<strong>Standard</strong> <strong>Bus</strong> <strong>Procurement</strong> <strong>Guidelines</strong><br />
subpart 9.4, debarred, suspended, ineligible, or voluntarily excluded from the covered<br />
transaction, unless it knows that the certification is erroneous. A participant may decide the<br />
method and frequency by which it determines the eligibility of its principals. Each participant<br />
may, but is not required to, check the Nonprocurement List issued by U.S. General Service<br />
Administration.<br />
8. Nothing contained in the foregoing shall be construed to require establishment of system of<br />
records in order to render in good faith the certification required by this clause. The<br />
knowledge and information of a participant is not required to exceed that which is normally<br />
possessed by a prudent person in the ordinary course of business dealings.<br />
9. Except for transactions authorized under Paragraph 5 of these instructions, if a participant in a<br />
covered transaction knowingly enters into a lower tier covered transaction with a person who<br />
is proposed for debarment under 48 CFR part 9, subpart 9.4, suspended, debarred, ineligible,<br />
or voluntarily excluded from participation in this transaction, in addition to all remedies<br />
available to the Federal Government, Procuring Agency may pursue available remedies<br />
including suspension and/or debarment.<br />
2.9.5 LOBBYING CERTIFICATION AND DISCLOSURE STATEMENTS<br />
In accordance with 31 U.S.C. ( 1352, and U.S. DOT regulations, "New Restrictions on Lobbying," 49<br />
C.F.R. Part 20, the Contractor must have provided a certification to the Procuring Agency that the<br />
Contractor has not and will not use Federal appropriated funds to pay any person or organization to<br />
influence or attempt to influence an officer or employee of any Federal department or agency, a<br />
member of Congress, officer or employee of Congress, or an employee of a member of Congress in<br />
connection with obtaining any Federal contract, grant or any other award covered by 31 U.S.C. 1352.<br />

2.10 POLICIES FOR PRIME CONTRACT<br />
2.10.1 PRE-AWARD AND POST-DELIVERY AUDIT REQUIREMENTS<br />
2.10.1.1 CERTIFICATIONS REQUIRED<br />
The Offeror and (if selected) Contractor agrees to <strong>com</strong>ply with 49 U.S.C. § 5323(l) and FTA's<br />
implementing regulation at 49 C.F.R. Part 663 and to submit the following certifications with its<br />
Offer and (if selected) after acceptance of the last bus:<br />
2.10.1.2 BUY AMERICA REQUIREMENTS<br />
The Offeror and (if selected) Contractor shall <strong>com</strong>plete and submit a declaration certifying either<br />
<strong>com</strong>pliance or non<strong>com</strong>pliance with Buy America. If the Offeror/Contractor certifies <strong>com</strong>pliance with<br />
Buy America, it shall submit documentation which lists 1) <strong>com</strong>ponent and sub<strong>com</strong>ponent parts of<br />
the rolling stock to be purchased identified by manufacturer of the parts, their country of origin and<br />
costs; and 2) the location of the final assembly point for the rolling stock, including a description of<br />
the activities that will take place at the final assembly point and the cost of final assembly.<br />
