Alternatively, particularly in the case of long and prolific negotiations, parts 2, 3, 4, and 5 can be<br />

incorporated together with the results of the negotiations into a new contract form.<br />

User Information<br />

To facilitate some of these modifications and additions, italic text is used throughout the document<br />

for instructions or guidance to the procuring agency. Each procuring agency should replace all italic<br />

text with the appropriate data for its procurement or should mark out or remove the italic text if it is<br />

inappropriate. It is intended that no italic text remains in a solicitation of offers finally issued to<br />

manufacturers.<br />

Options<br />

Also the manual contains several standard options to address the most <strong>com</strong>mon differences among<br />

agencies and procurements. In addition to selecting the <strong>com</strong>petitive negotiation or sealed bidding<br />

method of procurement, there are options for incorporating proposals into contract documents<br />

(§2.2.2), dispute resolution methods (§ 2.2.7), payment methods (§ 2.4), and a number of other<br />

variations in process and terms. These are presented in parallel columns in the text, so that the<br />

provisions that differ can be quickly identified and <strong>com</strong>pared. The Procuring Agency should remove<br />

these columns (by marking out or masking in hard copy, or by deleting from an electronic copy) so<br />

that only one column remains in the solicitation issued to manufacturers. It is suggested that the<br />

letter designations of these options (a, b, or c) be retained in the solicitation as an aid to offerors in<br />

interpreting the solicitation.<br />

Where an agency otherwise modifies the SBPG, it is suggested that the agency indicate with<br />

underlining added portions and with a caret character () the location of a deletion. These symbols<br />

together with a brief explanation will aid the offerors in identifying modifications from the SBPG.<br />

The date of the specific SBPG version used in the documents should be included.<br />

Interim Use<br />

If a procuring agency is using its own Part 5, Technical Specifications, the following links to the<br />

remainder of the SBPG should be made:<br />

“Guide for Inspection,” § 3.4, provides for inspection procedures or tests reflecting the technical<br />

specifications, and should be inserted;<br />

“Warranty Requirements,” § 4.1.1 provides specific warranty periods for specified systems in the bus; these<br />

systems should be clearly defined in the technical specifications;<br />

“Repair Procedures,” § 4.2, refers to rates of charge for Procuring Agency labor to be included in the<br />

Technical Specifications.<br />

Agency Responsibility<br />

The SBPG have been prepared by the Steering Committee to provide suggestions regarding bus<br />

purchases in general. Neither APTA, its consultants, nor any member of the <strong>com</strong>mittee has<br />

ascertained that these terms or specifications will achieve any specific result or are the most<br />

appropriate for any particular situation. The SBPG are based on the judgment of the Steering<br />

Committee and their assessment of the best procurement practices. The guidelines may not be<br />

responsive to varying legal and regulatory environments or varying dynamics of procurement<br />
