<strong>The</strong> legal proceedings against <strong>the</strong> prisoners were entrusted<br />

to Girolamo de Federicis as Governor <strong>of</strong> Rome, and to <strong>the</strong><br />

Procurator-Fiscal, Alessandro Pallantieri. Both were de-<br />

clared enemies <strong>of</strong> <strong>the</strong> Carafa, and <strong>the</strong>y immediately set to<br />

work with <strong>the</strong> greatest zeal. Investigations were carried<br />

on not only in Rome, but also at Gallese and Naples ; in <strong>the</strong><br />

latter city, two chests <strong>of</strong> documents, which Cardinal Carafa<br />

had hidden <strong>the</strong>re, were seized.^<br />

<strong>The</strong> opening <strong>of</strong> <strong>the</strong> arraignment, which was based upon an<br />

examination <strong>of</strong> <strong>the</strong> material that had been collected, took<br />

place, by means <strong>of</strong> a Papal Motu Proprio, on July ist •} a<br />

second Motu Proprio, that <strong>of</strong> July 5th, ordered that Cardinals<br />

Cesi, Cueva, Saraceni, Puteo, Cicada, Bertrand, Urbino and<br />

Cornaro should be present at <strong>the</strong> special inquiry and trial<br />

<strong>of</strong> <strong>the</strong> accused Cardinals, to watch over <strong>the</strong> proceedings,<br />

and to see that <strong>the</strong> proper judicial forms were observed.^<br />

<strong>The</strong> inquiry itself was to be entirely in <strong>the</strong> hands <strong>of</strong> Federicis<br />

and Pallantieri. <strong>The</strong> notary associated with <strong>the</strong>m was Luys<br />

de Torres, a Spaniard <strong>of</strong> <strong>the</strong> confraternity <strong>of</strong> S. Girolamo<br />

della Carita, who had <strong>the</strong> interests <strong>of</strong> <strong>the</strong> accused at heart.'*<br />

<strong>The</strong> principal crimes to be laid to <strong>the</strong> charge <strong>of</strong> <strong>the</strong> Duke<br />

<strong>of</strong> Paliano were <strong>the</strong> murders <strong>of</strong> Capece and <strong>the</strong> Duchess,<br />

while Cardinals Carlo and Alfonso were accused <strong>of</strong> having<br />

promoted <strong>the</strong> cruel proceedings against Violante by consent<br />

or incitement. Cardinal Carlo was also accused <strong>of</strong> several<br />

murders which belonged in part to <strong>the</strong> time <strong>of</strong> his life as a<br />

soldier, but above all, <strong>of</strong> having, while he was <strong>the</strong> director<br />
