Narrated Abu-Dhar (RA): The Prophet (PBUH)<br />
said that Allah SWT said: O My slaves! I have<br />
forbidden injustice for Myself, so it is forbidden<br />
amongst you. So, do not be unjust to each<br />
other......<br />
(This Hadith is sound and reported by Muslim)<br />
** Injustice is one of the most bad qualities most widely<br />
practised among men since the dawn of history. Allah SWT<br />
made it HARAM (unacceptable) and whoever practises<br />
injustice cannot be a good Muslim. Allah SWT Who is All-<br />
Judicious and All-Just wants us all, to practise every justice<br />
among ourselves.<br />

IN THE NAME OF GOD, THE COMPASSIONATE, THE MERCIFUL.<br />
PRAISE BE TO GOD, THE LORD OF THE UNIVERSE AND MAY THE<br />
BLESSINGS AND PEACE OF GOD UPON HIS MESSENGERS<br />
WHEREAS the time has now arrived when the people of the Persekutuan Tanah<br />
Melayu will assume the status of a free independent and sovereign nation among the<br />
nations of the World.<br />
AND WHEREAS by an agreement styled the Federation of Malaya Agreement, 1957,<br />
between Her Majesty the Queen and Their Highness the Rulers of the Malay States it<br />
was agreed that the Malay States of lohore, Pahang, Negeri Sembilan, Selangor,<br />
Kedah, Perlis, Kelantan, Trengganu and Perak and the former Settlements of Malacca<br />
and Penang should as from the 31st day of August, 1957, be formed into a new<br />
Federation of States by the name of Persekutuan Tanah Melayu.<br />
AND WHEREAS it was further agreed between the parties to the said agreement that<br />
the Settlements of Malacca and Penang aforesaid should as from the said date cease<br />
to form part of Her Majesty's dominions and that Her Majesty should cease to exercise<br />
any sovereignty over them.<br />
PROCLAMATION OF<br />
INDEPENDENCE<br />
AND WHEREAS it was further agreed by the parties aforesaid that the Federation of<br />
Malaya Agreement, 1948, and all other agreements subsisting between Her Majesty<br />
the Queen and Their Highness the Rulers or anyone of them immediately before the<br />

said date should be revoked as from that date and that all powers and jurisdiction of<br />
Her Majesty or of the Parliament of the United Kingdom in or in respects of the<br />
Settlements aforesaid or the Malay States or the Federation as a whole should come<br />
to an end.<br />
AND WHEREAS effect has been given in the Federation of Malaya Agreement, 1957,<br />
by Her Majesty the Queen, Their Highnesses the Rulers, the Parliament of the United<br />
Kingdom and Legislatures of the Federation and of the Malay States.<br />
AND WHEREAS a constitution for the Government of the Persekutuan Tanah Melayu<br />
has been established as the supreme law thereof.<br />
AND WHEREAS by the Federal Constitution aforesaid provision is made to safeguard<br />
the rights and prerogatives of Their Highness the Rulers and the fundamental rights<br />
and liberties of the people and to provide for the peaceful and orderly<br />
advancement of the Persekutuan Tanah Melayu as a constitutional monarchy based<br />
on Parliamentary democracy. AND WHEREAS the Federal Constitution aforesaid<br />
having been approved by an Ordinance of the Federal Legislatures, by the<br />
Enactments of the Malay States and by resolutions of the Legislatures of Malacca and<br />
Penang has come into force on the 31 st day of August, 1957, aforesaid. Now in the<br />
name of God the Compassionate, the Merciful, I, TUNKU ABDUL RAHMAN PUTRA<br />
IBNI AL-MARHUM SULTAN ABDUL HAMID HALIMSHAH, PRIME MINISTER OF<br />
THE PERSEKUTUAN TANAH MELAYU, with the concurrence and approval of<br />
Their Highnesses the Rulers of the Malay States do hereby proclaim and declare<br />
on behalf of the people of the Persekutuan Tanah Melayu that as from the thirty first<br />
day of August, nineteen hundred and fifty seven, the Persekutuan Tanah Melayu<br />
comprising the States of lohore, Pahang, Negri Sembilan, Selangor, Kedah, Perlis,<br />
Kelantan, Trengganu, Perak, Malacca and Penang is and with God's blessing shall<br />
be for ever a sovereign democratic and independent State founded upon the<br />
principles of liberty and justice and ever seeking the welfare and happiness of its<br />
people and the maintenance of a just peace among all<br />

<strong>NIAT</strong>’s primary objective is to send a crystal clear message to the Barisan<br />
Nasional (BN) and Pakatan Rakyat (PR) leadership that <strong>Indian</strong> Malaysians<br />
should not be taken for granted.<br />

‘PULSE’ and ‘NERVE CENTRE’ of every <strong>Indian</strong> Malaysian. <strong>NIAT</strong> on behalf of<br />
all <strong>Indian</strong> Malaysians humbly appeal to the <strong>Indian</strong> Malaysian leaders in<br />
Barisan Nasional / Pakatan Rakyat to consider this seriously and endorse it<br />
as a sign of agreement. It is your moral obligation to take up this document<br />
to your top leadership.<br />
As a God fearing Muslim, I urge the Muslim leaders not to treat Non-<br />

Gratitude &<br />
Hope<br />
First of all, on behalf of <strong>NIAT</strong><br />
and the wonderful team that<br />
came together to put up this paper, I would like to extend my<br />
gratitude to the numerous NGOs, MPs, DUNs not forgetting the<br />
courageous general public for their invaluable input in drafting this<br />
“<strong>Indian</strong> <strong>MALAYSIAN</strong>’s Call for <strong>GE13</strong>”, a substantial 5 year plan in<br />
line with our Political Landscape - <strong>GE13</strong>.<br />
In the past, the under-representation of the <strong>Indian</strong> minority<br />
interests in the economic planning and the poor consultative<br />
process has left the minorities’ concerns unattended – something<br />
that has gone on for many decades. Most of the solutions in the<br />
past were political and not need based solutions.<br />
<strong>NIAT</strong> with the help of many stakeholders have attempted to<br />
formulate requests and demands to be adapted as part of the<br />
election manifesto that reflects the real need(s) of <strong>Indian</strong><br />
Malaysians, irrespective of their religious or other inclination.<br />
The time has come for all Political Parties to recognize the<br />
importance of <strong>Indian</strong> Malaysian minority’s votes and needs. This<br />
paper seeks to identify and clarify those needs without fear or<br />
favour.<br />

<strong>NIAT</strong> is grateful to our Political Leaders, who gave many inputs in<br />
drafting this document by way of recommendations, information<br />
and suggestions thereby facilitating this “<strong>Indian</strong> Malaysians’ Call for<br />
<strong>GE13</strong> - <strong>Undo</strong> the <strong>History</strong> and Redo the <strong>Future</strong>”. We understand the<br />
dynamics of the political landscape towards <strong>GE13</strong> and we want to<br />
put forward a comprehensive paper describing the <strong>Indian</strong><br />
Malaysians’ needs and aspiration to both BARISAN and PAKATAN’s<br />
Leadership. We ask the leaders to come forward to endorse and<br />
make their promises based on <strong>Indian</strong> Malaysian needs with a clear<br />
view of their future direction. <strong>NIAT</strong> has also engaged with various<br />
individuals, groups and experts namely academicians, NGOs,<br />
students, youth groups, housewives, single mothers, micro business<br />
persons, civil servants, politicians, even school dropouts in<br />
formulating this paper.<br />
The success of this effort depends upon the implementation of<br />
these recommendations by respective Political Parties whose<br />
representatives are elected at the <strong>GE13</strong>. <strong>NIAT</strong> and other civil<br />
societies will back up and participate in the <strong>GE13</strong> to promote<br />
candidates / parties who are willing to grant our wish list.<br />

The <strong>Indian</strong> Malaysian Story<br />
The Nation must be reminded of this fact : That NO one race has<br />
DIED more than the <strong>Indian</strong> Malaysian in this country for making<br />
“SWARNABOOMI” a reality!<br />
A whopping 1.2 million <strong>Indian</strong> Malaysians died between the years of<br />
1850 to 1950. This is an average of approximately 33 persons per<br />
day. (The Malaysian <strong>Indian</strong> Dilemma Pg 11)<br />
Impossible! Some may deny; others may question : Is that true?<br />
Some question the veracity or some even try to hide the truth and<br />
spin it for their self engineered interest.<br />
However, the fact of the matter is that this is the truth and a fact.<br />
They died because of a host of calamities including snake bites,<br />
malaria, tropical diseases, mal-nutrition, exhaustion and slave like<br />
conditions to transform those thick Malayan virgin forests into the<br />
green (paradise) plantations that we have today.<br />
The same sacrifice happened one more time in modern times when<br />
another a million or more <strong>Indian</strong> Malaysians were displaced from<br />
estates nationwide since the 1980s. Look no further then the<br />
nation’s capital that swallowed many estates. These <strong>Indian</strong><br />
Malaysians are still looking for justice for their displacement. These<br />
“shawarnaboomi refugees” are squartering all over for survival -<br />
seeking for just treatment. Many do not have special skills to do<br />
anything other than plantation works, they have no place to stay<br />
other then basic estate housings, they have no saving other than<br />
their children and they have no hope for the future: these<br />

neglected <strong>Indian</strong> Malaysians were the new phenomenon of urban<br />
poverty and become the victim of unsustainable urbanization. The<br />
social crisis taking place includes crime, high dropout rates,<br />
rebellious mind. Illiterate, behaviors, gangsterism, alcoholism,<br />
drastic drop in family values and morals.<br />
We can undo the history and learn from the mistake by<br />
acknowledging the true condition and accepting the proposed<br />
solution in a holistic and honest manner.<br />
<strong>NIAT</strong> and its affiliates are very happy to have been able to reach this<br />
juncture to play a civil society’s role in assisting the community<br />
through sharing our findings for fast, permanent and effective<br />

A. Rationale<br />
We understand as a God fearing Malaysian, we want no one to be<br />
left behind from the current development and all issues must be<br />
solved effectively and quickly so that the adverse effect of socioeconomic<br />
imbalance of <strong>Indian</strong> Malaysians can be eradicated.<br />
Currently, political bodies are entrusted with the responsibilities<br />
and they are playing a major role in gauging, drafting, formulating,<br />
planning, executing, implementing and monitoring policies related<br />
to their respective group of representation like MIC for the <strong>Indian</strong>s<br />
and such. However, all the policies, execution and implementation<br />
have been political and NOT need based decisions ; as the parties<br />
are a political outfit and not a government department.<br />

Thus, there are issues that have grown amounting to a crisis and<br />
now affect all walks of people. <strong>For</strong> example, “Stateless Issue”,<br />
alcoholism, gangsterism, school dropouts, joblessness, single<br />
motherhood, poverty and etc. each of which will be identified and<br />
solutions are recommended below.<br />
It should be noted here that even the Prime Minister understands<br />
that the need for an affirmative action thru specific machinery (if<br />
not earlier) and initiated the Special Implementation Task <strong>For</strong>ce<br />
(STIF): SEED as a baby step. Unfortunately, the SITF/SEED has very<br />
limited year to date success in terms of reach, vision, planning, manpower<br />
and results in holistic and permanent manner because they<br />
are an ad-hoc setup. Quick fix methods adopted will not solve the<br />
<strong>Indian</strong> Malaysians who have been marginalized for the past 55<br />
years.<br />
Based on extensive studies and meetings that has been instituted by<br />
<strong>NIAT</strong> for half a year, it is our collective and collateral understanding<br />
that the <strong>Indian</strong> Malaysian community need a permanent built-in<br />
government structure to ensure an effective and collective<br />
approach to deal directly with issues in continuous and<br />
converging pattern.<br />
The need to do so is to blatantly exercise the rights enshrined in<br />
Malaysian Constitution under Article: 153(1) i.e. “…legitimate<br />
interest of other communities…“. It was on this promise that we<br />
obtained our independence.<br />

B. Timeline/ Dateline<br />
It is proposed that the aspiring Government of post <strong>GE13</strong> ADAPT<br />
this recommendation urgently and include in the election<br />
manifesto.<br />
C. Proposed Methodology<br />
A special committee which includes <strong>NIAT</strong> should be setup to<br />
formulate and institute the Department under JPM.<br />
The Department is to be established and parked under the Prime<br />
Minister’s Ministry while satellite offices to be established in all the<br />
state capitals to start with (within the first 5 years) before it goes to<br />
all districts particularly in the states of Johor, Perak, Penang, Negeri<br />
Sembilan, Selangor, Kedah, Malacca and Pahang.<br />
Funding to be allocated from annual budget by the Finance<br />
Minister; the employees are to be hired directly by the Department<br />
in consultation with the Board of Advisors (the composition of the<br />
Board is stipulated in the following page). In view of this, we<br />
propose creation of a Working Committee to setup this Department<br />
and to formulate the detailed task and KPI for this department.<br />

The complete task, scopes, organization charts and structure that<br />
are based on check, balance and real result orientation will be<br />
submitted at a later time by the <strong>NIAT</strong>’s Team and various<br />

D. Conclusion:<br />
<strong>Indian</strong> Malaysians request the post <strong>GE13</strong> Government not to merely<br />
consider but to implement these suggestions for the betterment of<br />
all minorities. This request is not a political request but to<br />
understand that this is a true reflection of an existing need of the<br />
marginalized communities. This caters for a permanent<br />
institutionalized solution rather than throwing quick fixes for issues<br />
that need greater understanding and complex maneuvering<br />
pertaining to the minorities, especially the <strong>Indian</strong> Malaysians. A<br />
systematic approach to issues and needs will benefit the<br />
government greatly rather than having too many ad-hoc<br />
committees or having politic parties to dispense task without<br />
expertise or infrastructure. Political bodies are meant for political<br />
work and aspiration not for policy-program-welfare deliveries.<br />
It is important to setup this department as soon as possible. <strong>NIAT</strong><br />
will render our full support and expertise in making sure the<br />
department is functional and delivers the result to end the<br />
minorities’ issues.<br />

NO: 2 - Education<br />
2.1 Abolish “PERALIHAN” classes<br />
(“Remove Classes”) Effective 1 st January 2014<br />
A. Rationale<br />
While very few may have been indoctrinated to believe otherwise,<br />
“Remove” condition or policy has always been perceived by the<br />
majority of Chinese Malaysians and <strong>Indian</strong> Malaysians as a<br />
“punishment or deterrence“ to force parents / students to opt for<br />
National Schools.<br />
This condition of a remove class has been introduced and practiced<br />
despite the fact that Tamil Schools in the country have almost 200<br />
years of history.<br />
The 1 st Tamil School was established at Penang Free School<br />
by Rev Hutching in 1816;<br />

In 1850 – Tamil Anglo School was established in Malacca;<br />
In 1896 the Tamil Anglo School was set up in Kuala Lumpur<br />
by Rev Abraham;<br />
The legacy continued till the Colonial British Government in<br />
the year 1912 passed a Labour Code to allow Tamil Schools<br />
to be built in estates.<br />

Unfortunately the Ministry of Education (MOE) may not see it from<br />
that vantage point. Education Blue Print Sept 2012 itself perceive<br />
vernacular schools as UNITY hindrance :<br />
1. Tan Sri Wan – <strong>For</strong>mer DG of MOE agrees that the<br />
fundamental perception of MOE must CHANGE before an<br />
COMPLIMENTARY Education System under a single vision<br />
can be achieved without sacrificing any system of schools.<br />
Synchronizing the English and Bahasa Malaysia between<br />
Vernacular Schools and SK school is definitely a good way<br />
forward.<br />

2. 1974 MIC <strong>Indian</strong> Blueprint, it had been clearly highlighted<br />
that “remove” classes were ineffective and it fuels the<br />
60% dropouts among <strong>Indian</strong> Malaysian students – yet the<br />
cry for educational justice fell on deaf ears.<br />
3. Action Plan for <strong>Future</strong> of Tamil schools in Malaysian –<br />
JPM Prof Dr Rajendran: echoed the idea to remove the<br />
“remove” class as part of his future recommendation to<br />
reform Tamil Schools.<br />
4. Mr. Doraisamy of the Headmaster’s Association lauded<br />
the idea recently in July 2012, The Star: to remove the<br />

“Remove” system because of is ineffectiveness and<br />
irrelevancy in modern Malaysian Society.<br />
5. The Malaysian Hindu Sangam submitted the same<br />
recommendation i.e. to scrap the “remove” system in its<br />
Rancangan Malaysia Ke-10 recommendations submitted in<br />
February, 2012<br />
6. Abolishing “remove class” 2017 -EBP – is too long and too<br />
late. The Language; Bahasa Malaysia and English in<br />
Vernacular School must be synchronized to the level of SK<br />
Schools. Education Blue Print – Sept 2012<br />
The time has now come to repeal the outdated policy or condition<br />
that essentially wastes a whole year of a child’s education. Based on<br />
the statistics available, it is clear that Tamils school population<br />
currently in 108,000 students and the number continuous to grow<br />
as more parents opt for Tamil schools for various reasons. MOE<br />
must treat Vernacular Schools – in particular the Tamil school as<br />
part of the National School Systems that compliments and delivers<br />
the National Education Vision.<br />
Additional Points<br />
Language Proficiency Argument: A student that has gotten<br />
undesirable grades in Bahasa Melayu, example an “E” grade has to<br />
go through “remove” classes if he/she is from the Tamil or Chinese<br />
Schools. A student with the same grade (Grade E) from the National<br />
school does not need to go through a similar requirement. It is<br />
imperative that the “E Grade” reflect the same language proficiency<br />
standing irrespective of the type of school of a student in that<br />

particular subject; yet the treatment of the students appears<br />
inconsistent – this inconsistency needs to be addressed.<br />
Medium of Language: Tamil School students are already<br />
learning most of the subjects in English or Malay. This is with the<br />
exception of the Tamil Language and Moral studies which are<br />
conducted in Tamil Language. Therefore it is undisputed that the<br />
students are used to non Tamil medium of instructions like the SK<br />
Students.<br />
Adaptation to Non <strong>Indian</strong> Students: We live in a plural<br />
society. <strong>NIAT</strong> does not see any need or justification for a special<br />
effort with a year’s sacrifice to or for adaptation – in fact it creates a<br />
further alienation not assimilation.<br />
The “Remove” class stereotyping the students as under<br />
achievers and group all of them as one big group of under achievers.<br />
Peer pressure and inferior complex mindset sets in and does not let<br />
them change any part of this progress or learning and teaching. As a<br />
matter of fact in RMK 10 recommendations: “Remove Class” was<br />
called as “Drop out Factory” by Malaysia Hindu Sangam Youth<br />
Team.<br />
“Remove” System is not working as idealistically<br />
imagined or envisaged. In reality these students are deprived of<br />
the special attention in many schools. At SMK Puchong, we<br />
personally interviewed the students and their grouses are the<br />
same. It is a “waste of time “.<br />

Boarding Schools clearly denies the rights of more than 57% of<br />
primary schools <strong>Indian</strong> Malaysian students - those from the SJKT<br />
schools cannot even dream of entering or applying fully boarded<br />
government schools, even if they procure the illusive “7 As”!<br />
To date we have about 60 SBP (Sekolah Berasrama Penuh) in<br />
Malaysia. This requirement is seconding SJK Schools in the national<br />
agenda of educating tomorrows’ Malaysian. Yet it is in complete<br />
breach of the “Falsafah Pendidikan Negara” which preaches<br />
solidarity and equality in education for all.<br />
It is sad to note that many Malaysians; including politicians do not<br />
know the discriminatory practices of MOE (Ministry of Education)!<br />
We urge the post GE 13 Government to immediately drop the<br />
requirement and work towards making- up for the racial<br />
imbalance in those schools.<br />

It is amazing to know only 29% (152)-Oct 2011 of Tamil Schools in<br />
Malaysia are “Fully Aided Schools” (Sekolah Bantuan Penuh).<br />
These 152 Schools are educating only about 1/4 of Tamil School<br />
Students in Malaysia (average) : i.e. 25000 out of 102K Tamil School<br />
students nationwide(2012)<br />
(pg 299 Malaysian <strong>Indian</strong> dilemma, Janakey Raman Manikam).<br />
It might be surprising to many but it is no surprise to many of us in<br />
the <strong>Indian</strong> Malaysian society. A staggering number of Tamil<br />
Schools i.e.72% of Tamils Schools in Malaysia are only partially<br />
funded (Bantuan Modal and Separuh Modal). These schools<br />
educate more than 50% of the Tamil School Students. This is<br />
unacceptable by any standards. This injustice cannot be accepted<br />
nor can any explanation be accepted, howsoever!<br />

Almost 85000 students are educated in sub-standard conditions or<br />
in schools that have sub-standard facilities and amenities – this<br />
includes the lack of trained teachers. While this is not a acceptable<br />
situation, <strong>NIAT</strong> takes this opportunity to thank Teachers, Parents<br />
and NGOs for playing a supportive and progressive role in<br />
overcoming many of the shortfalls and steadily accept all steady<br />
increase in the student intake.<br />
Under the 9 th Malaysia Plan, the Government has only allocated<br />
1.3% (RM62.88Mil) of the total allocation of RM4.8 Bil for Tamil<br />
Schools ( Adapted from 9 th Malaysian Plan) . We urge the GE 13 Government<br />
to explicitly agree to revise all Tamil schools as fully aided school by<br />
the year 2015. <strong>For</strong> this purpose, the new Government must<br />
immediately work on the directive to this extent.<br />
The effort of Action Plan for <strong>Future</strong> of Tamil Schools in Malaysia by<br />
JPM under Prof Dr Rajendran is a great move by Prime Minister and<br />
deserves applause; <strong>NIAT</strong> Projects the infrastructure upgrades,<br />
school relocation and new school buildings with full facilities: Would<br />
cost at least RM500Mil.<br />
B. Timeline/ Dateline<br />
It is proposed that the incoming government look into this proposal<br />
as urgent and work on the details immediately. The Directive for the<br />
conversion of all Tamil schools into Fully Aided Schools must be<br />
announced and the steps towards such an implementation must be<br />
announced and be effective within 120 days.<br />

It is undisputed that as it is currently in order to be classified or<br />
accepted as a Fully Aided School the School must self own the land<br />
etc. The hindrance to this is the fact that currently, the Education<br />
Department plays a non effective role in land negotiations or<br />
purchasing of the land.<br />
To make this proposal effective, this must be reversed in the<br />
interest of ensuring that all such schools become fully aided. <strong>For</strong><br />
this to be possible the ineffective Education Act of 1995 needs to be<br />
repealed or amended to make way for MOE to convert all nontitled<br />
lands. Currently MOE does not get involved in any land<br />
negotiation of the schools. It is left in the hands of the school<br />
administration, PTA and NGO. That is why politics and unnecessary<br />
considerations make it almost impossible that these schools convert<br />
to “fully aided” schools. This position is neither right nor<br />
appropriate as the Government has a better leverage / power to<br />
acquire and resolve land issues like acquisition, purchase or long<br />
term lease.<br />
D. Conclusion<br />
<strong>NIAT</strong> implores that the MOE and the Government must play a<br />
more effective role to convert the schools into fully aided schools<br />
to ensure that the basic and fundamental right of children is given<br />
due recognition as per the “Falsafah Pendidikan Negara”. Looking<br />
forward to seeing a more progressive schooling system unscathed<br />
by politics.<br />

2.4 MRSM (Maktab Rendah Malaysia) modeled –<br />
Full Boarding Schools for <strong>Indian</strong> Malaysian<br />
and other Minorities who perform<br />
exceptionally well at the UPSR<br />
A. Rationale<br />
In 2011 out of 16,800 UPSR Tamil School Students, 7% of them<br />
successfully procured 7As (1191): These 1191 <strong>Indian</strong> Malaysian high<br />
achieving students were merely not absorbed to SBP Schools. These<br />
high achievers are not given due recognition or opportunity to be<br />
educated through a boarding system, unlike Sekolah Kebangsaan<br />
(SK) students.<br />
Therefore besides the request to abolish the “only SK” requirement<br />
for Boarding Schools as illustrated above under 2.2 above, we<br />
request that a new Boarding school modeled after the MRSM to be<br />
set up.<br />
Prime Minister has given cabinet green light on 22 nd Feb 2012 for<br />
MRSM Modeled School with majority <strong>Indian</strong> Malaysian students<br />
from Tamil Schools. The directive still has not been materialized<br />
despite availability of infrastructure from newly vacated MARA-<br />
MRSM facilities that can be quickly renovated for this purpose and<br />
<strong>NIAT</strong> and the entire <strong>Indian</strong> Malaysians are waiting and expecting an<br />
announcement soon rather than later.<br />
B. Timeline/ Dateline<br />

establishment of this type of Boarding school exclusively for the<br />
<strong>Indian</strong> Malaysian High Achieving Students must be announced and<br />
be effective within 120 days if not before.<br />
C. Proposed Methodology<br />
Through a Directive issued by the Cabinet and the relevant Ministry.<br />
This school shall be fully funded by MOE with full boarding, sports<br />
facilities and state of art infrastructure. 70% of the intake of the<br />
students are to be from Jenis Kebangsaan Tamil Schools and 15%<br />
<strong>Indian</strong> Malaysian from Sekolah Kebangsaan while the balance 15%<br />
of the intake shall be open to others similarly qualified.<br />
The syllabus: Cambridge Syllabus and English Medium – Modeled<br />
after MRSM, while the schools should be located in any of the<br />
following states like: Selangor, Negeri Sembilan, Perak, Johor or<br />
Penang.<br />
It is not an unreasonable request as currently there are at least 3<br />
MSRM in the country conducting classes completely based on the<br />
Cambridge syllabus.<br />
The main objectives of this proposal are:<br />
To give special attention to those with outstanding merit with<br />
challenged socio-economic conditions.<br />
To nurture a new “cream of the crop” students that can help<br />
the future generation with outstanding merit, leaderships and<br />
positive attitude for <strong>Indian</strong> Transformation Program - ITP<br />

D. Conclusion<br />
This project is long overdue (since 197 – MIC Blueprint) as the<br />
outstanding students from Tamil schools do not get the attention<br />
they need to complete their SPM with confidence. This is a<br />
proactive measure to reduce dropouts in Menengah Schools by<br />
<strong>Indian</strong> Malaysian students and to boost more qualified students to<br />
be able to realize their full potential in line with the Falsafah<br />
Pendidikan Negara.<br />
2.5 Guarantee minimum 8% intake of <strong>Indian</strong><br />
Malaysian students in all boarding /<br />
“Asrama” Schools<br />
A. Rationale<br />
There are 2 types of Non Religious Boarding Schools:<br />
Science/Full Boarding Schools : Sekolah Menengah Sains<br />
Technical/Vocational Schools : Sekolah Menengah Teknik<br />
This request been pending since 1974 – Blue Book: pg 36 : by Tan<br />
Sri Manikavasagam to Late Prime Minister Tun Razak to allocate<br />

10% of the Science School and Boarding intakes for <strong>Indian</strong><br />
Malaysian students. The same request was echoed by MHS through<br />
RMK10-Proposal Feb 2009 : Unfortunately, the request been denied<br />
or forgotten or systematically set aside. We have about 60<br />
boarding schools nationwide but the <strong>Indian</strong> Malaysian<br />
representation in those schools is almost negligible. MOE must be<br />
proactive in bridging the gap of racial imbalance to seed unity<br />
through justified and balanced educational opportunities.<br />
Unfortunately, the intake is now p<strong>redo</strong>minantly dominated by<br />
Bumiputra students since 90% of the SK are Bumiputeras. It is<br />
<strong>NIAT</strong>’s contention that the composition must at the least reflect the<br />
racial population composition in Malaysia. MOE also must ensure<br />
the non-bumi students facilitated with food and other elements<br />
that is important for <strong>Indian</strong> Malaysian or Non Bumi to ensure the<br />
eco-system is welcoming to all to continue education smoothly.<br />
B. Timeline/ Dateline<br />
The Directive for the increase in <strong>Indian</strong> Malaysian Students in<br />
Boarding Schools to at least 8% of the intake must be announced<br />
and be effective immediately<br />
C. Proposed Methodology<br />
The <strong>GE13</strong> Government to immediately direct MOE to all the SBP<br />
schools to boost the intake and work with PIBG and NGOs to<br />
make sure enough applications are obtained to have at least 8%<br />
of the intake allocated for <strong>Indian</strong> Malaysian students from SJK(T)<br />
& SK Schools<br />

merit, just affirmative action and therefore the requirement of “SK”<br />
for Government Boarding Schools must be eliminated immediately<br />
and opportunities must be given to all on just and fair manner.<br />

Alcoholism<br />
It is the contention of <strong>NIAT</strong> that the following steps must be taken<br />
immediately:<br />
All types of Alcohol must be BANNED from Convenience Shops<br />
Impose a compulsory Liquor License Requirement to all Outlets<br />
with alcohol sales activities regardless of whether it comes in<br />
the form of bottle or drafts or other form.<br />
ALCOHOL Rehabilitation & Research Center with Hostel<br />
facilities to be established<br />
A. Rationale<br />
“Alcohol” has been the single biggest issue involving youth,<br />
especially <strong>Indian</strong> Malaysian Youths.<br />

Some of the related issues are underage drinking (below 21 years<br />
old), vandalism, violence, driving/riding under influence, addiction,<br />
absenteeism at schools, health issues, loitering at public<br />
parks/places (“lepak”) and family problems.<br />
Police record favors that the violent crime does have alcohol as the<br />
common denominator.<br />
Based on the research that has been conducted the public demands<br />
that alcohol be removed from all convenience shops or require<br />
them to procure a “retail liquor license” with current Municipality<br />
Laws with existing requirement.<br />
MHS Youth did get the consensus from the MIC Youth and PAS<br />
Youth on this matter as early as 2010. MIC Youth is revisiting the<br />
issue currently due to its seriousness.<br />
There were studies done with regards to this issue including the<br />
“ALiM-Alkohol Law in Malaysia” Project by Malaysia Hindu<br />
Sangam, in which 12 amendments to our existing laws had been<br />
proposed to protect the youngsters while simultaneously ensuring<br />
that the freedom of alcohol to adults is not infringed. I must stress<br />
no religion condone alcoholism or alcohol trades.<br />
Besides banning of Alcohol sale at Convenience stores, the other<br />
pressing issue is the lack of treatment for “alcoholism” and <strong>Indian</strong><br />
Malaysian do have DNA prone to addiction to alcohol naturally<br />
suggest some studies.<br />
Currently in Malaysia, we have a growing number of adults and<br />
youngsters that are addicted to alcohol and it is common<br />

knowledge that the problem needs to be addressed effectively<br />
through the proper implementation of corrective mechanisms. In<br />
fact, Malaysia is however amongst the top 5 highest alcohol<br />
consumers per kapita in the world.<br />
Yet, while many speaks of the ills of alcoholism and the social<br />
problems that are and have been in existence, to date there has<br />
been no effective remedy in place.<br />
B. Timeline/ Dateline<br />
The Executive Directive by Minister of Domestic Trade and<br />
Consumer Affairs<br />
An Announcement by Ministry of Health to identify spot and start<br />
Alcohol Rehabilitation Centre Project : Preferably in Selangor –<br />
Perak – Penang – Johor-Negeri Sembilan<br />
C. Proposed Methodology<br />
a. All alcohol sale at convenience shops must be banned<br />
immediately.<br />
Students and underage children are to be completely prohibited<br />
from purchasing any alcoholic items.<br />
Laws and regulations need to be in place and monitored and<br />
enforced effectively, through local municipalities and police.<br />
Mandatory jail sentencing must be put in place as a deterrent.<br />
b. Alcohol Rehabilitation & Research Centers<br />
Suitable rehabilitation centers for alcoholism treatment need to<br />
be established immediately to remedy the situation.<br />

Akin to the Drug rehabilitation centers, these centers need to<br />
be empowered to work with NGOs to educate and eradicate<br />
this problem. This may be established under the Ministry of<br />
Heath.<br />
D. Conclusion<br />
The problems illustrated are ongoing and needs urgent attention.<br />
The more the government closes its eye to the issue and the<br />
problem is swept under the carpet, the problem will surmount and<br />
it will be more difficult to tackle. The Government is urged to attend<br />
to this problem urgently in all states.<br />

Zero “<strong>Indian</strong> Malaysian Statelessness : IC / BC by<br />
1 st January 2014<br />
A. Rationale<br />
The “statelessness” issue has been a sore thumb for the <strong>Indian</strong><br />
Malaysian community since Independence – a good 55 years<br />
since!<br />

The problem has grown to be a crisis because of sheer negligence<br />
on the part of authorities with no clear direction, run-around<br />
attitude of authorities, unclear policies and indefinite timeline on<br />
application. The use of “budi bicara” creates many small napoleonsproduct<br />
of BTN, bribery and alibi for giving long run around. How do<br />
you justify an application still in process for Mr. Govindaraju<br />
Muthuvelu, recently been awarded citizenship after a whopping 25<br />
years wait?<br />
Malaysia must emulate naturalization process and procedure in<br />
other countries using point system or other objective requirements.<br />
Immigration in Malaysia needs a total reform to accommodate<br />
global migration and social changes.<br />
The attitude/mindset of the authorities appears to be:<br />
“Review of the applications to find a reason to dis-approve“<br />
rather than “Review the documents and seek reasons to<br />
approve”.<br />
One can deny or might give excuses, yet the fact of the matter is<br />
that this is a real problem and the problem needs an immediate<br />
solution that is both permanent and systematic in approach. <strong>NIAT</strong><br />
Hopes the request of late Tun Sambathan as part of independence<br />
social contract need not to be reminded to all once again,<br />
CITIZENSHIP is God given right to all. We have to make it happen.<br />
The National Registration Department (NRD), JPM, Political Parties<br />
& NGOs jointly conducted MyDaftar campaign to assist those with<br />
NRIC/BC Issues is applause able. However, one time “Panadol” one<br />
time “exclusion” or one time solution is not desirable for any issue.<br />

A permanent and executable action plan must be drawn: It is<br />
important to acknowledge many of this issues are revolving not only<br />
on the government’s regulations and implementations<br />
incompetence but it is revolving around discrimination, conversion<br />
issues, polygamy, orphan, religion, and social issues.<br />
The MyDaftar drive garnered 9568 returned applications and almost<br />
6000 were granted citizenships till August 2012. Well done.<br />
This was a great achievement since Independence by the<br />
government: yet it was a stark eye opener that so many people<br />
born and living in Malaysia have no proper identification! And to<br />
think that many more who have yet to come forward!<br />
Further, accordingly to Dato Siva, the Coordinator of the Special<br />
Implementation Task <strong>For</strong>ce (SITF) -, he received a letter from NRD<br />
stipulating that around 46000 <strong>Indian</strong> Malaysians who already have<br />
Birth Certificates (BC) have yet to apply for their NRIC-Identity card.<br />
<strong>NIAT</strong> finds this both alarming and frustrating! What have the<br />
authorities been doing about it, knowing this fact? Are we waiting<br />
for another HINDRAF to highlight the issue: We have to act before<br />
“ nasi jadi bubur ” I urge an immediate action to be taken by NRD<br />
or an action plan must be drawn by SITF.<br />
B. Timeline / Dateline<br />
We therefore propose the following measures immediately. The<br />
Directive to be issued within 120 days, with no delay. The<br />

infrastructure and methodology must be in place. The one very<br />

minimum fuss and protocols.<br />
C. Proposed Methodology<br />
<strong>NIAT</strong> propose an IC/BC Committee to be setup to draw a action plan<br />
and coordination involves NRD, KDN, Immigration, JPM and NGOs;<br />
To recommend measure to avoid future problem, one time solution<br />
to dissolve the issue and to identify all the cause of the problem.<br />
All <strong>Indian</strong> Malaysians satisfying the following criteria must be issued<br />
citizenships and all relevant documentations on the following<br />
conditions:<br />
Either parent is Malaysia with DNA test, then the Child /<br />
Children must be given citizen regardless of their other papers :<br />
Children housed in orphanages and/or homes must be awarded<br />
citizenship unless it can be shown that they are not of<br />
Malaysian Origin.<br />
Schools, Hospitals, Police, Homes and NGO’s may facilitate the<br />
identification of all persons facing such problem. Concession<br />
can be given to personal history foot print, lifestyle and<br />
language accent.<br />
Relax the rules on national language and religion requirements:<br />
Brochures, advertisements in all local newspapers of all<br />
languages must provide detailed description of how one who<br />
has no documents to come forward to procure the IC / BC;<br />

All NRD staff must be appropriately trained to have the aptitude<br />
(in language and mannerism) and helping nature to assist all to<br />
obtain the IC / BC<br />
A System of point and objective must be drawn to avoid “budi<br />
bicara” of officers in awarding citizenships: Australia, Singapore,<br />
Britain, French, USA all follows the system.<br />
D. Conclusion<br />
The awarding of citizenship to all <strong>Indian</strong> Malaysian born and living in<br />
Malaysia would be the single most important historic event for all<br />
<strong>Indian</strong> Malaysians in Malaysia, many of who have been sidelined or<br />
casted aside by their own kin, other Malaysians – it will be the true<br />
Merdeka for all! It is rebelling to see a person from Indonesia-<br />
Muslim becoming Citizen-Bumiputera so fast then an <strong>Indian</strong><br />
Malaysian that was born and bred here. Even though the fact is that<br />
the first wave of <strong>Indian</strong>s came to Malaya to conquer (Palava),<br />
second was to trade and religious (Islam) propagation reasons and<br />

Stemming from the above, all students under the age up to 18<br />
years old should not and cannot be deprived of the right to<br />
education merely due to lack of documentation.<br />
Besides education, the more sensitive topic which has been<br />
unreasonably politicized is the choice of religion – which must be<br />
left to the children to choose / decide at the age of 18 and never<br />
earlier, if there is a doubt.<br />

This tragedy is a known fact and this has been acknowledged by<br />
many leaders including the former MIC President, the late Tan Sri<br />
Manikavasagam, <strong>For</strong>mer Prime Minister Tun Dr. Mahathir<br />
Mohamad and Tun Abdullah Ahmad Badawi. One of the main<br />
reasons of this situation is because of the non-effective<br />
representation of the <strong>Indian</strong> Community in the Government, in the<br />

true “representative manner” and failure of attacking the issue with<br />
a true care and share attitude that we preach about.<br />

We therefore propose the following measures immediately. The<br />
several appointments must be made when the new Government<br />
and cabinet is formed; it is imperative that this must be within the<br />
120 days, with no delay.<br />

The Current Classification of <strong>Indian</strong> Malaysians based on the<br />
Population survey done in 2011 by the Statistic Department is<br />
complete and the <strong>Indian</strong> community is now officially categorized<br />

unified under one code to strengthen unification for national unity.<br />
B. Proposal<br />
Unify the <strong>Indian</strong>s under One Code: 6100: Bangsa India Malaysia.<br />
The Malay community is not sub-classified like Bugis, Jawa, Banjau<br />
Minangkabau and etc. They all come under a single “Malay”<br />
category as per the Federal Constitution definition.<br />
We have to assimilate the <strong>Indian</strong> Malaysians into one category as<br />
we are very minor category, even though we do have different<br />

language in use, custom in practice, religion or looks but we all<br />

The “Divide and Rule” formulas will no longer work. What Malaysia<br />
needs is a strong united Malaysia – one that works together as ONE!<br />
It is in the name of National Security and Unity; we must do away<br />
with sub classifications and it is clearly counter productive towards<br />
unity.<br />

A. National Economic Implementations<br />

<strong>Indian</strong> Malaysians are still trailing behind other races in terms of<br />
economic success. To reduce the development gap between races<br />
in Malaysia, which is the fundamental element of racial unity and<br />
social justice, the government has been inactive in tackling the<br />
economic imbalance issue among <strong>Indian</strong> Malaysian. Government<br />
effort since 2009 is applause able but not close to be enough.<br />
A holistic planning with political will, direct delivery and measured<br />
monitoring system are in absent to date. Secretariat for Economic<br />
of Empowerment of <strong>Indian</strong> (SEED) is a great move by Prime<br />
Minister Dato Seri Najib to facilitate the credit for micro, small and<br />
medium enterprises. However, SEED alone is not the answer for<br />
<strong>Indian</strong> Malaysian issues.<br />
The May 13 th<br />
1969 and Nov 25 th 2007<br />
were two big signs and reminder for the government on the<br />
seriousness of economic imbalance. Consequently, just as May 13 th<br />
created NEP the Nov 25th and the “Tsunami 8” inspired the<br />
economic transformation and political balance.<br />
To achieve the Malaysian dream, the following recommendations<br />
are made to reduce the economic imbalance among the working<br />
and challenged class of <strong>Indian</strong> Malaysians.<br />
a. I- Amanah<br />
The Government is to initiate an I-Amanah scheme to be parked<br />
under PNB or Khazanah National especially for <strong>Indian</strong> Malaysian<br />

with its sole purpose “to catch up with equity ownership in<br />
Malaysia”.<br />
To date the Government is still unable to reach the 3% equity share<br />
for <strong>Indian</strong> Malaysians by 2010 as previously planned. The idea of<br />
<strong>Indian</strong> Amanah (I-Amanah) had been mooted by various quarters in<br />
the past but the idea was shelved or scraped due to various<br />
reasons.<br />
MAICCI under the leadership of Dato Pradeep Kukerja –<br />
Dato Bhupat Rai : 2007 mooted this idea to Dato Seri<br />
SamyVelu. However, this idea was buried for not known<br />
reason.<br />
MIC Blue book – 1974: Tan Sri Manikavasagam have<br />
mooted similar idea to the late Premier Tun Razak. ; MIC<br />
Blue book 33 page ( V): The idea see no day light and<br />
hijacked with simple allocation of RM10Mil<br />
In 1990 NECC- National economic Consultative Council had<br />
this Concept of “I-Amanah” recommended; however this<br />
recommendation was inadvertently left out for one reason<br />
or another by Tun Mahathir.<br />
It is perhaps the right time for the government to seriously address<br />
the equity imbalance through the creation of I-Amanah.<br />
The equity must be evenly distributed to working class <strong>Indian</strong><br />
Malaysians. Rather than having the equity floating amongst only a<br />
few elite <strong>Indian</strong> Malaysians in this country.<br />
The Bank Simpanan Nansional (BSN) mooted the scheme<br />
“Simpanan BSN” in 1980s which was targeted at lower income<br />
groups with substantial return and ringgit to ringgit match by<br />
Government.<br />
Similarly, a total of RM250Mil as Seeding Fund should be set aside<br />
for this reason as part of this I-Amanah Initiative. Matching dollar to<br />

dollar: I-Amanah: <strong>Indian</strong> Malaysian earning less than<br />
RM3000/Household income and priority to those leaving in rural<br />
area, women and non-educated, minimum investment RM50<br />
monthly: This program can be parked very well under DEMA thru<br />
PNB or Khazanah<br />
A similar program was launched earlier in 2011 with an RM5000<br />
investment or loan through the Offering of Amanah Saham<br />
1Malaysia which is not directly inducing an increase in equity<br />
ownership but more targeted at reflecting positively in statistics.<br />
Unfortunately most of the lower income group could not qualify for<br />
the program through commercial loans, thus they are unable to<br />
benefit from it.<br />
The current proposed I-Amanah will work exactly the way it worked<br />
for the Bumiputra through BSN Investment.<br />
Clearly these ideas have not been newly conceptualized. This idea<br />
that has been pleaded many times before– but has unfortunately<br />
fallen on deaf ears! Time is Now.<br />
b. EPU – <strong>Indian</strong> and Minority Socio-Economic Planning Unit:<br />
The Government needs to setup an expert group within the<br />
Economic Planning Unit (EPU) consisting of experts specialized in<br />
the <strong>Indian</strong> Malaysian issues – called the Minority Socio-Economic<br />
Planning Unit.<br />
It would seek to understand and champion the Malaysian <strong>Indian</strong><br />
issues and needs. <strong>NIAT</strong> is aware that to date such a Unit is not in<br />
existence.<br />
This unit should be responsible for drawing up action plans and<br />
policies to eradicate poverty and create opportunities for the<br />
marginalized <strong>Indian</strong> Malaysian society. Currently, EPU does not<br />

have a deep understanding of issues pertaining to <strong>Indian</strong> Malaysians<br />
leave alone the strategies and methods of deliverables. Such a Unit<br />
would assist in highlighting the needs of the <strong>Indian</strong> Malaysian in an<br />
effective and timely manner.<br />
Despite recommendations of programs and policies in the past by<br />
many quarters, it has rarely been adopted. It is time that a special<br />
group of economists and policymakers are placed within EPU with<br />
the particular interest in dealing with the social economic imbalance<br />
of the minorities.<br />
Although, in the past, the political parties/organizations purportedly<br />
representing the minorities were consulted on case to case basis, it<br />
appears to be more a formality rather than an exercise that was<br />
beneficial to those in need.<br />
Based on our studies and inquiries, we found that firstly, due to lack<br />
of expertise, the parties/agencies themselves (without the help of<br />
experts from within EPU) were not in a position to exclusively<br />
formulate action plans. Secondly, recommendations by the<br />
respective parties to include certain programs or policies rarely saw<br />
the light of day in terms of implementation<br />
c. Independent Statistics Commission<br />
Currently, the reliability of the statistical data(s) with regards to<br />
<strong>Indian</strong> Malaysian’s participation rate in various economic activities<br />
is questionable and this is a source of disbelieve, complaints and<br />
dissatisfaction.<br />
The unreliability is NOT only on <strong>Indian</strong> issues but on many issues<br />
generally.<br />

<strong>For</strong> the general public, some of the published data are not the true<br />
reflection of what is experienced on the ground. As such, an<br />
Independent Statistics Commission should be formed which is both<br />
transparent and independent.<br />
The data collection methodology should be placed for public<br />
scrutiny to ensure societal trust in the data. Currently, based on the<br />
several encounters with the Commission, there appears to be some<br />
serious doubts placed on the <strong>Indian</strong> Malaysians population data,<br />
economic activities data, poverty data, education data, equity of<br />
Bumiputera ownership data, crime data, demographic data, just to<br />
name the few.<br />
In essence it creates a host of doubts on the true and real status<br />
quo.<br />
Besides this, in Malaysia in recent years there appears to be a<br />
general lack of public trust on the Bumiputera ownership data.<br />
The Government cannot afford to take this lightly as this is the<br />
primary indicator for policy makers and there is a pertinent need for<br />
public to trust the government with their future and development.<br />
A more transparent and realistic Independent Statistic<br />
Commission is seen as essential for this purpose.<br />
It is to be noted that the <strong>Indian</strong> Malaysian Population has seen a<br />
“suspiciously” symmetric decline despite the notable increase in<br />
the total Malaysian population since 1970 which stood at 10.8<br />
million(1970) to 29.1 million in 2011.<br />
The population in Malaysia has increased in 3 folds while ironically<br />
the <strong>Indian</strong> Malaysian population has only doubled from about<br />
900K in 1970 to the current population of 1.8 Million.<br />

Since 1970 the percentage of <strong>Indian</strong> population, according to the<br />
official statistics have dwindled by more than 30% “magically” to<br />
about 7.9% (2010) currently.<br />
Taking into consideration of fertility rate, population growth, socio<br />
economic status and mortality rate those numbers are quite hard to<br />
neither accept nor digest.<br />
d. Smart Agro Land Scheme<br />
The Massive forced/circumstantial migration of <strong>Indian</strong> Malaysians<br />
from estates to urban areas due to rapid industrialization in search<br />
of better opportunities without any urban skills has been a catalyst<br />
for the urban poverty phenomenon in the past decade.<br />
Perhaps, now (since not earlier!) it is the right time for government<br />
to drive these groups into technological base farming sectors in the<br />
urban skirts through land incentive initiatives.<br />
Agricultural activities like cattle farming, hydroponic farming,<br />
flower, white water fishery and many more lucrative areas could be<br />
some of the answers to address the Malaysian <strong>Indian</strong> urban poverty<br />
phenomenon.<br />
The scheme will work almost like FELDA but the scheme must be<br />
spelt out more clearly and carefully to attract <strong>Indian</strong> Malaysians<br />
through 10 acre land for smart agro activities complete with capital<br />
and technological assistance.<br />
This will mark the beginning of this scheme by giving out 5000 acres<br />
from 2013 – 2017.<br />

Based on statistics about 1 Million (plus) acres of land had been<br />
given out to 118K Settlers from 1956 to 1990; Yet <strong>Indian</strong>s only<br />
obtained 1.83K or approximately 1.5% of the total amount:<br />
Perhaps it is cogent to note that 1974 MIC Blueprint indicated that<br />
almost 3300 (end of 1973) <strong>Indian</strong> Malaysian applications were<br />
received and recommended FELDA to give more opportunity for<br />
<strong>Indian</strong> Malaysian Settlers; which means that just based on the<br />
statistics, almost 7000 possible opportunities of <strong>Indian</strong> Malaysian<br />
were ignored or blatantly “snatched” away from them!<br />
If 8% of the total land (and nothing more) were distributed to<br />
rightful claimants amongst the <strong>Indian</strong> Malaysians, that would have<br />
constituted over 70000 Acres of freehold plantation land schemes-<br />
which would have benefited over 7000 <strong>Indian</strong> Malaysian<br />
households.<br />
The Urban Poverty Phenomenon –was highlighted and warned in<br />
1974 through the MIC Blue print: Pg 26 (57) 63800 (45000 families)<br />
mass moving out of estates/mining quarries that needed urgent<br />
attention;<br />
The then MIC recommended FELDA/RISDA/FELCRA Scheme to<br />
used to replace those displaced from estates with at least 10% of<br />
the settlers, with a rate of 700 Families per year for 20 years (1970<br />
– 1990).<br />
Unfortunately the recommendation was ignored or rejected by<br />
<strong>For</strong>mer PM Tun Abdul Razak’s Administration.<br />
<strong>NIAT</strong> merely seeks to revisit this blueprint after almost 4 decades<br />
to start all over again and seek the Government’s open review of<br />
the problem and adapt a long overdue recommendation that was<br />
formulated under the able leadership of the late Harvard Alumni<br />
Datuk K Padmanaban who led the Economic Team as early as<br />
1970. Better late than never!<br />

B. Initiatives for the Micro Businesses<br />
a. Micro Loan - Problem Statement:<br />
Although the micro Malaysian <strong>Indian</strong> businesses contribute to the<br />
economy at large, these businesses still face significant challenges.<br />
These challenges are faced at every stage of business processes<br />
ranging from getting the premises, application for licenses and<br />
permits, startup capital, loan for operation, even in areas such as<br />
knowledge and know-how.<br />
Previous Solution that was made available : TEKUN (Tabung<br />
Keusahawanan National)- Thru SPUMI<br />
1. Access to friendly information regarding application process<br />
has been highly inadequate. It is presently coordinated through<br />
Yayasan Social Strategic/MIC which is ill equipped to reach the<br />
Malaysian <strong>Indian</strong> micro businesses and its operators. The<br />
hierarchical procedures and processes significantly delay the<br />
application process and increases the waiting time which these<br />
businesses can ill-afford<br />
2. Requirements for the loans ; significant delays deter businesses<br />
from getting their loans on time. There is a serious mismatch<br />
between the micro-business credit time of less than 30 days<br />
and the processing time for loans which exceeds 6 months. The<br />

loans application cycle should be synchronized with the<br />
business cycles for it to be useful and practical for business<br />
purposes.<br />
3. The funds get exhausted really fast and late disbursement of<br />
fund does not serve the purpose of nurturing the real needs of<br />
micro businesses over a longer term. The funds must be<br />
designed, funded and operated as a sustainable and long term<br />
project and not as an ad hoc initiative.<br />
4. In certain cases, the owners have excellent business ideas but<br />
lack the requisite skills and training. In this aspect, training of<br />
prospective businessmen with regards to businesses is<br />
important. MARA has been quite successful in training owners.<br />
The same approach / methodology can be extended or<br />
duplicated to <strong>Indian</strong> Malaysians as well.<br />
5. Blacklisting of <strong>Indian</strong> Malaysian Businessmen especially Micro<br />
and Small enterprises are alarming and very concrete action<br />
plan must be designed to tackle; Suria Malaysia Coop, and SEED<br />
also echoed this concern.<br />
b. Proposal<br />
i. Micro Loan Delivery System<br />
Micro loans to be disbursed through BSN, License Money<br />
Lenders, TEKUN and/or selected NGOs for a faster<br />
delivery of the services. Currently accessibility and<br />
processing time is the problem.<br />
Currently the Micro Loan Scheme through Bank Negara<br />
and RM180Mil loans for entrepreneurs-SEED through<br />
political infrastructures are not reaching those<br />
businessmen who really need it due to misappropriation<br />
or procedural improprieties or just plan improper<br />
dissemination.<br />

It must be noted that most of these current loans further<br />
create NPL and CRSS issues that will haunt micro business<br />
owners for many years to come.<br />
Excerpts from discussions and findings (Names have been<br />
omitted to safeguard the participants in the research) :<br />
- Mr.G, an entrepreneur from Kajang, who attended the<br />
briefing on SEED recently on 2.8.2012 informs <strong>NIAT</strong> “ … it is<br />
same story different scene”<br />
- Mr K, a young graduate from Klang (SKM Level 3 – INPENS<br />
Automotive under the scholarship of YSS 2007). He decided to<br />
embark on his own operation after 4 years of experience.<br />
Found himself a suitable place and to secure location, he<br />
procured an “along” type of loan which requires him to pay<br />
RM2K interest per month for a loan of RM20K. <strong>NIAT</strong> referred<br />
the matter to Suria Cooperative – Infrastructure to assist<br />
<strong>Indian</strong> Malaysian Micro Businessmen. However it failed to be<br />
of relevant assistance as the assistance they render is only in<br />
the form of equipment and not for capital or running capital:<br />
He applied for the Bank Negara Micro Loan and is pending<br />
approval. Meanwhile he is has no alternative but to service<br />
the loan at the interest of RM2 per month!<br />
- Mr V, a local artist applied for a loan under TEKUN to setup a<br />
Dance Studio in 2010 through YSS in the 2010 by MHS – Youth<br />
Assistance Team. He never received any reply nor call for<br />
interview.<br />
- Ms ABC, (name was refrained upon request) another local<br />
artist that made many famous debuts in Malaysia and India,<br />
applied for a loan through the Creative Fund from the<br />
Ministry of Culture and Heritage but never got a helping<br />
hand.<br />
ii. Loan Criteria<br />

The requirements for the loan to be relaxed and there must be<br />
an introduction of more innovative payback schemes if<br />
necessary. MARA Scheme could be used as model.<br />
In this respect, perhaps we should emulate the proposed micro<br />
schemes of Nobel laureate, Dr. Mohd Yunus of Bangladesh who<br />
proposed that “more importantly, priority should be given for<br />
loans to business women”.<br />
Conversely, despite the ALONG’s negative image, the ‘ALONG’ is<br />
more successful in attracting micro business for loans due to<br />
their fast delivery system.<br />
As such, the current systems need to be revised especially in<br />
terms of information, processing time, and methods of<br />
application.<br />
NPL, CRSS, CTOS are the biggest hindrances for getting loans<br />
approved. This is despite the help of LKPK.<br />
iii. Blacklisted – Micro Business Credit Restoration<br />
CRISS – CTOS-NPL credit standing are very important for any<br />
businessmen. Thus, <strong>Indian</strong> Malaysian is facing great challenge<br />
with credit scores, credit excess and reckless finance<br />
behavior. <strong>NIAT</strong> recognizes the problem and had confirmation<br />
of the problem from various agencies that are dealing with<br />
<strong>Indian</strong> businesses including PEMANDU/SURIA & SEED. We<br />
propose to initiate a fund in which a micro businessman with<br />
credit issues will be able to benefit thru good finance<br />
behavior. The fund size is RM30, 000 or less. A doable<br />
payment scheme will be drafted with debtor(s) with<br />
assistance of SEED and the payment scheme will be endorsed<br />

by JPM-SEED-debtor(s)-Creditor(s) with specific terms and<br />
legally binding: This is a re-imbursement credit restoration<br />
scheme “carrot & stick” approach. The plan is modeled after<br />
SBA-USA: Objectives of this scheme are;<br />
To rendering hand to micro businessmen/women to<br />
move forward in business: 2 nd Chance<br />
To coach and initiate responsible financial planning and<br />
fiscal habits.<br />
iv. Permanent Micro Loan Scheme<br />
Micro-Loan should not be limited for an allocated amount.<br />
Like PTPTN, micro loans should be made available for those who<br />
want to start a business. It should be continuously given to<br />
ensure the success of the businesses and it should be based on<br />
a payback scheme.<br />
It is clear that Micro business companies represent 87% of the<br />
entire count of companies incorporated in Malaysia in 2010.<br />
The current setup of SME Bank and etc works exactly like<br />
commercial banks. <strong>For</strong> example the Micro Loan Scheme from<br />
Bank Negara is not easy to get by despite many attempts. This<br />
deters micro business owners to expand or even starting<br />
businesses in the first place.<br />
The role of SEED is right on dot, however the SEED service must<br />
be translated into rural areas with more systematic<br />
infrastructure: SEED seems a temporary outfit for now. <strong>NIAT</strong><br />
emphasizes on creation of DEMA as permanent outfit that can<br />
facilitate SEED in every district for assistance.<br />
v. <strong>Indian</strong> Malaysian Micro Business Training<br />

An allocation of RM 5 Million per year set aside for training the<br />
owners of micro business. Blanket requirement for loan to go<br />
thru a week PAID training- especially of those of Micro & Small<br />
Businessmen/Women.<br />
Training and loans should come hand in hand, so that relevant<br />
and potential micro business can be selected. Upon successful<br />
completion of the training, the owners could assess loan<br />
schemes. This will ensure business sustainability as well as<br />
better loan recovery.<br />
The training should include issues on business law and<br />
legislation, company setup processes, banking requirements,<br />
labour law, taxation, management, marketing, purchasing,<br />
customer relations, customer services and other areas as shall<br />
be suitable for the specific businesses in its operations of micro<br />
businesses.<br />
This training need to be continuous and can be conducted on a<br />
part-time basis, as night classes or weekend classes. The<br />
training may be delivered through INSKEN – Institute<br />
Keusahawanan Negara : It is recommended that the Training<br />
must be conducted in Tamil & Malay.<br />
vi. Micro Loan for Home Based Business “Cottage Industry”<br />
<strong>Indian</strong> Malaysia community to be given priority for Home<br />
Based Business Loans<br />
The <strong>Indian</strong> Malaysian has not fully tapped the home based<br />
business as it is hard for them to get loans from commercial<br />
banks or the government.<br />
Loans should also be disbursed for ladies, single mothers and<br />
housewives who intend to start home based businesses. The<br />

approval and selection criteria need to be revisited to attract<br />
more ladies to be involved in home based business activities<br />
which include traditional businesses.<br />
Examples of business : Garland/Flower Service, Baby Sitting,<br />
Handicraft, Tailoring, Snack Food, Bridal Services, Jewelries<br />
Repair & Crafts, Mobile Hair Stylists, Home SPA, Morning<br />
Market, Home Tuition, cleaning Maid Services etc.<br />
Budget 2013 – GMBO – Get Msian business Online – 5000 to be<br />
set aside for <strong>Indian</strong> Malaysian Women:<br />
vii. Micro Business Information Dissemination Centre<br />
Training NGO to do the work:<br />
We must adapt the USA concept of SBA – Small Business<br />
Administration system where the government provides<br />
infrastructure for Micro/Small Business to use. Such a service<br />
may include printing services, conference – seminar rooms and<br />
providing avenue for volunteer or NGO to use to coach or<br />
disseminate information to the public. SEED idea could very well<br />
serve as SBA: SEED need to expand its objectives and role from<br />
just a credit facilitator. SEED need to expand to all districts at<br />
least to reach the target group effectively and directly.<br />
Due to the lack of effective information dissemination, society<br />
at large feels that their interest has been left out in the process<br />
of mega brand development.<br />
Centers to disseminate information regarding loan facilities and<br />
other opportunities provided by the government should be<br />
intensified.<br />

A one stop center to facilitate this process is required at<br />
strategic locations so that the facilities and information can<br />
reach the <strong>Indian</strong> society at large. SME Corp is still unreachable<br />
for many. In addition, temples and <strong>Indian</strong> NGOs should be<br />
roped in to tap and push information closer to the target<br />
groups. The SBA (Small Business Administration) in USA consists<br />
of businessmen or retired staffs.<br />
Currently the SME Corp is ineffective in counseling micro<br />
businesses.<br />
C. Initiatives for the Small Business<br />
a. Problem Statement<br />
The biggest segment of <strong>Indian</strong> Malaysian businesses fall into<br />
the small business category. The challenges of these<br />
businesses are definitely the startup capital, investments for<br />
expansion activities and working capital.<br />
b. Past Solution: SMIDEC/MIDF/SME<br />
1. Reimbursement Basis: <strong>For</strong> Example the Start Up Grants by<br />
SME Corp, Marketing/ Promotional Grants etc.<br />
2. Process and Decision Time : 6 months or more<br />
3. Inaccessibility particularly in remote areas<br />

4. Lack of transparency in the process.<br />
Limited transparency allows and provides room for every<br />
failed application to be perceived as based on racial<br />
biasness to have been an application by <strong>Indian</strong> applicants.<br />
This phenomenon must be stopped.<br />
c. Current Proposals<br />
i. Franchise Business Boost<br />
There is an urgent need to expand the franchise business<br />
schemes to <strong>Indian</strong> Malaysians.<br />
A realistic target is to create 50 Malaysian <strong>Indian</strong> Franchise<br />
Businesses in a year with 100 Local <strong>Indian</strong> Business<br />
Franchises in the next 5 years.<br />
Currently, PNB through PNS have been working on a similar<br />
concept.<br />
It is recommended that the Franchise programs that are<br />
currently allocated only for Bumiputra be opened for <strong>Indian</strong><br />
Malaysian as well.<br />
Since, the <strong>Indian</strong> Malaysians are involved in different types<br />
of business; the expansion of franchise concept to <strong>Indian</strong><br />
Malaysian business generally, will create more spillovers<br />
effect to the economy between 2013-2017.<br />
- Ms Vanaja, a housewife with reasonable education<br />
background fought many years to acquire a local convenient<br />
shop franchise Kwik Shop<br />
She failed to have neither SEEDing fund nor the support to<br />
nurture her interest in franchise business;<br />

She was not qualified for the PNS program as she do not have<br />
a Bumiputra status:<br />
She struggled for almost 2.5 years with Business Plans and<br />
Other information before she gave up and accepted her fate<br />
for being from an helpless <strong>Indian</strong> Malaysian. MHS Youth –<br />
was in consultation with her from 2008-2010<br />
ii. Boosting Franchising at Global Scale<br />
8% of the funds allocated for National Franchise program<br />
should be assigned to Malaysia <strong>Indian</strong> businesses<br />
The Malaysian <strong>Indian</strong> businesses in Malaysia are not getting<br />
enough help, expertise or know-how in franchising their<br />
business on a global scale. Nevertheless, currently the<br />
number of Malaysian <strong>Indian</strong> businesses that have great<br />
potential to be franchised can benefit the nation as a whole.<br />
With adequate planning this could be the beginning of a<br />
establishment of a global franchise presence.<br />
Therefore, it is recommended that 100 new Malaysian<br />
<strong>Indian</strong> franchise businesses to be assisted under various<br />
programs like PNS and others. Currently, <strong>Indian</strong> Malaysians<br />
do not have the awareness and incentives to move<br />
forward in this direction. The incentive can be delivered in<br />
the form of Consultation, Grants, Loans and Franchise<br />
Development Training.<br />
Hence, 8% of the funds allocated for National Franchise<br />
program should be assigned to Malaysia <strong>Indian</strong> businesses<br />
to make the effort a reality.<br />
Budget 2013 – PNS Allocation Rm25000 for franchisees<br />
and RM500000 franchisor: Set aside for <strong>Indian</strong> Malaysian<br />
Business men/women<br />

iii. Vendor Development Program<br />
8% of the vendors in GLCs must be <strong>Indian</strong> Malaysian.<br />
GLCs and MNCs, among others, train and develop vendors<br />
under the vendor development programs. This in return has<br />
created successful local businesses.<br />
It is recommended that 100 qualified <strong>Indian</strong> Malaysians per<br />
year to be trained under a similar scheme. This will<br />
ultimately create more business spillover for the nation.<br />
Currently, GLCs such as Proton are not willing to share their<br />
information and are not transparent to share the<br />
information of their vendors. This has to change with a view<br />
to work together towards making the 8% target a reality.<br />
iv. Business Opportunities in GLC<br />
<strong>GE13</strong> Government need to use the GLC machineries to<br />
allocate opportunities thru GLCs in order to increase the<br />
equity of <strong>Indian</strong> Malaysians. It is recommended that 8% of<br />
contract value to be set aside for <strong>Indian</strong> Malaysian<br />
businesses /vendors /contractors.<br />
This is more feasible, both politically and economically, to<br />
correct the economic imbalance than just having contracts<br />
on an Ali-Baba basis. It is important to make sure the<br />
businesses that have gotten approval through <strong>Indian</strong><br />
Malaysian quota to be made known and they have an<br />
obligation to create a cascading effect.<br />
In the past the Malaysian Businessmen/women refuse to<br />
actively participate in eradicating poverty among <strong>Indian</strong><br />
Malaysians and leave the whole burden to the government.<br />
Thus, moving forward we need to create a more favorable<br />

business environment built on trust and responsibility. We<br />
need a standing policy on hiring and business opportunities<br />
of 8% in place.<br />
The trickling down approach by the government through<br />
the “helping” of some <strong>Indian</strong> Malaysian company failed:<br />
example West Port – Maxis – Astro and many others<br />
v. Technology Incentive<br />
The government has to provide loans and incentives to<br />
ensure modernization.<br />
The 5 industries that the <strong>Indian</strong> Malaysian is presently very<br />
active in include:<br />
(1) Food/service<br />
(2)Metal/Precious Metal;<br />
(3)Transport/Logistic;<br />
(4)Newsstand/Printing; and<br />
(5)Retail/Textile.<br />
These industries are labour intensive and have potential for<br />
modernization; the government has to provide loans and<br />
incentives.<br />
Currently, the incentive programs under various ministries<br />
are hard to come by for the <strong>Indian</strong> Malaysian Businesses<br />
that are not savvy and not too well organized.<br />
Hence, it is recommended that a special allocation be<br />
given for technological and equipment improvement<br />
specifically for these pillars industries. The grants and<br />
incentives should include technology consultation<br />
activities, training and equipment upgrading and the like.<br />

<strong>For</strong> instance, restaurant owners could implement the POS<br />
systems to enhance the management quality.<br />
Representatives from respective association must be<br />
encouraged to participate actively in technology<br />
transformation in their industry in establishments like<br />
PRIMAS, PRESMA, MIMTA and etc.<br />
vi. Malaysian <strong>Indian</strong> Women Participation in Business<br />
It is recommended that the government create at least 500<br />
new enterprises for Malaysian <strong>Indian</strong> women graduates.<br />
Malaysian <strong>Indian</strong> women are left behind compared to their<br />
counterparts in other races and to eradicate this it is<br />
recommended that the government create at least 500 new<br />
enterprises for Malaysian <strong>Indian</strong> women graduates.<br />
A Special Program or Scheme could be developed under the<br />
Ministry of Women Affairs and Community Development to<br />
boost awareness and to provide training, grants/loans as<br />
well as supervision.<br />
The industries of interest should include marketing services,<br />
beauty, training, food/service, green technology, small scale<br />
manufacturing activities, human resource services, cottage<br />
industries and others.<br />
One possible introduction is similar to the concept of PINK<br />
TAXI like in UK-London: Special Taxi Services. 500 Taxi<br />
permits may be allocated to the <strong>Indian</strong> Malaysians Women<br />
(graduates) with a RM5000 down payment or full Loan<br />
Scheme for a new Taxi.<br />
vii. Home Based Business<br />

Creating 1000 home based businesses under various<br />
programs specifically for Women (Example, housewives,<br />
single mothers and the disabled).<br />
A specific program by the relevant ministries e.g. Ministry of<br />
Women Affairs and Community Development is needed at<br />
each level. The home-based businesses must be supported<br />
by grants, training, supervision and facilitation. The Chinese<br />
model of such program can be absorbed in this case.<br />
Industries such as food/service, catering, crafts, bakery,<br />
internet-based business, florist , online and telemarketing<br />
should be encouraged.<br />
Additionally, the Ministry should also create more<br />
awareness programs on the issues of home-based<br />
businesses.<br />
Amanah Ikhitiar may not be the appropriate solution to the<br />
<strong>Indian</strong> Malaysian. It creates a support system of 5 women to<br />
start a business and <strong>NIAT</strong> may give a list reason why this is<br />
not the remedy for <strong>Indian</strong> Malaysian:<br />
- <strong>Indian</strong> Malaysian – Traditional Business Ideas<br />
- Culture, Distrust & Language : Barriers<br />
- Infrastructure<br />
- Officers<br />
viii. Graduate Business Community<br />
It is recommended that the government assist and<br />
support the Malaysian <strong>Indian</strong> graduates to start up new<br />
businesses<br />

Young entrepreneurs are the engine of growth of the<br />
economy. Likewise, it is also a tool to reduce<br />
unemployment among graduates.<br />
It is recommended that the government assist and support<br />
the Malaysian <strong>Indian</strong> graduates to start up new businesses<br />
in areas like financial services, healthcare, consultation<br />
services, R&D related services, and others.<br />
A target of assisting 1000 new <strong>Indian</strong> Malaysian graduates<br />
in these new businesses is an important and necessary<br />
beginning.<br />
The program should be specifically tailored towards<br />
graduates who are less than 35 years old who have<br />
successfully undergone training and consultation. They<br />
should be given a loan facility of not less than RM500K to<br />
start and to develop their businesses. Additionally, during<br />
the training, the graduates need to be paid living allowances<br />
not less than RM1500/month and this is should be part of<br />
the loan.<br />
The loan should be flexible enough to be converted to a<br />
grant of equal amount, upon paying taxes or employing<br />
certain number of employees within 10 years of operation.<br />
Even though currently there are programs with few<br />
government agencies but these are not reachable to<br />
<strong>Indian</strong>s. Special quota and directive much be made.<br />
Budget 2013 –, Agro Tech Ventures possibilties, and<br />
Graduate Employability Blue Print by 2012 ;<br />
However, government must initiate afund for business<br />
START UP. Similar program to “Groom Big” -SME Corp : It is<br />
ONLY for Bumiputera-need to liberalize.<br />
ix. Traditional, Cultural & <strong>Indian</strong> Art Business<br />

It is important to develop and catalyze the traditional<br />
businesses. Cultivate new enterprises that are related to<br />
cultural and traditional-based business or services.<br />
These businesses include Dance Academies, Cultural sports,<br />
Cultural craft, Musical Equipment Manufacturing, Cultural<br />
Skill Training Centre, Sculpture, Theater Shows and Jewelry<br />
manufacturing.<br />
These industries are important for tourism and unique<br />
attraction for Malaysia. Currently, most of the supplies are<br />
imported from India and it will be an added advantage if<br />
Malaysians were to venture into these industries.<br />
The programs to develop these industries should be specific<br />
and parked under the Ministry of Heritage and Culture.<br />
The programs should include training, study scholarships to<br />
India perhaps or other suitable country for consultation as<br />
well as loans/grants.<br />
Other than this support Study Abroad Loan Scheme may<br />
be made available for example – priest and artists or<br />
talents interested in cultural musical instruments which is<br />
difficult to nurture locally.<br />
x. Young <strong>Indian</strong> Participation in Stock Market/Equity<br />
Market<br />
More effort is needed to engage the <strong>Indian</strong> Malaysian to<br />
participate in the stock and equity market.<br />

The lack of participation is due to funding constraints and<br />
knowledge. Traditionally, <strong>Indian</strong> Malaysian doesn’t have<br />
the mindset for portfolio investments.<br />
It is recommended that the government provide training for<br />
200 qualified <strong>Indian</strong> Malaysian Youths to participate in stock<br />
and equity markets as stock brokers and remises. The<br />
program is to be conducted by Bank Negara or other<br />
affiliated agencies. Adequate exposure, training and<br />
coaching will ensure the <strong>Indian</strong> Malaysian participation in<br />
this sector.<br />

xi. Development of Malaysian <strong>Indian</strong> in Lacking Sectors<br />
The government and private sector need to implement a<br />
broad range of assistance programs to facilitate the entry of<br />
<strong>Indian</strong> entrepreneurs into manufacturing and modern<br />
services sectors, particularly in the SMIs.<br />
As clearly indicated, the <strong>Indian</strong> Malaysian community<br />
participation in certain sectors, namely manufacturing,<br />
agriculture, utility, green tech, construction, finance,<br />
wholesale and retail is grossly lacking. Through such efforts,<br />
the <strong>Indian</strong> Malaysian participation in these areas will see a<br />
marked increase. These initiatives may include the<br />
following:<br />
Specially packaged programs currently implemented for<br />
the participation of Bumiputra entrepreneurs should be<br />
extended to the <strong>Indian</strong> Malaysian entrepreneurs. <strong>For</strong><br />

food industries including government owned companies<br />

given priority for example 8% of taxi, bas persiaran and<br />
lorry permits; 8% allocation of businesses in petrol<br />

Development to set up a special fund of RM500Mil for<br />
<strong>Indian</strong> entrepreneurs similar to the RM 2 billion fund for<br />
the Bumiputra Providing Seed Capital for start ups and<br />
business expansion.<br />
Open avenues for <strong>Indian</strong> Malaysian contractors to<br />
participate in Class A & B schemes in infrastructure and<br />
construction sector.<br />
Adequate Allocation of Seeding/incubator funds to<br />
intensify the <strong>Indian</strong> Malaysian participation in<br />
Manufacturing, Green Technology, Bio tech, Information<br />
& Communication Technology (ICT), Education, Health<br />
Tourism, professional and consultancy services.<br />
Budget 2013 – Incentive for Green Tech Business is<br />
highly anticipated.<br />
xii. Scheme Partnership/JV -Take Over<br />
A program to create 500 potential partnerships and JV<br />
To grow, <strong>Indian</strong> Malaysian businesses are actively seeking<br />
partnerships and joint venture arrangements as a source<br />
of fund and knowledge transfer.<br />

It is proposed that the government facilitate these<br />

Export/Import service, Technology Intensive Industries,<br />
Green Technology and Finance is proposed.<br />
The program includes creating awareness, training,<br />
coaching, consultation, loan/grant and supervision. The<br />
program can be parked within the SME Corp under<br />
Malaysian <strong>Indian</strong> Partnership scheme.<br />
With a loan allocation of up to RM1million, it is possible to<br />
create 500 new businessmen within 5 years.<br />
xiii. Permanent Business Loan<br />
Small business should be able to access permanent loan<br />
programs.<br />
Currently SME Corp does have few products for small<br />
business but it is on reimbursement terms. This type of<br />
schemes might not work for capitally challenged owners.<br />
Therefore the government has to setup a moderate term<br />
business loan for small businesses with relatively short<br />
processing time, like 2 weeks.<br />
Loan facilities are the fertilizer for the growth of small<br />
enterprise in any country.<br />
Unfortunately the SME Banks in Malaysia do business more<br />
like commercial banks. Micro/Medium owners with CRISS or<br />
CTOS problem are unable to seek financial help. Efforts<br />
must be made to change or reverse this predicament.<br />

skills training, advise on starting a small business, licensing<br />
arrangement and credit facilities. It should be set up at<br />
every state with full accreditation from the government<br />
so that banks and other agencies can assist them for loan<br />
facilitation and project approvals.<br />
The EDSTC need to offer consultancy services to<br />
overcome typical problems of the <strong>Indian</strong> SMEs that<br />

To ensure the continuous growth of the Pillar Industries of<br />

great care of the labour supply issues.<br />
In the past 15 years <strong>Indian</strong> Malaysians have made great<br />
progress in 5 prominent Pillar Industries, thanks to<br />
government policies on foreign labours.<br />

Retail & Textile<br />
To ensure the continuous growth of these industries, the<br />
government must ensure and take great care of the labour<br />

depends on uninterrupted labour.<br />
In the past decades, there were constant changes in the<br />
labour policies that have cost the Malaysian <strong>Indian</strong><br />
businessmen millions as well as in business growth in<br />
general.<br />

Since the entire pillar industries of <strong>Indian</strong> Malaysians are<br />
labour intensive, thus the degree of dependency towards<br />
foreign labour is slightly higher and any disruption on labour<br />
supply will directly affect the livelihood of thousands of<br />
Malaysian <strong>Indian</strong> businessmen.<br />
It is imperative that the government establish a long term<br />
policy measure with regards to foreign and local workers.<br />
Some of the long term measures that require serious<br />
attention include the following:<br />
• Serious attention towards tackling the wide spread<br />
corruption in the supply and demand chain of foreign<br />
labour in the country. It has been so long that the issue is<br />
been pushed under the carpet and it is time, now, to<br />
address it with a permanent solution;<br />
• Weak and ineffective enforcement due to<br />
corruption, unclear guidelines and too many overlapping<br />
authorities;<br />
• Simplification and standardization of procedure for<br />
foreign worker’s new applications, renewal process,<br />
replacement and cancellations.<br />
• Lack of enforcement and crack down on illegal<br />
workers: Projected to be around 2mil in the country by<br />
labour department 2011. It is time to intensify the<br />
enforcement on the crackdown of illegal workers. 6P is<br />
a stagnant pram so far.<br />
• Review the Levy Policies which is viewed to be<br />
main course of VISA abuse. <strong>For</strong> example, the<br />
plantation workers annual levy is RM400 while service<br />
industry is RM1800 annually. The levy for all industries<br />
must be synchronized. Tax Exemptions for local hiring<br />
companies would be a great move toward localizing<br />

our work force. USA and Singapore uses this method to<br />
protect their local labour force.<br />
• Intensify JPK Skill Training and Private Training<br />
Centers on the pillar industries to reduce the<br />
dependency on foreign workers by 25% in the next 5<br />
years without interrupting the labour supply while<br />
simultaneously maintaining a healthy growth of the pillar<br />
industries.<br />
• Awareness of Labour Laws, employer’s<br />
responsibilities and unyielding enforcement will surely<br />
make this industry more attractive and rewarding for<br />
local job seekers.<br />
• Government must also engage the pillar industries’<br />
representative to draw a comprehensive blue print with<br />
regards to foreign labour issues. Without a proactive,<br />
sincere and consultative move between the government<br />
and the pillar industries, there is a fear of unnecessary<br />
outflow of investment to India, Sri Lanka, Vietnam and<br />
other Asian countries.<br />
• Double Tax Incentive for employers that hire local<br />
workers. Through this employers will have a greater<br />
interest and attraction to recruit local workers. The<br />
additional labour cost shall be absorbed through tax<br />
relief.<br />

III INDIAN <strong>MALAYSIAN</strong> IN EDUCATION<br />
Rationale<br />
Education is the single most important driver of poverty eradication,<br />
political stability, unity, and economic development. It is also<br />
important to bridge the gap between the poor and the rich.<br />
The education system is constantly used for a political agenda that<br />
deprives one’s right to freely choose their path especially in public<br />
education.<br />
Currently, the <strong>Indian</strong> Malaysian is very much dissatisfied with the<br />
overall provision of education in Malaysia, what more the<br />
consistency in the inconsistency in education systems in Malaysia.<br />
The <strong>Indian</strong> Malaysians recognize the importance of societal<br />
integration and the unity of the nation and nation building while<br />
simultaneously believe that this should be achieved without<br />
infringing the rights enshrined in the constitution and social<br />
agreement.<br />
The government and EPU should not think that Tamil School<br />
educated citizens are any less patriotic compared to their<br />
contemporary from a national school.<br />
Policies unfortunately seem to favour the national schools,<br />
making the vernaculars school unattractive and inadequate.<br />

3 months. We are sure this will win the hearts and minds of every<br />
<strong>Indian</strong> Malaysian and build toward a healthier and stabile Malaysia.<br />
In the Past<br />
1. Sijil Pelajaran Malaysia (SPM) 10 Subject Issues<br />
This policy created suspicion among all <strong>Indian</strong> Malaysians about<br />
government’s real intention and sincerity. The decision was<br />
taken unilaterally by the ministry without consulting the society<br />
or the vernacular educationists.<br />
2. Merit System & Matriculation<br />
This system is proven to be flawed and has caused distrust in<br />
the government’s intention to make sure the system is based on<br />
merit and not race. The latest fiasco of additional 1000 seats<br />
(2012) for <strong>Indian</strong> Malaysian students in additional to previous<br />
intake of 559 (2011): We are know the 1559 is not fulfill and<br />
MIC flip flop information dissemination is the cause much<br />
uproar among <strong>Indian</strong> Malaysian: Till today: MIETA (Malaysian<br />
<strong>Indian</strong> education Transformation Assoc) the NGO that spear<br />
headed this issue never was given the list of matriculation<br />
students or called for consultative. Matriculation intake is<br />
conducted under great secrecy by MOE and political bodies,<br />
why?<br />
3. Tamil Schools are ill aided, under-funded<br />
Tamil Schools are generally inadequately funded and not<br />
expanded in line with their growth and this has left <strong>Indian</strong><br />
Malaysians disappointed.<br />

The Tamil school issues have historically and continually used as<br />
a political tool with a hidden agenda while to date no long term<br />
workable solution is available.<br />
The formation: Action Plan for Tamil School Reforms – Prof Dr<br />
Rajendran is a great move forward : However, any plan without<br />
action or implementation will only make the issue worst or the<br />
deception deepen.<br />
4. UPSR – Tamil School and the “Peralihan / Remove Class<br />
“Peralihan” classes for under achievers in UPSR are the main<br />
cause for dropouts and no effective solution is available to help<br />
the students to catch up in education. Stringing from this issue<br />
is the issue or concerns on student discipline; sufficiency of well<br />
trained teachers to handle under achievers, proper curriculum<br />
specifically designed for under achievers, and others add to the<br />
ultimate purpose and agenda behind the current education<br />
system. EDB- Education Blue Print 2012 – removing “remove”<br />
2017 is too late.<br />
5. Issues of Tamil School Classification<br />
The numerous school classifications eg SKM (Sekolah Separa<br />
Model), SBM (Sekolah Bantuan Modal) Grade B, Grade A<br />
(Sekolah Bantuan Penuh) add to the dissatisfaction amongst<br />
the <strong>Indian</strong> Malaysians<br />
6. Issues of Attachment Teachers and Training<br />
Inadequate and inappropriate teachers and training of<br />
teachers and the consistent changes ill-afford consistent<br />
improvement of the Tamil Schools<br />

EDP is a safe passage to educational reform without much twist and<br />
turn. The committee totally ignored or stayed away from real<br />
reform on POLICY and POLITIC Levels;<br />
Infrastructure Improvement is pretty much understood and<br />
can never go wrong<br />
Improving the teaching Talent – How can one can go wrong<br />
with that<br />
Improving the MOE – department Red Tapes and empower<br />
the ground to perform.<br />
Etc<br />
Some of REAL Reform TALK must ADRESS the following:-<br />
1. TOF – Term of reference of the Education Blue Print (EBP):<br />
Sept 2012: Vernacular Schools and SK are Equal in carrying<br />
the mandate of National Education Mission- This means SK<br />
schools must not see Vernacular school as a historical<br />
nuisance that segregate or divide Malaysians: TOF –<br />
EQUALITY – MOE must accept not TOLERATE that Malaysia<br />
is built base upon multi educational system and no one<br />
system is above any. REMOVE all Policies that sideline the<br />
Vernacular Schools as off system.<br />
2. The Base line for the EBP is a “fear” of Tamil and Chinese<br />
Schools growth of 7% and 4% accordingly among <strong>Indian</strong><br />
Malaysian and Chinese Malaysian: That kind of fear or<br />
mindset is totally 180’ degrees against the UNITY Code<br />

propagated by “Falsafah Pendidkan Negara” : MOE – must<br />
not envy or fear the popularity and performance hike in<br />
vernacular schools. EBP intro gives a chilled effect on EBP.<br />
3. Abolishing “Remove Class” 2017 – is too long and too late.<br />
The Language; Bahasa Malaysia and English in Vernacular<br />
School must be synchronized to the level of SK schools in<br />
terms of syllabus: especially in Bahasa and English<br />
4. Tamil Schools must be given options to do Math and<br />
Science in Tamil or English; Rather than pushing it all for<br />
Tamil Language/Chinese. Tamil Schools showed a great<br />
performance in Math and Science thought in English<br />
compare previously in Tamil Language. So, aren’t broken<br />
don’t fix it.<br />
5. Permanent Assessment System that is TRANSPARENT for<br />
all School; - The biggest shortfall of Malaysian Education<br />
System is the inconsistency and affirmative action enforced<br />
upon our national exam assessment system. Current, bell<br />
curve system is used under great secrecy. The A grade<br />
score of the year 2010 is not necessarily same as the A<br />
Grade quality of year 2009: because the grading is based<br />
on year and locality and possibly race/religion. This<br />
discriminatory grading deprived the teachers of knowing<br />
their real performance and achievement, depriving the<br />
children of their real knowledge level of standing in<br />
reference to the rest and yester years and refuse the<br />
system a credibility assessment to improve and move<br />
forward with reliable and universal standard. <strong>For</strong><br />

example, If the 80 percentile is the level for an A grade then<br />

political or affirmative reasons. This is the Single self –<br />
destructional REASON of education system in Malaysia<br />
since NEP: English grading of getting an A in Kelantan or<br />
Sabah may very well lower then Selangor for the same year<br />
and same exam questions. This is a political-social reasons<br />
rather than an academicals evaluation. Compare that with<br />
GCE O Level or A Levels. PBS-Penilaian Beraraskan Sekolah<br />
– it is scary path in terms of readiness but right move in long<br />
run.<br />
6. Vocational Reform : Vocational education must be inserted<br />
in Primary School itself rather than waiting to be a last<br />
resort for DROPOUTS – That is a fundamental Policy and<br />
Principle Change should be address in EDP – total missing<br />
7. Vocational Education must be migrated to MOE-<br />
immediately to ensure the effectiveness synchronizing with<br />
academic process. MOE – IPT to follow thru the idea<br />
University Kemahiran Malaysia is been pending for ages<br />
now.<br />
8. EQUAL ACCCESS – Tamil Schools must be given equal and<br />
propionate fund allocation equal to SK Schools : Including<br />
the upgrades of Infrastructure – ICT excess – Teachers<br />
Upgrades – ETC<br />
9. POC – People Own Culture Studies is part of Malaysian<br />
Value Driven Growth – must be included: Cross culture<br />

Proposals<br />
Review of 10 Subjects Cap in SPM<br />
A review of the policy is a must - This is a policy that appears to<br />
have been made in haste to hush a more important predicament<br />
without proper thought being put into it.<br />
It has had a deep impact on Tamil Language & Tamil Literature<br />
which needs to be given equal treatment in University / other<br />
intakes.<br />
We urge the Government to instruct the Ministry of Education<br />
(MOE) to review this policy and revert to old policy to ensure that<br />
Tamil and Tamil Literature be made mandatory for all <strong>Indian</strong><br />
Malaysian Students.<br />
The new Review Panel set up by the Ministry of Education to do<br />
the framework for Malaysian Education system till 2025 must look<br />
into and consider this issue seriously.<br />

Higher Education & Matriculation<br />
We urge the government to do away with the merit system for IPT<br />
intakes including for the matriculation programs and install<br />
affirmative action base on quota.<br />
Currently, due to lack of transparency, intakes for matriculation and<br />
IPT sideline the <strong>Indian</strong> Malaysians.<br />
The evidence is apparent in universities where <strong>Indian</strong> Malaysians<br />
have limited opportunity in getting the courses they prefer although<br />
their results appear to be suitable and sufficient to qualify them to<br />
take up such a course or program.<br />
In addition, treating STPM and matriculation as the same entry<br />
qualification for university intake is not justifiable.<br />
It is important that the government establish one university entry<br />
system.<br />
It is recommended that a 8% quota for <strong>Indian</strong> Malaysians be given<br />
for all courses in matriculation and IP<br />
STPM –Rebranding – Pre University Year 1 & Year II<br />
STPM – Sijil Tinggi Pelajaran Malaysia is manage by MPM – Majlis<br />
Pelajaran Malaysia : STPM revamp of the system and concept is<br />
overdue as the pre-entry qualification to public universities and<br />
equating Matriculation to STPM as an entry for University is gravely<br />
an oversight. <strong>NIAT</strong> congratulates the move by MOE July 2011 to<br />
introduce semesterly exam format. However, the rebranding is not<br />
complete without the following addendums; <strong>NIAT</strong> is recommending<br />
this changes due to high percentile of <strong>Indian</strong> Malaysian students<br />

resorting to STPM as their path of choice to University while most of<br />
the Bumi students will go through matriculation or other simplified<br />
form of entry to higher education.<br />
1. Conditional Entry Requirement for Government :<br />
FREE education thru Pre-University-STPM to be made<br />
2 credits: If without Bahasa Malaysia or English Credit:<br />
They are required to sit for July papers/December<br />
paaper to earn credits before Pre-University Certificate<br />
can be released or University Application can be<br />
processed: Basic – We are recommending conditional<br />
Intake for those pass SPM with at least 2 credits. This<br />

Reducing the dropouts from SPM – as one of the<br />

Reducing the financial burden of students and<br />
parents trying to seek private education.<br />
2. Do away with UNIFORM in Pre- University – impose<br />
concept dress codes like some of the University – UUM<br />
This move will mentally liberate the school like culture,<br />
behavior and give renewed perspective of carrier<br />
and life outlook for students after 11 years of<br />
uniform education system.<br />
3. Increase number of school-centre offering<br />
Government and Private Pre-University by 25% by<br />
2018 that offers Tamil and Tamil Literature: The<br />
boost of Tamil and Tamil Literature will help<br />
government in effectively to fulfill qualified Tamil<br />

New Tamil Schools with 1:2750 population<br />
New Fully Aided Tamil to be build in areas which have a population<br />
average of more than 10000 <strong>Indian</strong>s within a 5KM radius in a given<br />
district.<br />
This is particularly relevant in Selangor (especially in Klang and<br />
Petaling Jaya), Perak, Johor, Penang and Kedah.<br />
With better Tamil school performance records and an increasing<br />
demand for the Tamil schools in these areas, new schools are<br />
urgently needed.<br />
7 New Tamil School permission is great move, however, relocation<br />
of Sekolah Kurang Murid (SKM) schools is equally important.<br />
New Tamil Private School Permission<br />
The Ministry of Education (MOE) must allow for a more competitive<br />
and open transparent system to set up and establish New Tamil<br />
Private Schools at locations that are appropriate e.g. Selangor,<br />
Johor, Penang.<br />
Tamil School Land Acquisition<br />
The Ministry of Education (MOE) must participate in land acquisition<br />

Approximately 61% of the 523 Tamil schools are under SKM<br />
(Sekolah Kurang Murid) especially in estates.<br />
To overcome this Tamil School can go thru relocation into more<br />
populated and strategic areas that meet the basic needs of the full<br />
infrastructure. Otherwise, “cantuman” too is good idea to<br />
consolidate the resources for better performance in certain<br />
geographical area. However, combination of one school must be<br />
followed of relocation of another one. So, the number of school will<br />
maintained.<br />
Sekolah Cantuman Chaah Johor is one of the successful examples of<br />
“Sekolah Cantuman”.<br />
Disparity Among Male & Female Teachers<br />
Currently, Tamil School is overwhelmingly dominated by female<br />
teachers.<br />
While naturally inclined towards education and the skills of<br />
nurturing, the female teachers are finding it difficult to impose<br />
discipline, to engage in sports activities and other activities that are<br />
generally regarded as more male friendly activities.<br />
It is important to achieve gender equality in this aspect.<br />
We need to reduce the female: male ratio to 60: 40.<br />
8% PTD for Diplomatic and Governmental positions<br />
Recruitment for PTD positions has been overwhelmingly limited for<br />
Malay Malaysians in the past.<br />

It is recommended that the government ensures 8% of the PTD<br />
recruitment for suitably qualified <strong>Indian</strong> Malaysians.<br />
<strong>Indian</strong> Malaysian Counselor in Schools<br />
The Primary and Secondary schools with significant <strong>Indian</strong><br />
Malaysian population need to appoint a qualified <strong>Indian</strong><br />
Counselor(s) to deal with disciplinary and other issues.<br />
Tamil School (Grade A and Grade B) must also appoint counselors<br />
to deal with problematic students.<br />
It is proposed that for every 200 students a fulltime counselor<br />
should be appointed – a fair ratio of 200:1.<br />
POC ( People Own Culture ) in Primary & Secondary Schools<br />
All secondary/Primary school must be given a POC program apart<br />
from the POL (People’s Own Language).<br />
Cultural studies is equally if not more important than secular or sex<br />
education which is gaining support now among all quarters, which<br />
we agree is important for a balanced growth of students and could<br />
can prevent unwarranted activities. Yet cultural activities are also<br />
important to ensure a well rounded growth as per “Falsafah<br />
Pendidikan Negara”<br />
DBP – Dewan Bahasa & Pustaka : Tamil Translation Unit<br />
Tamil schools are facing acute shortage of reference books in<br />
science and technology related subjects such as computers,<br />
biology and mathematic for students’ reference and general<br />
knowledge.<br />

Although these books can be imported from India, a more proactive<br />
measure would be to provide incentives for the local publishers to<br />
publish or to assign DBP to appropriately translate from other<br />
languages into Tamil language.<br />
Government Study Loan for Studies Abroad Thru PTPTN<br />
Students should be able to seek loans to pursue studies locally and<br />
abroad.<br />
Currently, the PTPTN loans are only for those recognized local<br />
studies. However, in certain cases important critical areas of study<br />
are only available overseas.<br />
The Government must identify fields of studies and type of schools<br />
for candidates to be eligible for study loans. Example of field of<br />
study include Green Technology, <strong>Indian</strong> Culinary arts,<br />
Manufacturing Technology, Aerospace, Piloting, cultural, acting and<br />
others.<br />
The loan repayments can be similar to that of commercial banks<br />
which is always difficult to obtain.<br />
Loan from the government or suitably appointed Government body<br />
can be guaranteed by parents with a mandatory requirement to<br />
return home or full payment failing which their passports could be<br />
revoked.<br />
Presently studies that is gaining popularity amongst the <strong>Indian</strong><br />
Malaysian Students include a vast area including Medical, Pilot,<br />
Accrual Science, Engineering, Cultural Degrees (Singing, Musical,<br />
Acting, Sculptures, Architect) <strong>Indian</strong> Culinary, Bridal, Jewelry<br />
Engineering/art, Textile, even Hindu Priesthood.<br />

Therefore the loan disbursement ought not to be based on the type<br />
of study but primarily based on making the facility available.<br />
IV INDIAN <strong>MALAYSIAN</strong> AND THEIR<br />
SOCIAL ISSUES<br />
a. Alcohol Laws and Programs in Malaysia<br />
The Government has to recognize that alcohol consumption is a<br />
growing problem among youths and especially Malaysian <strong>Indian</strong><br />
youths.<br />
This is in need of an urgent attention. Ministry of Youth need to<br />
take this initiative. The Malaysia Hindu Sangam with a coalition of<br />
NGOs had initiated the effort to check this scourge, but with the<br />
lack of enforcement by the authorities, all efforts will be of no<br />
use.<br />

<strong>NIAT</strong> has recognized the importance of creating KRAs and prepare<br />
KPIs for ministry on the following issues particularly for a review of<br />
the alcohol laws and regulation in Malaysia particularly to deter<br />
youth from alcohol.<br />
1. 21 to Drink – Change the current age limit of 18 to above 21<br />
2. Criminalize Public Drinking, Displays and Intoxicated Person<br />
3. Setting up of a Malaysia Alcohol Research and Rehabilitation<br />
Centre<br />
4. Legislate Under Aged Alcoholism & make it an arrest able<br />
offence for Minors To Consume Alcohol<br />
5. Restricted Alcohol Retail whereby all Alcohol Retailing should<br />
be confined to Liquor Shops with controlled business hours<br />
6. Liquor Licensing at all eateries that dispense alcohol of any type<br />
inclusive of cocktail and beer.<br />
7. Banning of Alcohol Advertisements – Glorification in all<br />
mainstream Media - Electronic, Alternative and Printing Media<br />
completely. Including in Movie – Songs<br />
8. Mandatory Jail Terms for Alcohol Smuggling, illegal trade and<br />
Law Breakers :<br />
9. Banning the Manufacturing, trading and retailing of local illegal<br />
brands such as Samsu & Toddy<br />
10. Taxation System based on Alcohol content which will<br />
simultaneously increase government’s tax revenue by another<br />
RM200Mil<br />
11. Anti Alcohol Slogan on all labels including reminders from<br />
major religions<br />
12. Alcohol & Drug Test in Colleges/University - IPT &<br />
College/University administration to do random alcohol and<br />
drug test in campus.<br />
Alcohol and drug is rampant is colleges especially in private colleges.<br />
Random tests need to be carried pout particularly on Mondays.<br />

ICE, Weed and many other enhancer drug pills/substance used in<br />
colleges/universities for various reasons and excuses must be<br />
eliminated. The University, Police and Ministry of Higher Education<br />
must work in coordination.<br />
<strong>NIAT</strong> random test yielded very dramatic results in one of the private<br />
Universities. The usage of ICE and its availability to college students<br />
is a generally known and unfortunately accepted culture.<br />
b. Youth Gangsterism<br />
The Government has to recognize the seriousness of this issue.<br />
The Government has to allocate appropriate funding of up to<br />
10Million for NGOs to be involved in preventive measures especially<br />
in curbing Gangsterism.<br />
Creating of Peace Clubs in Schools through KPM as part of their cocurriculum<br />
etc. is one of the many initiatives that need to be<br />
undertaken.<br />
The Police must hold more talks in school on the issue with students<br />
and children.<br />
Further, the Schools need to work closely with the police in<br />
respect of the following:<br />
Placement of Police in secondary schools with serious<br />
discipline issues could be seen as a deterrent to curb<br />
discipline problems.<br />
Schools in many western countries have adopted this method<br />
widely and have been effective.<br />

<strong>NIAT</strong> urges MOE to look into having Permanent Police Presence<br />
in crime prone schools or locations like Puchong, Sentul etc.<br />
BAN GANGSTERISM – “Funeral or Celebration of Matcha”<br />
During the several inquires it was learnt that when a member of<br />
a gangster group died due to accident or victim of violence, his<br />
funeral has become stage of glory whereby his history of<br />
violence (including killing, fighting and etc) will be glorified, fire<br />
crackers will be burnt and alcohol will flow freely. “Rempit”<br />
motorbike motorcades, sign of gangster group like 8, 36 and etc<br />
will be displayed.<br />
So what happens after a Macha had passed away?<br />
The guy’s friends will immediately be informed and a few teams will spread out<br />
to inform the rest. The Facebook communication team will immediately set up<br />
a fan page for the Macha and pictures of him, his gang activities, and the full<br />
statistics of his crime records are displayed. The rest of the gang members will<br />
immediately shout their slogan ‘Hidup,Hidup’. Some will start preaching about<br />
these criminals as though they’re heroes of the society. Ugly Meenachis on the<br />
other hand will comment a common thing which is ‘RIP Anne’.<br />
Depending on their gang numbers, a few banners will be printed out by their<br />
media team. The media team is also responsible to hang the banners around<br />

This practice is not only for funerals but at birthday<br />
celebrations. Most of the time the family members have very<br />
little say or say nothing due to fear.<br />
This practice must be BANNED immediately and action must be<br />
taken to curb this practice as it is against public morals and the<br />
police must be given full authority to take appropriate action.<br />
c. National Service Additional Allocation<br />
National Service is known for its effective methods in shifting<br />
mindset of our young youths.<br />
We also urge the government to place all the Malaysian <strong>Indian</strong><br />
students with disciplinary issues, dropouts and gangsterism<br />
problems into Special NS programs.<br />
We are requesting that the Government make an additional 5000<br />
places allocation for Malaysian <strong>Indian</strong> students; spread into 5<br />
years.<br />
The program should be fine-tuned to fit the challenged nature of<br />
the students. The same concept can be used for similarly inclined<br />
students from all races in the country.<br />

d. Special Skill & Mindset Training –Shorten Jail Term<br />
Ex-convicts and dropouts and have no or no other serious crime<br />
records, should be enrolled in SPECIAL SKILL & Mindset Training<br />
while in castration especially, inmates under 30 years old. The Skill<br />
Training Certificate requirement can be exchanged for shorter jail<br />
term.<br />
The Skills Training inclusive of MINDSET Training for a duration of 6<br />
months (a package) should be done before the embark on the SKM<br />
Level 1 studies. Subsequently, they can be absorbed as general<br />
workers in government and in the private sectors.<br />
The government can provide incentives for a year to encourage the<br />
hiring of ex-convicts. Additionally, they can be requested to attend<br />
frequent counseling in assigned counseling centers or registered<br />
NGOs with counseling programs.<br />
These efforts will reduce the tendency of those involved in crime to<br />
go back to the similar activities in the future. Such programs have<br />
been found to be successful in the US and have shown dramatic<br />
improvements.<br />
In addition, upon successful completion of the program, they should<br />
be eligible for micro loan programs to start a business or relocation<br />
assistance.<br />
We ask the government to set aside 1000 Spaces to this group: They<br />
must be given loan incentives to undertake the course and if<br />
suitably qualified to take appropriate loans for business<br />
development<br />
e. Youth Organization : Permanent Annual Allocation<br />

Youth Organizations should be provided with adequate funds<br />
annually, particularly all Malaysian <strong>Indian</strong> Youth NGOs.<br />
Currently, the allocation comes from MBM (Majlis Belia Malaysia)<br />
and limits the NGOs to conduct effective programs. The allocation is<br />
difficult to obtain by Malaysian <strong>Indian</strong> Youth NGOs.<br />
Since these programs are an integral part of Youth development in<br />
Malaysia, it is recommended that the allocation of RM 10 million be<br />
allocated to register NGOs for their various approved programs.<br />
This should be done at national, state and district levels.<br />
Programs related to Education, Culture, Sport, Alcohol, Gangsterism<br />
eradication, Violence Crime and School Dropouts eradication should<br />
be emphasized since these are the striking issues among <strong>Indian</strong><br />
Malaysian youth.<br />
The government should set KPIs to monitor these NGOs. Current<br />
<strong>Indian</strong> Malaysian Youth organization does not get enough funding<br />
for them to do vigorous programs on Youth issues.<br />
We therefore urge their funding to be increased to assist<br />
government in curbing crime, dropouts, gangsterism and<br />
alcoholism.<br />
We recommend that the permanent allocation be made based on<br />
Memberships, Activities, Effectiveness and National Image.<br />
<strong>For</strong> an immediate purpose, the MIYC – Malaysian <strong>Indian</strong> Youth<br />
Council : KBBT – Kelab Bell Belia Tamil : with more than 200<br />
branches national wide may be chosen as the ambassador to bring<br />
about change in youth outreach.<br />

f. Religious NGOs Program Funding<br />
Religious Organizations should be provided with adequate funds<br />
annually, particularly those who have proven track record of<br />
facilitating and encouraging proper and good social conduct and<br />
decorum.<br />
Currently, most of these organizations derive their funding through<br />
charity fund raisers and philanthropists. The funding from the<br />
government is minimal and rather on a piece meal basis.<br />
A permanent and structured formula of funding must be created<br />
and monitored.<br />
Since religious and social programs are an integral part of a<br />
structured development of the people of Malaysia, it is<br />
recommended that the allocation of RM 10 million be allocated to<br />
registered NGOs for their various approved programs.<br />
This should be done at national, state and district levels.<br />
Programs related to Religious education, Culture, Culture, Cultural<br />
sport, Alcoholism and Gangsterism Eradication, Violence Crime and<br />
School Dropouts Eradication should be emphasized since these are<br />
the striking issues among the <strong>Indian</strong> Malaysian youth currently.<br />
<strong>For</strong> an immediate purpose, the Hindu Sangam with its extensive<br />
channels in Malaysia may be chosen as the ambassador to bring<br />
about change in youth outreach through religion.<br />
g. Sports NGO & Sport Program Funding<br />
The <strong>Indian</strong> Malaysians used to be leading the sports arena of<br />
Malaysia at one time. Yet today not only the <strong>Indian</strong> Malaysian’s<br />

participation is limited but at a national level the performance is<br />
undeniably below expectation.<br />
Sports is one of the most effective ways to channel the energy into<br />
good causes, preventing the youths from any major inappropriate<br />
or unwanted activities.<br />
It is recommended that more allocation be channeled to boost the<br />
creation of more SPORTs NGOs in the likes of the Futsal Club<br />
Petaling Jaya, Persatuan Sepak Takraw and others.<br />
- In addition, we are urging the government to consider giving<br />
incentive for creating 100 new Malaysian <strong>Indian</strong> cultural and<br />
sport NGOs nationwide which can be parked under the Ministry<br />
of Youth.<br />
- As a long term measure, the creation of NGOs will eventually<br />
distract youths from engaging in illegal activities which is costing<br />
the government a significant amount – ‘prevention is better and<br />
cheaper than cure”.<br />
The Prime Minister’s announcement on the 3 rd of August 2012<br />
on grants for Sports NGOs was a commendable one.<br />
However, a onetime grant will not do anything or will not be<br />
able to reflect on a tangible effect on the ground.<br />
A special grant scheme must be introduced.<br />
- The Government must REVIVE immediately the SPORT<br />
infrastructure in all housing, township, rural, and public<br />
places to encourage more youth to be pulled into sports ;<br />
examples :- Basketball courts, Badminton courts, Futsal court,<br />
skating ring, public swimming, park equipped with gym<br />
equipments.<br />

- We also propose “Pusat Gym Rakyat” : with subsidized gym<br />
service. Free for Students and Public RM50/Month.<br />
h. Wedding Courses & Counseling<br />
Divorce and Parenting flaws is costing the society and government<br />
millions on the expense of their kids.<br />
Currently, Muslim weddings are to be solemnized only after the<br />
couple has attended a certified wedding course but the same is not<br />
applicable to non-Muslims.<br />
This wedding course is proven to be effective and imposing such a<br />
pre requisite condition for registration is important for the non-<br />
Muslims too.<br />
This course can be conducted by the religious NGOs while the main<br />
framework of the course should be drawn up and provided by the<br />
Ministry of Women, Family and Community Development and<br />
should incorporate issues such as :<br />
- HIV & Health: test a must for all wedding registration. This is<br />
also a way to impose and implement responsibility on health<br />
and child support issues.<br />
- Parenting: Mandatory marriage courses are implemented<br />
before the legal marriage registration. Example Malaysia Hindu<br />
Sangam can engage in Wedding Courses for all Hindu/Christian<br />
couples. Couples also will be reminded of children needs for<br />
birth certificates, medical vaccination and etc.<br />
- Religious Competency Training : Sikh – Hindu – Christian –<br />
Buddhist – cooperation of Inter religious Council<br />
- All Divorce must have gone thru counseling. If children and<br />
custody issues are involved additionally divorce couple must<br />

attend appropriate counseling session. It is important that<br />
before the couples are eligible for divorce application, the<br />
couple must have obtained a certificate / letter from the<br />
counselor. This may deter or reduce the number of divorces as<br />
it has been recorded in the USA, UK and France<br />
i. Domestic Abuse, Abuse Awareness & Rights<br />
<strong>Indian</strong>s from lower economic strata are primarily the victims of<br />
domestic abuse.<br />
Although the law requests an arrest, seldom the abusers get<br />
punished. Little is done by the Police and the Ministry to overcome<br />
this problem. The domestic abuse assistance is purely left to NGOs .<br />
The situation gets really bad in rural and estate localities.<br />
Moreover, the children’s and the mothers of such abuse are left<br />
without any support. As such, it is recommended that serious steps<br />
be taken in terms of allocating hostels for the mother and the<br />
children at least as temporary refuge. Consequently, financial<br />
support is needed for such cases.<br />
The Ministry of Women Family and Community Development<br />
must also formulate even more harsh laws to protect these<br />
children, enforce child support laws and alimony for mothers.<br />
Usually alcohol, drugs, unemployment, and financial conditions<br />
are the main reasons for the problem.<br />
One in 4 poverty prone families are affected by this phenomenon.<br />
Two in 3 kids from these families are dropouts.<br />
Two in 4 kids that are dropouts are involved in illegal activities<br />
that may involve violent crimes. The statistic must be changed<br />
urgently<br />

j. Single Mother - Motherhoods<br />
The “Single Mother” must be redefined to include, OKU husbands,<br />
separated women, and widows.<br />
Single mothers must be given the opportunity to own their own<br />
house through the government’s low cost housing programs.<br />
<strong>Indian</strong> Malaysian single mothers are to be assisted to own houses<br />
with at least a target of 1000 low cost houses set aside for this<br />
challenged group with Welfare Assistance.<br />
E-Kasih can be used as a platform to identify these poor families.<br />
The rental payment approach could be implemented for the<br />
purchase of the houses.<br />
In the past, these practices failed due to corruption, unethical<br />
political motives and huge amount of red tape. The right platform is<br />
to set the KPI on the basis of house ownerships and the rightful<br />
owners must be identifiable and justifiable.<br />
k. Adult Community Night Classes<br />
Once a week classes revolving around unity, business opportunities,<br />
parenting, government programs, racial integration and others is<br />
needed. The attendees of this program could be given allowances<br />
like the Train & Place Program according to their attendance.<br />
NGOs or welfare department should organize these classes at<br />
strategic areas especially within the vicinity of the poor and<br />
uneducated society as well as crime prone areas. Examples, Taman<br />
Dato Harun. Taman Sri Sentosa, Sentul, Taman Sri Andalas, and<br />
others.<br />

This would be an effective effort in integrating the people and<br />
educating them substantially lifting them up in society<br />
l. Ex convicts Special Programs<br />
Program to Hire Convicts direct from prison itself<br />
It is part of Social Integration Program for convicts. Usually the<br />
final year of their sentence for good behavior.<br />
The USA has implemented this program very successfully -<br />
restaurants, construction and manufacturing sectors uses this<br />
special program. The salary will be paid to inmates through<br />
prison system.<br />
Research shows 70% of the inmates eventually joined the<br />
company in which they were working during this special<br />
program.<br />
SKM – JPK Program – Level 1 – 4 to be offered for convicts<br />
under 30 years old as mandatory for those that do not have<br />
Diploma or Higher education. 6 Month SKM MINDSET<br />
program before they are enrolled into SKM Lev 1-4 Programs.<br />
Make it a mandatory requirement and shorten their<br />
monitoring period so that they can get on with life.<br />
NGO-Prison – Mentoring & Monitoring Program: example<br />
Tamilan Uthavum Karangal is a great value NGO helping Ex-<br />
Convicts to find new path of life and role model.<br />

Youth Crimes by 50% and Repeat Offenders by 75% in 5 years.<br />
The Government must work with relevant NGO and the society<br />
to ensure the right and effective solution is identified to reverse<br />
the current trend.<br />

The biggest cause of the problems surrounding the <strong>Indian</strong><br />
Malaysian includes:<br />

3. Gangsterism Influence<br />
4. Alcohol & Violence Eco System<br />
5. Glamorizing Violence-Alcohol in movies<br />
m. Social Entertainment, Media & Press<br />
<strong>Indian</strong> Malaysians are the highest spender in terms of per capita for<br />
movies and this is a known fact. The entertainment has a great<br />
influence in the behavioral aspects of Malaysian <strong>Indian</strong> youth<br />
ranging from the fashion influence, language influence and to the<br />
attitude influence. Thus, we urge the government to :<br />

Censorship Policies on Tamil movies, especially movies from<br />
India and subject them to the same level or standard in respect<br />
of violence and sexual content.<br />
In recent years, Tamil movies have become one of the main<br />
contributors of gangsterism, violence and morals decay<br />
amongst the youths.<br />
Censorship board has been very relaxed on foreign Tamil movies<br />
and the rating is questionable and inconsistent if compared with<br />
our values and moral.<br />
In the recent days movies like Naan Mahan Alla, Mangatha,<br />
Billa, Kandasamy, Goa and Ayirathil Oruvan were proof of failed<br />
censorship in sexual- alcoholism - gangsterism content.<br />
Censor all the drinking glorifying scenes – songs or gestures not<br />
for PUBLIC VIEWING<br />
Censor and impose Special Tax on Movies Glorifying<br />
Gangsterism : Billa, Mangattha<br />
Censor all the violent scene involving “Aruva” or instruments<br />
Sexual Content & Women exploiting Scene or gestures to be<br />
removed<br />

V. INDIAN <strong>MALAYSIAN</strong> AND GOVERNMENT<br />
POLICIES<br />
Government Policy should forcefully ensure that it allows all society<br />
members to participate in the economy especially with regards to<br />
government programs and initiatives. However, the government has<br />
been a little slow in making the necessary policy to show its<br />
commitment on certain issues. <strong>NIAT</strong> recommends that the new<br />
Government work towards a more open door policy and in<br />
particular the following areas.<br />
a. Policy in West Malaysia<br />
It is recommended that the government declares 8% allocation for<br />
the Malaysian <strong>Indian</strong> for critical areas of interest so that<br />
proportionate participation is achieved at every level. The 8%<br />
allocation for Malaysian <strong>Indian</strong> such includes areas as follows:<br />
i. Civil Service Employment<br />

The Government has to proactively meet the participation<br />
quota of Malaysian <strong>Indian</strong> in Civil Services at the minimum of<br />
8% across the board.<br />
It is recommended that an additional 60000 employments be<br />
made available in the civil services. Currently, <strong>Indian</strong> Malaysians<br />
represent less than 4% of civil servant force.<br />
This area was overlooked for a long time and it’s time now to<br />
act fast and effectively.<br />
Almost 56000 government jobs including 1350 “executive” level<br />
jobs that should have been given to <strong>Indian</strong> Malaysians have<br />
been “diverted”. This must be changed immediately.<br />
3500 <strong>Indian</strong> Malaysian must be recruited into civil service per<br />
annum to fill the quota. It is interesting to note that even so it<br />
will take 16 years before we can make the population<br />
composition<br />
ii. PTD – Pegawai Tadbir & Diplomatic<br />
We are recommending that at the end of 5 years, the<br />
government achieves a target of 8% of Malaysian <strong>Indian</strong><br />
participation for PTD.<br />
The Government must fix the disparity in opportunities in<br />
every government sector to ensure the success in winning the<br />
hearts of the people and moving forward with trust and<br />
respect.<br />

iii. Military/Police/Enforcement<br />
8% of the new recruitment must be filled with <strong>Indian</strong><br />
Malaysians and by 2020 these sectors must individually show a<br />
8% participation by <strong>Indian</strong> Malaysians.<br />
According our meeting with IGP on August 2 nd 2012 – only 3.4%<br />
of the total Police <strong>For</strong>ce are current <strong>Indian</strong>s; the force must<br />
reach out to reduce the gap. Police has to add at least 750<br />
<strong>Indian</strong> Malaysian officers on various levels annually to the <strong>For</strong>ce<br />
for 5 years to fulfill the racial composition.<br />
Currently Police have shortfall of about 5000 Officers to match<br />
the population composition. By adding 750 officers per year will<br />
take 7 years to fulfill;<br />
Current Statistic example: 4500 Applications: 473 Applications<br />
were from <strong>Indian</strong> Malaysian, 213 were qualified for interviews<br />
while 54 were offered a job as Inspector. This info was rendered<br />
to <strong>NIAT</strong> during our meeting with IGP on Aug 2 nd 2012.<br />
iv. GLCs: Employment, Business & Participation<br />
Government has to engage and erase some of the unwritten<br />
and unspoken policies. All GLCs including TNB. Telekom,<br />
PETRONAS and etc must now openly employ <strong>Indian</strong> Malaysians.<br />
Government must make an affirmative policy to all GLC to meet<br />
the quota. GLCs are seen to be Malay oriented companies based<br />
on public perception.<br />
We need a Government policy stating and requiring 8% <strong>Indian</strong><br />
Malaysian employment across the board just like the 30%<br />

requirement for private listing company to have Bumiputera<br />
stake. Please amend it to include the minorities including the<br />
Sabah & Sarawak<br />
v. Education, IPT & Matriculation<br />
Intake for Matriculation and IPT must be synchronized with<br />
national policy of 8% and the merit system need to be<br />
discontinued.<br />
JPA Scholarships must be awarded according to the 8% quota,<br />
so the Malaysian <strong>Indian</strong> student does not get sidelined by the<br />
purported merit requirement which is highly questionable and<br />
not transparent.<br />
The opportunities in Engineering, Biotech, Medicine, Law,<br />
Finance, Oil & Gas, Chemical, Pilot, and etc must be safe<br />
guarded and the <strong>Indian</strong> Malaysian must be given the 8 % of the<br />
seats in each of the area of studies.<br />
vi. Skill & JPK<br />
We propose that the government allocate RM50Mil as study<br />
loans with “saradiri” of RM350/month allowances through<br />
PTPK for Malaysian <strong>Indian</strong>’s Skill Training Scheme up to DKM<br />
level.<br />
Budget 2013 – Rm50Mil – 3200 Skill training for <strong>Indian</strong><br />
Malaysian.<br />
The FUND is scholarship only for those complete up to DKM<br />
Level. Other level education should be treated as loan as part<br />
deterrence to be dropout in skill education..<br />
Government needs to make policies and ruling for private<br />
MLVK/JPK institutions to offer up to Level 3 in disciplines of<br />
their choice. This means, they should not be allowed to do<br />
Level 1 or level 2 only but, must complete the entire set up to<br />

Level 3. Currently there are great number of private operators<br />
offering only Level 1 and 2 and upon completion the students<br />
are left to find another institution to continue their studies.<br />
This has resulted in only 20% or less pursuing all the way up to<br />
level 3. The 80% of those who have completed Level 1 and 2 are<br />
found to be inadequate for the employment entry level in the<br />
market. Additionally, without sufficient push to Level 3, this<br />
path is less viable as carrier options that will enhance socialeconomic<br />
wellbeing of the <strong>Indian</strong> Malaysians.<br />
Likewise, we also urge JPK to look hard into MQA accredited<br />
Skill University for those wanting to continue further to diploma<br />
and degree level. These ideas have been bouncing around for a<br />
while at the MOHR because of unresolved coordination<br />
between IPT & MQA. We urge that the Government sets a firm<br />
date on the Skill University issue with 8% allocation for<br />
Malaysian <strong>Indian</strong> students in various and demanding fields like,<br />
healthcare, oil & gas, aerospace, automobile, green tech, civil &<br />
construction, networking and etc.<br />
vii. Federal Tenders<br />
Malaysia belongs to all Malaysian; so does the government<br />
business. However due to lack of transparency or clear policy<br />
direction the Federal business has been a “jackpot lottery” only<br />
to few Malaysians who fall under the favored category or<br />
extremely limited <strong>Indian</strong> Malaysians contractors.<br />
All qualified <strong>Indian</strong> Malaysians should be allowed to register as<br />
Class F Contractors at the Central Works Registry and this<br />
registration should not be reserved for Bumiputra contractors<br />
alone.<br />

An <strong>Indian</strong> contractor should not be forced to obtain only subcontract<br />
jobs from Malay contractors who are registered, as it is<br />
currently practiced.<br />
Most <strong>Indian</strong> Malaysian contractors do not have the financial<br />
capacity to wrestle jobs from the more established Chinese<br />
contractors and they need assistance at the starting blocks as<br />
Class F contractors.<br />
Besides these factors, currently, there is a requirement for<br />
BUMIPUTERA STATUS for companies to qualify for certain<br />
tenders; requirement of 30% Bumiputera employees or equity<br />
ownerships in public listing company and etc. this is against the<br />
very notion of Malaysianism.<br />
viii. <strong>For</strong>mation New Status: Unity Company “Status” replacing<br />
“Bumi” Status Company<br />
We recommend a new company composition is created. This<br />
category of company will be called “Unity”, the companies<br />
ought to have a 30-20-10 ratio in respect of ethic participation.<br />
The balance 40% can be held by any one or more of the ethnic<br />
population. This will give a true reflection of a Malaysian<br />
company.<br />
It could be made a requirement that all Government projects<br />
be awarded to these companies as a remedial action instead<br />
of Bumi status companies alone.<br />
ix. APs<br />
We seek 8% APs to be given to <strong>Indian</strong> Malaysians<br />
accordingly, so that the wealth is distributed equally among<br />
all law abiding citizens of the land. The transparency in AP<br />

awards will reduce the suspicion of “RAKYAT” on the<br />
government.<br />
b. One Malaysia Language<br />
Recognize and declare Mandarin and Tamil as forming part of the<br />
Malaysian Language.<br />
Multi-Lingual Information dissemination is a great and effective<br />
communication mode. The Government should look into additional<br />
choices on Mandarin and Tamil.<br />
“Bahasa Jiwa Bangsa” - it is the best way to imprint, penetrate and<br />
ensure smooth flow of information to all quarters regardless of their<br />
proficiency in English and Malay languages. Singapore has done a<br />
great job in creating a multi-lingual environment and yet they have<br />
a great sense belonging as “Singaporean”.<br />
It is undisputed that the Patriotism is not degenerated due only to<br />
additional languages being recognized as Malaysian Languages<br />
while simultaneously upholding the privileged position of Bahasa<br />
Malaysia as our National Language.<br />
We recognize our National Language’s privileged position but we<br />
also must ensure the information and connectivity through<br />
languages remain strong by all means.<br />
Establishing Multi-Lingual signage in the true spirit of Malaysia<br />
should be a good starting point.<br />
Sign boards will become a constant reminder that we all are<br />
recognized, respected and the diversity of its citizens is being<br />
celebrated under the proud stripes of the “Jalur Gemilang”.<br />
c. Language Unity<br />

The Government has to encourage more Malays to learn Mandarin<br />
and Tamil, and vice versa Malays and <strong>Indian</strong> Malaysians to learn<br />
Mandarin and more Malays and Malaysian Chinese to learn Tamil.<br />
A Chinese that speaks Tamil naturally will be closer to <strong>Indian</strong>s and<br />
accordingly others who understands another language and their<br />
culture would be closer with each other.<br />
Unity by language integration is the fastest approach in reducing the<br />
growing unity gap.<br />
d. Public listed Companies – Additional Requirement<br />
Require all Public Listed Companies to allocate a 8% employment to<br />
the minority <strong>Indian</strong> Malaysian just as there is current policy on<br />
Bumputera requirement of 30%.<br />
It is only with the government policy to enforce such a requirement<br />
on the corporate sector to join hands with the government to reach<br />
balance economical progress, can such an exercise be a success<br />
e. Estate Relocation Policy<br />
All Malaysians including <strong>Indian</strong> Malaysian relocated from the<br />
estate for any reason must be awarded the following:-<br />
- Re-Skill program for not less than 6 months before the<br />
relocation take place.<br />
- People Housing Ownership: Offered for those who worked<br />
for more than 10 years or<br />

- People Rental Program for those who have less than 10 years<br />

a salary or RM3000 per household, whichever higher.<br />
- Medical & Life Insurance for the ex-employees, including for<br />
the 32 critical illnesses<br />
- Education Scholarship for those who makes it to Pre-University<br />
or University programs, locally or abroad<br />
Malaysia has been in the pocket of the MNC companies for decades<br />
and continues to be neglected.<br />
<strong>NIAT</strong> – interview ( Oct 10 th 2012) with NUPW former President Mr.<br />
Navamugunthan, indicated British was very clear in awarding<br />
independence and not to have their interest in terms of plantation<br />
business to be disturbed by any legislation or enforcement by<br />
incoming Alliance government. It is clear that no permanent plan<br />
was ever in place to defend the poor condition of estate workers.<br />
In the 1970’s, 65% of national wealth were owned by foreign<br />
holdings and during the rapid urbanization, Malaysia has either<br />
forgotten or conveniently neglected the fair share for those chased<br />
out of estates.<br />
One example is Madam K & Mr. S worked in an estate for 3 decades<br />
and exited the estate with nothing in hand, with 9 children on tow.<br />
They were only “gifted” RM2K called service money.<br />
Squartered on a KTM Land for years before their children pulled<br />
them out of poverty through education.<br />

While this is a story with a happy ending many were not so lucky<br />
and end up in the iron grip of the new phenomenon called Urban<br />
Poverty.<br />
Situation must end and the Government must take proactive steps<br />
to ensure that when families are uprooted from their home base,<br />
adequate steps are taken to ensure their livelihood and continued<br />
sustainability to ensure all round development – and not a lop-sided<br />
one in the name of urbanization or development.<br />
f. Malaysian <strong>Indian</strong> Term & Racial Terms<br />
The <strong>Indian</strong> Malaysian must not be referred as “<strong>Indian</strong>”. <strong>Indian</strong> refers<br />
to the citizen of India.<br />
Reference of “Orang India” is an insult and questioning our<br />
Malaysian Citizenship.<br />
We urge the Government to correct this overlooked term of<br />
reference and officially announce the correct use of the reference<br />
as “<strong>Indian</strong> Malaysian” or Malaysian of <strong>Indian</strong> roots.<br />
In the same token we strongly recommend the government to<br />
classify a series of words that are deemed to be sensitive, racially<br />
motivated and unity destroyer. Example “Kaum Pendatang”,<br />
“Keling” and etc.<br />
A legislation should be drafted to spell out clearly and in the<br />
strongest way possible to punish those who use such phrases or<br />
terms intentionally or unintentionally, racially and religiously<br />
sensitive words, name callings, race implication and racist terms<br />
to create sensitivity in the country.<br />

We have survived enough race based controversies in the country<br />
before and we cannot afford to let it go on any longer.<br />
The Seditious Act must be amended to include a clear definition of<br />
those acts and make it a mandatory crime to utter such terms and<br />
insinuations, whether intended or otherwise. Intention is irrelevant<br />
when it hurts the very base of humanity.<br />
g. Dasar Pandang Kehadapan<br />
Enough of finger pointing, enough of blaming, enough of hating and<br />
enough of racial based division.<br />
Let us move forward in a friendly and positive manner, putting all<br />
our differences behind and our future in front, we Malaysians can<br />
make it happen.<br />
In the past, it was our courage, unity and trust that moved the<br />
country forward and without a doubt it is going to be the unity and<br />
togetherness regardless of race and religion that will thrust the<br />
economy and country into the next millennium fundamentally<br />
resting on a common interest of living in harmony and mutual<br />
prosperity.<br />
VI INDIAN <strong>MALAYSIAN</strong> AND THE CALL FOR<br />
CORRECTIVE ACTION<br />
a. Royal Commission of Inquiry on the May 13 th 1969 incident<br />
and Declassification of OSA on all documents related to the<br />
incident<br />
After more than 3 decades the May 13 th seems to be the biggest<br />
mystery while many others argue as to whether it was the biggest<br />

conspiracy theory. Whatever it is, the document and report<br />
submitted by the government and amount of contradiction with<br />
other reports and studies do give us reasonable doubts to propose<br />
that it warrants a non-partisan and fair investigation into the<br />
incident.<br />
The reason why a RCI is needed:-<br />
Objectives<br />
- To clear the doubts about one of the biggest (negative)<br />
historical event in Malaysia<br />
- To exonerate the Malaysian history which has been<br />
manipulated by certain individuals or parties.<br />
- Those responsible need to be identified and be brought to<br />
justice<br />
- Identify and recognize those unnecessarily murdered in those<br />
events<br />
- Truth must be revealed as there is a need for the “real lesson”<br />
for the future while all the conspiracy and doubts must be put<br />
to rest once and for all.<br />

b. Kempen Sejarah Malaysia Sebenar (KemSMS)<br />
It is learnt that the Government is planning on implementing the<br />
proposal for <strong>History</strong> to be made a compulsory pass for the SPM<br />
2013 examination.<br />
Since the government made the announcement for this plan,<br />
KemSMS have had many meetings and discussions with parents and<br />
members of the public throughout the country. Based on these<br />
discussions <strong>NIAT</strong> proposes that there should be no stipulation for a<br />
Compulsory Pass for the <strong>History</strong> Subject – 2013<br />
Yet at the same time, there must be a review the <strong>History</strong> Lesson to<br />
be inclusive of the contribution and role of all races including the<br />
role of east Malaysia.<br />
<strong>History</strong> must be true reflection of what actually happened and<br />
distinguished from opinion, preaching, non-collaborated legendary<br />
stories, brainwashing, misleading, political tactics, racial division,<br />
religious propagation, government propaganda and other nonhistorical<br />
matters.<br />
c. Remove Anak Lelaki and Anak Perempuan (a/l and a/p)<br />
It is interesting to note that Muslims can use the term “Bin’ and<br />
“Binti”, while the Chinese use the surname without the need to<br />
have an additional “A/L” or “S/O”.<br />

It is now proposed that for all others including the <strong>Indian</strong><br />
Malaysians – the use of the phrase “A/L” or “S/O” or “A/P” or “D/O”<br />
be dropped or at least be at the discretion of the Parents and not a<br />
mandatory requirement.<br />
Instead the father’s name or family name if any, should be included<br />
at the end of the name; therefore if the father’s name is Ramasamy<br />
and the child is being named Anjali (a girl) the child’s name on the<br />
Birth certificate should read “ANJALI RAMASAMY” instead of<br />
‘ANJALI A/P RAMASAMY”<br />
<strong>NIAT</strong> believes this gives more credibility to the name and form<br />
rather than the previous style. The use of the phrase “A/L” or “S/O”<br />
or “A/P” or “D/O” is not existent in any of the developed or modern<br />
societies around the world.<br />
As a country aspiring to reach developed nation status Malaysia<br />
must also drop the use of such unnecessary additional phrases etc<br />
which does not in any way improve the or benefit the situation – it<br />
not only looks but sounds odd!<br />
- The usage is single out <strong>Indian</strong>s/minority and leave (AL or AP) as<br />
middle name in international documentation that creates<br />
confusion when we enter foreign countries eg USA, Britain etc<br />
- Cultural and religious believe to use numerical addition which<br />
does not sync well with A/P or A/L.<br />
- In reality, the A/P, A/L is rarely used in public and only in<br />
formal documentation.<br />
Malaysians deserve to have their name they was they want<br />
without having to comply with abbreviations and oblique(s) (“/”)<br />
just for the sake of purported administrative convenience<br />

d. REVIEW Biro Tatanegara (BTN) - CONTENT<br />
Based on its vision and mission – it was to “formed to nurture the<br />
true spirit of Malaysian in a professional and ethical manner”.<br />
To reflect this intention, the Biro needs to uplift its current efforts to<br />
ensure a more wholesome effort is made to uplift the patriotism of<br />
all Malaysians towards Malaysia. All activities carried out by the Biro<br />
must ensure proportionate enrolment and participation by all the<br />
communities esp the minority communities including the <strong>Indian</strong><br />
Malaysian<br />
The process of unifying all Malaysians cannot be achieved merely<br />
through mediocre efforts involving primarily the Malays. Unification<br />
by its very intention means uniting all the people of the land –<br />
which necessarily includes the Chinese, the <strong>Indian</strong>s and all other<br />
races in the country. Based on the current effort, the programs are<br />
primarily centered around the Muslims and the Malay Community<br />
only.<br />
Building a “Developed and Happy Nation” cannot be successful if<br />
only one part of the society benefits. It is the aspiration of <strong>NIAT</strong> that<br />
all communities are involved in the projects organized by BTN. To<br />
this extent, the BTN must engage with the numerous NGOs and<br />
seek assistance and ideas to ensure that it can reach all, irrespective<br />
of race, language and economic standing.<br />
e. Civil Service needs to go Multi Lingual<br />
It is proposed that all documentation at the Civil Service and Public<br />
sector should include columns and explanations in Tamil and<br />
Mandarin.<br />

<strong>NIAT</strong> believes this would be a short term process as we are certain<br />
that in the next 20 years (or less), all Malaysians will be proficient in<br />
both English and Bahasa Malaysia with no doubt.<br />
However, there is no reason why we cannot include Tamil and<br />
Mandarin presently to ensure that all Malaysians irrespective of<br />
educational background have adequate knowledge and<br />
understanding of all public documentations and application / forms<br />
etc.<br />
f. Resurrection of the Rukun Tetangga<br />
The RUKUN Tetangga was implemented to foster togetherness in<br />
eradicating nuisance of petty crimes etc through a communal effort.<br />
This effort saw tremendous support from all walks of life especially<br />
from amongst the older residents in given locations.<br />
It enabled the residents within a specific location to come together<br />
and work as a team to fight against the negative elements – and<br />
given the opportunity, it can serve as a proper forum of solidarity<br />
and unity amongst all residents.<br />
The Government must resurrect this avenue to muster the old and<br />
the young to work together as one irrespective of race or religion.<br />
g. Removal of Race & Religion Column<br />
As an extension of the previous proposal, it is undesirable to have<br />
the columns “Race” and “Religion” / “Bangsa” and “Agama” in all<br />
formal documentation – except for statistics purposes including<br />
NRD, Police and Census and data collection.<br />
The need to verify the race and religion of a person should be<br />
limited to areas that need such information.<br />

<strong>For</strong> example, for the purposes of making a complaint at a local<br />
municipality, <strong>NIAT</strong> does not see the reason why RACE and RELIGION<br />
is required.<br />
Does it in any way imply that if the person complaining is of a<br />
certain Race or Religion, his or her complain may or may not be<br />
acted upon. If the answer is “NO” (as it should be) – then the need<br />
for such a column cannot be justified.<br />
Therefore the inclusion of such columns and all public documents or<br />
inquiries including government job inquiries and scholarship<br />
applications must be removed immediately.<br />
This will give more credibility and reliability on all Census<br />
immediately thereafter.<br />
h. Repeal Act 114A<br />
Section 114A is the second of two amendments made to Malaysia’s<br />
Evidence Act 1950.<br />
Law Minister Nazri Aziz tabled the second amendment, formally<br />
known as Evidence (Amendment) (No2) Act 2012, in Dewan Rakyat<br />
on 18 April. James Dawos Mamit supported the motion, and Section<br />
114A was passed after the second and third reading. On 9 May,<br />
Dewan Negara passed the amendment.<br />
The newly-introduced provision, which came into force on July 31<br />
2012, also goes against a fundamental principle of law that a person<br />
is considered innocent until proven guilty. To the contrary this<br />
provision reverses the situation.<br />
Section 114A is problematic for a number of reasons:<br />

i) “Section 114A violates the human rights principles of freedom<br />
of expression as enshrined in Article 19 of both the Universal<br />

ii) It disproportionately burdens the average Internet user who<br />
may be accused of publishing seditious or defamatory content<br />
(whether the accusation is substantiated or otherwise).<br />
iii) It makes Internet intermediaries – parties that provide online<br />
community forums, blogging and hosting services liable for the<br />
content that is published through their services.<br />
iv) It allows hackers and cyber criminals to be free by making the<br />
person whose account/computer is hacked liable for any<br />
content/data which might have changed.<br />
v) it is a bad law passed in haste and does not take into account<br />
public interest and participation.<br />
i. Minority Protection Act<br />
The term "minority" is still ambiguously defined in specialized<br />
literature as well as in the political debate.<br />
According to Capotorti's definition for the UN (Pan/Pfeil, 2003, p.<br />
XV) "minority" means a community that is “Compactly or<br />
dispersedly settled on the territory of a state; which is smaller in<br />
number than the rest of the population of a state; whose<br />
members are citizens of that state; which have ethnic, linguistic<br />
or cultural features different from those of the rest of the<br />
majority population; Whose members are guided by the will to<br />
safeguard these features”.<br />
In Malaysia Article 153 of the Malaysian Constitution reads<br />

"Provision should be made in the Constitution for the safeguarding<br />
of the special position of the Malays and the legitimate interests of<br />
the other Communities”.<br />
While the scope of Article 153 is limited by Article 136, which<br />
requires that civil servants be treated impartially regardless of race.<br />
Keeping that constitutional mention in mind ; <strong>NIAT</strong> on behalf of the<br />
minorities seek a clear and well spelt out “Minority Protection Act”<br />
like many other countries like Australia, United Kingdom to ensure<br />
their future and to build their confidence and erase the anxiety of<br />
the minority against the majority ruling. The laws must specifically<br />
spell out affirmative action on:<br />
Educational opportunities<br />
Economic representation and help<br />
Public Service Opportunities<br />
Social Representation<br />
Political, & Religious Rights<br />
In Conclusion…<br />
<strong>NIAT</strong> recognized many proposals, memorandums, conferences,<br />
consensus and rhetorical plans have come and gone without traces.<br />
We recognize the issue right from the bottom and we propose the<br />
solutions right from the top.<br />
Without doubt the <strong>Indian</strong> Malaysians should be and are entitled to<br />
all benefits enshrined in our Federal Constitution.<br />
It is now the political will of the post <strong>GE13</strong> Government to make<br />
good on promises and the promises must be based on the needs.<br />

the only fair start in addressing <strong>Indian</strong> Malaysian issue for long term<br />
sustainability.<br />

all of us are answerable to Allah SWT in the hereafter on the Day of<br />
Judgment. Any injustice to Non-Muslims under a majority Muslim<br />
dominated rule is not permitted as per Holy Al-Quran and Hadith.<br />
