remaining in the Acquisition Fund on or after the earlier of (i) the expiration of the Acquisition
Period and (ii) the date on which Lessee executes an Acceptance Certificate shall be applied as
provided in Section 4 hereof.

distribution of amounts in the Acquisition Fund or (ii) written notice given by Lessor of the
occurrence of a default or termination of the Lease due to non-appropriation.
