Standard Bus Procurement Guidelines SUBMITTED BY: 1. Price and Proposal 2. Pricing Schedule 3. Supporting Data (Offeror's name and address) No cost, price or financial information of any kind shall be included in Package No. 1 or in any of the proposal documents that it will contain. Proposal packages shall be addressed and delivered to the address specified in “Procuring Agency and Contracting Officer” (Section 1.1.1.1). 1.1.3.5 DBE CERTIFICATION Pursuant to Title 49, Code of Federal Regulations, part 23.67, an Offeror, as a condition of being authorized to respond to this solicitation, must certify by completing “DBE APPROVAL CERTIFICATION” (Section 1.1.6.7), that it has on file with the Federal Transportation Administration (FTA) an approved or not disapproved annual Disadvantaged Business Enterprise (DBE) subcontracting participation goal. 1.1.3.6 MODIFICATION OR WITHDRAWAL OF PROPOSALS A modification of a proposal already received will be accepted by the Procuring Agency only if the modification is received prior to the Proposal Due Date, or is specifically requested by the Procuring Agency, or is made with a requested BAFO. All modifications shall be made in writing and executed and submitted in the same form and manner as the original proposal. A Offeror may withdraw a proposal already received prior to the Proposal Due Date by submitting, in the same manner as the original proposal, to the Procuring Agency a written request for withdrawal executed by the Offeror's authorized representative. After the proposal Due Date, a proposal may be withdrawn only if the Procuring Agency fails to award the Contract within the proposal validity period prescribed in “Due Date” (Section 1.1.3.1) or any agreed upon extension thereof. The withdrawal of a proposal does not prejudice the right of an offeror to submit another proposal within the time set for receipt of proposals. This provision for modification and withdrawal of proposals may not be utilized by an Offeror as a means to submit a late proposal and, as such, will not alter the Procuring Agency's right to reject a proposal. 1.1.4 PROPOSAL EVALUATION, NEGOTIATION AND SELECTION Proposals will be evaluated, negotiated, selected and any award made in accordance with the criteria and procedures described below. The approach and procedures are those which are applicable to a competitive negotiated procurement whereby proposals are evaluated to determine which proposals are within a competitive range. Discussions and negotiations may then be carried out with Offerors within the competitive range, after which Best and Final Offers (BAFOs) may be requested. Standard Bus Procurement Guidelines However, the Procuring Agency may select a proposal for award without any discussions or negotiations or request for any BAFO(s). Subject to the Procuring Agency's right to reject any or all proposals, the Offeror will be selected whose proposal is found to be most advantageous to the Procuring Agency, based upon consideration of the criteria of “Qualification Requirements” (Sections 1.1.4.3.1) and “Proposal Evaluation Criteria” (Section 1.1.4.3.2) below.
