(4) All active <strong>Army</strong> installations authorized 4,000 or more AD military personnel.<br />

(5) HRC–St. Louis.<br />

d. Unless otherwise stated, the appropriate related paragraph will be cited as the separation authority.<br />

e. The related separation program designator (SPD) codes are provided in AR 635–5–1.<br />

2–3. Status upon separation<br />

a. Unless discharged, officers holding a Reserve appointment will retain their current permanent grade in the RC.<br />

b. Service academy graduates <strong>and</strong> Reserve <strong>Officer</strong>s’ Training Corps (ROTC) distinguished military graduates<br />

(DMG) who are released/separated from AD before completing their ADSO will complete the remainder of their<br />

ADSO in the Selected Reserve. This requirement may only be waived by the Assistant Secretary of the <strong>Army</strong><br />

(Manpower <strong>and</strong> Reserve Affairs) (ASA (M&RA)) or their delegate if he or she determines that no unit vacancy is<br />

available for the officer. The Selected Reserve includes troop units of the ARNGUS <strong>and</strong> <strong>Army</strong> Reserve, the AGR<br />

Program, <strong>and</strong> Individual Mobilization Augmentation Program.<br />

c. <strong>Army</strong> Regulation 135–91 defines various statutory <strong>and</strong> contractual service obligations (to include methods of<br />

fulfillment) incurred by Reserve personnel on initial entry into military service. <strong>Officer</strong>s not continued on AD in<br />

another status will be released from AD <strong>and</strong> returned to <strong>Army</strong> National Guard of the United States (ARNGUS) or<br />

USAR by separation orders.<br />

d. An officer must serve in the Armed Forces until completion of the statutory MSO (10 USC 651). In accordance<br />

with DODI 1304.25, an officer has an 8–year MSO. REFRAD under provisions of chapter 2 of this regulation does not<br />

terminate the MSO. An officer who requests REFRAD before completing the 8–year MSO must complete the MSO in<br />

a RC, or submit a resignation under chapter 3 of this regulation with a request for waiver of the MSO by the ASA<br />

(M&RA). To waive an officer’s MSO, the ASA (M&RA) must find that the officer has no potential for service under<br />

conditions of full mobilization.<br />

2–4. Years of service<br />

a. For the purpose of this chapter, years of service applies to all periods of service in which the officer held an<br />

appointment as a commissioned officer, other than constructive service <strong>and</strong> service as a warrant officer.<br />

b. Travel time will be included in years of service computation for officers who are ordered to AD exceeding 30<br />

calendar days (37 USC 204 (b)).<br />

Section II<br />

Task: Process Voluntary Release from Active Duty Due to Personal Reasons<br />

2–5. Rules for processing voluntary release from active duty due to personal reasons<br />

a. If eligible under the criteria prescribed below, an officer may request REFRAD (see fig 2–1) whenever such<br />

action is considered appropriate. Unless specified otherwise in this paragraph, application for REFRAD will be<br />

submitted not earlier than 12 months or no later than 6 months before the desired release date or beginning date of<br />

transition leave, whichever is the earliest. The officer’s immediate (or higher) comm<strong>and</strong>er/supervisor may waive the<br />

6–month requirement if the needs of the <strong>Army</strong> are met through a change in mission requirement or the assignment of a<br />

replacement officer.<br />

b. To be eligible for REFRAD under this section, an officer must have—<br />

(1) Completed the current period of service required by law or the minimum period required by the program that<br />

placed the officer on AD as a commissioned or warrant officer.<br />

(2) Completed 1 year of current AD commitment, unless such commitment was submitted <strong>and</strong> approved with<br />

stipulations of AR 135–215 or AR 140–30 for AGR officers that authorize earlier REFRAD.<br />

(3) Fulfilled the following additional service requirements, as applicable:<br />

(a) <strong>Officer</strong>s who have departed the CONUS normally will be required to complete the current prescribed tour for<br />

the areas of assignment as specified in AR 614–30, unless returned earlier under existing policies.<br />

(b) <strong>Officer</strong>s who have attended service schools or civilian educational institutions or participated in special training<br />

for which a utilization tour is required, or who have received continuation or accession pay, normally will complete the<br />

period of service specified. The period of service will be as specified by AR 350–100 <strong>and</strong> other appropriate regulations<br />

under which officers applied for or received such schooling or benefits.<br />

(c) <strong>Officer</strong>s on orders for assignment to a military mission, a Military Assistance Advisory Group, or attache office<br />

must complete their training <strong>and</strong> the OCONUS tour of duty prescribed by AR 614–30.<br />
