gested charge to the committee; (3) as soon as possible, the appointment<br />

<strong>of</strong> a committee within such procedures as the board may adopt; and (4)<br />

a suggested appropriation for anticipated expenses <strong>of</strong> the committee.<br />

“I would suggest a time schedule alonq the following lines : the devel-<br />

opment <strong>of</strong> a statement <strong>of</strong> procedures and a charge to the Committee-<br />

no later than the October meeting (perhaps involving a special meeting) ;<br />

and the appointment <strong>of</strong> a Consultative Committee by October or early<br />

November.<br />

“This board will devote prompt attention and every energy to this<br />

task-one <strong>of</strong> the most important we have. Let us close with expressing<br />

again our heartfelt thanks to Jack and our prayers for a happy next<br />

“phase” in his life.<br />

RECESS AND EXECUTIVE SESSION<br />

Following a short recess, the board reconvened in executive session and<br />

considered the following items <strong>of</strong> business :<br />

Litigation Initiated on Behalf <strong>of</strong> Karen Turner<br />

(38) A complaint has been filed in the Circuit Court for Peoria County (Case No.<br />

77 L 4936) by Willene Tetrev, as mother and next friend <strong>of</strong> Karen Turner, a minor,<br />

seeking damages for alleged conduct <strong>of</strong> a medical student at the Peoria School <strong>of</strong><br />

Medicine. <strong>The</strong> defendants are Norman Powers, M.D., who is represented by counsel<br />

<strong>of</strong> his own selection, and the medical student, Nick Schlagetrr (designated in t!:r<br />

complaint as Nick Schlater). One count in the complaint alleges that cn February<br />

8, 1977, at the pr<strong>of</strong>essional <strong>of</strong>fices <strong>of</strong> Dr. Powers in Pcoria the medical studcnt made<br />

an indecent assault on the minor when the student was present without authority<br />

in the examining room assisting Dr. Powers who was conducting a physical exami-<br />

nation <strong>of</strong> the minor. In another count it is alleged that the medical student was<br />

assirting Dr. Powers without the consent <strong>of</strong> the minor or her parents at the time<br />

<strong>of</strong> the medical examination in questiun and that the student directed obscene lan-<br />

guage toward the minor.<br />

Mr. Schlageter has stated that at all times alleged in the complaint he was<br />

acting in his capacity as a medical student, has denied he assaulted the minor or<br />

used obscene language, and has requested the <strong>University</strong> to provide representation<br />

for him in the matter under the <strong>University</strong>’s self-insuranee program. <strong>The</strong> Peoria<br />

School <strong>of</strong> Medicine has confirmed that at the times alleged in the complaint Mr.<br />

Schlageter was a student arid that as a part <strong>of</strong> the student’s regular course <strong>of</strong> in-<br />

struction he was assigned to Dr. Powers’ <strong>of</strong>fice to gain experience in the observation<br />

and practice <strong>of</strong> history taking and physical examination <strong>of</strong> patients.<br />

Pursuant t3 previous delegations by the <strong>Board</strong> <strong>of</strong> <strong>Trustees</strong>, the university coun-<br />

sel has been given interim authorization to take such steps as are necessary or appro-<br />

priate, including the employment <strong>of</strong> special counsel, to protect the interests <strong>of</strong> the<br />

<strong>University</strong> in this matter and to provide representation for Mr. Schlageter. <strong>The</strong><br />

university counsel has recommended that such authcrization be ratified, approved,<br />

and confirmed in all respects.<br />
