<strong>Best</strong> practice<br />

• Appropriate safeguards to address privacy issues should be in place where CCTV is used.<br />

• Implement operational procedures to preserve the integrity <strong>of</strong> the CCTV as an effective surveillance measure<br />

and to respect the privacy rights <strong>of</strong> patrons.<br />

• Patrons should be in<strong>for</strong>med about the use <strong>of</strong> CCTV. This is a legislative obligation in some licence<br />

conditions.<br />

• Staff with responsibilities in CCTV operations should receive appropriate training about their duties and<br />

relevant privacy obligations.<br />

Remember<br />

• Where these best practice principles are consistent with a legal standard under the <strong>Liquor</strong> Act or <strong>Liquor</strong><br />

Regulation that specifically applies to your venue, including a condition <strong>of</strong> licence, then you are obligated to<br />

follow that legal standard.<br />

Implementation<br />

For this purpose, a venue required by legislation or by conditions <strong>of</strong> licence to operate CCTV will be referred to<br />

as a ‘regulated venue’.<br />

• A ‘regulated venue’ must operate CCTV in accordance with the legislated and prescribed standards but may<br />

also refer to the CCTV Guide <strong>for</strong> best practice purposes.<br />

• While the CCTV Guide recognises and incorporates the legislative requirements, if there is any confusion or<br />

inconsistency, a regulated venue should follow the legislated standard.<br />

• A venue other than a regulated venue should refer to the CCTV Guide.<br />
