was assassinated three years after his appointment, on <strong>the</strong> pretext that he<br />

bore <strong>the</strong> name. Those respited are recorded in <strong>the</strong> following order : Sir James<br />

Johnstoun <strong>of</strong> Dunskellie, John Carmichael, Robert Johnstoun <strong>of</strong> Raecleuch,<br />

next <strong>of</strong> kin to Sir James, Symon, (half) bro<strong>the</strong>r to <strong>the</strong> Laird <strong>of</strong> Johnstoun,<br />

Robert Johnstoun in Brigholme, William, <strong>the</strong> heir <strong>of</strong> Graitney, and John<br />

Johnstoun in Cummertrees. Then come Johnstouns <strong>of</strong> Wamfray, Kirkton,<br />

William, Adam and James <strong>of</strong> Elsieshields, Howcleuch, Milnbank, Craigaburn,<br />

Corrie, Lockerbie, and Clochrie, besides Irvings, M<strong>of</strong>fats, Carru<strong>the</strong>rs, Scotts,<br />

Eliots, Stewarts, one Chisholm, Arthur Graham, one Armstrong, and several<br />

Murrays. All <strong>of</strong>fences were forgiven <strong>the</strong>m except passing bad money. It<br />

was <strong>the</strong> greatest tribal fight that had ever taken place in <strong>Scotland</strong>, and it was<br />

<strong>the</strong> last.<br />

Lord Hereis (Johnstoun's bro<strong>the</strong>r-in-law) succeeded his cousin, Maxwell,<br />

as Warden, but he paid no attention to <strong>the</strong> respite. He tried to capture<br />

Johnstoun's followers, till he kept <strong>the</strong> country in such a state <strong>of</strong> confusion that<br />

<strong>the</strong> King ended by superseding him <strong>with</strong> Johnstoun himself. This Chief stated<br />

that "<strong>the</strong> last unhappy and ungodly work arose out <strong>of</strong> <strong>the</strong> grit skaithis <strong>of</strong> fire,<br />

and heartless slaughters " done by Maxwell upon Johnstoun's fa<strong>the</strong>r, " which<br />

was his death. Never<strong>the</strong>less he had buried <strong>the</strong>se materials in his heart<br />

and entered into a hand agreement <strong>with</strong> Maxwell, when he found that he<br />

had made ano<strong>the</strong>r bond for <strong>the</strong> wrecking <strong>of</strong> him and his friends."<br />

Till <strong>the</strong> King sent Protestant preachers to convert Dumfries <strong>the</strong> Reformation<br />

had made little way <strong>the</strong>re, still less in Annandale, but, outside, Buccleuch,<br />

Drumlanrig, Lag, Gordon, and Kirkpatrick were Protestants. Between 1594<br />

and 1603 <strong>the</strong>re are several sentences <strong>of</strong> outlawry against <strong>the</strong> Lairds <strong>of</strong><br />

Johnstoun and Newbie, Robert, Edward and Abraham <strong>of</strong> Newbie, Charles<br />

Murray <strong>of</strong> Cockpool, and Edward Maxwell <strong>of</strong> <strong>the</strong> He for attending Mass,<br />

and for allowing <strong>the</strong>ir children " to be baptized and taught by Roman priests,<br />

and entertaining <strong>the</strong> same." That Newbie was dealt <strong>with</strong> more harshly than<br />

Johnstoun was probably his proximity to England, which brought him specially<br />

under <strong>the</strong> notice <strong>of</strong> <strong>the</strong> Warden, and <strong>the</strong> desire <strong>of</strong> <strong>the</strong> King to appear a<br />

good Protestant in English eyes. Newbie's fa<strong>the</strong>r had been killed at Langside,<br />

but his Chief and Robert Johnstoun <strong>of</strong> Lochmaben had long been respited for<br />

"carrying <strong>the</strong>ir banners" on that occasion. The Roman priests had been<br />

chased from <strong>the</strong> country before <strong>the</strong> Reformed Church was ready to replace<br />

<strong>the</strong>m, and both Protestants and Romanists believed that an unbaptized infant<br />

could be exchanged for a demon, and that <strong>the</strong> unshriven soul found no peace.<br />

The Presbyterians were forbidden to baptize <strong>the</strong> children <strong>of</strong> Romanists, and<br />

a Borderer's marriage was illegal if solemnised in England.<br />

When Johnstoun was made Warden in 1596 Newbie returned to Annan,<br />

and his long delayed retour was made out in 1603. It is signed by five<br />

Maxwells, a Wamfray Johnstoun, many Brouns <strong>of</strong> Land, Roger Kirkpatrick,<br />

Stewart <strong>of</strong> Swee<strong>the</strong>art Abbey, John Marschall, Tumour, and John Corsane,<br />

Provost <strong>of</strong> Dumfries. It alludes to <strong>the</strong> estate having been in ward for<br />

twenty-five years " or <strong>the</strong>re abouts," when <strong>the</strong> Crown took <strong>the</strong> half rents.
