than 4 months prior to the retirement date or the beginning of the officer’s transition leave date. The officer’s<br />
immediate comm<strong>and</strong>er will ensure the medical examination is processed according to AR 40–501.<br />
6–7. Hospitalization/physical evaluation board<br />
a. An officer who requests (or is scheduled for) retirement <strong>and</strong> has a medical problem (or becomes hospitalized) will<br />
be evaluated by the comm<strong>and</strong>er (or designated representative) of the MTF to determine if referral to a PEB is<br />
n e c e s s a r y . W h e n t h e o f f i c e r i s r e f e r r e d t o t h e P E B , t h e M T F w i l l p r o m p t l y n o t i f y C D R , H R C – A l e x a n d r i a<br />
(AHRC–OPD–A), or HQDA (DAPE–GO for general officers). The PEB Liaison <strong>Officer</strong> must provide the officer’s<br />
medical condition <strong>and</strong> scheduled date of the PEB.<br />
b. An officer found fit for duty by a PEB will retire on the first day of the month following the month the officer is<br />
found fit.<br />
c. When a PEB is not necessary but additional medical care is, a nondisability retirement will be processed. Medical<br />
treatment will continue up to <strong>and</strong> after (if necessary) the approved retirement date. The retirement date will not be<br />
changed because of medical treatment.<br />
6–8. Retirement status<br />
a. An RA <strong>Officer</strong> placed on the retired list continues to be an officer of the U.S. <strong>Army</strong>.<br />
b. Unless there is evidence of fraud, an officer’s retirement under a particular statute exhausts the power of the<br />
President <strong>and</strong> the Secretary of the <strong>Army</strong>. The record of Executive action cannot be revoked or modified to make the<br />
retirement relate to another statute, even though more than one statute properly applied at the time of retirement. No<br />
member of the <strong>Army</strong> may be ordered to AD solely for the purpose of qualifying for retired pay for non-Regular service<br />
(10 USC 12737).<br />
6–9. Residence <strong>and</strong> travel abroad<br />
A retired officer may travel or reside in any area to which access is authorized U.S. citizens by the United States<br />
Department of State. Permission for travel or for residence is a Department of State matter <strong>and</strong> does not require<br />
approval from officials in HQDA.<br />
6–10. Advancement of an Active <strong>Army</strong> warrant officer to a higher grade<br />
a. When a retired warrant officer’s active service plus service on the retired list totals 30 years, they are entitled to<br />
be advanced on the retired list to the highest grade satisfactorily served on AD, as determined by the Secretary of the<br />
<strong>Army</strong> (10 USC 3964).<br />
b. Orders announcing a warrant officer’s advancement are issued by the HRC–St. Louis (AHRC–PAP), 1 Reserve<br />
Way, St. Louis, MO 63132–5200. Notification is sent to the officer; to Retired Pay Operations, Defense Finance <strong>and</strong><br />
Accounting Service, Indianapolis, IN 46249–0001; <strong>and</strong> to other appropriate agencies.<br />
6–11. Restoration of an Active <strong>Army</strong> warrant officer to a former grade<br />
An RA warrant officer or enlisted member advanced to a higher commissioned grade under 10 USC 3964 may be<br />
restored on the retired list to their former grade. The officer must apply within 3 months of the advancement to the<br />
Secretary of the <strong>Army</strong> for approval.<br />
6–12. Permanent professors of the United States Military Academy<br />
Upon retirement, any permanent professor of the United States Military Academy (USMA) in a grade below brigadier<br />
general whose service as such a professor has been long <strong>and</strong> distinguished may, in the discretion of the President, be<br />
retired in the grade of brigadier general (10 USC 3962).<br />
Section II<br />
Voluntary Retirements<br />
6–13. Approval authority<br />
a. The Secretary of the <strong>Army</strong> is the approval authority for retirements. The Secretary of the <strong>Army</strong> has delegated<br />
approval authority for voluntary retirements (waiver/nonwaiver) to CG, HRC-Alex<strong>and</strong>ria. CG-HRC-Alex<strong>and</strong>ria may<br />
approve, disapprove, or delay/defer the requested retirement date of an officer who has completed 20 but less than 30<br />
years of AFS. Endorsing comm<strong>and</strong>ers are reminded that an officer requesting a voluntary nonwaiver retirement who<br />
has completed 20 but less than 30 years of AFS is eligible, but not entitled to retire upon request. Comm<strong>and</strong>ers who<br />
wish to recommend denial of a voluntary nonwaiver retirement request should forward the application to HRC-<br />
Alex<strong>and</strong>ria with an accompanying statement setting forth the recommendation of denial. Voluntary retirements may be<br />
denied or delayed based on the needs of the <strong>Army</strong>, <strong>and</strong> each application will be evaluated on its individual merits.<br />
Approval authority for voluntary retirements requiring a waiver is HRC <strong>and</strong>, in some cases, the Secretary of the <strong>Army</strong>.<br />
Approval authority for voluntary retirements of regular commissioned officers with at least 30 but not less than 40<br />
years of active service for retirement purposes is the Secretary of the <strong>Army</strong>. Approval of retirement requests may be<br />
