1. PURPOSE. This regulation rescribes policies and procedures regarding the<br />

overseas l~ousing allowance (0 !-I A) payment rc t ram. The OHA program is designed<br />

to provide additional housin allowances to e !'% igi le military personnel for housing<br />

costs which are higher than t B lose in the continental United States. The OHA is based<br />

on the actual cost paid by military personnel for housin . Applicants must rovide<br />

required information on their 11ouslng situation to estab k ish the rate at whic K OHA will<br />

be paid.<br />

2. APPIJCAl3ICXW. This regulation applies to all United States military personnel in<br />

the Republic of Korea who are eligible for OHA.<br />

a. Required publications.<br />

a. BAQ basic allowance for quarters<br />

b. OHA overseas housing allowance<br />

a. The Assistant Chief of Staff, J1, will exercise staff su ervision over the OHA<br />

program and supervise the administration of the annual 8 HA survey.<br />

c. Installation and unit commanders will ensur~e that annual OHA project officers<br />

are appointed and that surveys are monitored for completeness and are representative<br />

of the area housing costs.<br />

a. All military personnel (E6 and below) who a.re authorized by ro er authori<br />

reside off- ost are entitled to basic allowance for quarters (BAQ) an 0 A except t ose<br />

residing o f-post at their own expense.<br />

b. Military married couples (E6 and below)<br />

member. If it is determined by the installation<br />

quarters are not available, then BAQ and OHA<br />

c. Unaccompanied military personnel (E6 and below) may be directed by the<br />

installation commander to move back on post should adequate quarters become<br />

available or should mission requirements dictate. I'n either case, a milita member will<br />

be provided enough time to give advance notice to the lessor and not suf er a financial<br />

penalty.<br />

d. Before approvin a request (E6 and below) to reside off- ost at their own<br />

expense, unit comman % ers must counsel the individuals that It' AQ and OHA will not<br />

be authorized.<br />

e. Military personnel receiving OHA will notify (within 5 dutv da s) the<br />

commander, the servicing finance office, and the s4rvicing housing re erral office, or<br />

their designated representatives, of any of the follvwing:<br />

(1) Change of residence.<br />

(2) Change of rent cost.<br />

(3) Change in the number or the identity of the military occupants of the<br />

residence.<br />

(3) Command sponsorship orders, if applicable.<br />

(4) <strong>Overseas</strong> housing allowance brief sheet (see appendix A).<br />

(5) USFK Form 179-R (Off-Post <strong>Housing</strong> Checklist).<br />

(6) DD Form 1351-5 (Government Quarters and Mess). This statement is<br />

required by all personnel requestinl; OHA except joint domicile personnel and military<br />

members with a military spouse assigned to the same geographical area.<br />

b. After finalization, the original of each document is retained by the billeting office<br />

or housing referral office, one copy is returned to the person, and one copy is<br />

rnaintained by the person's personnel and administration center or orderly room.<br />

c. Rent costs will be certified on DD Form 2367. A proved leases will not be<br />

required due to the potential roblem of breaking the ease if the OHA request is<br />

disa proved. The housing re P erral office will ensure that all blocks on the DD Form<br />

roperly completed. Prior to authorization or payment of OHA, an approved<br />

re uired, Service regulations require a copy of the lease to substantiate<br />

payment of o A .<br />

d. Ex enditures to make a dwelling habitable, such as installin sinks, toilets, li ht<br />

To authorize this lump sum payment, block 12B, DD Form 2367, must be checked. B<br />

e. The fami9 housing or billetin office will make the final determination on<br />

availability of Government quarters efore forwarding the request to the appropriate<br />

approval authority.<br />

g. An OHA survey will be conducted annually durin the month of December. The<br />

information gathered durin the survey sets the rate at w ich OHA payments will be<br />

made. Ceilings are adjuste throughout the year based on monetary conversion rates.<br />

A-1. OHA was im lemented to give military personnel assigned to overseas locations<br />

an allowance base 1 on the difference between a member's BAQ and the actual rent a<br />

member pays, not to exceed the maximum ceiling established for the area. A<br />

supplemental amount for utilities, maintenance, and moving-in costs is also authorized.<br />

A-2. An OHA survey will be conducted annually during the month of December. You<br />

will be given an OHA survey form to show your costs for rent, utilities, recurring<br />

maintenimce, and moving-in/ termination costs. To he1 ou accurately complete the<br />

survey, you should keep all receipts during the year. &s all OHA survey forms are<br />

A3. To establish your entitlement to OHA, you must present a copy of the housing<br />

allowance ap lication endorsed by our command. Personnel sharm the housin unit<br />

must be liste on the DD Form 236 (Individual Chrerseas <strong>Housing</strong> A owance (0 AN<br />

Re ort). For the purpose of OHA eligibility and payment, a "sharer" is defined as a<br />

mi itcry member ent~tled to a housing allowance and residing with--<br />

a. Their spouse who is also a soldier, sailor, airman, or marine.<br />

b. Their spouse or other dependent who is a Federal civilian employee entitled<br />

to a living quarters allowance.<br />

c. Another soldier, sailor, airman, or marine entitled to a housing allowance.<br />

d. Any others, excluding dependents, who pay a portion of the rent, mortgage,<br />

and utilities.<br />

A4. If you share the residence with one or more persons, monthly rent from xour<br />

a reement is divided by that number. This figure is used to compute your 0 A.<br />

dilitary members without dependents will receive only 80 ercent of the utilities<br />

allowance if living alone. If you are sharin the residence, &vide the utility allowance<br />

by the number of you live with. W I? en utilities are included in the rental costs,<br />

the allowance is a to your OHA ceiling.<br />

A-5. If you are bu ing a home, divide the actual purchase price by 120 to obtain the<br />

equivalent month l? y rent figure. If two or more personnel jointIy own a home, divide<br />

the equivalent monthly rent by the number of owners.


A-6. Members entitled to OHA may draw advance entitlements for the purpose of<br />

paying advance rent, security deposits, or initial expenses involved in moving. The<br />

amount of the advance normally will not exceed the total of a 3-month entitlement;<br />

however, a 12-month entitlement may be authorized when the need is justified and<br />

a roved in writing b the appropriate commanding officer. Advance payment of<br />

8L is not authorize (I for the purchase of a home or other living accommodation.<br />

Personnel returning advance payments are liable for any differences in the<br />

won-to-dollar conversion rates.<br />

A-7. If you receive an OHA, you must notify (within 5 duty days) your commander,<br />

the housing referral office, and the custodian of your military pay record of any of the<br />

following:<br />

a. Moving back on station. When you move to on-station quarters, you must<br />

stop OHA entitlements. The effective date will be the date you are assigned to<br />

on-station quarters.<br />

b. Changing houses. When you change houses, you are required to make a new<br />

lease and have the new house inspected.<br />

c. Gaining or losing roommate(s) or a change in rental fee. Whenever this<br />

occurs, each member should make a new lease agreement with the landlord.<br />

A-8. For further information on how OHA is calculated or what items you may claim<br />

under the moving-in and moving-out expenses, see Joint Federal Travel Regulation,<br />

Volume I, appendix K.<br />

(NCITB: The maximum enalty for makin a fraudulent claim or statement is a $10,000<br />

fine or imprisonment of 5 years or both (1 8 USC 2871.)<br />
