c.When the final approved action must be considered or executed by HRC, forward the proceedings<br />

d. Determine whether medical board or PEB proceedings are pending or appropriate per paragraph<br />
1–22.<br />
6 C&S The school comm<strong>and</strong>ant authorizes a student serving on ADT to return in time to arrive at their home<br />
station by the termination date of self-terminating order, when he or she has not received the final decision<br />
of the case.<br />
7 SACT<br />

a. Separates a student whose REFRAD (USAR <strong>and</strong> ARNGUS) or discharge (USAR only) is directed<br />
by the GCM authority or TJAG. (Exception: for a student of the USAR on ADT who has returned home<br />
under self-terminating orders <strong>and</strong> any student of the ARNGUS on full-time training duty, then para<br />
2–33e or f applies). Unless one of exceptions apply, final release orders <strong>and</strong> forms will cite regulatory<br />
authority <strong>and</strong> SPD as shown in AR 635–5–1.<br />
b.Forwards to CDR, HRC–St. Louis (AHRC–PAT–R), for USAR students, or to Chief, National<br />
Guard Bureau (NGB–ARP–O), as appropriate, one copy of the release order, a report of the student’s<br />
academic performance, a copy of the faculty board proceedings (if applicable), <strong>and</strong> the action directed<br />
by the GCMCA or TJAG. For an ROTC graduate, includes the name of the school.<br />

Task: Process Involuntary Early Release of <strong>Army</strong> National Guard of the United States <strong>and</strong> United<br />
States <strong>Army</strong> Reserve <strong>Officer</strong>s on Active duty for Training, Active Duty for Special Work, <strong>and</strong><br />
Temporary Tour of Active Duty<br />
2–35. Rules for processing involuntary early release of <strong>Army</strong> National Guard of the United States <strong>and</strong><br />
United States <strong>Army</strong> Reserve officers on active duty for training, active duty for special work, <strong>and</strong><br />
temporary tour of active duty<br />
a. The ARNGUS <strong>and</strong> USAR commissioned <strong>and</strong> warrant officers may be involuntarily released early from ADT,<br />
ADSW, <strong>and</strong> TTAD for any of the reasons shown in paragraphs (1) through (3) , below. The unit or agency sponsoring<br />
the tour will initiate the recommendation for involuntary early release when appropriate, taking into consideration the<br />
length of time remaining on the officer’s tour, based on automatic release date authorized by self-terminating orders.<br />
(This section does not relieve the comm<strong>and</strong>er from moral obligation to pursue separation for cause under other sections<br />
of this regulation when the circumstances exist.) The approval authority for early release under paragraphs (2) <strong>and</strong> (3),<br />
below is the comm<strong>and</strong>er of the unit or agency sponsoring the tour <strong>and</strong> does not require board action.<br />
(1) An officer’s conduct, degree of efficiency, or manner of performance is seriously deficient.<br />
(2) There is a change in mission requirements which results in malutilization of the officer’s skills (no board).<br />
(3) Funds are curtailed for the tour (no board).<br />
b. The initiating comm<strong>and</strong>er will refer the recommendation for involuntary early release (see fig 2–7) to the officer<br />
for rebuttal or comment. Specific reasons must be included in the recommendation. The officer’s rebuttal or comments<br />
must be returned to the initiating comm<strong>and</strong>er within 15 calendar days from the date of receipt. No reasons will be<br />
added after the officer’s review, without further referral to the officer (AR 600–37). The officer may submit a written<br />
request (see fig 2–1) for voluntary early release instead of responding to the recommendation for involuntary early<br />
release. Should the officer request voluntary release, the request will be processed in the same manner as a recommendation<br />
for involuntary early release, except that no board action is required. The officer’s request for voluntary release<br />
will be accepted <strong>and</strong> all involuntary release action will cease.<br />
c. The unit or agency comm<strong>and</strong>er sponsoring the tour that initiated the involuntary early release under a(1,) above,<br />
will submit a completed recommendation to include the officer’s rebuttal or comments. The recommendation will be<br />
sent through comm<strong>and</strong> channels of the unit or agency sponsoring the tour to CDR, HRC–St. Louis (AHRC–OPZ–O), 1<br />

(NGB–ARP–O), Chief National Guard Bureau, 2500 <strong>Army</strong> Pentagon, Washington, DC 20310–2500, for ARNGUS<br />
officers. In addition, a copy of the recommendation will be sent to the officer’s assigned unit. Intermediate comm<strong>and</strong>ers<br />
will recommend approval or disapproval with reasons <strong>and</strong> forward promptly to the next higher headquarters.<br />
d. The DARNG <strong>and</strong> CDR, HRC–St. Louis, acting for HQDA, will convene a board of officers to consider<br />
recommendations for involuntary early release under a(1), above, concerning their respective personnel. The board will<br />
