A MEDICAL ETHICS PERSPECTIVE TO LAWS IN<br />
PUBLIC HEALTH IN TURKEY<br />
Health workers have an ethical duty not to discriminate<br />
against persons infected with HIV. In Turkey,<br />
AIDS cases are few. In <strong>the</strong>se kinds <strong>of</strong> cases, doctor<br />
should respect to privacy principle and should in<strong>for</strong>m<br />
this case to necessary administration places according<br />
to <strong>the</strong> Turkish Agreement <strong>of</strong> Medical Ethics,<br />
with <strong>the</strong> date <strong>of</strong> 1960. Here, <strong>the</strong> beneficence <strong>of</strong> community<br />
is necessary.<br />
Moreover, health insurance shows modern characteristics<br />
in Turkey. But, we see some ethical problems<br />
in health insurance from <strong>the</strong> point <strong>of</strong> view <strong>of</strong> <strong>the</strong><br />
medical ethics. Modern insurance laws are present,<br />
today. We know two kinds <strong>of</strong> health insurances in<br />
Turkey. One <strong>of</strong> <strong>the</strong>m is <strong>the</strong> health insurance with<br />
regard to <strong>the</strong> Official Foundations. Ano<strong>the</strong>r one is <strong>the</strong><br />
special health insurance. Ethical dilemmas between<br />
patient, insurance company and hospital can cause to<br />
some difficulties in <strong>the</strong> patients’ <strong>the</strong>rapies. For example,<br />
<strong>the</strong> hospitals <strong>of</strong> social insurances are very crowded<br />
in Turkey. The physicians cannot have <strong>the</strong> time <strong>for</strong><br />
<strong>the</strong> <strong>the</strong>rapies <strong>of</strong> <strong>the</strong> patients. Sometimes, physicians<br />
cannot behave as emphatic because <strong>of</strong> <strong>the</strong>ir economical,<br />
social and pr<strong>of</strong>essional problems. Some modern<br />
laws try to prevent <strong>the</strong>se problems (9,10).<br />
There are laws or regulations aimed at protecting<br />
people against tainted foodstuffs, unsafe working<br />
conditions, and unsatisfactory housing. Moreover, in<br />
Turkey, community values and standards have lately<br />
shifted toward greater control over environmental<br />
hazards to health, reflecting growing concern about<br />
our deteriorating environment. Turkish Law <strong>of</strong><br />
Protection <strong>of</strong> Health has some articles on this topic.<br />
In this paper, all <strong>of</strong> <strong>the</strong>se topics are stressed from<br />
<strong>the</strong> point <strong>of</strong> <strong>the</strong> medical ethics and laws in public<br />
health in Turkey and some results are obtained.<br />
