2.3 DELIVERY AND TITLE<br />
2.3.1 DELIVERIES<br />
2.3.1.1 BUS DELIVERY PROCEDURE<br />
Delivery of buses shall be determined by signed receipt of the Procuring Agency's designated<br />
agent(s) (name and address) , at the following point of delivery and may be preceded by a cursory<br />
inspection of the bus..<br />

2.3.1.2 DELIVERY SCHEDULE<br />
The buses shall be delivered at a rate not to exceed (insert maximum) buses per week. Delivery<br />
shall be <strong>com</strong>pleted within (insert) weeks after delivery of the executed contract documents. Hours<br />
of delivery shall be (opening time) through (closing time) the following days of the week:<br />
(Procuring Agency to insert receiving periods).<br />
2.3.1.3 PRE-DELIVERY TESTS AND INSPECTIONS<br />
The pre-delivery tests and inspections shall be performed at or near the Contractor's plant; they shall<br />
be performed in accordance with the procedures defined in Part 3: Quality Assurance Provisions, and<br />
they may be witnessed by the resident inspector. When the bus passes these tests and inspections,<br />
the resident inspector shall authorize release of the bus.<br />
2.3.1.4 ASSUMPTION OF RISK OF LOSS<br />
The Procuring Agency shall assume risk of loss of the bus on delivery, as defined in "<strong>Bus</strong> Delivery<br />
Procedure" (Section 2.3.1.1), if delivered by <strong>com</strong>mon carrier or driveway, or on release to the<br />
Procuring Agency's drivers at the Contractor's plant. Prior to this delivery or release, the Contractor<br />
shall have risk of loss of the bus, including any damages sustained during the <strong>com</strong>mon carrier or<br />
driveaway operation regardless of the status of title or any payments related to the bus. Drivers shall<br />
keep a maintenance log enroute and it shall be delivered to the Procuring Agency with the bus.<br />
2.3.1.5 ACCEPTANCE OF BUS<br />
Within 15 (fifteen) calendar days after arrival at the designated point of delivery, the bus shall<br />
undergo the Procuring Agency tests defined in Part 4: Quality Assurance Provisions. If the bus<br />
passes these tests or if the Procuring Agency does not notify Contractor of nonacceptance within 15<br />
(fifteen) calendar days after delivery, acceptance of the bus by the Procuring Agency occurs on the<br />
fifteenth day after delivery. Acceptance may occur earlier if the Procuring Agency notifies the<br />
Contractor of early acceptance or places the bus in revenue service. If the bus fails these tests, it shall<br />
not be accepted until the repair procedures defined in "Repairs After Nonacceptance" (Section 2.3.2)<br />
have been carried out and the bus retested until it passes.<br />
