force and effect.
Section 11. Effecttvity Clause - This ordinance shall take effect after
fifteen (15) days after its publication in a newspaper of general circulation in the
City of Bacolod.
