Did you know that there are<br />

sixty-nine licensure boards for<br />

engineers <strong>and</strong> l<strong>and</strong> surveyors in<br />

this country? There are licensing boards<br />

in all 50 states, the District of Columbia,<br />

Puerto Rico, U.S. Virgin Isl<strong>and</strong>s <strong>and</strong><br />

Guam. Most states have joint boards<br />

which administer the engineering <strong>and</strong><br />

l<strong>and</strong> surveying professions, but some<br />

states have separate licensing boards for<br />

Surveyors <strong>and</strong> Engineers. Illinois has a<br />

separate licensing board for Structural<br />

Engineers alone.<br />

The <strong>Louisiana</strong> <strong>Professional</strong><br />

<strong>Engineering</strong> <strong>and</strong> L<strong>and</strong> Surveying board<br />

issues licenses by comity to professionals<br />

who gained their licensure in another<br />

state or jurisdiction. Our laws <strong>and</strong> rules<br />

allow us to do so provided that their<br />

license was issued under conditions that<br />

“do not conflict” with the requirements<br />

in <strong>Louisiana</strong> <strong>and</strong> “were of a st<strong>and</strong>ard<br />

not lower than” the requirements in<br />

<strong>Louisiana</strong> at the time of their licensure.<br />

With sixty-nine licensing boards<br />

operating across the country, you can<br />

imagine the effort it takes for your<br />

Board to analyze those licenses <strong>and</strong><br />

determine if they measure-up to the<br />

requirements in <strong>Louisiana</strong>. We spend<br />

<strong>and</strong> inordinate amount of time on<br />

reciprocity applications at our board<br />

meetings.<br />

Fortunately, many of the states in<br />

recent years have moved toward more<br />

uniform licensure requirements. It’s<br />

no small task assembling all of these<br />

state jurisdictions in one room, but the<br />

common denominator in the equation<br />

is the National Council of Examiners<br />

for <strong>Engineering</strong> <strong>and</strong> Surveying (NCEES).<br />

All state boards are members of the<br />

NCEES, <strong>and</strong> actively participate in the<br />

effort to develop <strong>and</strong> adopt “model<br />

laws” <strong>and</strong> “model rules” that govern<br />

licensure for Surveyors <strong>and</strong> Engineers<br />

across the country. NCEES is most<br />

noted for developing <strong>and</strong> administering<br />

the “Fundamentals” <strong>and</strong> “<strong>Professional</strong><br />

Practices” exams for Surveyors <strong>and</strong><br />

Engineers, but they provide so many<br />

more services to the various state<br />

Boards.<br />

The NCEES has an annual meeting<br />

in which modifications <strong>and</strong> changes to<br />

model rules/laws <strong>and</strong> licensure protocol<br />

are discussed <strong>and</strong> often adopted.<br />

Your LAPELS board members will be<br />

actively participating in this meeting in<br />

Louisville, Kentucky in mid August.<br />

In addition to the annual meeting,<br />

NCEES has “zone” meetings in the spring<br />

of the year. <strong>Louisiana</strong> is a member<br />

of the Southern Zone, as you may<br />

guess, <strong>and</strong> recently hosted the Southern<br />

Zone Conference in New Orleans. This<br />

conference rotates around the South <strong>and</strong><br />

it has been many years since <strong>Louisiana</strong><br />

hosted the event. Donna Sentell, Evelyn<br />

Mayeux, Heidi Watts <strong>and</strong> the multitalented<br />

staff of LAPELS worked their<br />

tails off to coordinate this event. My<br />

sincere thanks to your LAPELS staff<br />

for making this an informative <strong>and</strong><br />

entertaining conference. Over two<br />

hundred participants came <strong>and</strong> were<br />

introduced to the effects of Hurricane<br />

Katrina, the Corps of Engineers<br />

efforts to rebuild the flood protection<br />

infrastructure, the ambiance of the<br />

French Quarter <strong>and</strong> a special evening<br />

at the National World War II Museum.<br />

I received so many congratulatory <strong>and</strong><br />

thank-you comments for a wonderful<br />

conference, but was very quick to point<br />

out that the LAPELS staff deserves the<br />

credit, not the Board members. The<br />

staff truly went above <strong>and</strong> beyond the<br />

call of duty <strong>and</strong> was great ambassadors<br />

for LAPELS, the City of New Orleans <strong>and</strong><br />

the State of <strong>Louisiana</strong>!<br />

In late June, I attended a meeting<br />

at the NCEES office in Clemson, SC to<br />

participate in the Exam for <strong>Professional</strong><br />

Surveyors (EPS) Committee, which is<br />

charged with reviewing <strong>and</strong> critiquing<br />

the various surveying exams. It was a<br />

very rewarding experience, but hardly<br />

any fun. Being locked in the NCEES<br />

office for two days working surveying<br />

problems brought back less-than-fond<br />

memories of studying for my professional<br />

licensure exams many years ago! I was<br />

truly amazed, though, at the dedication<br />

of the professionals from across the<br />

country who volunteer their time <strong>and</strong><br />

talents to make the NCEES exams the<br />

quality product that they are.<br />

I flew from Clemson, SC to<br />

Destin, Florida in early July to attend<br />

the <strong>Louisiana</strong> <strong>Engineering</strong> Society<br />

(LES) dual-state society meeting with<br />

the Mississippi <strong>Engineering</strong> Society.<br />

Although it may seem odd that the<br />

<strong>Louisiana</strong> <strong>and</strong> Mississippi societies chose<br />

to gather in Florida, I assure you they had<br />

ulterior motives. The S<strong>and</strong>estin resort is<br />

a wonderful family vacation destination<br />

<strong>and</strong> a great place to have a relaxed<br />

engineering conference. I venture to say<br />

that it is the only location where you can<br />

acquire Continuing Education Credits<br />

while wearing Bermuda shorts, flip-flops<br />

<strong>and</strong> a Hawaiian shirt. Pocket protectors<br />

stuffed with mechanical pencils <strong>and</strong> ink<br />

pens do look peculiar in a ‘Caribbean<br />

camouflage’ shirt pocket though! The<br />

technical presentations <strong>and</strong> exhibitors<br />

were excellent, <strong>and</strong> the program was<br />

set up to allow some extracurricular<br />

activities in the afternoons. Hat’s off to<br />

LES for a successful event.<br />

In closing, please know that your<br />

LAPELS board <strong>and</strong> staff are working<br />

diligently to safeguard the life, safety<br />

<strong>and</strong> welfare of the citizens of this great<br />

state <strong>and</strong> to ensure that those who<br />

are allowed the privilege of practicing<br />

<strong>Engineering</strong> <strong>and</strong> Surveying here are<br />

qualified to do so.<br />

Must Your Business Be Licensed by the Board?<br />

Recently, the Board has been made aware of ongoing<br />

confusion regarding the licensure requirements for sole<br />

proprietorships. The definitive answer may be found in<br />

Chapter 23 of the Rules of the Board:<br />

LAC Title 46:LXI§2301(C) states, “Unless otherwise provided,<br />

non-firm individual proprietorships which bear the full name of the<br />

owner who is a licensed professional are exempt from the application<br />

of this Chapter. Such proprietorships are not required to be licensed<br />

as engineering or l<strong>and</strong> surveying firms with the board. Non-firm<br />

individual proprietorships that do not bear the full name of the<br />

owner who is a licensed professional must be licensed with the board<br />

as an engineering or l<strong>and</strong> surveying firm <strong>and</strong> must comply with all<br />

the provisions of this Chapter.” (Emphasis added).<br />

Obviously, if the owner operates his business through an<br />

entity (e.g., corporation, limited liability company, partnership),<br />

then it is not a sole-proprietorship <strong>and</strong> must be licensed by the<br />

Board as any other firm.<br />

Examples of acceptable sole proprietorship names are,<br />

“John Q. Public, P.E.”, “John Q. Public, P.L.S.”, “John Q. Public<br />

Consulting”, <strong>and</strong> “John Q. Public <strong>Engineering</strong>”. Examples of<br />

unacceptable sole proprietorship names are “John Q. Public<br />

<strong>Engineering</strong>, Inc.”, “John Q. Public Surveying, Inc.”, <strong>and</strong> “John<br />

Q. Public Engineers, L.L.C.”<br />

La. R.S. 37:681 <strong>and</strong> 37:689(A) require any individual or<br />

firm practicing or offering to practice engineering or l<strong>and</strong><br />

surveying in <strong>Louisiana</strong> to be licensed by the Board. Therefore,<br />

any licensee who desires to offer or provide engineering or l<strong>and</strong><br />

surveying services through a firm must first obtain from the<br />

Board a license for that firm.<br />

The steps required for obtaining firm licensure are as<br />

follows:<br />

Execute the paperwork to create the firm.<br />

If the firm is a corporation or limited liability company,<br />

obtain a certificate of incorporation or certificate of<br />

organization (domestic corporations <strong>and</strong> LLCs) or certificate<br />

of authority (foreign firms) from the <strong>Louisiana</strong> Secretary of<br />

State.<br />

Within thirty days after forming the firm or obtaining the<br />

certificate from the <strong>Louisiana</strong> Secretary of State, submit to<br />

the Board a completed Application for Firm License along<br />

with a copy of the firm’s certificate from the <strong>Louisiana</strong><br />

Secretary of State.<br />

NOTE: The licensed professional(s) designated as the firm’s<br />

Supervising <strong>Professional</strong>(s) must be an active employee of<br />

the firm whose primary employment is with the firm on a<br />

full-time basis; or whose secondary employment is with the<br />

firm, provided the firm is totally owned by one or more of the<br />

Supervising <strong>Professional</strong>s whose license is used to qualify the<br />

firm for licensure.<br />

The Board continues to investigate alleged violations of<br />

laws <strong>and</strong> rules which regulate the practice of engineering <strong>and</strong><br />

l<strong>and</strong> surveying in <strong>Louisiana</strong>. Substantiated violations result in<br />

disciplinary or enforcement action being taken either through<br />

a Consent Order or by Board Order following a formal hearing<br />

at which the respondent is adjudged guilty of one or more<br />

violations. Below are summaries of some of the disciplinary/<br />

enforcement actions taken by the Board since the previous<br />

issue of the <strong>Journal</strong>.<br />

FAILURE TO COMPLY WITH CONTINUING<br />

PROFESSIONAL DEVELOPMENT REQUIREMENTS:<br />

Bin Shen, P.E., a licensed engineer (PE-30525), was subject to<br />

disciplinary action by the Board for (a) making a false statement<br />

in applying for a renewal license in violation of La. R.S. 37:698(A)<br />

(1) <strong>and</strong> (b) failing to comply with the continuing professional<br />

development (CPD) requirements of the Board in violation of La.<br />

R.S. 37:698(A)(6), to wit LAC Title 46:LXI§3105, 3117 <strong>and</strong> 3119.<br />

In 2007, Mr. Shen falsely stated on his license renewal form<br />

that he had met the Board’s CPD requirements for the renewal<br />

period of April 1, 2005 to March 31, 2007. Mr. Shen initially<br />

failed to submit proof of CPD compliance in response to a Board<br />

audit <strong>and</strong> then later responded that he had not earned any of<br />

the required CPD hours. Following a formal hearing, Mr. Shen<br />

was found to have committed violations of the above statutes<br />

<strong>and</strong> rules <strong>and</strong> was assessed the following sanctions: a fine of<br />

$500; actual costs of $2,526.53; an administrative fee of $200;<br />

successful completion of the Board’s online <strong>Louisiana</strong> Laws <strong>and</strong><br />

Rules Examination; satisfaction of the Board’s CPD requirements<br />

which he should have completed <strong>and</strong> submission to the Board<br />

of an up-to-date, complete <strong>Professional</strong> Development Activity<br />

Log <strong>and</strong> all supporting documentation; suspension of his<br />

license until he fully complies with all provisions of the final<br />

decision <strong>and</strong> order; <strong>and</strong> the publication of the final findings of<br />

fact <strong>and</strong> conclusions of law <strong>and</strong> final decision <strong>and</strong> order on the<br />

Board’s website, the printing of a summary of this matter by<br />

name in this publication, <strong>and</strong> the reporting of this matter by<br />

name to NCEES.<br />

Melvin K. Lara, P.E., a licensed engineer (PE-30267), was<br />

subject to disciplinary action by the Board for failing to<br />

comply with the continuing professional development (CPD)<br />

requirements of the Board in violation of La. R.S. 37:698(A)<br />

(6), to wit LAC Title 46:LXI§3117 <strong>and</strong> 3119. In 2007, Mr. Lara<br />

failed to submit proof of CPD compliance in response to a<br />

Board audit <strong>and</strong> then failed to submit such proof within 120<br />

days after notice of noncompliance from the Board. Following<br />

a formal hearing, Mr. Lara was found to have committed<br />

violations of the above statute <strong>and</strong> rules <strong>and</strong> was assessed the<br />

administrative fee of $200; successful completion of the Board’s<br />

online <strong>Louisiana</strong> Laws <strong>and</strong> Rules Examination; submission to<br />

the Board of an up-to-date, complete <strong>Professional</strong> Development<br />

Activity Log <strong>and</strong> all supporting documentation; suspension<br />

of his license until he fully complies with all provisions of<br />

the final decision <strong>and</strong> order; <strong>and</strong> the publication of the final<br />

findings of fact <strong>and</strong> conclusions of law <strong>and</strong> final decision <strong>and</strong><br />

order on the Board’s website, the printing of a summary of this<br />

matter by name in this publication, <strong>and</strong> the reporting of this<br />

matter by name to NCEES.<br />

Edward C. Haight, P.E., a licensed engineer (PE-16592),<br />

was subject to disciplinary action by the Board for (a) making<br />

a false statement in applying for a renewal license in violation<br />

of La. R.S. 37:698(A)(1) <strong>and</strong> (b) failing to comply with the<br />

continuing professional development (CPD) requirements of<br />

the Board in violation of La. R.S. 37:698(A)(6), to wit LAC<br />

Title 46:LXI§3105, 3117 <strong>and</strong> 3119. In 2007, Mr. Haight<br />

falsely stated on his license renewal form that he had met the<br />

Board’s CPD requirements for the renewal period of April 1,<br />

2005 to March 31, 2007. Mr. Shen initially failed to submit<br />

proof of CPD compliance in response to a Board audit <strong>and</strong><br />

then later submitted documentation indicating that he had<br />

earned fewer than all of the required CPD hours. Following<br />

violations of the above statutes <strong>and</strong> rules <strong>and</strong> was assessed the<br />

following sanctions: a fine of $500; actual costs of $2,298.81; an<br />

administrative fee of $200; successful completion of the Board’s<br />

online <strong>Louisiana</strong> Laws <strong>and</strong> Rules Examination; submission to<br />

the Board of an up-to-date, complete <strong>Professional</strong> Development<br />

Activity Log <strong>and</strong> all supporting documentation; suspension<br />

of his license until he fully complies with all provisions of<br />

the final decision <strong>and</strong> order; <strong>and</strong> the publication of the final<br />

findings of fact <strong>and</strong> conclusions of law <strong>and</strong> final decision <strong>and</strong><br />

order on the Board’s website, the printing of a summary of this<br />

matter by name in this publication, <strong>and</strong> the reporting of this<br />

matter by name to NCEES.<br />

Steven M. Horridge, P.E., a licensed engineer (PE-27400),<br />

was subject to disciplinary action by the Board for failing to<br />

comply with the continuing professional development (CPD)<br />

requirements of the Board in violation of La. R.S. 37:698(A)(6),<br />

to wit LAC Title 46:LXI§3117 <strong>and</strong> 3119. In 2007, Mr. Horridge<br />

initially failed to submit proof of CPD compliance in response<br />

to a Board audit <strong>and</strong> then failed to submit such proof within<br />

120 days after notice of noncompliance from the Board. Mr.<br />

Horridge later submitted documentation indicating that he had<br />

earned all of the required CPD hours. Mr. Horridge has entered<br />

into a Consent Order with the Board, wherein he admitted to<br />

violations of the above statute <strong>and</strong> rules <strong>and</strong> agreed to pay a fine<br />

of $200; to pay actual costs of $235.59; to pay an administrative<br />

fee of $200; to successfully complete the Board’s online<br />

<strong>Louisiana</strong> Laws <strong>and</strong> Rules Examination; <strong>and</strong> to the publication<br />

of the Consent Order on the Board’s website, the printing of a<br />

summary of this matter by name in this publication, <strong>and</strong> the<br />

reporting of this matter by name to NCEES.<br />

MULTIPLE STATUTES AND/OR RULES:<br />

Andrew D. Primeaux, P.E., P.L.S., a licensed engineer (PE-<br />

11156) <strong>and</strong> l<strong>and</strong> surveyor (PLS-3108), was subject to disciplinary<br />

action by the Board for (a) committing gross misconduct in<br />

the practice of l<strong>and</strong> surveying in <strong>Louisiana</strong> in violation of La.<br />

R.S. 37:698(A)(2) <strong>and</strong> (b) failing to comply with the Board’s<br />

minimum st<strong>and</strong>ards for property boundary surveys in violation<br />

of La. R.S. 37:698(A)(6), to wit LAC Title 46:LXI§2907(C), 2907(D)<br />

(1), 2907(E)(3)(f), 2907(F)(4) <strong>and</strong> (5), <strong>and</strong> 2907(G)(4), (9), (10)<br />

<strong>and</strong> (13). Mr. Primeaux prepared, signed <strong>and</strong> sealed a survey<br />

map for property in <strong>Louisiana</strong> which contained data compiled<br />

<strong>and</strong> assembled by another licensee who was not under his<br />

responsible charge. Mr. Primeaux also took the work of another<br />

licensee without permission <strong>and</strong> accepted it without proving or<br />

disproving its correctness. Additionally, Mr. Primeaux did not<br />

(a) properly establish <strong>and</strong> label all corner monuments on the<br />

survey map as “found” or “set”, (b) obtain the legal description<br />

or plats describing the property to be surveyed or evaluate the<br />

necessity to obtain the most recent recorded legal descriptions<br />

<strong>and</strong> plats of the tract to be surveyed <strong>and</strong> tracts adjoining or<br />

in proximity to the property to be surveyed, (c) properly set<br />

ADvOCACy<br />

Advocacy is one of the many benefits of your<br />

membership in ACEC/L <strong>and</strong> ACEC <strong>and</strong> over<br />

the past several months we have certainly been<br />

advocating on your behalf. On the 25th of April, a group<br />

of our members traveled to Washington, DC to speak with<br />

our Congressional Delegation, or their key staff person,<br />

on issues that are the life blood of our members. ACEC<br />

National provided us with three (3) vital issues to discuss<br />

with them. Since the Highway Transportation Act (Safe,<br />

Accountable, Flexible, Efficient Act (SAFETEA-LU) expires<br />

on September 30, 2009, it is a key priority for Congress.<br />

While our delegation underst<strong>and</strong>s the need for this Act to<br />

be renewed, no one wants to see a tax increase- of at least<br />

double the current rate- during these recessionary times.<br />

The Clean & Safe Water Infrastructure was another<br />

issue of concern. As federal funding has fallen substantially<br />

in recent years, we encouraged our delegation to support<br />

the Clean Water Act <strong>and</strong> the Safe Drinking Water Act.<br />

As one of the government’s primary funding programs<br />

for wastewater projects, the Clean Water State Revolving<br />

Fund (CWSRF) has declined steadily from its traditional<br />

level of $1.35 billion annually. In addition, the Drinking<br />

Water State Revolving Fund (DWSRF) has not kept pace<br />

with inflation or the growing cost of delivering safe<br />

drinking water to consumers.<br />

Our final issue of discussion was to urge our delegation<br />

to repel the 3% Withholding M<strong>and</strong>ate in Section 511 of<br />

the Tax Increase Prevention <strong>and</strong> Reconciliation Act of<br />

2005. The law, which takes effect in 2012, m<strong>and</strong>ates that<br />

federal, state <strong>and</strong> local governments that have annual<br />

expenditures exceeding $100 million will be required to<br />

withhold three (3) % from the payments to engineering<br />

firms.<br />

Those attending the Annual Legislative meeting <strong>and</strong><br />

making calls on our delegation were Larry Blanchette,<br />

Wilfred Barry, Ralph Junius, Mike McGaugh, Frank Newell,<br />

Frank Nicoladis, Richard VanWootten, Lee Underwood<br />

<strong>and</strong> Dan Mobley.<br />

At the ACEC Annual Legislative Convention, our very<br />

own Frank Nicoladis received an award for ACEC/L<br />

reaching its PAC goals. Also honored was Ralph Junius<br />

of the firm Linfield, Hunter <strong>and</strong> Junius, who received an<br />

Daniel Mobley, CAE<br />

Honor Award for the 17th Street Canal Interim Closure<br />

Structure <strong>and</strong> Larry Blanchette of the Associated Design<br />

Group who was a National Finalist for their work on the<br />

Superdome.<br />

Closer to home, the <strong>Louisiana</strong> Legislature completed<br />

their 2009 Regular Session at the end of June. For the<br />

first time we hired a legislative consultant to assist us in<br />

working with our legislators. As our results were mixed,<br />

in that we won some <strong>and</strong> lost some, we are using the<br />

time between now <strong>and</strong> next spring to be better prepared.<br />

Since the 2010 Session will not be fiscal session, we will<br />

be facing more bills that could affect us <strong>and</strong> we will need<br />

to be proactive in proposing bills that will benefit our<br />

engineering community.<br />

Here is a summary of some of the bills that will affect<br />

our industry:<br />

Act 598 – Passed by the legislature during the 2008<br />

Regular Session- Prohibited design professionals from<br />

submitting for a project if they had been involved in<br />

the study or creation of the project. Working with our<br />

colleagues from the American Institute of Architects of<br />

<strong>Louisiana</strong> we were able to pass legislation that clarified<br />

the process.<br />

SB 308 – Introduced by the Secretary of Transportation<br />

– Changed how consultants will be chosen in the future.<br />

We were able to work with the secretary to modify the<br />

language of the bill.<br />

SB 351 – Introduced by the Secretary of Transportation<br />

– Would have been a major change to Design Build. We<br />

were able to make major changes to this bill by working<br />

with the <strong>Louisiana</strong> Associated General Contractors.<br />

HB 833 – Officially created the Office of Coastal Protection<br />

<strong>and</strong> Restoration (OCPR) – This new agency was created by<br />

taking responsibilities from the Department of Natural<br />

Resources (DNR) <strong>and</strong> the Department of Transportation<br />

<strong>and</strong> Development (DOTD).<br />

All of these bills have been signed into law by the<br />

Annual Meeting<br />

Our Annual meeting was held from June 18-22,<br />

2009 aboard the Carnival Fantasy. We had excellent<br />

attendance <strong>and</strong> received many positive comments on<br />

our speaker, John Doehring of ZwiegWhite. Those in<br />

attendance said that this one of the best Annual Meetings<br />

that our organization has held. On Saturday evening, a<br />

reception was held to accept the vote of the members <strong>and</strong><br />

install our new Board of Governors. Congratulations to<br />

PRESIDEnTIAL PRIvILEgE<br />

Let me start by saying that I am honored to be serving<br />

as your <strong>Louisiana</strong> <strong>Engineering</strong> Society President for<br />

the 2009-2010 year. I pledge to do my best to fulfill<br />

the duties <strong>and</strong> responsibilities of the office, <strong>and</strong> I am looking<br />

forward to travelling around the state to visit with many of<br />

you at your chapter meetings. Remember that the LES Board<br />

<strong>and</strong> the State office staff are here to address your needs as<br />

members of this great organization. So let us know what you<br />

think by sharing your ideas <strong>and</strong> suggestions with us.<br />

I want to publicly acknowledge the great job done by our<br />

immediate Past President, Alan Krouse. Under his steady<br />

leadership, LES has enjoyed another outst<strong>and</strong>ing year. It has<br />

been a pleasure to work with Alan over the past few years on<br />

the Board, including a few times on the golf course. Through<br />

him, I also had the pleasure of meeting a relative that I never<br />

knew, his wonderful wife Stephanie. I hope we can maintain<br />

the success of his tenure <strong>and</strong> continue to build on that<br />

momentum in the upcoming year.<br />

Someone once said, I think it was one of my thermo professors,<br />

that “change is the only constant”. I recently accepted a<br />

new position with my company <strong>and</strong> I am in the process of<br />

relocating my family from Pineville to New Iberia. Our Second<br />

Vice President, Greg Danielson, is also making a move. He will<br />

be opening a new office for his firm in Birmingham, Alabama.<br />

Because of his relocation out of state, Greg has resigned his LES<br />

Board position. We congratulate Greg <strong>and</strong> thank him for the<br />

time he served on the State Board. We hate to see him go, but<br />

we wish him the best of luck in his new venture. At our June<br />

meeting, in accordance with our bylaws, the Board approved<br />

the following position changes: John Lowery resigned as<br />

Secretary-Treasurer <strong>and</strong> will assume the Second Vice President<br />

position, David Kunz resigned his State Director position <strong>and</strong><br />

will become the Secretary-Treasurer, <strong>and</strong> Craig Dooley will<br />

fill the open State Director position. I would like to thank all<br />

three of them for stepping up to help fill these openings on<br />

the Board. They have all been active on the Board <strong>and</strong> I know<br />

they will do a great job in their new capacities.<br />

I have been a member of LES for over twenty-three years,<br />

having joined when I started my first job after college. I was<br />

very fortunate that my employer, Cleco Power, was a big<br />

supporter of LES back<br />

then. And I’m glad to say<br />

they still are today. All Michael L. Bares, P.E.<br />

engineers in the company <strong>Louisiana</strong> <strong>Engineering</strong><br />

were encouraged to join Society President<br />

LES <strong>and</strong> participate in<br />

their activities, mainly attending the monthly meetings <strong>and</strong><br />

volunteering for MathCounts. It was a great opportunity to<br />

meet <strong>and</strong> network with many of the engineers working in<br />

our community. It was also a great chance to develop our<br />

leadership <strong>and</strong> team building skills. Two people I would like<br />

to thank individually for their support <strong>and</strong> encouragement<br />

in the early years of my career are Mr. Billy Thevenote <strong>and</strong><br />

Mr. Carroll Fuselier. As upper level engineering managers at<br />

Cleco, they recognized both the personal <strong>and</strong> professional<br />

development value offered through LES membership. They<br />

also promoted engineer licensure, even though it was not<br />

required in our industry, by sponsoring PE review classes in<br />

house. We should all follow their example by promoting the<br />

positive image of the engineering profession <strong>and</strong> persuading<br />

young engineers to get involved in LES.<br />

I hope you are enjoying your summer! It has been a busy<br />

one for me. The annual Dual-State meeting was held jointly<br />

with the Mississippi <strong>Engineering</strong> Society at S<strong>and</strong>estin in June.<br />

Despite concerns about the economic downturn, we had good<br />

attendance at the meeting. S<strong>and</strong>estin is a fantastic location <strong>and</strong><br />

there was a generous offering of PDH’s available. In addition,<br />

I was also able to squeeze a couple of days of vacation on the<br />

back end of the conference. You know what they say, “all work<br />

<strong>and</strong> no play…”. Enjoy what’s left of your summer!<br />

As the Monroe Chapter begins the 2009-2010 year, I know that<br />

I speak for all Chapter members in thanking the past year’s officers<br />

for their dedication, leadership <strong>and</strong> support. These individuals<br />

are a model for not only the Monroe Chapter but also<br />

the engineering profession as a whole.<br />

The official start of the 2009-2010 year of the Monroe Chapter<br />

the third Wednesday of each month from September through<br />

May. Meeting topics will vary. There will be emphasis on the<br />

Chapter as we look forward to continuing to develop ourselves as<br />

engineers, increasing the interaction amongst ourselves <strong>and</strong> the<br />

community, <strong>and</strong> our ongoing service to advance our profession.<br />

I would like to thank the incoming Officers for their dedication<br />

Also, I would like to take a moment to thank Joey, our outgoing<br />

Chapter President, for a wonderful job serving the Chapter<br />

<strong>and</strong> Society. A few notable accomplishments made under<br />

Joey’s leadership:<br />

LES State office to attend. As in the past, the meetings will be<br />

at Noon <strong>and</strong> one (1) PDH will be available for those members<br />

who attend. The meeting locations will vary with at least two<br />

of the meetings in Ruston to allow the <strong>Louisiana</strong> Tech students<br />

an opportunity to attend.<br />

A special note of recognition to our outgoing MATHCOUNTS<br />

Coordinator, David Kunz, P.E. David has served in this capacity<br />

for seven years <strong>and</strong> done a fantastic job. Joey will be stepping<br />

in to fill this post, <strong>and</strong> I know he will do a great job as<br />

well. Thanks David <strong>and</strong> Joey.<br />

Also, I would like to recognize our own Andrew Zagars, P.E. for<br />

being awarded this year’s E.M. Freeman Award for his longst<strong>and</strong>ing<br />

involvement in <strong>and</strong> dedication to our Chapter. This is a<br />

Chapter level award bestowed annually to a deserving member.<br />

In closing, I leave you with a quote by Henry Ford that I heard<br />

This one day seminar will explore specific issues related to the life safety requirements of the<br />

2006 Editions of NFPA 101 - Life Safety Code <strong>and</strong> the International Building Code<br />

<strong>and</strong> related st<strong>and</strong>ards as used in design of projects with multiple use <strong>and</strong> mixed occupancy buildings.<br />

The seminar takes a practical approach to learning the use of the IBC, Life Safety Code, <strong>and</strong> other Codes <strong>and</strong> St<strong>and</strong>ards enforced by<br />

building officials. This seminar is based on real examples of design issues that arise at final inspection that will prevent occupancy of the<br />

building until costly corrections are made.<br />

The intent is to make the attendee aware of these issues so that they will be addressed at the design <strong>and</strong> documentation phase of the projects<br />

prior to start of construction. Upon completion you should be aware of some of the basic Code requirements that can cause major issues at<br />

final inspection.<br />

Attendees should bring their copies of the NFPA 101-Life Safety Code <strong>and</strong> International Building Code. A copy of the 2006 Life Safety Code<br />

(H<strong>and</strong>book recommended) may be purchased from NFPA on their website (www.nfpa.org). The 2006 IBC (Commentary recommended) can be<br />

The LES Strategic Plan lists the following as our<br />

organizational values: Leadership, Integrity, Education,<br />

Career Orientation, Quality <strong>and</strong> Commitment. I’m sure<br />

many of you apply these same ideals to your personal careers as<br />

well; rightfully so, as this list is the cornerstone to an effective<br />

<strong>and</strong> respectable career as an engineer. But at a personal level,<br />

most engineers aspire for even greater heights <strong>and</strong> add other<br />

values to the list. The most prominent of all is PROFESSIONAL.<br />

The title of <strong>Professional</strong> Engineer holds a special honor within<br />

the engineering profession. This level of achievement is not<br />

taken lightly <strong>and</strong> holds great responsibilities along with its<br />

many rewards. Part of that responsibility is to promote <strong>and</strong><br />

defend the engineering profession. This too, is a cornerstone<br />

of LES’s mission.<br />

So how does the individual engineer <strong>and</strong> LES help promote<br />

<strong>and</strong> defend the profession? Mentoring young engineering<br />

graduates <strong>and</strong> encouraging high school students to consider<br />

engineering as a career path are great ways to ensure the<br />

longevity of our profession. Get involved with your local high<br />

<strong>Professional</strong> Engineers<br />

celebrated its 75th anniversary<br />

at its annual meeting in St. Louis,<br />

Missouri, from July 16-19, 2009. In<br />

addition to the meetings of the House<br />

of Delegates <strong>and</strong> Board of Directors,<br />

there was a two day leadership<br />

conference. Representing LES at the<br />

National Meeting <strong>and</strong> pictured here<br />

Executive Director, Chris Richard, LES House of Delegates<br />

Representative, <strong>and</strong> Susan Richard, LES First Vice President.<br />

The House of Delegates meeting was dominated by discussion<br />

of whether or not to allow state societies to have members that<br />

are not members of the national society. Several state societies<br />

are bringing in new state-only members, in violation of their<br />

charter with NSPE. Although there was much discussion on the<br />

subject, eventually a proposal to allow state-only membership<br />

was voted down. The Board of Directors voted to form a task<br />

force to review the options for membership.<br />

The House of Delegates also rejected a recommendation<br />

by the Board of Directors to increase the size of the Board.<br />

The Board recommended that the NICET (National Institute<br />

schools, speak at career<br />

day events, volunteer as<br />

a judge at science fairs, or<br />

volunteer to teach a class<br />

for a day. Don’t forget about your alma mater, universities<br />

are constantly looking for guest speakers for classes or student<br />

chapter meetings.<br />

One of LES’s Strategic Goals is to elevate the status <strong>and</strong> image<br />

of the engineering profession through outreach activities,<br />

recognition <strong>and</strong> public awareness. An outst<strong>and</strong>ing goal<br />

for the profession, but it is one of the most challenging to<br />

achieve. LES sponsored programs such as E-Week, MathCounts<br />

<strong>and</strong> Future Cities are great avenues for our members to get<br />

involved in public outreach to promote the engineering<br />

profession. Encouraging young engineers to attain licensure<br />

<strong>and</strong> educating them on the requirements to do so is another.<br />

LES has a vast array of information <strong>and</strong> opportunities available<br />

to all engineers, all we need is a small amount of your time<br />

<strong>and</strong> together we can make great things happen.<br />

on the Board. Both groups are part<br />

of the NSPE family. Although the<br />

proposal to add both seats got a<br />

majority, it fell short of the two-thirds<br />

vote needed to amend the Bylaws.<br />

NSPE also ushered in a new set of<br />

officers. Sam Grossman of California<br />

was installed as President. Michael<br />

hardy of Oregon serves as President-Elect. Chris Stone of<br />

Virginia was elected as Vice-President. Leanne P<strong>and</strong>uren of<br />

Michigan was elected Treasurer. John Plaisance of <strong>Louisiana</strong><br />

was elected the Southwest Region Representative to the NSPE<br />

Board of Directors. Chris Richard is now the <strong>Louisiana</strong> member<br />

of the NSPE House of Delegates.<br />

One of the more interesting sessions was on <strong>Engineering</strong><br />

Squad, an engineering show for teenagers on PBS. The show<br />

takes two teams of teenagers <strong>and</strong> pits them against each other<br />

in real world engineering challenges. About one hundred<br />

twenty girl scouts came in to the conference <strong>and</strong> took<br />

engineering challenges based on the show, such as putting<br />

together a zip line vehicle <strong>and</strong> a musical dance pad. About<br />

sixty engineers were on h<strong>and</strong> to help them develop their<br />

ideas into reality.<br />

The <strong>Louisiana</strong> <strong>Engineering</strong> Foundation is now ten months<br />

into the fund raising campaign to retire the debt on<br />

the <strong>Louisiana</strong> <strong>Engineering</strong> Center. Our fund raising<br />

efforts have gone quite well since we started in October of last<br />

year. As of June 1, we have reduced the building debt from<br />

$485,000 to approximately $330,000. We have raised a little<br />

over $200,000 in donations <strong>and</strong> pledges to date. Eighty-two<br />

thous<strong>and</strong> dollars has been earmarked for endowed scholarships<br />

to be given to deserving engineering students in <strong>Louisiana</strong>.<br />

Once the building debt is retired, these scholarships will be<br />

endowed with the lease payments collected from tenants.<br />

This fall we will be sending<br />

reminders to those that<br />

have pledged donations. In<br />

addition, we will be sending<br />

out letters to all engineers<br />

<strong>and</strong> companies in <strong>Louisiana</strong><br />

asking for your support. No<br />

amount is too small. If we<br />

all give toward this most<br />

worthwhile cause, we will<br />

2009 DuAL-STATE EngInEERIng SOCIETIES mEETIng hIghLIghTS<br />

Mr. Mike Bares of New Iberia was installed as President<br />

of the <strong>Louisiana</strong> <strong>Engineering</strong> Society at the 2009<br />

Dual-State <strong>Engineering</strong> Societies Meeting held at the<br />

S<strong>and</strong>estin Resort in Destin, Florida. Mr. Dan Wittliff , Director<br />

of NSPE, installed the officers from the societies of <strong>Louisiana</strong><br />

<strong>and</strong> Mississippi at the Installation Banquet.<br />

John Plaisance II, PE was honored at the installation banquet<br />

with the <strong>Louisiana</strong> <strong>Engineering</strong> Society Lifetime Achievement<br />

Award. John’s peers recognize his many contributions to the<br />

society from the chapter, state <strong>and</strong> national level. A Lifetime<br />

Achievement Award may be made to a nominee having made<br />

significant contributions to the advancement of engineering<br />

<strong>and</strong> the objectives of the Society throughout his or her career.<br />

The nominee shall have acknowledged eminence in engineering<br />

or related sciences. Nominees are chosen only from members<br />

of the Society <strong>and</strong> NSPE. Ten total voting members of the<br />

Society <strong>and</strong> NSPE are required to recommend the nominee.<br />

Five Past Society Presidents who are still members are required<br />

to support <strong>and</strong> attest to the qualifications of the nominee. All<br />

other living Past Presidents who are still members would then<br />

vote to confirm the nominee.<br />

The Dual-State <strong>Engineering</strong> Societies Meeting was once again a<br />

great success. The Conference offered thirty-six (36) hours of<br />

continuing education courses spread over three tracks as well<br />

as eight (8) possible hours of Life Safety Code. The diverse<br />

courses offered the attendees the opportunity to receive up to<br />

12 professional development hours.<br />

The generous support of the many exhibitors <strong>and</strong> sponsors<br />

allows us to keep the cost of attending the conference at a<br />

minimum. Please see the list of exhibitors <strong>and</strong> sponsors in this<br />

issue <strong>and</strong> be sure to thank them for their continued support<br />

of LES.<br />

After the sessions, the attendees were free to spend time<br />

with their families enjoying the many amenities available<br />

at S<strong>and</strong>estin Resort <strong>and</strong> the nearby communities, including<br />

enjoying the beautiful beaches, playing golf <strong>and</strong> tennis,<br />

shopping, or just relaxing.<br />

As with any endeavor, this conference would not have been<br />

successful without the hard work of volunteers. LES Executive<br />

Director Brenda Gajan <strong>and</strong> the LES staff Jason Pasqua <strong>and</strong><br />

Cathy Guidry did a great job organizing this year’s event.<br />

John Plaisance once again masterfully organized the golf<br />

highway <strong>and</strong> other public works contracting but also included<br />

liability protection <strong>and</strong> the removal of engineering qualifications<br />
