IjWe agree that <strong>AERA</strong> shall, without prejudice to any other right or remedy, be at<br />
liberty to <strong>for</strong>feit the fully said earnest money absolutely. In case the conditions<br />
mentioned in NIT clause 7.3 is found violated after opening the Cover No 2 (Financial<br />
Bid), the <strong>tender</strong> shall be summarily rejected. <strong>AERA</strong> shall without prejudice to any<br />
other remedy be at liberty to <strong>for</strong>feit the full said earnest money absolutely and IjWe<br />
shall not be considered as un-successful <strong>tender</strong>er <strong>for</strong> the purpose <strong>of</strong> return <strong>of</strong> earnest<br />
money as provided in the <strong>notice</strong> <strong>inviting</strong> <strong>tender</strong>. Should this <strong>tender</strong> be accepted, I jWe<br />
hereby agree to abide by and fulfill all the terms and conditions and provisions <strong>of</strong> the<br />
a<strong>for</strong>esaid documents.<br />
If, after the <strong>tender</strong> is accepted, I/We fail to comply with fulfill required <strong>for</strong>malities<br />
and further fail to commence the work in time as provided in the conditions, I/We<br />
agree that <strong>AERA</strong> shall without prejudice to any other right or remedy be at liberty to<br />
<strong>for</strong>feit the said earnest money absolutely and take such action against me/us, as<br />
deemed fit under the terms and conditions <strong>of</strong> the contract including <strong>of</strong> that the<br />
contract may be <strong>for</strong>eclosed and debar us /me from participating in <strong>tender</strong> <strong>for</strong> future<br />
works.<br />
I/We agree that should <strong>AERA</strong> decide to <strong>for</strong>feit the earnest money as a<strong>for</strong>esaid,<br />
unless a sum equal to earnest money mentioned above is paid by me/us <strong>for</strong>thwith,<br />
<strong>AERA</strong> may at its option recover it out <strong>of</strong> the deposit and in the event <strong>of</strong> deficiency, out<br />
<strong>of</strong> any other money due to me/us or otherwise.<br />
Ifthe <strong>tender</strong> is accepted I/We agree that within ls(fifteen) days <strong>of</strong>the receipt <strong>of</strong><br />
notification <strong>of</strong> award from <strong>AERA</strong>, the per<strong>for</strong>mance security shall be furnished by us in<br />
accordance with the general condition <strong>of</strong> the contract in the per<strong>for</strong>mance security<br />
<strong>for</strong>m (Bank Guarantee) provided at Annexure- G to Pro<strong>for</strong>ma <strong>for</strong> Agreement.<br />
