egress therefrom; the rights and easement granted to be limited to the extent that<br />

this public Corporation has the present right and capacity to grant the same.<br />

Grantee shall have the right to clear and remove any obstacles or obstructions on<br />

the easement tract as may be required to provide necessary clearance. Grantee shall<br />

agree to repair any damage caused to property <strong>of</strong> this Corporation or pay any<br />

damages which may be caused to property <strong>of</strong> this Corporation in the process <strong>of</strong><br />

laying, construction, reconstruction, operation, maintenance, renewal or removal <strong>of</strong><br />

said pipeline, and to indemnify this Corporation and its representatives from liabil-<br />

ity in connection with Grantee’s activities. <strong>The</strong> pipeline easement shall remain in<br />

full force and effect from the date granted and for so long thereafter as said pipe-<br />

line is continued in service and has not been abandoned ahd discontinued. Upon<br />

termination <strong>of</strong> the easement Grantee shall peaceably surrender possession <strong>of</strong> said<br />

premises to this Corporation and full and complete title then shall remain in this<br />

Corporation free and clear <strong>of</strong> said easement and without necessity <strong>of</strong> re-entry or<br />

demand. <strong>The</strong> right-<strong>of</strong>-way easement shall be over the following-described property:<br />

Situated in the County <strong>of</strong> Champaign, State <strong>of</strong> <strong>Illinois</strong>, and being a part<br />

<strong>of</strong> Section Twenty Eight (28), Township Nineteen North (T 19 N),<br />

Range Nine East (R 9 E) <strong>of</strong> the Third Principal Meridian; aforesaid<br />

rights and easement shall be located on the West one-half (W %) <strong>of</strong><br />

the public road extending north and south along the east line <strong>of</strong> the<br />

Northwest Quarter (NW W ) <strong>of</strong> Section 28 in the Township and Range<br />

aforesaid.<br />

Easement to <strong>Illinois</strong> Power Company (Springfield Avenue, Champaign)<br />

(32) <strong>The</strong> president <strong>of</strong> the <strong>University</strong>, with the concurrence <strong>of</strong> appropriate adminis-<br />

trative <strong>of</strong>ficers, recommends adoption <strong>of</strong> the following resolution granting to <strong>Illinois</strong><br />

Power Company an easement for land 1 foot by 230 feet and three parcels 3 feet<br />

in diameter for a street lighting transmission system along the south side <strong>of</strong> Spnng-<br />

field Avenue between Sixth and Wright Streets, Champaign. <strong>The</strong> improved lighting<br />

will provide greater safety for vehicular and pedestrian traffic.<br />

This project is funded by the city <strong>of</strong> Champaign and includes the installation<br />

<strong>of</strong> new underground power lines and construction <strong>of</strong> aluminum poles with cqn-<br />

Crete bases.<br />

Resolution Authorizing Electric Transmission Line Easement to <strong>Illinois</strong><br />

Power Company along South Side <strong>of</strong> Springfield Avenue<br />

between Wright and Sixth Streets, Champaign, <strong>Illinois</strong><br />

Be It, and It Hereby Is Resolved by the <strong>Board</strong> <strong>of</strong> <strong>Trustees</strong> <strong>of</strong> the <strong>University</strong> <strong>of</strong><br />

<strong>Illinois</strong>, a public corporation <strong>of</strong> the State <strong>of</strong> <strong>Illinois</strong>, that the Comptroller and<br />

Secretary <strong>of</strong> this Corporation be, and they hereby are, authorized to execute, ac-<br />

knowledge, and deliver in the name and on behalf <strong>of</strong> this Corporation such instru-<br />

ments <strong>of</strong> conveyance, contract, or other document or documents as to them may<br />

seem necessary or desirable in order to grant to <strong>Illinois</strong> Power Company, an<br />

<strong>Illinois</strong> corporation, hereinafter referred to as “GrantZe,” its successors and<br />

assigns, the right and easement to construct, reconstruct, operate and maintain,<br />

repair, alter, replace, move, and remove an electric transmission lighting system<br />

including aluminum poles, buried cylindrical concrete bases, and other equipment<br />

appurtenant thereto under, through, and across the land hereinafter described and<br />

the right <strong>of</strong> ingress to and egress therefrom; the rights and easement granted to be<br />

limited to the extent that this Corporation has the present right and capacity to<br />

grant the same. Grantee shall agree to repair any damage caused to property <strong>of</strong><br />

this Corporation by the construction, reconstruction, operation, maintenance, re-<br />

pairing, alteration, moving, and removing <strong>of</strong> said power line and to indemnify this<br />

Corporation and its representatives from liability in connection with Grantee’s
