PART 9. ENFORCING THE CLAIM FOR DAMAGES<br />

Section 48 The following forms/templates must be used for the purpose of enforcing claims for<br />

damages:<br />

Annex 4: The student’s notification of a hearing in a tort case<br />

Annex 5: Decision on the claim for damages<br />

Section 49 The decision issued on the basis of the minutes of the tort procedure contains the<br />

name and personal data of the person causing the damage, the description of the damaged, lost<br />

or destroyed asset, the amount of damages payable, the manner of providing compensation and<br />

the deadline for providing compensation (Annex 5).<br />

The person responsible for the damage may be allowed to pay in instalments if this is reasonable<br />

due to their financial situation. A copy of the decision on the damages must be sent to the<br />

Financial Director. The minutes must be signed by the chair of the tort committee and the keeper<br />

of the minutes.<br />

Section 50 If the deadline for the payment of the compensation expires and no payment is made,<br />

the person responsible for the damage must be sued in court and the documents of the case must<br />

be sent to the Legal Department for this purpose.<br />

Section 51 The statute of limitations is three years. If the damage has been caused by a crime,<br />

the statute of limitations is five years, unless the statute of limitations of the particular crime is<br />

longer. In the latter case, the statute of limitations for the damage claim will expire when the<br />

statute of limitations for the criminal case expires.<br />

Section 52<br />

(1) The Civil Code will apply to all financial liability-related issues not regulated above.<br />

(2) A judicial review of the final tort decisions may be sought in court.<br />

Attention to Students of Foreign Language Programs at Semmelweis<br />

University<br />

In recent years, Semmelweis University has built a valuable student community by maintaining<br />

high academic standards and placing much emphasis on the ethical integrity of our education. The<br />

overwhelming majority of our students appreciate our efforts. Unfortunately, a small minority does<br />

not want to accept our ethical guidelines, and tries to take undue advantage at exams by using<br />

unacceptable techniques.<br />

We therefore do implement the following sanctions:<br />

Against students who are found at exams possessing forbidden items, including electrical devices,<br />

such as mobile phones, ipods, etc. a disciplinary action will be initiated that can end with<br />

immediate discharge with disgrace from Semmelweis University. By implementing this rule, we<br />

wish to preserve the academic and material value of the Semmelweis Diploma.
