assigned to the Selective Service System may be retained on AD <strong>and</strong> in an active status until further retention is<br />

considered inappropriate by HRC or the agency concerned or until age 60, whichever is earlier.<br />

(5) An officer of the ARNGUS assigned as Chief, National Guard Bureau.<br />

(6) An officer whose retention is approved on an individual basis by the Secretary of the <strong>Army</strong>.<br />

(7) An officer who on attainment of age 58 is within 2 years of qualifying for retired pay under AR 135–180 will be<br />

retained, if otherwise qualified, until the end of the month in which age 60 is reached.<br />

h. The m<strong>and</strong>atory release of a RC warrant officer is governed by the field promotion to CW2 ADL selection for RA<br />

integration.<br />

(1) A warrant officer retained by HRC under a voluntary retention program.<br />

(2) A warrant officer serving on the CW3, CW4, or CW5 will not be released prior to completion of an incurred<br />

ADSO, unless granted a waiver for earlier release. In any case, the release will not be prior to completing 31 calendar<br />

days of active service in the new grade.<br />

(3) A warrant officer who began current AD warrant officer tour prior to 1 October 1987 <strong>and</strong> who has completed<br />

less than 20 years active service or is serving beyond 20 years active service on an incurred ADSO, <strong>and</strong> who is<br />

recommended for AD list promotion to CW3, CW4, or CW5 will be allowed to remain on AD until promoted <strong>and</strong> until<br />

he or she has completed the incurred ADSO, or until promoted <strong>and</strong> he or she has completed the time needed to<br />

complete 20 years of active service for retirement, as appropriate. Earlier release may be required to meet current needs<br />

of the Active <strong>Army</strong>.<br />

(4) A warrant officer serving on an initial tour of OBV service will be retained on AD until expiration of OBV<br />

service unless earlier release is required to meet current needs of the Active <strong>Army</strong>.<br />

i. <strong>Officer</strong>s to be released will be notified directly by CG, HRC, normally not later than 6 months prior to the<br />

scheduled release date. In addition, a copy of the notification memor<strong>and</strong>um will be forwarded to the SAA <strong>and</strong> the<br />

officers’ immediate comm<strong>and</strong>er for inclusion in the officers’ MPF. The AGR officers who will be released from AD<br />

under this section will be notified by the Chief, National Guard Bureau; Chief, <strong>Army</strong> Reserve; or the State adjutants<br />

general.<br />

j. An officer scheduled for release (under this paragraph) who is not eligible or does not apply for retirement but<br />

who is hospitalized will have release determination made according to the medical examination.<br />

k. The officer’s separation will not be delayed past the scheduled release date due to nonsubmission or late<br />

submission of a voluntary retirement request.<br />

2–24. Steps for processing involuntary release from active duty due to maximum service<br />

The steps required for processing involuntary REFRAD due to maximum service are as shown in table 2–10.<br />

a. Upon receipt of notification memor<strong>and</strong>um, determines whether medical board proceedings are<br />

pending or appropriate under paragraph 1–23. Informs the officer that if they desire to retire coincident<br />

with their REFRAD, or earlier, an application for retirement must be submitted. Advises the officer that<br />

the separation will not be delayed due to nonsubmission or late submission of a request for voluntary<br />

retirement.<br />

b. Submits requests for retention based on military necessity to the CDR, HRC–Alex<strong>and</strong>ria<br />

(AHRC–OPD–A), or the CDR, HRC–St. Louis (AHRC–AR), for USAR AGR officers with justification<br />

(amount of advance notice comm<strong>and</strong>er had for planning <strong>and</strong> new effective date requested). <strong>Officer</strong> will<br />

continue separation processing to preclude unnecessary hardship if the retention is not approved.<br />

Separates or retires officer on scheduled release date. Final release orders <strong>and</strong> forms will cite<br />

regulatory authority <strong>and</strong> SPD as shown in AR 635–5–1.<br />

2–25. Rules for processing involuntary release from active duty due to nonselection of active guard<br />

reserve continuation<br />

a. An AGR officer on an initial period of duty will be separated from AD 90 calendar days after notification of<br />

continuation board action of nonselection (AR 135–18, para 4–6) or at the end of the initial period of duty, whichever<br />
