K. Notwithstanding any term <strong>of</strong> this <strong>Settlement</strong> <strong>Agreement</strong>, <strong>California</strong><br />

specifically does not release any person or entity from, or renounce any action or remedy for, any<br />

<strong>of</strong> the following claims or liabilities:<br />

1. Any civil, criminal, or administrative liability arising under Title<br />

26, U.S. Code (Internal Revenue Code), or <strong>California</strong>’s Taxation and Revenue Code.<br />

2. Any criminal liability.<br />

3. Any administrative liability for mandatory suspension or<br />

mandatory exclusion from <strong>State</strong> <strong>of</strong> <strong>California</strong> or United <strong>State</strong>s health care programs.<br />

4. Any liability to the <strong>State</strong> <strong>of</strong> <strong>California</strong> (or their agencies) for any<br />

conduct other than the Covered Conduct.<br />

5. Any liability for express or implied warranty claims or other<br />

claims for defective or deficient products or services, including, but not limited to, quality <strong>of</strong><br />
