This Protocol includes:<br />

ARTICLE 1<br />

1) an <strong>Agreement</strong> on reciprocal preferential trade concessions for certain wines<br />

(Annex I to this Protocol),<br />

2) an <strong>Agreement</strong> on reciprocal recognition, protection <strong>and</strong> control of wine,<br />

spirits drinks <strong>and</strong> aromatised wine names (Annex II to this Protocol).<br />

ARTICLE 2<br />

The <strong>Agreement</strong>s referred to in Article 1 apply to:<br />

1) wines falling under heading 22.04 of the Harmonised System of the<br />

International Convention on the Harmonised Commodity Description <strong>and</strong> Coding<br />

System, done at Brussels on 14 June 1983 which have been produced from fresh<br />

grapes,<br />

(a) originate in the Community <strong>and</strong> have been produced in accordance with<br />

the rules governing the oenological practices <strong>and</strong> processes referred to<br />

in Title V of Council Regulation (EC) No 1493/1999 of 17 May 1999<br />

on the common organisation of the market in wine 1 , <strong>and</strong> Commission<br />

Regulation (EC) No 1622/2000 of 24 July 2000 laying down detailed<br />

rules for implementing Regulation (EC) No 1493/1999 on the common<br />

market organisation in wine <strong>and</strong> establishing a Community code of<br />

oenological practices <strong>and</strong> processes 2 ;<br />

or<br />

(b) originate in Bosnia <strong>and</strong> Herzegovina <strong>and</strong> have been produced in<br />

accordance with the rules governing the oenological practices <strong>and</strong><br />

processes in conformity with the law of Bosnia <strong>and</strong> Herzegovina.<br />

These rules governing the oenological practices <strong>and</strong> processes shall be<br />

in conformity with the Community legislation;<br />

2) spirit drinks falling under heading 22.08 of the Convention referred to in<br />

paragraph 1 which:<br />

(a) originate in the Community <strong>and</strong> comply with Council<br />

Regulation (EEC) No 1576/89 of 29 May 1989 laying down general<br />
