01/06/2012 : Online digitally signed tenders are invited from the General <strong>In</strong>surance<br />
Companies for selection of <strong>In</strong>surance Company / Companies to implement Centrally<br />
Sponsored “Livestock <strong>In</strong>surance Scheme” as per the guidelines of the scheme for the<br />
period 2012 - 2014. The scheme will be in operation in Nagpur, Bhandara, Gondiya,<br />
Wardha, Yavatmal, Jalna, Aurangabad, Beed, Nanded, Latur, Jalgaon, Nashik,<br />
Ahamadnagar, Pune, Satara, Sangali, Solapur & Kolhapur of Maharashtra. However, the<br />
number of districts might be increased as per the guidelines of Government of <strong>In</strong>dia. The<br />
<strong>In</strong>surance Company must have office at these district head quarters for insurance<br />
coverage & claim settlement with sufficient insurance agents at blocks/ Talukas which is<br />
mandatory. The <strong>In</strong>surance coverage is presently restricted to two high yielding cows &<br />
buffaloes per animal owner for general death as well as Permanent Total Disabled (PTD)<br />
cases for one or three years period, however, the number animals per beneficiary are<br />
likely to be increased. The 50% premium share will be paid by this office & 50%<br />
premium will be born by animal owner which should be collected by the <strong>In</strong>surance<br />
concerned companies.<br />
The tender details, terms and conditions may be purchased, downloaded, prepared from<br />
04.06.2012 to 19.06.2012 & submitted online till 19.06.2012 upto 17.00 hrs. on the<br />
department’s e-Tendering Portal http://adf.maharashtra.etenders.in and submit payment for<br />
website Registration charges or Rs. 5000/- (Rs Five thousand Only) in the form of Demand draft<br />
drawn in the name of “Chief Executive Officer, Maharashtra Livestock Development Board,<br />
Akola” drawn from any Nationalized Bank payable at Akola. This amount is not refundable.<br />

TERMS & CONDITIONS FOR SUBMITTING THE TENDER FOR PREMIUM RATES<br />
FOR LIVESTOCK INSURANCE (2012 - 2014)<br />

1. How to get Tender forms:<br />
The Tender Form along with Terms & Conditions can be downloaded from<br />
http://adf.maharashtra.etenders.in w.e.f. 04.06.2012 to 19.06.2012. by payment of Rs. 5000/-(Rs<br />
Five thousand Only) as the cost of website registration charges in the form of Demand Draft.<br />
This amount is non-refundable. The Demand Draft should be drawn in favour of “Chief<br />
Executive Officer, Maharashtra Livestock Development Board”, payable at Akola. Failure to<br />
submit the cost of website registration charges within stipulated time will disqualify the tender.<br />
2. EARNEST MONEY DEPOSIT (EMD)-<br />
a. Earnest Money Deposit should be paid Rs. 6,00,000/- in the form of Demand Draft of<br />
any Nationalized Bank. Cheque and cash will not be accepted at any stage and in that<br />
case tender form will be rejected.<br />
b. The Government institutes will be exempted from payment of EMD.<br />
3.LAST DATE AND PLACE OF SUBMISSION OF COMPLETED TENDER FORMS –<br />
Completed Tender Form along with the tender rate should be prepared on department’s etendering<br />
Portal on or before (SCHEDULED DATE) & submitted on same portal on or before<br />
(SCHEDULE DATE) duly filled in and digitally signed by concerned authority. e-tendering<br />
system won’t accept any tender after the deadline for preparation & will allow only those tenderer<br />
who have completed their online bid preparation for submission, Tender received in other format<br />
will not be accepted.<br />
4. MANNER OF SUBMISSION OF COMPLETED TENDER FORMS-<br />
A) Tenderers should submit tenders in two envelopes system (two bid system).<br />
Accordingly, the tender form dully filled for the rates quoted for items should be mentioned<br />
in online form given in Commercial Bid (C1). All other required documents such as<br />
Technical documents as mentioned in the check-list, demand draft along with a copy of terms<br />
and conditions duly signed and all documents supporting the Eligibility criteria for<br />
participation in tender process (Refer GENERAL TERMS & CONDITIONS FOR<br />
SUBMITTING TENDER) etc. should be uploaded in forms given under Technical Envelope<br />
(T1).<br />
B) It may be noted that while opening the tender online on above mentioned e-Tendering<br />
Portal, Technical Envelope (Envelope No.1) will be opened in the first instance. Commercial<br />
Bid C1 will be opened on above mentioned e-Tendering Portal only after ascertaining<br />
whether the tenderer has fulfilled all requisites in Envelope No.1. The tenderer not fulfilling<br />
the above requirements will be rejected and no further claim will be entertained.<br />
Technical Bid (T 1) :- Technical information (as per Checklist) in the form of following<br />
documents. All the documents uploaded in Technical Bid (T1), should be scanned in <strong>PDF</strong><br />
Format having duly certified/attested by Gazatted Officer or Notary and the originals should<br />
be kept ready for submission on demand.<br />

2. Earnest money Deposit of Rs.6,00,000/- in the form of uncrossed Demand Draft drawn in<br />
favor of “Chief Executive Officer, Maharashtra Livestock Development Board”, payable<br />
at Akola.<br />

4. All Documents attested by Gazetted Officer/ Notarized.<br />
5. Declaration form, all pages of the tender form including Terms and conditions duly<br />

Commercial Bid (C1 ) :- The Commercial Bid C1 as mentioned above should contain rates.<br />
Rates quoted in prescribed tender form or uploaded on separate paper will not be considered and<br />
the tender form will be rejected. The rates should be quoted as per stipulated format. The Chief<br />
Executive Officer, Maharashtra Livestock Development Board, Akola reserves the right to call<br />
for break up of rate wherever necessary.<br />
The Technical Bid T1 and Commercial Bid C1 should also be digitally signed by<br />
tenderer before completion of Online Bid Preparation on or before (SCHEDULED<br />
DATE) and again submitted online on or before (SCHEDULED DATE) of Online Bid<br />
Submission. e-Tendering System won’t allow any tenderer to participate in tender after<br />
stipulated date & time. Similarly no request for extension of time will be considered.<br />
The firm who make any undue effort to bring the pressure from outside or from any<br />
departmental authority will be liable for outright rejection.<br />
Tenders not submitted as per the above-prescribed manner will be treated as invalid.<br />
5.COMPANY PERFORMANCE: If any company has not given satisfactory performance<br />
during previous years, then Chief Executive officer, Maharashtra Livestock Development Board,<br />
Akola reserves the full right to reject its tender or part thereof.<br />
6. REGISTRATION: The copy of valid Registration certificate must be enclosed in Technical<br />
T1.<br />
7. COMPANY OFFICE & NETWORK: The <strong>In</strong>surance company must have offices at district<br />
head quarters with Network in the above mentioned districts for correspondence about insurance<br />
policies issued, ear tagging-Retagging & claim settlement. For this purpose insurance companies<br />
must appoint one development officer at district head quarters & minimum four insurance agents<br />
at Taluka/ Block level. It is mandatory to mention name, address, phone no. & authorization<br />
letter for district & block level officer & insurance agents of company.<br />
8. CHANGE OF INSURANCE COMPANY: <strong>In</strong> the event of the order being placed to the<br />
successful tenderer and if the tenderer fails to quote the premium rates & not performing<br />
according to the terms and conditions envisaged, then Chief Executive Officer, Maharashtra<br />
Livestock Development Board, Akola will be at liberty to engage another <strong>In</strong>surance<br />
Company/Companies in his sole discretion which he thinks fit.<br />
9. DOCUMENTS: The tender documents should be written legible and free from errors, over<br />
writings scratches etc.<br />
a) No tenders will be accepted after stipulated date & time. Similarly no request for extension of<br />
time will be considered.<br />
b) The firm who make any undue effort to bring the pressure from out side or from any<br />
departmental authority will be liable for outright rejection.<br />
c) Tenders not submitted as per the above prescribed manner will be treated as invalid.<br />
10. LAST DATE FOR SUBMISSION & OPENING OF TENDER FORM:<br />
Online e-tender should be submitted on e-tender Portal http://adf.maharashta.etenders.in on or<br />
before 19.06.2012 up to 17.00 hrs. The technical bid tender will be opened possibly on<br />
21.06.2012 at 13.00 hrs and Commercial bid shall be possibly on 22.06.2012 at 14.00 Hrs. in the<br />
“Office of Regional Manager, Frozen Semen Laboratory”, 5, Mula Road, Khadki, Pune 411003.<br />
The tender form will not be accepted after stipulated date & time & hence no request for<br />
extension of time will be considered.<br />
11. PREMIUM RATES: The tenderer should quote premium rates separately for General Death<br />
and Permanent Total Disability (PTD) for one & three year period in commercial bid C1. These<br />

premium rates once quoted will not be increased on account of increase in Govt taxes or due to<br />
escalation of any costs during the contract period.<br />
12. INCOMPLETE TENDER: The tender is liable to be ignored if complete information is not<br />
furnished or if any or all the conditions prescribed herein are not fulfilled or if any item is<br />
overwritten or corrected.<br />
13. PENALTY: i) If advance premium received is not refunded within stipulated time at the end<br />
of contract period then 2% interest per month will be charge as penalty.<br />
ii) If claims are not settled in stipulated time of 15 days as per agreement then 2% of sum insured<br />
per month will be charged as penalty.<br />
iii) Services of Govt. field veterinary staff/ Officers should not be utilized for collection of<br />
premium from farmers/ livestock owners & if found, the concerned company will be penalized<br />
@15% of the premium collected from the farmers & will be deducted from the next installment to<br />
be given by MLDB.<br />
14. INSURANCE COVERAGE: The insurance coverage is presently restricted to high milk<br />
yielding cows and buffaloes with restriction of maximum two animals per animal owner of the<br />
Nagpur, Bhandara, Gondiya, Wardha, Yavatmal, Jalna, Aurangabad, Beed, Nanded, Latur,<br />
Jalgaon, Nashik, Ahamadnagar, Pune, Satara, Sangali, Solapur & Kolhapur of Maharashtra.<br />

15. INSURANCE POLICIES:<br />
i) <strong>In</strong>surance company will make district wise master policy for contract period & copy will be<br />
given to concerned district & MLDB.<br />
ii) <strong>In</strong>surance company will issue insurance policy to policy owner along with information about<br />
claim procedure, retagging procedure etc. This document should be in Marathi language. No<br />
other documents will be demanded by the insurance company without the permission of MLDB.<br />
16. CLAIM AMOUNT: The <strong>In</strong>surance claim amount in case of death will be equal to sum<br />
insured & 75% for PTD cases. The <strong>In</strong>surance company should settle the claim on time and should<br />
send the claim amount to policy holder i.e. cattle owner.<br />
17. SETTLEMENT CLAIMS: The <strong>In</strong>surance Company will be committed for settlement of<br />
claim at district level only within 15 days from the date, the claim is received by company which<br />
is mandatory. The documents for claim settlement will include:<br />
i) First information report about death of animal to be reported by animal owner on toll free or<br />
contact no provided by insurance company<br />
ii) <strong>In</strong>surance policy.<br />
iii) Claim form<br />
iv) Post Mortem Report with intact ear tag.<br />
v)No other documents will be demanded by the insurance company. <strong>In</strong> case of investigation of<br />
claim is required then it will be done within 7 days of documents received from animal owner.<br />
vi)If death of animal is reported within 48 Hrs, but the documents are submitted late due to<br />
genuine & legal difficulties & confirmed by the Govt. Veterinarian then the claim will not be<br />
denied on the ground of delay in submission of necessary documents by animal owner.<br />
The cost of ear-tagging/ re-ear-tagging & photo identity (if insisted by insurance<br />
company) of animal will be borne by the insurance company.<br />

18. PUBLICITY: <strong>In</strong>surance company must ensure wide publicity in Marathi language by way of<br />
leaflets and posters, in addition to Radio, Television, News paper advertisements etc. The<br />
proposal/ claim form should be made available in Marathi. The <strong>In</strong>surance company should<br />
display scheme information including claim procedure in all Gram-panchayat offices, Veterinary<br />
<strong>In</strong>stitutes and ensure wide publicity to achieve the targets as per agreement and guidelines of<br />
Govt. of <strong>In</strong>dia.<br />
19. PERFORMANCE GUARANTEE: <strong>In</strong>surance Company will have to give performance<br />
Guarantee during the period of scheme in operational area till the expiry period of insurance<br />
coverage and claim settlement.<br />
20. INSURANCE EXPERIENCE: The <strong>In</strong>surance Company should have at least three years<br />
experience in the field of Cattle <strong>In</strong>surance preferably where the scheme is being implimented, the<br />
attested copies of related documents should be enclosed.<br />
21. INSURANCE AGENT: The insurance company/ companies should ensure sufficient agents<br />
at the block level, so as to provide services at all Govt. veterinary institutes & to the concerned<br />
involved in the insurance coverage for the purpose of identification of animals, collection of<br />
premium, timely issue of policies, ear- tagging / retagging, prompt claim settlement procedure.<br />
For this purpose, insurance company should pay 15% commission to their agents at company cost<br />
as per the directives of the scheme given by the Govt. of <strong>In</strong>dia. No Govt. employee will be<br />
entrusted for collection of premium from farmers which will come under penalty.<br />
22. ADVANCE PAYMENT: The 50% premium share will be borne by govt. and if required<br />
could be paid in advance to the insurance company. However, insurance company will have to<br />
give complete information in the prescribed format duly certified by concerned Dist. Dy.<br />
Commissioner of A.H. at the time of recoupment as per the guidelines of the scheme & will be<br />
mentioned in the MOU/ agreement.<br />
23. MOU / AGREEMENT: Selected <strong>In</strong>surance company(s) will have to make MOU/Agreement<br />
as per the directives given in the insurance scheme of Govt. of <strong>In</strong>dia within 10 days of acceptance<br />
of tender.<br />
24. MONTHLY REPORTING: The <strong>In</strong>surance Company will have to submit monthly report of<br />
physical & financial statement in the prescribed format along with individual policy details of<br />
each district and claim report on or before 5 th of each month which is mandatory.<br />
<strong>In</strong> case of any breach of terms and conditions of the contract & if dispute is not resolved<br />
within stipulated time with Chief Executive Officer, Maharashtra Livestock Development Board,<br />
Akola, the matter will be referred to <strong>In</strong>surance Regulatory and Development Agency, as per the<br />
guidelines of the scheme.<br />
25. OPENING OF TENDERS:<br />
Opening of Technical bid of tenders shall be possibly on 21.06.2012 at 13.00 Hrs. and<br />
Commercial bid shall be possibly on 22.06.2012 at 14.00 Hrs. in the office of the Regional<br />
Manager, Frozen Semen Laboratory, Mula Road, Khadki, Pune-03. Every bidder is at liberty to<br />
remain present or authorize one representative to be present at the opening of the tender at the<br />
time and date specified.<br />
26. ACCEPTANCE OF TENDERS:<br />
Chief Executive Officer, Maharashtra Livestock Development Board, Akola reserves the right of<br />
accepting the whole or any part of the tender or to refuse all tenders without assigning any reason.<br />

27. SETTLEMENT OF DISPUTES:<br />
a. All disputes with <strong>In</strong>surance Company shall be settled by the Chief Executive Officer,<br />
Maharashtra Livestock Development Board, Akola. However, the disputes between the<br />
insurance company and the Chief Executive Officer, Maharashtra Livestock Development<br />
Board, Akola or the appeal against the decision of Chief Executive Officer, Maharashtra<br />
Livestock Development Board, Akola in disputes referred to him shall lie with the<br />
Secretary (ADF) Mantralaya, Mumbai-32/ Chairman, Maharashtra Livestock Development<br />
Board, Akola<br />
b. Judicial proceedings, if any, can be started only in Courts of the State of Maharashtra at<br />
Akola Court only.<br />
c. Chief Executive Officer, Maharashtra Livestock Development Board, Akola will not be<br />
held responsible for any claim demands and/ or judgement of any nature brought against<br />
the M.L.D.B. Akola arising out of the services rendered by the insurer and it’s staff under<br />
this contract. Default in settlement of claim or any types of deficiency in services on the<br />
part of insurance company could be brought to the notice of <strong>In</strong>surance Regulating and<br />
Development Authority, which is nodal authority in the country. <strong>In</strong> case of dispute in<br />
implementation of this scheme the opinion of Chief Executive Officer, Maharashtra<br />
Livestock Development Board, Akola will be final and will be binding to the insurance<br />
companies.<br />
28. REMOVAL OF DIFFICULTY:<br />
The dates quoted in the tender form are subject to change in the event of any holiday abruptly<br />
declared by Govt. Chief Executive Officer, Maharashtra Livestock Development Board, Akola<br />
will take appropriate decisions to remove difficulties arising due to ambiguity in provisions made<br />
in the tender document.<br />
