INDIAN MALAYSIANS’ CALLS FOR GE13 - UNDO the HISTORY and REDO the PLAN
Equality and Justice for all in ISLAMIC
Administration
Al-Quran 49:13 (Surah Al-Hujurat)
“O men! Behold, We have created you all out of a male and a
female, and have made you into nations and tribes, so that
you might come to know one another. Verily, the noblest of
you in the sight of God is the one who is most deeply
conscious of Him. Behold, God is all-knowing, all-aware.”
49:13.
Injustice Forbidden in Islam
www.myniat.com
Narrated Abu-Dhar (RA): The Prophet (PBUH)
said that Allah SWT said: O My slaves! I have
forbidden injustice for Myself, so it is forbidden
amongst you. So, do not be unjust to each
other......
(This Hadith is sound and reported by Muslim)
** Injustice is one of the most bad qualities most widely
practised among men since the dawn of history. Allah SWT
made it HARAM (unacceptable) and whoever practises
injustice cannot be a good Muslim. Allah SWT Who is All-
Judicious and All-Just wants us all, to practise every justice
among ourselves.
NIAT’s primary objective is to send a crystal clear message to the Barisan
Nasional (BN) and Pakatan Rakyat (PR) leadership that Indian Malaysians
should not be taken for granted.
“GRANTS FOR TEMPLES AND PIECE MEAL GOODIES FOR
www.myniat.com
In order to assist the Barisan Nasional /Pakatan Rakyat leadership, this
document has been painstakingly compiled by NIAT and a host of well
wishes. Syabas to my team consisting of Mr. ARUN DORASAMY and several
them.
“MISSION IMPOSSIBLE” IS POSSIBLE IF LEADERS ARE SINCERE
document with an open mind and come together for a ‘BRAINSTORMING
SESSION’. Be truthful to the people who voted all of you into either
INDIAN MALAYSIANS’ CALLS FOR GE13 - UNDO the HISTORY and REDO the PLAN
A Note of
Gratitude &
Hope
First of all, on behalf of NIAT
and the wonderful team that
came together to put up this paper, I would like to extend my
gratitude to the numerous NGOs, MPs, DUNs not forgetting the
courageous general public for their invaluable input in drafting this
“Indian MALAYSIAN’s Call for GE13”, a substantial 5 year plan in
line with our Political Landscape - GE13.
In the past, the under-representation of the Indian minority
interests in the economic planning and the poor consultative
process has left the minorities’ concerns unattended – something
that has gone on for many decades. Most of the solutions in the
past were political and not need based solutions.
NIAT with the help of many stakeholders have attempted to
formulate requests and demands to be adapted as part of the
election manifesto that reflects the real need(s) of Indian
Malaysians, irrespective of their religious or other inclination.
The time has come for all Political Parties to recognize the
importance of Indian Malaysian minority’s votes and needs. This
paper seeks to identify and clarify those needs without fear or
favour.
www.myniat.com
NIAT is grateful to our Political Leaders, who gave many inputs in
drafting this document by way of recommendations, information
and suggestions thereby facilitating this “Indian Malaysians’ Call for
GE13 - Undo the History and Redo the Future”. We understand the
dynamics of the political landscape towards GE13 and we want to
put forward a comprehensive paper describing the Indian
Malaysians’ needs and aspiration to both BARISAN and PAKATAN’s
Leadership. We ask the leaders to come forward to endorse and
make their promises based on Indian Malaysian needs with a clear
view of their future direction. NIAT has also engaged with various
individuals, groups and experts namely academicians, NGOs,
students, youth groups, housewives, single mothers, micro business
persons, civil servants, politicians, even school dropouts in
formulating this paper.
The success of this effort depends upon the implementation of
these recommendations by respective Political Parties whose
representatives are elected at the GE13. NIAT and other civil
societies will back up and participate in the GE13 to promote
candidates / parties who are willing to grant our wish list.
Gayathiri Prayers : Oh God! Thou art the Giver of Life,
Remover of pain and sorrow,
The Bestower of happiness,
Oh! Creator of the Universe,
May we receive thy supreme sin-destroying light,
May Thou guide our intellect in the right direction
INDIAN MALAYSIANS’ CALLS FOR GE13 - UNDO the HISTORY and REDO the PLAN
The Indian Malaysian Story
The Nation must be reminded of this fact : That NO one race has
DIED more than the Indian Malaysian in this country for making
“SWARNABOOMI” a reality!
A whopping 1.2 million Indian Malaysians died between the years of
1850 to 1950. This is an average of approximately 33 persons per
day. (The Malaysian Indian Dilemma Pg 11)
Impossible! Some may deny; others may question : Is that true?
Some question the veracity or some even try to hide the truth and
spin it for their self engineered interest.
However, the fact of the matter is that this is the truth and a fact.
They died because of a host of calamities including snake bites,
malaria, tropical diseases, mal-nutrition, exhaustion and slave like
conditions to transform those thick Malayan virgin forests into the
green (paradise) plantations that we have today.
The same sacrifice happened one more time in modern times when
another a million or more Indian Malaysians were displaced from
estates nationwide since the 1980s. Look no further then the
nation’s capital that swallowed many estates. These Indian
Malaysians are still looking for justice for their displacement. These
“shawarnaboomi refugees” are squartering all over for survival -
seeking for just treatment. Many do not have special skills to do
anything other than plantation works, they have no place to stay
other then basic estate housings, they have no saving other than
their children and they have no hope for the future: these
www.myniat.com
neglected Indian Malaysians were the new phenomenon of urban
poverty and become the victim of unsustainable urbanization. The
social crisis taking place includes crime, high dropout rates,
rebellious mind. Illiterate, behaviors, gangsterism, alcoholism,
drastic drop in family values and morals.
We can undo the history and learn from the mistake by
acknowledging the true condition and accepting the proposed
solution in a holistic and honest manner.
NIAT and its affiliates are very happy to have been able to reach this
juncture to play a civil society’s role in assisting the community
through sharing our findings for fast, permanent and effective
solutions.
INDIAN MALAYSIANS’ CALLS FOR GE13 - UNDO the HISTORY and REDO the PLAN
NO: 1 – Department -DEMA
Formation of a New Department:
Jabatan Hal-Ehwal, Pembangunan & Penyelidikan
Kaum Minority Malaysia – DEMA (Department of
Minority Affair – Development – Research)
A. Rationale
We understand as a God fearing Malaysian, we want no one to be
left behind from the current development and all issues must be
solved effectively and quickly so that the adverse effect of socioeconomic
imbalance of Indian Malaysians can be eradicated.
Currently, political bodies are entrusted with the responsibilities
and they are playing a major role in gauging, drafting, formulating,
planning, executing, implementing and monitoring policies related
to their respective group of representation like MIC for the Indians
and such. However, all the policies, execution and implementation
have been political and NOT need based decisions ; as the parties
are a political outfit and not a government department.
www.myniat.com
Thus, there are issues that have grown amounting to a crisis and
now affect all walks of people. For example, “Stateless Issue”,
alcoholism, gangsterism, school dropouts, joblessness, single
motherhood, poverty and etc. each of which will be identified and
solutions are recommended below.
It should be noted here that even the Prime Minister understands
that the need for an affirmative action thru specific machinery (if
not earlier) and initiated the Special Implementation Task Force
(STIF): SEED as a baby step. Unfortunately, the SITF/SEED has very
limited year to date success in terms of reach, vision, planning, manpower
and results in holistic and permanent manner because they
are an ad-hoc setup. Quick fix methods adopted will not solve the
Indian Malaysians who have been marginalized for the past 55
years.
Based on extensive studies and meetings that has been instituted by
NIAT for half a year, it is our collective and collateral understanding
that the Indian Malaysian community need a permanent built-in
government structure to ensure an effective and collective
approach to deal directly with issues in continuous and
converging pattern.
The need to do so is to blatantly exercise the rights enshrined in
Malaysian Constitution under Article: 153(1) i.e. “…legitimate
interest of other communities…“. It was on this promise that we
obtained our independence.
Page8

B. Timeline/ Dateline
It is proposed that the aspiring Government of post GE13 ADAPT
this recommendation urgently and include in the election
manifesto.
C. Proposed Methodology
A special committee which includes NIAT should be setup to
formulate and institute the Department under JPM.
The Department is to be established and parked under the Prime
Minister’s Ministry while satellite offices to be established in all the
state capitals to start with (within the first 5 years) before it goes to
all districts particularly in the states of Johor, Perak, Penang, Negeri
Sembilan, Selangor, Kedah, Malacca and Pahang.
Funding to be allocated from annual budget by the Finance
Minister; the employees are to be hired directly by the Department
in consultation with the Board of Advisors (the composition of the
Board is stipulated in the following page). In view of this, we
propose creation of a Working Committee to setup this Department
and to formulate the detailed task and KPI for this department.
D. Conclusion:
Indian Malaysians request the post GE13 Government not to merely
consider but to implement these suggestions for the betterment of
all minorities. This request is not a political request but to
understand that this is a true reflection of an existing need of the
marginalized communities. This caters for a permanent
institutionalized solution rather than throwing quick fixes for issues
that need greater understanding and complex maneuvering
pertaining to the minorities, especially the Indian Malaysians. A
systematic approach to issues and needs will benefit the
government greatly rather than having too many ad-hoc
committees or having politic parties to dispense task without
expertise or infrastructure. Political bodies are meant for political
work and aspiration not for policy-program-welfare deliveries.
It is important to setup this department as soon as possible. NIAT
will render our full support and expertise in making sure the
department is functional and delivers the result to end the
minorities’ issues.
INDIAN MALAYSIANS’ CALLS FOR GE13 - UNDO the HISTORY and REDO the PLAN
NO: 2 - Education
2.1 Abolish “PERALIHAN” classes
(“Remove Classes”) Effective 1 st January 2014
A. Rationale
While very few may have been indoctrinated to believe otherwise,
“Remove” condition or policy has always been perceived by the
majority of Chinese Malaysians and Indian Malaysians as a
“punishment or deterrence“ to force parents / students to opt for
National Schools.
This condition of a remove class has been introduced and practiced
despite the fact that Tamil Schools in the country have almost 200
years of history.
The 1 st Tamil School was established at Penang Free School
by Rev Hutching in 1816;
www.myniat.com
In 1850 – Tamil Anglo School was established in Malacca;
In 1896 the Tamil Anglo School was set up in Kuala Lumpur
by Rev Abraham;
The legacy continued till the Colonial British Government in
the year 1912 passed a Labour Code to allow Tamil Schools
to be built in estates.
(Professor Dr R Thadayuthabani –UM Indian Studies – The origin of Tamil Schools)
Unfortunately the Ministry of Education (MOE) may not see it from
that vantage point. Education Blue Print Sept 2012 itself perceive
vernacular schools as UNITY hindrance :
1. Tan Sri Wan – Former DG of MOE agrees that the
fundamental perception of MOE must CHANGE before an
COMPLIMENTARY Education System under a single vision
can be achieved without sacrificing any system of schools.
Synchronizing the English and Bahasa Malaysia between
Vernacular Schools and SK school is definitely a good way
forward.
(Adapted GBM from meeting at UiTM; Date: Oct 2 nd 2012)
2. 1974 MIC Indian Blueprint, it had been clearly highlighted
that “remove” classes were ineffective and it fuels the
60% dropouts among Indian Malaysian students – yet the
cry for educational justice fell on deaf ears.
3. Action Plan for Future of Tamil schools in Malaysian –
JPM Prof Dr Rajendran: echoed the idea to remove the
“remove” class as part of his future recommendation to
reform Tamil Schools.
4. Mr. Doraisamy of the Headmaster’s Association lauded
the idea recently in July 2012, The Star: to remove the
Page12

INDIAN MALAYSIANS’ CALLS FOR GE13 - UNDO the HISTORY and REDO the PLAN
“Remove” system because of is ineffectiveness and
irrelevancy in modern Malaysian Society.
5. The Malaysian Hindu Sangam submitted the same
recommendation i.e. to scrap the “remove” system in its
Rancangan Malaysia Ke-10 recommendations submitted in
February, 2012
6. Abolishing “remove class” 2017 -EBP – is too long and too
late. The Language; Bahasa Malaysia and English in
Vernacular School must be synchronized to the level of SK
Schools. Education Blue Print – Sept 2012
The time has now come to repeal the outdated policy or condition
that essentially wastes a whole year of a child’s education. Based on
the statistics available, it is clear that Tamils school population
currently in 108,000 students and the number continuous to grow
as more parents opt for Tamil schools for various reasons. MOE
must treat Vernacular Schools – in particular the Tamil school as
part of the National School Systems that compliments and delivers
the National Education Vision.
Additional Points
Language Proficiency Argument: A student that has gotten
undesirable grades in Bahasa Melayu, example an “E” grade has to
go through “remove” classes if he/she is from the Tamil or Chinese
Schools. A student with the same grade (Grade E) from the National
school does not need to go through a similar requirement. It is
imperative that the “E Grade” reflect the same language proficiency
standing irrespective of the type of school of a student in that
www.myniat.com
particular subject; yet the treatment of the students appears
inconsistent – this inconsistency needs to be addressed.
Medium of Language: Tamil School students are already
learning most of the subjects in English or Malay. This is with the
exception of the Tamil Language and Moral studies which are
conducted in Tamil Language. Therefore it is undisputed that the
students are used to non Tamil medium of instructions like the SK
Students.
Adaptation to Non Indian Students: We live in a plural
society. NIAT does not see any need or justification for a special
effort with a year’s sacrifice to or for adaptation – in fact it creates a
further alienation not assimilation.
The “Remove” class stereotyping the students as under
achievers and group all of them as one big group of under achievers.
Peer pressure and inferior complex mindset sets in and does not let
them change any part of this progress or learning and teaching. As a
matter of fact in RMK 10 recommendations: “Remove Class” was
called as “Drop out Factory” by Malaysia Hindu Sangam Youth
Team.
“Remove” System is not working as idealistically
imagined or envisaged. In reality these students are deprived of
the special attention in many schools. At SMK Puchong, we
personally interviewed the students and their grouses are the
same. It is a “waste of time “.
Page13

INDIAN MALAYSIANS’ CALLS FOR GE13 - UNDO the HISTORY and REDO the PLAN
B. Timeline/ Dateline
It is proposed that the incoming government look into this proposal
as urgent and work on the details immediately. The Directive for the
abolishment of the remove classes must be announced and be
effective within 120 days :- Taking effect 2014.
C. Proposed Methodology
Directive issued by the Cabinet to the relevant Ministry to take
effect 2014
D. Conclusion
This proposal is in line with the NIAT’s believe that the objective of
education and schools is NOT to create a division in education or
society BUT to educate the next generation of Malaysian as
expounded in the “Falsafah Pendidikan Negara” (a National
Policy).
2.2 Abolish “SK” only requirement for all
“Asrama” and “Asrama Penuh” Schools
A. Rationale
According to research conducted, it has become apparent that the
requirement for entry into “Sekolah Berasrama Penuh” / Boarding
School after UPSR is that the student must be “ Sekolah kebangsaan
student”
www.myniat.com
Adapted from moe.gov.my
http://www.moe.gov.my/?id=213
SYARAT PEMILIHAN MURID TINGKATAN SATU (1) SBP
2. Murid Sekolah Kebangsaan (SK)
3. Memperolehi 5A atau 4A 1B dalam Ujian Penilaian Sekolah
Rendah (UPSR) dengan mata pelajaran Matematik dan
Sains memperoleh gred A.
4. Aktif dalam kokurikulum.
The “SK” only requirement for entry or selection for Government
Boarding Schools clearly denies the rights of more than 57% of
primary schools Indian Malaysian students - those from the SJKT
schools cannot even dream of entering or applying fully boarded
government schools, even if they procure the illusive “7 As”!
To date we have about 60 SBP (Sekolah Berasrama Penuh) in
Malaysia. This requirement is seconding SJK Schools in the national
agenda of educating tomorrows’ Malaysian. Yet it is in complete
breach of the “Falsafah Pendidikan Negara” which preaches
solidarity and equality in education for all.
It is sad to note that many Malaysians; including politicians do not
know the discriminatory practices of MOE (Ministry of Education)!
We urge the post GE 13 Government to immediately drop the
requirement and work towards making- up for the racial
imbalance in those schools.
It is the humble plea of NIAT that the one area in which politics
ought not to operate is in education - education is the fundamental
right of every child irrespective of any other consideration and in
line with this, the requirement of “SK” only for consideration for
Government Boarding Schools must be eliminated immediately.
www.myniat.com
2.3 Tamil Schools to be “Sekolah Bantuan Penuh”
/ Fully Aided
A. Rationale
Fact:
Total Tamil Schools in Malaysia – 523 with 102577 students
Total Fully Aided Tamil Schools - 148 with 25000 students
Table 1 : Number of Tamil Schools and Enrolment
Adapted from MyNadi Report
http://mynadi.wordpress.com/tamil-schools/
It is amazing to know only 29% (152)-Oct 2011 of Tamil Schools in
Malaysia are “Fully Aided Schools” (Sekolah Bantuan Penuh).
These 152 Schools are educating only about 1/4 of Tamil School
Students in Malaysia (average) : i.e. 25000 out of 102K Tamil School
students nationwide(2012)
(pg 299 Malaysian Indian dilemma, Janakey Raman Manikam).
It might be surprising to many but it is no surprise to many of us in
the Indian Malaysian society. A staggering number of Tamil
Schools i.e.72% of Tamils Schools in Malaysia are only partially
funded (Bantuan Modal and Separuh Modal). These schools
educate more than 50% of the Tamil School Students. This is
unacceptable by any standards. This injustice cannot be accepted
nor can any explanation be accepted, howsoever!
Page15

INDIAN MALAYSIANS’ CALLS FOR GE13 - UNDO the HISTORY and REDO the PLAN
Almost 85000 students are educated in sub-standard conditions or
in schools that have sub-standard facilities and amenities – this
includes the lack of trained teachers. While this is not a acceptable
situation, NIAT takes this opportunity to thank Teachers, Parents
and NGOs for playing a supportive and progressive role in
overcoming many of the shortfalls and steadily accept all steady
increase in the student intake.
Under the 9 th Malaysia Plan, the Government has only allocated
1.3% (RM62.88Mil) of the total allocation of RM4.8 Bil for Tamil
Schools ( Adapted from 9 th Malaysian Plan) . We urge the GE 13 Government
to explicitly agree to revise all Tamil schools as fully aided school by
the year 2015. For this purpose, the new Government must
immediately work on the directive to this extent.
The effort of Action Plan for Future of Tamil Schools in Malaysia by
JPM under Prof Dr Rajendran is a great move by Prime Minister and
deserves applause; NIAT Projects the infrastructure upgrades,
school relocation and new school buildings with full facilities: Would
cost at least RM500Mil.
B. Timeline/ Dateline
It is proposed that the incoming government look into this proposal
as urgent and work on the details immediately. The Directive for the
conversion of all Tamil schools into Fully Aided Schools must be
announced and the steps towards such an implementation must be
announced and be effective within 120 days.
C. Proposed Methodology
www.myniat.com
It is undisputed that as it is currently in order to be classified or
accepted as a Fully Aided School the School must self own the land
etc. The hindrance to this is the fact that currently, the Education
Department plays a non effective role in land negotiations or
purchasing of the land.
To make this proposal effective, this must be reversed in the
interest of ensuring that all such schools become fully aided. For
this to be possible the ineffective Education Act of 1995 needs to be
repealed or amended to make way for MOE to convert all nontitled
lands. Currently MOE does not get involved in any land
negotiation of the schools. It is left in the hands of the school
administration, PTA and NGO. That is why politics and unnecessary
considerations make it almost impossible that these schools convert
to “fully aided” schools. This position is neither right nor
appropriate as the Government has a better leverage / power to
acquire and resolve land issues like acquisition, purchase or long
term lease.
D. Conclusion
NIAT implores that the MOE and the Government must play a
more effective role to convert the schools into fully aided schools
to ensure that the basic and fundamental right of children is given
due recognition as per the “Falsafah Pendidikan Negara”. Looking
forward to seeing a more progressive schooling system unscathed
by politics.
2.4 MRSM (Maktab Rendah Malaysia) modeled –
Full Boarding Schools for Indian Malaysian
and other Minorities who perform
exceptionally well at the UPSR
A. Rationale
In 2011 out of 16,800 UPSR Tamil School Students, 7% of them
successfully procured 7As (1191): These 1191 Indian Malaysian high
achieving students were merely not absorbed to SBP Schools. These
high achievers are not given due recognition or opportunity to be
educated through a boarding system, unlike Sekolah Kebangsaan
(SK) students.
Therefore besides the request to abolish the “only SK” requirement
for Boarding Schools as illustrated above under 2.2 above, we
request that a new Boarding school modeled after the MRSM to be
set up.
Prime Minister has given cabinet green light on 22 nd Feb 2012 for
MRSM Modeled School with majority Indian Malaysian students
from Tamil Schools. The directive still has not been materialized
despite availability of infrastructure from newly vacated MARA-
MRSM facilities that can be quickly renovated for this purpose and
NIAT and the entire Indian Malaysians are waiting and expecting an
announcement soon rather than later.
B. Timeline/ Dateline
It is proposed that the incoming government look into this proposal
as urgent and work on the details immediately. The Directive for the
www.myniat.com
establishment of this type of Boarding school exclusively for the
Indian Malaysian High Achieving Students must be announced and
be effective within 120 days if not before.
C. Proposed Methodology
Through a Directive issued by the Cabinet and the relevant Ministry.
This school shall be fully funded by MOE with full boarding, sports
facilities and state of art infrastructure. 70% of the intake of the
students are to be from Jenis Kebangsaan Tamil Schools and 15%
Indian Malaysian from Sekolah Kebangsaan while the balance 15%
of the intake shall be open to others similarly qualified.
The syllabus: Cambridge Syllabus and English Medium – Modeled
after MRSM, while the schools should be located in any of the
following states like: Selangor, Negeri Sembilan, Perak, Johor or
Penang.
It is not an unreasonable request as currently there are at least 3
MSRM in the country conducting classes completely based on the
Cambridge syllabus.
The main objectives of this proposal are:
To give special attention to those with outstanding merit with
challenged socio-economic conditions.
To nurture a new “cream of the crop” students that can help
the future generation with outstanding merit, leaderships and
positive attitude for Indian Transformation Program - ITP
Page17

INDIAN MALAYSIANS’ CALLS FOR GE13 - UNDO the HISTORY and REDO the PLAN
D. Conclusion
This project is long overdue (since 197 – MIC Blueprint) as the
outstanding students from Tamil schools do not get the attention
they need to complete their SPM with confidence. This is a
proactive measure to reduce dropouts in Menengah Schools by
Indian Malaysian students and to boost more qualified students to
be able to realize their full potential in line with the Falsafah
Pendidikan Negara.
2.5 Guarantee minimum 8% intake of Indian
Malaysian students in all boarding /
“Asrama” Schools
A. Rationale
There are 2 types of Non Religious Boarding Schools:
Science/Full Boarding Schools : Sekolah Menengah Sains
Technical/Vocational Schools : Sekolah Menengah Teknik
This request been pending since 1974 – Blue Book: pg 36 : by Tan
Sri Manikavasagam to Late Prime Minister Tun Razak to allocate
www.myniat.com
10% of the Science School and Boarding intakes for Indian
Malaysian students. The same request was echoed by MHS through
RMK10-Proposal Feb 2009 : Unfortunately, the request been denied
or forgotten or systematically set aside. We have about 60
boarding schools nationwide but the Indian Malaysian
representation in those schools is almost negligible. MOE must be
proactive in bridging the gap of racial imbalance to seed unity
through justified and balanced educational opportunities.
Unfortunately, the intake is now predominantly dominated by
Bumiputra students since 90% of the SK are Bumiputeras. It is
NIAT’s contention that the composition must at the least reflect the
racial population composition in Malaysia. MOE also must ensure
the non-bumi students facilitated with food and other elements
that is important for Indian Malaysian or Non Bumi to ensure the
eco-system is welcoming to all to continue education smoothly.
B. Timeline/ Dateline
The Directive for the increase in Indian Malaysian Students in
Boarding Schools to at least 8% of the intake must be announced
and be effective immediately
C. Proposed Methodology
The GE13 Government to immediately direct MOE to all the SBP
schools to boost the intake and work with PIBG and NGOs to
make sure enough applications are obtained to have at least 8%
of the intake allocated for Indian Malaysian students from SJK(T)
& SK Schools
Page18

INDIAN MALAYSIANS’ CALLS FOR GE13 - UNDO the HISTORY and REDO the PLAN
D. Conclusion
It is the humble plea of NIAT that as education is the fundamental
right of every child no other consideration is relevant other than
merit, just affirmative action and therefore the requirement of “SK”
for Government Boarding Schools must be eliminated immediately
and opportunities must be given to all on just and fair manner.
NO: 3
Alcoholism
It is the contention of NIAT that the following steps must be taken
immediately:
All types of Alcohol must be BANNED from Convenience Shops
Impose a compulsory Liquor License Requirement to all Outlets
with alcohol sales activities regardless of whether it comes in
the form of bottle or drafts or other form.
ALCOHOL Rehabilitation & Research Center with Hostel
facilities to be established
A. Rationale
“Alcohol” has been the single biggest issue involving youth,
especially Indian Malaysian Youths.
www.myniat.com
Some of the related issues are underage drinking (below 21 years
old), vandalism, violence, driving/riding under influence, addiction,
absenteeism at schools, health issues, loitering at public
parks/places (“lepak”) and family problems.
Police record favors that the violent crime does have alcohol as the
common denominator.
Based on the research that has been conducted the public demands
that alcohol be removed from all convenience shops or require
them to procure a “retail liquor license” with current Municipality
Laws with existing requirement.
MHS Youth did get the consensus from the MIC Youth and PAS
Youth on this matter as early as 2010. MIC Youth is revisiting the
issue currently due to its seriousness.
There were studies done with regards to this issue including the
“ALiM-Alkohol Law in Malaysia” Project by Malaysia Hindu
Sangam, in which 12 amendments to our existing laws had been
proposed to protect the youngsters while simultaneously ensuring
that the freedom of alcohol to adults is not infringed. I must stress
no religion condone alcoholism or alcohol trades.
Besides banning of Alcohol sale at Convenience stores, the other
pressing issue is the lack of treatment for “alcoholism” and Indian
Malaysian do have DNA prone to addiction to alcohol naturally
suggest some studies.
Currently in Malaysia, we have a growing number of adults and
youngsters that are addicted to alcohol and it is common
Page19

INDIAN MALAYSIANS’ CALLS FOR GE13 - UNDO the HISTORY and REDO the PLAN
knowledge that the problem needs to be addressed effectively
through the proper implementation of corrective mechanisms. In
fact, Malaysia is however amongst the top 5 highest alcohol
consumers per kapita in the world.
Yet, while many speaks of the ills of alcoholism and the social
problems that are and have been in existence, to date there has
been no effective remedy in place.
B. Timeline/ Dateline
The Executive Directive by Minister of Domestic Trade and
Consumer Affairs
An Announcement by Ministry of Health to identify spot and start
Alcohol Rehabilitation Centre Project : Preferably in Selangor –
Perak – Penang – Johor-Negeri Sembilan
C. Proposed Methodology
a. All alcohol sale at convenience shops must be banned
immediately.
Students and underage children are to be completely prohibited
from purchasing any alcoholic items.
Laws and regulations need to be in place and monitored and
enforced effectively, through local municipalities and police.
Mandatory jail sentencing must be put in place as a deterrent.
b. Alcohol Rehabilitation & Research Centers
Suitable rehabilitation centers for alcoholism treatment need to
be established immediately to remedy the situation.
www.myniat.com
Akin to the Drug rehabilitation centers, these centers need to
be empowered to work with NGOs to educate and eradicate
this problem. This may be established under the Ministry of
Heath.
D. Conclusion
The problems illustrated are ongoing and needs urgent attention.
The more the government closes its eye to the issue and the
problem is swept under the carpet, the problem will surmount and
it will be more difficult to tackle. The Government is urged to attend
to this problem urgently in all states.
NO: 4
Zero “Indian Malaysian Statelessness : IC / BC by
1 st January 2014
A. Rationale
The “statelessness” issue has been a sore thumb for the Indian
Malaysian community since Independence – a good 55 years
since!
Page20

INDIAN MALAYSIANS’ CALLS FOR GE13 - UNDO the HISTORY and REDO the PLAN
The problem has grown to be a crisis because of sheer negligence
on the part of authorities with no clear direction, run-around
attitude of authorities, unclear policies and indefinite timeline on
application. The use of “budi bicara” creates many small napoleonsproduct
of BTN, bribery and alibi for giving long run around. How do
you justify an application still in process for Mr. Govindaraju
Muthuvelu, recently been awarded citizenship after a whopping 25
years wait?
Malaysia must emulate naturalization process and procedure in
other countries using point system or other objective requirements.
Immigration in Malaysia needs a total reform to accommodate
global migration and social changes.
The attitude/mindset of the authorities appears to be:
“Review of the applications to find a reason to dis-approve“
rather than “Review the documents and seek reasons to
approve”.
One can deny or might give excuses, yet the fact of the matter is
that this is a real problem and the problem needs an immediate
solution that is both permanent and systematic in approach. NIAT
Hopes the request of late Tun Sambathan as part of independence
social contract need not to be reminded to all once again,
CITIZENSHIP is God given right to all. We have to make it happen.
The National Registration Department (NRD), JPM, Political Parties
& NGOs jointly conducted MyDaftar campaign to assist those with
NRIC/BC Issues is applause able. However, one time “Panadol” one
time “exclusion” or one time solution is not desirable for any issue.
www.myniat.com
A permanent and executable action plan must be drawn: It is
important to acknowledge many of this issues are revolving not only
on the government’s regulations and implementations
incompetence but it is revolving around discrimination, conversion
issues, polygamy, orphan, religion, and social issues.
The MyDaftar drive garnered 9568 returned applications and almost
6000 were granted citizenships till August 2012. Well done.
This was a great achievement since Independence by the
government: yet it was a stark eye opener that so many people
born and living in Malaysia have no proper identification! And to
think that many more who have yet to come forward!
Further, accordingly to Dato Siva, the Coordinator of the Special
Implementation Task Force (SITF) -, he received a letter from NRD
stipulating that around 46000 Indian Malaysians who already have
Birth Certificates (BC) have yet to apply for their NRIC-Identity card.
NIAT finds this both alarming and frustrating! What have the
authorities been doing about it, knowing this fact? Are we waiting
for another HINDRAF to highlight the issue: We have to act before
“ nasi jadi bubur ” I urge an immediate action to be taken by NRD
or an action plan must be drawn by SITF.
B. Timeline / Dateline
We therefore propose the following measures immediately. The
Directive to be issued within 120 days, with no delay. The
Page21

INDIAN MALAYSIANS’ CALLS FOR GE13 - UNDO the HISTORY and REDO the PLAN
infrastructure and methodology must be in place. The one very
clear directive to the National Registration Department is to honour
the social contract of awarding all Indian Malaysians citizenship with
minimum fuss and protocols.
C. Proposed Methodology
NIAT propose an IC/BC Committee to be setup to draw a action plan
and coordination involves NRD, KDN, Immigration, JPM and NGOs;
To recommend measure to avoid future problem, one time solution
to dissolve the issue and to identify all the cause of the problem.
All Indian Malaysians satisfying the following criteria must be issued
citizenships and all relevant documentations on the following
conditions:
Either parent is Malaysia with DNA test, then the Child /
Children must be given citizen regardless of their other papers :
Children housed in orphanages and/or homes must be awarded
citizenship unless it can be shown that they are not of
Malaysian Origin.
Schools, Hospitals, Police, Homes and NGO’s may facilitate the
identification of all persons facing such problem. Concession
can be given to personal history foot print, lifestyle and
language accent.
Relax the rules on national language and religion requirements:
Brochures, advertisements in all local newspapers of all
languages must provide detailed description of how one who
has no documents to come forward to procure the IC / BC;
www.myniat.com
All NRD staff must be appropriately trained to have the aptitude
(in language and mannerism) and helping nature to assist all to
obtain the IC / BC
A System of point and objective must be drawn to avoid “budi
bicara” of officers in awarding citizenships: Australia, Singapore,
Britain, French, USA all follows the system.
D. Conclusion
The awarding of citizenship to all Indian Malaysian born and living in
Malaysia would be the single most important historic event for all
Indian Malaysians in Malaysia, many of who have been sidelined or
casted aside by their own kin, other Malaysians – it will be the true
Merdeka for all! It is rebelling to see a person from Indonesia-
Muslim becoming Citizen-Bumiputera so fast then an Indian
Malaysian that was born and bred here. Even though the fact is that
the first wave of Indians came to Malaya to conquer (Palava),
second was to trade and religious (Islam) propagation reasons and
finally to work in British plantations.
Stemming from the above, all students under the age up to 18
years old should not and cannot be deprived of the right to
education merely due to lack of documentation.
Besides education, the more sensitive topic which has been
unreasonably politicized is the choice of religion – which must be
left to the children to choose / decide at the age of 18 and never
earlier, if there is a doubt.
Page22

INDIAN MALAYSIANS’ CALLS FOR GE13 - UNDO the HISTORY and REDO the PLAN
A concerted effort to refrain from any act or effort of child
conversion must be enacted. Child conversion must be illegalized
within the period of 5 years in government as per cabinet consensus
during tenure of Prime Minster Pak Lah – May 8 th 2009 “cabinet
has come up with a morally correct decision, that the
children of such marriage breakups with split religious
affiliation would be brought up in the religion of the parents
prior to the marriage breakup”
Statelessness must be a non –issue in the true spirit of Malaysia and
Representation of Indian Malaysians in the New
GE13 Government (s) / Cabinet Post GE13
A. Rationale
The Indian Malaysian had been sidelined and marginalized
systematically for more than 15 decades by the English colonial
masters, the Estate middle managements and then later by our own
Government after Independence.
This tragedy is a known fact and this has been acknowledged by
many leaders including the former MIC President, the late Tan Sri
Manikavasagam, Former Prime Minister Tun Dr. Mahathir
Mohamad and Tun Abdullah Ahmad Badawi. One of the main
reasons of this situation is because of the non-effective
representation of the Indian Community in the Government, in the
www.myniat.com
true “representative manner” and failure of attacking the issue with
a true care and share attitude that we preach about.
B. Timeline / Dateline
We therefore propose the following measures immediately. The
several appointments must be made when the new Government
and cabinet is formed; it is imperative that this must be within the
120 days, with no delay.
C. Proposed Methodology
One (1) Punjabi and one (1) Lady
All Ministers & Deputy Ministers must declare to PUBLIC their;-
Asset & Property Ownerships detail : Individually, jointly
and immediate family
Must disclose their 3 years tax return and annual tax return
State Government
As for the State Governments, it is recommended that all State
Governments include an Indian Malaysian Deputy Chief Minister,
wherever possible. However, for states which have a significant
Indian Malaysian representation in the voter segment, as in
Selangor, Perak, Penang and Negeri Sembilan, the recommendation
is rather mandatory to give proper cognizance to the Indian
Malaysian community.
State Indian Malaysian Representation:
Selangor Deputy Chief Minister
Perak Deputy Chief Minister
Penang Deputy Chief Minster
N.Sembilan Deputy Chief Minister
D. Conclusion
www.myniat.com
The recognition of the Indian Malaysian through the appointments
as Deputy Prime Minister, additional Ministerial and Deputy
positions would inadvertently increase the true representation of
the Indian Malaysian voice in and within the Cabinet, Government
and decision making processes. The new Cabinet must not be
Barisan or Pakatan Cabinet but A TRULY PEOPLE’S CABINET with
check and balance on self interest and graft.
I. UNIFICATION OF “INDIAN MALAYSIANS “
A. Rationale
The Current Classification of Indian Malaysians based on the
Population survey done in 2011 by the Statistic Department is
complete and the Indian community is now officially categorized
under nine (9) codes listed as below:
BIL. KOD NO. BANGSA
1. 6110 India Muslim & Malbari
2. 6120 Malayali
3. 6130 Punjabi ( Kecuali Sikh)
4. 6140 Sikh
5. 6150 Sinhala
6. 6160 Tamil India
7. 6170 Tamil Sri Lanka
8. 6180 Telugu
9. 6998 Orang India Lain
“In Malaysia, the Malay population is defined by Article 160 of the
Malaysian Constitution as someone born to a Malaysian citizen who
professes to be a Muslim, habitually speaks the Malay language,
www.myniat.com
adheres to Malay customs and is domiciled in Malaysia. This
definition is loose enough to include people of a variety of ethnic
backgrounds which basically can be defined eventually as
"Malaysian Muslims" and it therefore differs from the
anthropological understanding of what constitutes an ethnic Malay.
This understanding of the meaning of "Malay" in Malaysia has led to
the creation of an ethic religious identity. Adapted from Wikipedia
Definition of Indian
Relating to India or to the subcontinent comprising India,
Pakistan, Sri Langka and Bangladesh. Adapted Oxford dictionary
Indian Malaysian is the ONLY race in Malaysia that consists of all
religion – Hindu – Muslim – Christians – Sikh -Buddhist-Baha’i: The
traditional Definition of Race and ethnicity is related to biological,
geographical and sociological factors respectively.
The Indian Malaysian all originated from the continent of Indian
continent, thus with same argument as the MALAY: Indian must be
unified under one code to strengthen unification for national unity.
B. Proposal
Unify the Indians under One Code: 6100: Bangsa India Malaysia.
The Malay community is not sub-classified like Bugis, Jawa, Banjau
Minangkabau and etc. They all come under a single “Malay”
category as per the Federal Constitution definition.
We have to assimilate the Indian Malaysians into one category as
we are very minor category, even though we do have different
language in use, custom in practice, religion or looks but we all
originated from the sub continent of India.
Only through effective assimilation and recognition as one
community, would all future efforts of progress be plausible!
The “Divide and Rule” formulas will no longer work. What Malaysia
needs is a strong united Malaysia – one that works together as ONE!
It is in the name of National Security and Unity; we must do away
with sub classifications and it is clearly counter productive towards
unity.
II. INDIAN MALAYSIANS IN THE ECONOMY
A. National Economic Implementations
Rationale
www.myniat.com
Indian Malaysians are still trailing behind other races in terms of
economic success. To reduce the development gap between races
in Malaysia, which is the fundamental element of racial unity and
social justice, the government has been inactive in tackling the
economic imbalance issue among Indian Malaysian. Government
effort since 2009 is applause able but not close to be enough.
A holistic planning with political will, direct delivery and measured
monitoring system are in absent to date. Secretariat for Economic
of Empowerment of Indian (SEED) is a great move by Prime
Minister Dato Seri Najib to facilitate the credit for micro, small and
medium enterprises. However, SEED alone is not the answer for
Indian Malaysian issues.
The May 13 th
1969 and Nov 25 th 2007
were two big signs and reminder for the government on the
seriousness of economic imbalance. Consequently, just as May 13 th
created NEP the Nov 25th and the “Tsunami 8” inspired the
economic transformation and political balance.
To achieve the Malaysian dream, the following recommendations
are made to reduce the economic imbalance among the working
and challenged class of Indian Malaysians.
a. I- Amanah
The Government is to initiate an I-Amanah scheme to be parked
under PNB or Khazanah National especially for Indian Malaysian
Page29

INDIAN MALAYSIANS’ CALLS FOR GE13 - UNDO the HISTORY and REDO the PLAN
with its sole purpose “to catch up with equity ownership in
Malaysia”.
To date the Government is still unable to reach the 3% equity share
for Indian Malaysians by 2010 as previously planned. The idea of
Indian Amanah (I-Amanah) had been mooted by various quarters in
the past but the idea was shelved or scraped due to various
reasons.
MAICCI under the leadership of Dato Pradeep Kukerja –
Dato Bhupat Rai : 2007 mooted this idea to Dato Seri
SamyVelu. However, this idea was buried for not known
reason.
MIC Blue book – 1974: Tan Sri Manikavasagam have
mooted similar idea to the late Premier Tun Razak. ; MIC
Blue book 33 page ( V): The idea see no day light and
hijacked with simple allocation of RM10Mil
In 1990 NECC- National economic Consultative Council had
this Concept of “I-Amanah” recommended; however this
recommendation was inadvertently left out for one reason
or another by Tun Mahathir.
It is perhaps the right time for the government to seriously address
the equity imbalance through the creation of I-Amanah.
The equity must be evenly distributed to working class Indian
Malaysians. Rather than having the equity floating amongst only a
few elite Indian Malaysians in this country.
The Bank Simpanan Nansional (BSN) mooted the scheme
“Simpanan BSN” in 1980s which was targeted at lower income
groups with substantial return and ringgit to ringgit match by
Government.
Similarly, a total of RM250Mil as Seeding Fund should be set aside
for this reason as part of this I-Amanah Initiative. Matching dollar to
www.myniat.com
dollar: I-Amanah: Indian Malaysian earning less than
RM3000/Household income and priority to those leaving in rural
area, women and non-educated, minimum investment RM50
monthly: This program can be parked very well under DEMA thru
PNB or Khazanah
A similar program was launched earlier in 2011 with an RM5000
investment or loan through the Offering of Amanah Saham
1Malaysia which is not directly inducing an increase in equity
ownership but more targeted at reflecting positively in statistics.
Unfortunately most of the lower income group could not qualify for
the program through commercial loans, thus they are unable to
benefit from it.
The current proposed I-Amanah will work exactly the way it worked
for the Bumiputra through BSN Investment.
Clearly these ideas have not been newly conceptualized. This idea
that has been pleaded many times before– but has unfortunately
fallen on deaf ears! Time is Now.
b. EPU – Indian and Minority Socio-Economic Planning Unit:
The Government needs to setup an expert group within the
Economic Planning Unit (EPU) consisting of experts specialized in
the Indian Malaysian issues – called the Minority Socio-Economic
Planning Unit.
It would seek to understand and champion the Malaysian Indian
issues and needs. NIAT is aware that to date such a Unit is not in
existence.
This unit should be responsible for drawing up action plans and
policies to eradicate poverty and create opportunities for the
marginalized Indian Malaysian society. Currently, EPU does not
Page30

INDIAN MALAYSIANS’ CALLS FOR GE13 - UNDO the HISTORY and REDO the PLAN
have a deep understanding of issues pertaining to Indian Malaysians
leave alone the strategies and methods of deliverables. Such a Unit
would assist in highlighting the needs of the Indian Malaysian in an
effective and timely manner.
Despite recommendations of programs and policies in the past by
many quarters, it has rarely been adopted. It is time that a special
group of economists and policymakers are placed within EPU with
the particular interest in dealing with the social economic imbalance
of the minorities.
Although, in the past, the political parties/organizations purportedly
representing the minorities were consulted on case to case basis, it
appears to be more a formality rather than an exercise that was
beneficial to those in need.
Based on our studies and inquiries, we found that firstly, due to lack
of expertise, the parties/agencies themselves (without the help of
experts from within EPU) were not in a position to exclusively
formulate action plans. Secondly, recommendations by the
respective parties to include certain programs or policies rarely saw
the light of day in terms of implementation
c. Independent Statistics Commission
Currently, the reliability of the statistical data(s) with regards to
Indian Malaysian’s participation rate in various economic activities
is questionable and this is a source of disbelieve, complaints and
dissatisfaction.
The unreliability is NOT only on Indian issues but on many issues
generally.
www.myniat.com
For the general public, some of the published data are not the true
reflection of what is experienced on the ground. As such, an
Independent Statistics Commission should be formed which is both
transparent and independent.
The data collection methodology should be placed for public
scrutiny to ensure societal trust in the data. Currently, based on the
several encounters with the Commission, there appears to be some
serious doubts placed on the Indian Malaysians population data,
economic activities data, poverty data, education data, equity of
Bumiputera ownership data, crime data, demographic data, just to
name the few.
In essence it creates a host of doubts on the true and real status
quo.
Besides this, in Malaysia in recent years there appears to be a
general lack of public trust on the Bumiputera ownership data.
The Government cannot afford to take this lightly as this is the
primary indicator for policy makers and there is a pertinent need for
public to trust the government with their future and development.
A more transparent and realistic Independent Statistic
Commission is seen as essential for this purpose.
It is to be noted that the Indian Malaysian Population has seen a
“suspiciously” symmetric decline despite the notable increase in
the total Malaysian population since 1970 which stood at 10.8
million(1970) to 29.1 million in 2011.
The population in Malaysia has increased in 3 folds while ironically
the Indian Malaysian population has only doubled from about
900K in 1970 to the current population of 1.8 Million.
Page31

INDIAN MALAYSIANS’ CALLS FOR GE13 - UNDO the HISTORY and REDO the PLAN
Since 1970 the percentage of Indian population, according to the
official statistics have dwindled by more than 30% “magically” to
about 7.9% (2010) currently.
Taking into consideration of fertility rate, population growth, socio
economic status and mortality rate those numbers are quite hard to
neither accept nor digest.
d. Smart Agro Land Scheme
The Massive forced/circumstantial migration of Indian Malaysians
from estates to urban areas due to rapid industrialization in search
of better opportunities without any urban skills has been a catalyst
for the urban poverty phenomenon in the past decade.
Perhaps, now (since not earlier!) it is the right time for government
to drive these groups into technological base farming sectors in the
urban skirts through land incentive initiatives.
Agricultural activities like cattle farming, hydroponic farming,
flower, white water fishery and many more lucrative areas could be
some of the answers to address the Malaysian Indian urban poverty
phenomenon.
The scheme will work almost like FELDA but the scheme must be
spelt out more clearly and carefully to attract Indian Malaysians
through 10 acre land for smart agro activities complete with capital
and technological assistance.
This will mark the beginning of this scheme by giving out 5000 acres
from 2013 – 2017.
www.myniat.com
Based on statistics about 1 Million (plus) acres of land had been
given out to 118K Settlers from 1956 to 1990; Yet Indians only
obtained 1.83K or approximately 1.5% of the total amount:
Perhaps it is cogent to note that 1974 MIC Blueprint indicated that
almost 3300 (end of 1973) Indian Malaysian applications were
received and recommended FELDA to give more opportunity for
Indian Malaysian Settlers; which means that just based on the
statistics, almost 7000 possible opportunities of Indian Malaysian
were ignored or blatantly “snatched” away from them!
If 8% of the total land (and nothing more) were distributed to
rightful claimants amongst the Indian Malaysians, that would have
constituted over 70000 Acres of freehold plantation land schemes-
which would have benefited over 7000 Indian Malaysian
households.
The Urban Poverty Phenomenon –was highlighted and warned in
1974 through the MIC Blue print: Pg 26 (57) 63800 (45000 families)
mass moving out of estates/mining quarries that needed urgent
attention;
The then MIC recommended FELDA/RISDA/FELCRA Scheme to
used to replace those displaced from estates with at least 10% of
the settlers, with a rate of 700 Families per year for 20 years (1970
– 1990).
Unfortunately the recommendation was ignored or rejected by
Former PM Tun Abdul Razak’s Administration.
NIAT merely seeks to revisit this blueprint after almost 4 decades
to start all over again and seek the Government’s open review of
the problem and adapt a long overdue recommendation that was
formulated under the able leadership of the late Harvard Alumni
Datuk K Padmanaban who led the Economic Team as early as
1970. Better late than never!
INDIAN MALAYSIANS’ CALLS FOR GE13 - UNDO the HISTORY and REDO the PLAN
B. Initiatives for the Micro Businesses
a. Micro Loan - Problem Statement:
Although the micro Malaysian Indian businesses contribute to the
economy at large, these businesses still face significant challenges.
These challenges are faced at every stage of business processes
ranging from getting the premises, application for licenses and
permits, startup capital, loan for operation, even in areas such as
knowledge and know-how.
Previous Solution that was made available : TEKUN (Tabung
Keusahawanan National)- Thru SPUMI
1. Access to friendly information regarding application process
has been highly inadequate. It is presently coordinated through
Yayasan Social Strategic/MIC which is ill equipped to reach the
Malaysian Indian micro businesses and its operators. The
hierarchical procedures and processes significantly delay the
application process and increases the waiting time which these
businesses can ill-afford
2. Requirements for the loans ; significant delays deter businesses
from getting their loans on time. There is a serious mismatch
between the micro-business credit time of less than 30 days
and the processing time for loans which exceeds 6 months. The
www.myniat.com
loans application cycle should be synchronized with the
business cycles for it to be useful and practical for business
purposes.
3. The funds get exhausted really fast and late disbursement of
fund does not serve the purpose of nurturing the real needs of
micro businesses over a longer term. The funds must be
designed, funded and operated as a sustainable and long term
project and not as an ad hoc initiative.
4. In certain cases, the owners have excellent business ideas but
lack the requisite skills and training. In this aspect, training of
prospective businessmen with regards to businesses is
important. MARA has been quite successful in training owners.
The same approach / methodology can be extended or
duplicated to Indian Malaysians as well.
5. Blacklisting of Indian Malaysian Businessmen especially Micro
and Small enterprises are alarming and very concrete action
plan must be designed to tackle; Suria Malaysia Coop, and SEED
also echoed this concern.
b. Proposal
i. Micro Loan Delivery System
Micro loans to be disbursed through BSN, License Money
Lenders, TEKUN and/or selected NGOs for a faster
delivery of the services. Currently accessibility and
processing time is the problem.
Currently the Micro Loan Scheme through Bank Negara
and RM180Mil loans for entrepreneurs-SEED through
political infrastructures are not reaching those
businessmen who really need it due to misappropriation
or procedural improprieties or just plan improper
dissemination.
Page33

INDIAN MALAYSIANS’ CALLS FOR GE13 - UNDO the HISTORY and REDO the PLAN
It must be noted that most of these current loans further
create NPL and CRSS issues that will haunt micro business
owners for many years to come.
Excerpts from discussions and findings (Names have been
omitted to safeguard the participants in the research) :
- Mr.G, an entrepreneur from Kajang, who attended the
briefing on SEED recently on 2.8.2012 informs NIAT “ … it is
same story different scene”
- Mr K, a young graduate from Klang (SKM Level 3 – INPENS
Automotive under the scholarship of YSS 2007). He decided to
embark on his own operation after 4 years of experience.
Found himself a suitable place and to secure location, he
procured an “along” type of loan which requires him to pay
RM2K interest per month for a loan of RM20K. NIAT referred
the matter to Suria Cooperative – Infrastructure to assist
Indian Malaysian Micro Businessmen. However it failed to be
of relevant assistance as the assistance they render is only in
the form of equipment and not for capital or running capital:
He applied for the Bank Negara Micro Loan and is pending
approval. Meanwhile he is has no alternative but to service
the loan at the interest of RM2 per month!
- Mr V, a local artist applied for a loan under TEKUN to setup a
Dance Studio in 2010 through YSS in the 2010 by MHS – Youth
Assistance Team. He never received any reply nor call for
interview.
- Ms ABC, (name was refrained upon request) another local
artist that made many famous debuts in Malaysia and India,
applied for a loan through the Creative Fund from the
Ministry of Culture and Heritage but never got a helping
hand.
ii. Loan Criteria
www.myniat.com
The requirements for the loan to be relaxed and there must be
an introduction of more innovative payback schemes if
necessary. MARA Scheme could be used as model.
In this respect, perhaps we should emulate the proposed micro
schemes of Nobel laureate, Dr. Mohd Yunus of Bangladesh who
proposed that “more importantly, priority should be given for
loans to business women”.
Conversely, despite the ALONG’s negative image, the ‘ALONG’ is
more successful in attracting micro business for loans due to
their fast delivery system.
As such, the current systems need to be revised especially in
terms of information, processing time, and methods of
application.
NPL, CRSS, CTOS are the biggest hindrances for getting loans
approved. This is despite the help of LKPK.
iii. Blacklisted – Micro Business Credit Restoration
CRISS – CTOS-NPL credit standing are very important for any
businessmen. Thus, Indian Malaysian is facing great challenge
with credit scores, credit excess and reckless finance
behavior. NIAT recognizes the problem and had confirmation
of the problem from various agencies that are dealing with
Indian businesses including PEMANDU/SURIA & SEED. We
propose to initiate a fund in which a micro businessman with
credit issues will be able to benefit thru good finance
behavior. The fund size is RM30, 000 or less. A doable
payment scheme will be drafted with debtor(s) with
assistance of SEED and the payment scheme will be endorsed
Page34

INDIAN MALAYSIANS’ CALLS FOR GE13 - UNDO the HISTORY and REDO the PLAN
by JPM-SEED-debtor(s)-Creditor(s) with specific terms and
legally binding: This is a re-imbursement credit restoration
scheme “carrot & stick” approach. The plan is modeled after
SBA-USA: Objectives of this scheme are;
To rendering hand to micro businessmen/women to
move forward in business: 2 nd Chance
To coach and initiate responsible financial planning and
fiscal habits.
iv. Permanent Micro Loan Scheme
Micro-Loan should not be limited for an allocated amount.
Like PTPTN, micro loans should be made available for those who
want to start a business. It should be continuously given to
ensure the success of the businesses and it should be based on
a payback scheme.
It is clear that Micro business companies represent 87% of the
entire count of companies incorporated in Malaysia in 2010.
The current setup of SME Bank and etc works exactly like
commercial banks. For example the Micro Loan Scheme from
Bank Negara is not easy to get by despite many attempts. This
deters micro business owners to expand or even starting
businesses in the first place.
The role of SEED is right on dot, however the SEED service must
be translated into rural areas with more systematic
infrastructure: SEED seems a temporary outfit for now. NIAT
emphasizes on creation of DEMA as permanent outfit that can
facilitate SEED in every district for assistance.
v. Indian Malaysian Micro Business Training
www.myniat.com
An allocation of RM 5 Million per year set aside for training the
owners of micro business. Blanket requirement for loan to go
thru a week PAID training- especially of those of Micro & Small
Businessmen/Women.
Training and loans should come hand in hand, so that relevant
and potential micro business can be selected. Upon successful
completion of the training, the owners could assess loan
schemes. This will ensure business sustainability as well as
better loan recovery.
The training should include issues on business law and
legislation, company setup processes, banking requirements,
labour law, taxation, management, marketing, purchasing,
customer relations, customer services and other areas as shall
be suitable for the specific businesses in its operations of micro
businesses.
This training need to be continuous and can be conducted on a
part-time basis, as night classes or weekend classes. The
training may be delivered through INSKEN – Institute
Keusahawanan Negara : It is recommended that the Training
must be conducted in Tamil & Malay.
vi. Micro Loan for Home Based Business “Cottage Industry”
Indian Malaysia community to be given priority for Home
Based Business Loans
The Indian Malaysian has not fully tapped the home based
business as it is hard for them to get loans from commercial
banks or the government.
Loans should also be disbursed for ladies, single mothers and
housewives who intend to start home based businesses. The
Page35

INDIAN MALAYSIANS’ CALLS FOR GE13 - UNDO the HISTORY and REDO the PLAN
approval and selection criteria need to be revisited to attract
more ladies to be involved in home based business activities
which include traditional businesses.
Examples of business : Garland/Flower Service, Baby Sitting,
Handicraft, Tailoring, Snack Food, Bridal Services, Jewelries
Repair & Crafts, Mobile Hair Stylists, Home SPA, Morning
Market, Home Tuition, cleaning Maid Services etc.
Budget 2013 – GMBO – Get Msian business Online – 5000 to be
set aside for Indian Malaysian Women:
vii. Micro Business Information Dissemination Centre
Training NGO to do the work:
We must adapt the USA concept of SBA – Small Business
Administration system where the government provides
infrastructure for Micro/Small Business to use. Such a service
may include printing services, conference – seminar rooms and
providing avenue for volunteer or NGO to use to coach or
disseminate information to the public. SEED idea could very well
serve as SBA: SEED need to expand its objectives and role from
just a credit facilitator. SEED need to expand to all districts at
least to reach the target group effectively and directly.
Due to the lack of effective information dissemination, society
at large feels that their interest has been left out in the process
of mega brand development.
Centers to disseminate information regarding loan facilities and
other opportunities provided by the government should be
intensified.
www.myniat.com
A one stop center to facilitate this process is required at
strategic locations so that the facilities and information can
reach the Indian society at large. SME Corp is still unreachable
for many. In addition, temples and Indian NGOs should be
roped in to tap and push information closer to the target
groups. The SBA (Small Business Administration) in USA consists
of businessmen or retired staffs.
Currently the SME Corp is ineffective in counseling micro
businesses.
C. Initiatives for the Small Business
a. Problem Statement
The biggest segment of Indian Malaysian businesses fall into
the small business category. The challenges of these
businesses are definitely the startup capital, investments for
expansion activities and working capital.
b. Past Solution: SMIDEC/MIDF/SME
1. Reimbursement Basis: For Example the Start Up Grants by
SME Corp, Marketing/ Promotional Grants etc.
2. Process and Decision Time : 6 months or more
3. Inaccessibility particularly in remote areas
Page36

INDIAN MALAYSIANS’ CALLS FOR GE13 - UNDO the HISTORY and REDO the PLAN
4. Lack of transparency in the process.
Limited transparency allows and provides room for every
failed application to be perceived as based on racial
biasness to have been an application by Indian applicants.
This phenomenon must be stopped.
c. Current Proposals
i. Franchise Business Boost
There is an urgent need to expand the franchise business
schemes to Indian Malaysians.
A realistic target is to create 50 Malaysian Indian Franchise
Businesses in a year with 100 Local Indian Business
Franchises in the next 5 years.
Currently, PNB through PNS have been working on a similar
concept.
It is recommended that the Franchise programs that are
currently allocated only for Bumiputra be opened for Indian
Malaysian as well.
Since, the Indian Malaysians are involved in different types
of business; the expansion of franchise concept to Indian
Malaysian business generally, will create more spillovers
effect to the economy between 2013-2017.
- Ms Vanaja, a housewife with reasonable education
background fought many years to acquire a local convenient
shop franchise Kwik Shop
She failed to have neither SEEDing fund nor the support to
nurture her interest in franchise business;
www.myniat.com
She was not qualified for the PNS program as she do not have
a Bumiputra status:
She struggled for almost 2.5 years with Business Plans and
Other information before she gave up and accepted her fate
for being from an helpless Indian Malaysian. MHS Youth –
was in consultation with her from 2008-2010
ii. Boosting Franchising at Global Scale
8% of the funds allocated for National Franchise program
should be assigned to Malaysia Indian businesses
The Malaysian Indian businesses in Malaysia are not getting
enough help, expertise or know-how in franchising their
business on a global scale. Nevertheless, currently the
number of Malaysian Indian businesses that have great
potential to be franchised can benefit the nation as a whole.
With adequate planning this could be the beginning of a
establishment of a global franchise presence.
Therefore, it is recommended that 100 new Malaysian
Indian franchise businesses to be assisted under various
programs like PNS and others. Currently, Indian Malaysians
do not have the awareness and incentives to move
forward in this direction. The incentive can be delivered in
the form of Consultation, Grants, Loans and Franchise
Development Training.
Hence, 8% of the funds allocated for National Franchise
program should be assigned to Malaysia Indian businesses
to make the effort a reality.
Budget 2013 – PNS Allocation Rm25000 for franchisees
and RM500000 franchisor: Set aside for Indian Malaysian
Business men/women
Page37

INDIAN MALAYSIANS’ CALLS FOR GE13 - UNDO the HISTORY and REDO the PLAN
iii. Vendor Development Program
8% of the vendors in GLCs must be Indian Malaysian.
GLCs and MNCs, among others, train and develop vendors
under the vendor development programs. This in return has
created successful local businesses.
It is recommended that 100 qualified Indian Malaysians per
year to be trained under a similar scheme. This will
ultimately create more business spillover for the nation.
Currently, GLCs such as Proton are not willing to share their
information and are not transparent to share the
information of their vendors. This has to change with a view
to work together towards making the 8% target a reality.
iv. Business Opportunities in GLC
GE13 Government need to use the GLC machineries to
allocate opportunities thru GLCs in order to increase the
equity of Indian Malaysians. It is recommended that 8% of
contract value to be set aside for Indian Malaysian
businesses /vendors /contractors.
This is more feasible, both politically and economically, to
correct the economic imbalance than just having contracts
on an Ali-Baba basis. It is important to make sure the
businesses that have gotten approval through Indian
Malaysian quota to be made known and they have an
obligation to create a cascading effect.
In the past the Malaysian Businessmen/women refuse to
actively participate in eradicating poverty among Indian
Malaysians and leave the whole burden to the government.
Thus, moving forward we need to create a more favorable
www.myniat.com
business environment built on trust and responsibility. We
need a standing policy on hiring and business opportunities
of 8% in place.
The trickling down approach by the government through
the “helping” of some Indian Malaysian company failed:
example West Port – Maxis – Astro and many others
v. Technology Incentive
The government has to provide loans and incentives to
ensure modernization.
The 5 industries that the Indian Malaysian is presently very
active in include:
(1) Food/service
(2)Metal/Precious Metal;
(3)Transport/Logistic;
(4)Newsstand/Printing; and
(5)Retail/Textile.
These industries are labour intensive and have potential for
modernization; the government has to provide loans and
incentives.
Currently, the incentive programs under various ministries
are hard to come by for the Indian Malaysian Businesses
that are not savvy and not too well organized.
Hence, it is recommended that a special allocation be
given for technological and equipment improvement
specifically for these pillars industries. The grants and
incentives should include technology consultation
activities, training and equipment upgrading and the like.
Page38

INDIAN MALAYSIANS’ CALLS FOR GE13 - UNDO the HISTORY and REDO the PLAN
For instance, restaurant owners could implement the POS
systems to enhance the management quality.
Representatives from respective association must be
encouraged to participate actively in technology
transformation in their industry in establishments like
PRIMAS, PRESMA, MIMTA and etc.
vi. Malaysian Indian Women Participation in Business
It is recommended that the government create at least 500
new enterprises for Malaysian Indian women graduates.
Malaysian Indian women are left behind compared to their
counterparts in other races and to eradicate this it is
recommended that the government create at least 500 new
enterprises for Malaysian Indian women graduates.
A Special Program or Scheme could be developed under the
Ministry of Women Affairs and Community Development to
boost awareness and to provide training, grants/loans as
well as supervision.
The industries of interest should include marketing services,
beauty, training, food/service, green technology, small scale
manufacturing activities, human resource services, cottage
industries and others.
One possible introduction is similar to the concept of PINK
TAXI like in UK-London: Special Taxi Services. 500 Taxi
permits may be allocated to the Indian Malaysians Women
(graduates) with a RM5000 down payment or full Loan
Scheme for a new Taxi.
vii. Home Based Business
www.myniat.com
Creating 1000 home based businesses under various
programs specifically for Women (Example, housewives,
single mothers and the disabled).
A specific program by the relevant ministries e.g. Ministry of
Women Affairs and Community Development is needed at
each level. The home-based businesses must be supported
by grants, training, supervision and facilitation. The Chinese
model of such program can be absorbed in this case.
Industries such as food/service, catering, crafts, bakery,
internet-based business, florist , online and telemarketing
should be encouraged.
Additionally, the Ministry should also create more
awareness programs on the issues of home-based
businesses.
Amanah Ikhitiar may not be the appropriate solution to the
Indian Malaysian. It creates a support system of 5 women to
start a business and NIAT may give a list reason why this is
not the remedy for Indian Malaysian:
- Indian Malaysian – Traditional Business Ideas
- Culture, Distrust & Language : Barriers
- Infrastructure
- Officers
viii. Graduate Business Community
It is recommended that the government assist and
support the Malaysian Indian graduates to start up new
businesses
Page39

INDIAN MALAYSIANS’ CALLS FOR GE13 - UNDO the HISTORY and REDO the PLAN
Young entrepreneurs are the engine of growth of the
economy. Likewise, it is also a tool to reduce
unemployment among graduates.
It is recommended that the government assist and support
the Malaysian Indian graduates to start up new businesses
in areas like financial services, healthcare, consultation
services, R&D related services, and others.
A target of assisting 1000 new Indian Malaysian graduates
in these new businesses is an important and necessary
beginning.
The program should be specifically tailored towards
graduates who are less than 35 years old who have
successfully undergone training and consultation. They
should be given a loan facility of not less than RM500K to
start and to develop their businesses. Additionally, during
the training, the graduates need to be paid living allowances
not less than RM1500/month and this is should be part of
the loan.
The loan should be flexible enough to be converted to a
grant of equal amount, upon paying taxes or employing
certain number of employees within 10 years of operation.
Even though currently there are programs with few
government agencies but these are not reachable to
Indians. Special quota and directive much be made.
Budget 2013 –, Agro Tech Ventures possibilties, and
Graduate Employability Blue Print by 2012 ;
However, government must initiate afund for business
START UP. Similar program to “Groom Big” -SME Corp : It is
ONLY for Bumiputera-need to liberalize.
ix. Traditional, Cultural & Indian Art Business
www.myniat.com
It is important to develop and catalyze the traditional
businesses. Cultivate new enterprises that are related to
cultural and traditional-based business or services.
These businesses include Dance Academies, Cultural sports,
Cultural craft, Musical Equipment Manufacturing, Cultural
Skill Training Centre, Sculpture, Theater Shows and Jewelry
manufacturing.
These industries are important for tourism and unique
attraction for Malaysia. Currently, most of the supplies are
imported from India and it will be an added advantage if
Malaysians were to venture into these industries.
The programs to develop these industries should be specific
and parked under the Ministry of Heritage and Culture.
The programs should include training, study scholarships to
India perhaps or other suitable country for consultation as
well as loans/grants.
Other than this support Study Abroad Loan Scheme may
be made available for example – priest and artists or
talents interested in cultural musical instruments which is
difficult to nurture locally.
x. Young Indian Participation in Stock Market/Equity
Market
More effort is needed to engage the Indian Malaysian to
participate in the stock and equity market.
Page40

INDIAN MALAYSIANS’ CALLS FOR GE13 - UNDO the HISTORY and REDO the PLAN
The lack of participation is due to funding constraints and
knowledge. Traditionally, Indian Malaysian doesn’t have
the mindset for portfolio investments.
It is recommended that the government provide training for
200 qualified Indian Malaysian Youths to participate in stock
and equity markets as stock brokers and remises. The
program is to be conducted by Bank Negara or other
affiliated agencies. Adequate exposure, training and
coaching will ensure the Indian Malaysian participation in
this sector.
Congrats: Budget 2013 – Address the program ; Securities
Commission to Coach and offer fund for youth graduate to
involve in Securities business. Fund for Indian Malaysian
must be set aside.
xi. Development of Malaysian Indian in Lacking Sectors
The government and private sector need to implement a
broad range of assistance programs to facilitate the entry of
Indian entrepreneurs into manufacturing and modern
services sectors, particularly in the SMIs.
As clearly indicated, the Indian Malaysian community
participation in certain sectors, namely manufacturing,
agriculture, utility, green tech, construction, finance,
wholesale and retail is grossly lacking. Through such efforts,
the Indian Malaysian participation in these areas will see a
marked increase. These initiatives may include the
following:
Specially packaged programs currently implemented for
the participation of Bumiputra entrepreneurs should be
extended to the Indian Malaysian entrepreneurs. For
www.myniat.com
example the vendor development programs for privately
owned companies in automotive, motorcycle and Halal
food industries including government owned companies
such as Petroleum Nasional Bhd, Tenaga Nasional Bhd,
Telekom Bhd and MISC.
Issuance of Licenses and Permits to Indians should be
given priority for example 8% of taxi, bas persiaran and
lorry permits; 8% allocation of businesses in petrol
stations and Proton dealership.
A request for the Ministry of Entrepreneurial
Development to set up a special fund of RM500Mil for
Indian entrepreneurs similar to the RM 2 billion fund for
the Bumiputra Providing Seed Capital for start ups and
business expansion.
Open avenues for Indian Malaysian contractors to
participate in Class A & B schemes in infrastructure and
construction sector.
Adequate Allocation of Seeding/incubator funds to
intensify the Indian Malaysian participation in
Manufacturing, Green Technology, Bio tech, Information
& Communication Technology (ICT), Education, Health
Tourism, professional and consultancy services.
Budget 2013 – Incentive for Green Tech Business is
highly anticipated.
xii. Scheme Partnership/JV -Take Over
A program to create 500 potential partnerships and JV
To grow, Indian Malaysian businesses are actively seeking
partnerships and joint venture arrangements as a source
of fund and knowledge transfer.
Page41

INDIAN MALAYSIANS’ CALLS FOR GE13 - UNDO the HISTORY and REDO the PLAN
It is proposed that the government facilitate these
businesses to engage in partnership and Joint ventures. A
program to create 500 potential partnerships with
established business owners in selected industries like Halal,
Export/Import service, Technology Intensive Industries,
Green Technology and Finance is proposed.
The program includes creating awareness, training,
coaching, consultation, loan/grant and supervision. The
program can be parked within the SME Corp under
Malaysian Indian Partnership scheme.
With a loan allocation of up to RM1million, it is possible to
create 500 new businessmen within 5 years.
xiii. Permanent Business Loan
Small business should be able to access permanent loan
programs.
Currently SME Corp does have few products for small
business but it is on reimbursement terms. This type of
schemes might not work for capitally challenged owners.
Therefore the government has to setup a moderate term
business loan for small businesses with relatively short
processing time, like 2 weeks.
Loan facilities are the fertilizer for the growth of small
enterprise in any country.
Unfortunately the SME Banks in Malaysia do business more
like commercial banks. Micro/Medium owners with CRISS or
CTOS problem are unable to seek financial help. Efforts
must be made to change or reverse this predicament.
www.myniat.com
Permanent Loan Products needed:
- Business Start Fund
With limited and simple loan requirement
- Running Capital Fund
Running business and Starting Up business
- Other Fund
Equipment, Renovation, Marketing, IT, Certification,
Consultation, R&D and Training
SURIA COOP – can play a positive role to expand the
services to service business loans for start ups,
expansion, take over, and running capital.
xiv. Invite Reputable Business Associations to Assist
To recommend that the government should offer funding for
any proven nationwide business association on
Entrepreneurial Development and Skills Training Centre
(EDSTC).
The centre should guide Indian Malaysian youths in basic
skills training, advise on starting a small business, licensing
arrangement and credit facilities. It should be set up at
every state with full accreditation from the government
so that banks and other agencies can assist them for loan
facilitation and project approvals.
The EDSTC need to offer consultancy services to
overcome typical problems of the Indian SMEs that
include:-
Small family owned business
Labour intensive with low capital
Limited production capacity
Limited Capital
o Utilizing simple technology
Page42

INDIAN MALAYSIANS’ CALLS FOR GE13 - UNDO the HISTORY and REDO the PLAN
o Limited specialization
o Inappropriate marketing literature
Non competitiveness in terms of price, service quality,
packaging etc.
Limited Market Accessibility due to lack of marketing
expertise, lack of R&D unattractive packing and labeling
Technological levels
xv. Uninterrupted Labour Supplies
To ensure the continuous growth of the Pillar Industries of
the Indian Malaysian, the government must ensure and take
great care of the labour supply issues.
In the past 15 years Indian Malaysians have made great
progress in 5 prominent Pillar Industries, thanks to
government policies on foreign labours.
The industries are
Service & Food Industries
Recycle, Metal & Precious Metal
Newsstand and Printing
Transport and Logistic
Retail & Textile
To ensure the continuous growth of these industries, the
government must ensure and take great care of the labour
supply issues. The survival of these industries highly
depends on uninterrupted labour.
In the past decades, there were constant changes in the
labour policies that have cost the Malaysian Indian
businessmen millions as well as in business growth in
general.
www.myniat.com
Since the entire pillar industries of Indian Malaysians are
labour intensive, thus the degree of dependency towards
foreign labour is slightly higher and any disruption on labour
supply will directly affect the livelihood of thousands of
Malaysian Indian businessmen.
It is imperative that the government establish a long term
policy measure with regards to foreign and local workers.
Some of the long term measures that require serious
attention include the following:
• Serious attention towards tackling the wide spread
corruption in the supply and demand chain of foreign
labour in the country. It has been so long that the issue is
been pushed under the carpet and it is time, now, to
address it with a permanent solution;
• Weak and ineffective enforcement due to
corruption, unclear guidelines and too many overlapping
authorities;
• Simplification and standardization of procedure for
foreign worker’s new applications, renewal process,
replacement and cancellations.
• Lack of enforcement and crack down on illegal
workers: Projected to be around 2mil in the country by
labour department 2011. It is time to intensify the
enforcement on the crackdown of illegal workers. 6P is
a stagnant pram so far.
• Review the Levy Policies which is viewed to be
main course of VISA abuse. For example, the
plantation workers annual levy is RM400 while service
industry is RM1800 annually. The levy for all industries
must be synchronized. Tax Exemptions for local hiring
companies would be a great move toward localizing
Page43

INDIAN MALAYSIANS’ CALLS FOR GE13 - UNDO the HISTORY and REDO the PLAN
our work force. USA and Singapore uses this method to
protect their local labour force.
• Intensify JPK Skill Training and Private Training
Centers on the pillar industries to reduce the
dependency on foreign workers by 25% in the next 5
years without interrupting the labour supply while
simultaneously maintaining a healthy growth of the pillar
industries.
• Awareness of Labour Laws, employer’s
responsibilities and unyielding enforcement will surely
make this industry more attractive and rewarding for
local job seekers.
• Government must also engage the pillar industries’
representative to draw a comprehensive blue print with
regards to foreign labour issues. Without a proactive,
sincere and consultative move between the government
and the pillar industries, there is a fear of unnecessary
outflow of investment to India, Sri Lanka, Vietnam and
other Asian countries.
• Double Tax Incentive for employers that hire local
workers. Through this employers will have a greater
interest and attraction to recruit local workers. The
additional labour cost shall be absorbed through tax
relief.
www.myniat.com
III INDIAN MALAYSIAN IN EDUCATION
Rationale
Education is the single most important driver of poverty eradication,
political stability, unity, and economic development. It is also
important to bridge the gap between the poor and the rich.
The education system is constantly used for a political agenda that
deprives one’s right to freely choose their path especially in public
education.
Currently, the Indian Malaysian is very much dissatisfied with the
overall provision of education in Malaysia, what more the
consistency in the inconsistency in education systems in Malaysia.
The Indian Malaysians recognize the importance of societal
integration and the unity of the nation and nation building while
simultaneously believe that this should be achieved without
infringing the rights enshrined in the constitution and social
agreement.
The government and EPU should not think that Tamil School
educated citizens are any less patriotic compared to their
contemporary from a national school.
Policies unfortunately seem to favour the national schools,
making the vernaculars school unattractive and inadequate.
Page44

INDIAN MALAYSIANS’ CALLS FOR GE13 - UNDO the HISTORY and REDO the PLAN
The GE13 Government has a golden opportunity to show the Indian
Malaysians its noble and sincere intention to solve impending issues
on education in Tamil school on “Mega Impact Policy Shifts” within
3 months. We are sure this will win the hearts and minds of every
Indian Malaysian and build toward a healthier and stabile Malaysia.
In the Past
1. Sijil Pelajaran Malaysia (SPM) 10 Subject Issues
This policy created suspicion among all Indian Malaysians about
government’s real intention and sincerity. The decision was
taken unilaterally by the ministry without consulting the society
or the vernacular educationists.
2. Merit System & Matriculation
This system is proven to be flawed and has caused distrust in
the government’s intention to make sure the system is based on
merit and not race. The latest fiasco of additional 1000 seats
(2012) for Indian Malaysian students in additional to previous
intake of 559 (2011): We are know the 1559 is not fulfill and
MIC flip flop information dissemination is the cause much
uproar among Indian Malaysian: Till today: MIETA (Malaysian
Indian education Transformation Assoc) the NGO that spear
headed this issue never was given the list of matriculation
students or called for consultative. Matriculation intake is
conducted under great secrecy by MOE and political bodies,
why?
3. Tamil Schools are ill aided, under-funded
Tamil Schools are generally inadequately funded and not
expanded in line with their growth and this has left Indian
Malaysians disappointed.
www.myniat.com
The Tamil school issues have historically and continually used as
a political tool with a hidden agenda while to date no long term
workable solution is available.
The formation: Action Plan for Tamil School Reforms – Prof Dr
Rajendran is a great move forward : However, any plan without
action or implementation will only make the issue worst or the
deception deepen.
4. UPSR – Tamil School and the “Peralihan / Remove Class
“Peralihan” classes for under achievers in UPSR are the main
cause for dropouts and no effective solution is available to help
the students to catch up in education. Stringing from this issue
is the issue or concerns on student discipline; sufficiency of well
trained teachers to handle under achievers, proper curriculum
specifically designed for under achievers, and others add to the
ultimate purpose and agenda behind the current education
system. EDB- Education Blue Print 2012 – removing “remove”
2017 is too late.
5. Issues of Tamil School Classification
The numerous school classifications eg SKM (Sekolah Separa
Model), SBM (Sekolah Bantuan Modal) Grade B, Grade A
(Sekolah Bantuan Penuh) add to the dissatisfaction amongst
the Indian Malaysians
6. Issues of Attachment Teachers and Training
Inadequate and inappropriate teachers and training of
teachers and the consistent changes ill-afford consistent
improvement of the Tamil Schools
Page45

INDIAN MALAYSIANS’ CALLS FOR GE13 - UNDO the HISTORY and REDO the PLAN
Education Blue Print (EBP)
EDP is a safe passage to educational reform without much twist and
turn. The committee totally ignored or stayed away from real
reform on POLICY and POLITIC Levels;
Infrastructure Improvement is pretty much understood and
can never go wrong
Improving the teaching Talent – How can one can go wrong
with that
Improving the MOE – department Red Tapes and empower
the ground to perform.
Etc
Some of REAL Reform TALK must ADRESS the following:-
1. TOF – Term of reference of the Education Blue Print (EBP):
Sept 2012: Vernacular Schools and SK are Equal in carrying
the mandate of National Education Mission- This means SK
schools must not see Vernacular school as a historical
nuisance that segregate or divide Malaysians: TOF –
EQUALITY – MOE must accept not TOLERATE that Malaysia
is built base upon multi educational system and no one
system is above any. REMOVE all Policies that sideline the
Vernacular Schools as off system.
2. The Base line for the EBP is a “fear” of Tamil and Chinese
Schools growth of 7% and 4% accordingly among Indian
Malaysian and Chinese Malaysian: That kind of fear or
mindset is totally 180’ degrees against the UNITY Code
www.myniat.com
propagated by “Falsafah Pendidkan Negara” : MOE – must
not envy or fear the popularity and performance hike in
vernacular schools. EBP intro gives a chilled effect on EBP.
3. Abolishing “Remove Class” 2017 – is too long and too late.
The Language; Bahasa Malaysia and English in Vernacular
School must be synchronized to the level of SK schools in
terms of syllabus: especially in Bahasa and English
4. Tamil Schools must be given options to do Math and
Science in Tamil or English; Rather than pushing it all for
Tamil Language/Chinese. Tamil Schools showed a great
performance in Math and Science thought in English
compare previously in Tamil Language. So, aren’t broken
don’t fix it.
5. Permanent Assessment System that is TRANSPARENT for
all School; - The biggest shortfall of Malaysian Education
System is the inconsistency and affirmative action enforced
upon our national exam assessment system. Current, bell
curve system is used under great secrecy. The A grade
score of the year 2010 is not necessarily same as the A
Grade quality of year 2009: because the grading is based
on year and locality and possibly race/religion. This
discriminatory grading deprived the teachers of knowing
their real performance and achievement, depriving the
children of their real knowledge level of standing in
reference to the rest and yester years and refuse the
system a credibility assessment to improve and move
forward with reliable and universal standard. For
Page46

INDIAN MALAYSIANS’ CALLS FOR GE13 - UNDO the HISTORY and REDO the PLAN
example, If the 80 percentile is the level for an A grade then
it should be left as 80 percentile and affirmative action’s
should be exerted toward students to facilitate them to
reach that competency level without lowering the bar for
political or affirmative reasons. This is the Single self –
destructional REASON of education system in Malaysia
since NEP: English grading of getting an A in Kelantan or
Sabah may very well lower then Selangor for the same year
and same exam questions. This is a political-social reasons
rather than an academicals evaluation. Compare that with
GCE O Level or A Levels. PBS-Penilaian Beraraskan Sekolah
– it is scary path in terms of readiness but right move in long
run.
6. Vocational Reform : Vocational education must be inserted
in Primary School itself rather than waiting to be a last
resort for DROPOUTS – That is a fundamental Policy and
Principle Change should be address in EDP – total missing
7. Vocational Education must be migrated to MOE-
immediately to ensure the effectiveness synchronizing with
academic process. MOE – IPT to follow thru the idea
University Kemahiran Malaysia is been pending for ages
now.
8. EQUAL ACCCESS – Tamil Schools must be given equal and
propionate fund allocation equal to SK Schools : Including
the upgrades of Infrastructure – ICT excess – Teachers
Upgrades – ETC
9. POC – People Own Culture Studies is part of Malaysian
Value Driven Growth – must be included: Cross culture
www.myniat.com
learning will only strengthen the unity, understanding and
the diversity further.
10. MUSIC/ARTS element is totally ignored from the Education
System: Many countries emphasize in Music – Art Education
right from Primary to cultivate both size of the brain : Art /
Science to create and well balanced individual – Falsafah
Pendididkan Negara
Proposals
Review of 10 Subjects Cap in SPM
A review of the policy is a must - This is a policy that appears to
have been made in haste to hush a more important predicament
without proper thought being put into it.
It has had a deep impact on Tamil Language & Tamil Literature
which needs to be given equal treatment in University / other
intakes.
We urge the Government to instruct the Ministry of Education
(MOE) to review this policy and revert to old policy to ensure that
Tamil and Tamil Literature be made mandatory for all Indian
Malaysian Students.
The new Review Panel set up by the Ministry of Education to do
the framework for Malaysian Education system till 2025 must look
into and consider this issue seriously.
Page47

INDIAN MALAYSIANS’ CALLS FOR GE13 - UNDO the HISTORY and REDO the PLAN
Higher Education & Matriculation
We urge the government to do away with the merit system for IPT
intakes including for the matriculation programs and install
affirmative action base on quota.
Currently, due to lack of transparency, intakes for matriculation and
IPT sideline the Indian Malaysians.
The evidence is apparent in universities where Indian Malaysians
have limited opportunity in getting the courses they prefer although
their results appear to be suitable and sufficient to qualify them to
take up such a course or program.
In addition, treating STPM and matriculation as the same entry
qualification for university intake is not justifiable.
It is important that the government establish one university entry
system.
It is recommended that a 8% quota for Indian Malaysians be given
for all courses in matriculation and IP
STPM –Rebranding – Pre University Year 1 & Year II
STPM – Sijil Tinggi Pelajaran Malaysia is manage by MPM – Majlis
Pelajaran Malaysia : STPM revamp of the system and concept is
overdue as the pre-entry qualification to public universities and
equating Matriculation to STPM as an entry for University is gravely
an oversight. NIAT congratulates the move by MOE July 2011 to
introduce semesterly exam format. However, the rebranding is not
complete without the following addendums; NIAT is recommending
this changes due to high percentile of Indian Malaysian students
www.myniat.com
resorting to STPM as their path of choice to University while most of
the Bumi students will go through matriculation or other simplified
form of entry to higher education.
1. Conditional Entry Requirement for Government :
FREE education thru Pre-University-STPM to be made
2 credits: If without Bahasa Malaysia or English Credit:
They are required to sit for July papers/December
paaper to earn credits before Pre-University Certificate
can be released or University Application can be
processed: Basic – We are recommending conditional
Intake for those pass SPM with at least 2 credits. This
move will ease the following issues
Reducing the dropouts from SPM – as one of the
concern in education Blue Print 2012
Reducing the financial burden of students and
parents trying to seek private education.
2. Do away with UNIFORM in Pre- University – impose
concept dress codes like some of the University – UUM
This move will mentally liberate the school like culture,
behavior and give renewed perspective of carrier
and life outlook for students after 11 years of
uniform education system.
3. Increase number of school-centre offering
Government and Private Pre-University by 25% by
boost of Tamil and Tamil Literature will help
government in effectively to fulfill qualified Tamil
New Tamil Schools with 1:2750 population
New Fully Aided Tamil to be build in areas which have a population
average of more than 10000 Indians within a 5KM radius in a given
district.
This is particularly relevant in Selangor (especially in Klang and
Petaling Jaya), Perak, Johor, Penang and Kedah.
With better Tamil school performance records and an increasing
demand for the Tamil schools in these areas, new schools are
urgently needed.
7 New Tamil School permission is great move, however, relocation
of Sekolah Kurang Murid (SKM) schools is equally important.
New Tamil Private School Permission
The Ministry of Education (MOE) must allow for a more competitive
and open transparent system to set up and establish New Tamil
Private Schools at locations that are appropriate e.g. Selangor,
Johor, Penang.
Tamil School Land Acquisition
The Ministry of Education (MOE) must participate in land acquisition
and make all Tamil school fully aided schools. The Primary role of an
www.myniat.com
effective government is to provide basic education free to society
irrespective of race, religion or segmentation howsoever. Tamil
schools are facing many daunting issues with land aqusation and the
fund for land purchase. MOE must take over the role and adapt all
school for SBP – Sekolah Bantuan Penuh.
Approximately 61% of the 523 Tamil schools are under SKM
(Sekolah Kurang Murid) especially in estates.
To overcome this Tamil School can go thru relocation into more
populated and strategic areas that meet the basic needs of the full
infrastructure. Otherwise, “cantuman” too is good idea to
consolidate the resources for better performance in certain
geographical area. However, combination of one school must be
followed of relocation of another one. So, the number of school will
maintained.
Sekolah Cantuman Chaah Johor is one of the successful examples of
“Sekolah Cantuman”.
Disparity Among Male & Female Teachers
Currently, Tamil School is overwhelmingly dominated by female
teachers.
While naturally inclined towards education and the skills of
nurturing, the female teachers are finding it difficult to impose
discipline, to engage in sports activities and other activities that are
generally regarded as more male friendly activities.
It is important to achieve gender equality in this aspect.
We need to reduce the female: male ratio to 60: 40.
8% PTD for Diplomatic and Governmental positions
Recruitment for PTD positions has been overwhelmingly limited for
Malay Malaysians in the past.
www.myniat.com
It is recommended that the government ensures 8% of the PTD
recruitment for suitably qualified Indian Malaysians.
Indian Malaysian Counselor in Schools
The Primary and Secondary schools with significant Indian
Malaysian population need to appoint a qualified Indian
Counselor(s) to deal with disciplinary and other issues.
Tamil School (Grade A and Grade B) must also appoint counselors
to deal with problematic students.
It is proposed that for every 200 students a fulltime counselor
should be appointed – a fair ratio of 200:1.
POC ( People Own Culture ) in Primary & Secondary Schools
All secondary/Primary school must be given a POC program apart
from the POL (People’s Own Language).
Cultural studies is equally if not more important than secular or sex
education which is gaining support now among all quarters, which
we agree is important for a balanced growth of students and could
can prevent unwarranted activities. Yet cultural activities are also
important to ensure a well rounded growth as per “Falsafah
Pendidikan Negara”
DBP – Dewan Bahasa & Pustaka : Tamil Translation Unit
Tamil schools are facing acute shortage of reference books in
science and technology related subjects such as computers,
biology and mathematic for students’ reference and general
knowledge.
Page50

INDIAN MALAYSIANS’ CALLS FOR GE13 - UNDO the HISTORY and REDO the PLAN
Although these books can be imported from India, a more proactive
measure would be to provide incentives for the local publishers to
publish or to assign DBP to appropriately translate from other
languages into Tamil language.
Government Study Loan for Studies Abroad Thru PTPTN
Students should be able to seek loans to pursue studies locally and
abroad.
Currently, the PTPTN loans are only for those recognized local
studies. However, in certain cases important critical areas of study
are only available overseas.
The Government must identify fields of studies and type of schools
for candidates to be eligible for study loans. Example of field of
study include Green Technology, Indian Culinary arts,
Manufacturing Technology, Aerospace, Piloting, cultural, acting and
others.
The loan repayments can be similar to that of commercial banks
which is always difficult to obtain.
Loan from the government or suitably appointed Government body
can be guaranteed by parents with a mandatory requirement to
return home or full payment failing which their passports could be
revoked.
Presently studies that is gaining popularity amongst the Indian
Malaysian Students include a vast area including Medical, Pilot,
Accrual Science, Engineering, Cultural Degrees (Singing, Musical,
Acting, Sculptures, Architect) Indian Culinary, Bridal, Jewelry
Engineering/art, Textile, even Hindu Priesthood.
www.myniat.com
Therefore the loan disbursement ought not to be based on the type
of study but primarily based on making the facility available.
IV INDIAN MALAYSIAN AND THEIR
SOCIAL ISSUES
a. Alcohol Laws and Programs in Malaysia
The Government has to recognize that alcohol consumption is a
growing problem among youths and especially Malaysian Indian
youths.
This is in need of an urgent attention. Ministry of Youth need to
take this initiative. The Malaysia Hindu Sangam with a coalition of
NGOs had initiated the effort to check this scourge, but with the
lack of enforcement by the authorities, all efforts will be of no
use.
Page51

INDIAN MALAYSIANS’ CALLS FOR GE13 - UNDO the HISTORY and REDO the PLAN
NIAT has recognized the importance of creating KRAs and prepare
KPIs for ministry on the following issues particularly for a review of
the alcohol laws and regulation in Malaysia particularly to deter
youth from alcohol.
1. 21 to Drink – Change the current age limit of 18 to above 21
2. Criminalize Public Drinking, Displays and Intoxicated Person
3. Setting up of a Malaysia Alcohol Research and Rehabilitation
Centre
4. Legislate Under Aged Alcoholism & make it an arrest able
offence for Minors To Consume Alcohol
5. Restricted Alcohol Retail whereby all Alcohol Retailing should
be confined to Liquor Shops with controlled business hours
6. Liquor Licensing at all eateries that dispense alcohol of any type
inclusive of cocktail and beer.
7. Banning of Alcohol Advertisements – Glorification in all
mainstream Media - Electronic, Alternative and Printing Media
completely. Including in Movie – Songs
8. Mandatory Jail Terms for Alcohol Smuggling, illegal trade and
Law Breakers :
9. Banning the Manufacturing, trading and retailing of local illegal
brands such as Samsu & Toddy
10. Taxation System based on Alcohol content which will
simultaneously increase government’s tax revenue by another
RM200Mil
11. Anti Alcohol Slogan on all labels including reminders from
major religions
12. Alcohol & Drug Test in Colleges/University - IPT &
College/University administration to do random alcohol and
drug test in campus.
Alcohol and drug is rampant is colleges especially in private colleges.
Random tests need to be carried pout particularly on Mondays.
www.myniat.com
ICE, Weed and many other enhancer drug pills/substance used in
colleges/universities for various reasons and excuses must be
eliminated. The University, Police and Ministry of Higher Education
must work in coordination.
NIAT random test yielded very dramatic results in one of the private
Universities. The usage of ICE and its availability to college students
is a generally known and unfortunately accepted culture.
b. Youth Gangsterism
The Government has to recognize the seriousness of this issue.
The Government has to allocate appropriate funding of up to
10Million for NGOs to be involved in preventive measures especially
in curbing Gangsterism.
Creating of Peace Clubs in Schools through KPM as part of their cocurriculum
etc. is one of the many initiatives that need to be
undertaken.
The Police must hold more talks in school on the issue with students
and children.
Further, the Schools need to work closely with the police in
respect of the following:
Placement of Police in secondary schools with serious
discipline issues could be seen as a deterrent to curb
discipline problems.
Schools in many western countries have adopted this method
widely and have been effective.
Page52

INDIAN MALAYSIANS’ CALLS FOR GE13 - UNDO the HISTORY and REDO the PLAN
NIAT urges MOE to look into having Permanent Police Presence
in crime prone schools or locations like Puchong, Sentul etc.
BAN GANGSTERISM – “Funeral or Celebration of Matcha”
During the several inquires it was learnt that when a member of
a gangster group died due to accident or victim of violence, his
funeral has become stage of glory whereby his history of
violence (including killing, fighting and etc) will be glorified, fire
crackers will be burnt and alcohol will flow freely. “Rempit”
motorbike motorcades, sign of gangster group like 8, 36 and etc
will be displayed.
So what happens after a Macha had passed away?
The guy’s friends will immediately be informed and a few teams will spread out
to inform the rest. The Facebook communication team will immediately set up
a fan page for the Macha and pictures of him, his gang activities, and the full
statistics of his crime records are displayed. The rest of the gang members will
immediately shout their slogan ‘Hidup,Hidup’. Some will start preaching about
these criminals as though they’re heroes of the society. Ugly Meenachis on the
other hand will comment a common thing which is ‘RIP Anne’.
Depending on their gang numbers, a few banners will be printed out by their
media team. The media team is also responsible to hang the banners around
the funeral location. Few examples of the banners and decorations below
www.myniat.com
Adapted from raggedindian.com
This practice is not only for funerals but at birthday
celebrations. Most of the time the family members have very
little say or say nothing due to fear.
This practice must be BANNED immediately and action must be
taken to curb this practice as it is against public morals and the
police must be given full authority to take appropriate action.
c. National Service Additional Allocation
National Service is known for its effective methods in shifting
mindset of our young youths.
We also urge the government to place all the Malaysian Indian
students with disciplinary issues, dropouts and gangsterism
problems into Special NS programs.
We are requesting that the Government make an additional 5000
places allocation for Malaysian Indian students; spread into 5
years.
The program should be fine-tuned to fit the challenged nature of
the students. The same concept can be used for similarly inclined
students from all races in the country.
Page53

INDIAN MALAYSIANS’ CALLS FOR GE13 - UNDO the HISTORY and REDO the PLAN
d. Special Skill & Mindset Training –Shorten Jail Term
Ex-convicts and dropouts and have no or no other serious crime
records, should be enrolled in SPECIAL SKILL & Mindset Training
while in castration especially, inmates under 30 years old. The Skill
Training Certificate requirement can be exchanged for shorter jail
term.
The Skills Training inclusive of MINDSET Training for a duration of 6
months (a package) should be done before the embark on the SKM
Level 1 studies. Subsequently, they can be absorbed as general
workers in government and in the private sectors.
The government can provide incentives for a year to encourage the
hiring of ex-convicts. Additionally, they can be requested to attend
frequent counseling in assigned counseling centers or registered
NGOs with counseling programs.
These efforts will reduce the tendency of those involved in crime to
go back to the similar activities in the future. Such programs have
been found to be successful in the US and have shown dramatic
improvements.
In addition, upon successful completion of the program, they should
be eligible for micro loan programs to start a business or relocation
assistance.
We ask the government to set aside 1000 Spaces to this group: They
must be given loan incentives to undertake the course and if
suitably qualified to take appropriate loans for business
development
e. Youth Organization : Permanent Annual Allocation
www.myniat.com
Youth Organizations should be provided with adequate funds
annually, particularly all Malaysian Indian Youth NGOs.
Currently, the allocation comes from MBM (Majlis Belia Malaysia)
and limits the NGOs to conduct effective programs. The allocation is
difficult to obtain by Malaysian Indian Youth NGOs.
Since these programs are an integral part of Youth development in
Malaysia, it is recommended that the allocation of RM 10 million be
allocated to register NGOs for their various approved programs.
This should be done at national, state and district levels.
Programs related to Education, Culture, Sport, Alcohol, Gangsterism
eradication, Violence Crime and School Dropouts eradication should
be emphasized since these are the striking issues among Indian
Malaysian youth.
The government should set KPIs to monitor these NGOs. Current
Indian Malaysian Youth organization does not get enough funding
for them to do vigorous programs on Youth issues.
We therefore urge their funding to be increased to assist
government in curbing crime, dropouts, gangsterism and
alcoholism.
We recommend that the permanent allocation be made based on
Memberships, Activities, Effectiveness and National Image.
For an immediate purpose, the MIYC – Malaysian Indian Youth
Council : KBBT – Kelab Bell Belia Tamil : with more than 200
branches national wide may be chosen as the ambassador to bring
about change in youth outreach.
Page54

INDIAN MALAYSIANS’ CALLS FOR GE13 - UNDO the HISTORY and REDO the PLAN
f. Religious NGOs Program Funding
Religious Organizations should be provided with adequate funds
annually, particularly those who have proven track record of
facilitating and encouraging proper and good social conduct and
decorum.
Currently, most of these organizations derive their funding through
charity fund raisers and philanthropists. The funding from the
government is minimal and rather on a piece meal basis.
A permanent and structured formula of funding must be created
and monitored.
Since religious and social programs are an integral part of a
structured development of the people of Malaysia, it is
recommended that the allocation of RM 10 million be allocated to
registered NGOs for their various approved programs.
This should be done at national, state and district levels.
Programs related to Religious education, Culture, Culture, Cultural
sport, Alcoholism and Gangsterism Eradication, Violence Crime and
School Dropouts Eradication should be emphasized since these are
the striking issues among the Indian Malaysian youth currently.
For an immediate purpose, the Hindu Sangam with its extensive
channels in Malaysia may be chosen as the ambassador to bring
about change in youth outreach through religion.
g. Sports NGO & Sport Program Funding
The Indian Malaysians used to be leading the sports arena of
Malaysia at one time. Yet today not only the Indian Malaysian’s
www.myniat.com
participation is limited but at a national level the performance is
undeniably below expectation.
Sports is one of the most effective ways to channel the energy into
good causes, preventing the youths from any major inappropriate
or unwanted activities.
It is recommended that more allocation be channeled to boost the
creation of more SPORTs NGOs in the likes of the Futsal Club
Petaling Jaya, Persatuan Sepak Takraw and others.
- In addition, we are urging the government to consider giving
incentive for creating 100 new Malaysian Indian cultural and
sport NGOs nationwide which can be parked under the Ministry
of Youth.
- As a long term measure, the creation of NGOs will eventually
distract youths from engaging in illegal activities which is costing
the government a significant amount – ‘prevention is better and
cheaper than cure”.
The Prime Minister’s announcement on the 3 rd of August 2012
on grants for Sports NGOs was a commendable one.
However, a onetime grant will not do anything or will not be
able to reflect on a tangible effect on the ground.
A special grant scheme must be introduced.
- The Government must REVIVE immediately the SPORT
infrastructure in all housing, township, rural, and public
places to encourage more youth to be pulled into sports ;
examples :- Basketball courts, Badminton courts, Futsal court,
skating ring, public swimming, park equipped with gym
equipments.
Page55

INDIAN MALAYSIANS’ CALLS FOR GE13 - UNDO the HISTORY and REDO the PLAN
- We also propose “Pusat Gym Rakyat” : with subsidized gym
service. Free for Students and Public RM50/Month.
h. Wedding Courses & Counseling
Divorce and Parenting flaws is costing the society and government
millions on the expense of their kids.
Currently, Muslim weddings are to be solemnized only after the
couple has attended a certified wedding course but the same is not
applicable to non-Muslims.
This wedding course is proven to be effective and imposing such a
pre requisite condition for registration is important for the non-
Muslims too.
This course can be conducted by the religious NGOs while the main
framework of the course should be drawn up and provided by the
Ministry of Women, Family and Community Development and
should incorporate issues such as :
- HIV & Health: test a must for all wedding registration. This is
also a way to impose and implement responsibility on health
and child support issues.
- Parenting: Mandatory marriage courses are implemented
before the legal marriage registration. Example Malaysia Hindu
Sangam can engage in Wedding Courses for all Hindu/Christian
couples. Couples also will be reminded of children needs for
birth certificates, medical vaccination and etc.
- Religious Competency Training : Sikh – Hindu – Christian –
Buddhist – cooperation of Inter religious Council
- All Divorce must have gone thru counseling. If children and
custody issues are involved additionally divorce couple must
www.myniat.com
attend appropriate counseling session. It is important that
before the couples are eligible for divorce application, the
couple must have obtained a certificate / letter from the
counselor. This may deter or reduce the number of divorces as
it has been recorded in the USA, UK and France
i. Domestic Abuse, Abuse Awareness & Rights
Indians from lower economic strata are primarily the victims of
domestic abuse.
Although the law requests an arrest, seldom the abusers get
punished. Little is done by the Police and the Ministry to overcome
this problem. The domestic abuse assistance is purely left to NGOs .
The situation gets really bad in rural and estate localities.
Moreover, the children’s and the mothers of such abuse are left
without any support. As such, it is recommended that serious steps
be taken in terms of allocating hostels for the mother and the
children at least as temporary refuge. Consequently, financial
support is needed for such cases.
The Ministry of Women Family and Community Development
must also formulate even more harsh laws to protect these
children, enforce child support laws and alimony for mothers.
Usually alcohol, drugs, unemployment, and financial conditions
are the main reasons for the problem.
One in 4 poverty prone families are affected by this phenomenon.
Two in 3 kids from these families are dropouts.
Two in 4 kids that are dropouts are involved in illegal activities
that may involve violent crimes. The statistic must be changed
urgently
Page56

INDIAN MALAYSIANS’ CALLS FOR GE13 - UNDO the HISTORY and REDO the PLAN
j. Single Mother - Motherhoods
The “Single Mother” must be redefined to include, OKU husbands,
separated women, and widows.
Single mothers must be given the opportunity to own their own
house through the government’s low cost housing programs.
Indian Malaysian single mothers are to be assisted to own houses
with at least a target of 1000 low cost houses set aside for this
challenged group with Welfare Assistance.
E-Kasih can be used as a platform to identify these poor families.
The rental payment approach could be implemented for the
purchase of the houses.
In the past, these practices failed due to corruption, unethical
political motives and huge amount of red tape. The right platform is
to set the KPI on the basis of house ownerships and the rightful
owners must be identifiable and justifiable.
k. Adult Community Night Classes
Once a week classes revolving around unity, business opportunities,
parenting, government programs, racial integration and others is
needed. The attendees of this program could be given allowances
like the Train & Place Program according to their attendance.
NGOs or welfare department should organize these classes at
strategic areas especially within the vicinity of the poor and
uneducated society as well as crime prone areas. Examples, Taman
Dato Harun. Taman Sri Sentosa, Sentul, Taman Sri Andalas, and
others.
www.myniat.com
This would be an effective effort in integrating the people and
educating them substantially lifting them up in society
l. Ex convicts Special Programs
Program to Hire Convicts direct from prison itself
It is part of Social Integration Program for convicts. Usually the
final year of their sentence for good behavior.
The USA has implemented this program very successfully -
restaurants, construction and manufacturing sectors uses this
special program. The salary will be paid to inmates through
prison system.
Research shows 70% of the inmates eventually joined the
company in which they were working during this special
program.
SKM – JPK Program – Level 1 – 4 to be offered for convicts
under 30 years old as mandatory for those that do not have
Diploma or Higher education. 6 Month SKM MINDSET
program before they are enrolled into SKM Lev 1-4 Programs.
Make it a mandatory requirement and shorten their
monitoring period so that they can get on with life.
NGO-Prison – Mentoring & Monitoring Program: example
Tamilan Uthavum Karangal is a great value NGO helping Ex-
Convicts to find new path of life and role model.
Page57

INDIAN MALAYSIANS’ CALLS FOR GE13 - UNDO the HISTORY and REDO the PLAN
Religious, Welfare & Social – Monitoring of their Family &
Children must be added as part of this program.
We ask the new government to have NKRA to reduce the Indian
Youth Crimes by 50% and Repeat Offenders by 75% in 5 years.
The Government must work with relevant NGO and the society
to ensure the right and effective solution is identified to reverse
the current trend.
Gang Buster Hotline – Open Line for public input and their
activities
Monitoring of certain Areas of Gang Activities
Separate Juvenile Offenders from adults in castration
School – Campaign ; Primary School
Busting Gangster Heads
Criminalize certain Signs – 08, 03, 36 and etc
etc
The biggest cause of the problems surrounding the Indian
Malaysian includes:
1. Urban Poverty – Anger/Inferior Complex
2. School Dropouts & No Skill
3. Gangsterism Influence
4. Alcohol & Violence Eco System
5. Glamorizing Violence-Alcohol in movies
m. Social Entertainment, Media & Press
Indian Malaysians are the highest spender in terms of per capita for
movies and this is a known fact. The entertainment has a great
influence in the behavioral aspects of Malaysian Indian youth
ranging from the fashion influence, language influence and to the
attitude influence. Thus, we urge the government to :
www.myniat.com
Censorship Policies on Tamil movies, especially movies from
India and subject them to the same level or standard in respect
of violence and sexual content.
In recent years, Tamil movies have become one of the main
contributors of gangsterism, violence and morals decay
amongst the youths.
Censorship board has been very relaxed on foreign Tamil movies
and the rating is questionable and inconsistent if compared with
our values and moral.
In the recent days movies like Naan Mahan Alla, Mangatha,
Billa, Kandasamy, Goa and Ayirathil Oruvan were proof of failed
censorship in sexual- alcoholism - gangsterism content.
Censor all the drinking glorifying scenes – songs or gestures not
for PUBLIC VIEWING
Censor and impose Special Tax on Movies Glorifying
Gangsterism : Billa, Mangattha
Censor all the violent scene involving “Aruva” or instruments
Sexual Content & Women exploiting Scene or gestures to be
removed
Limit showings of “Indian Tamil serial” Impact – ASTRO: 1 hour
or less in Local Channel : Syndicated – higher tax
Mute Foul Language & Double Meaning Dialogs
We recommend Higher Taxes on Violence and sexual content
INDIAN MALAYSIANS’ CALLS FOR GE13 - UNDO the HISTORY and REDO the PLAN
V. INDIAN MALAYSIAN AND GOVERNMENT
POLICIES
Government Policy should forcefully ensure that it allows all society
members to participate in the economy especially with regards to
government programs and initiatives. However, the government has
been a little slow in making the necessary policy to show its
commitment on certain issues. NIAT recommends that the new
Government work towards a more open door policy and in
particular the following areas.
a. Policy in West Malaysia
It is recommended that the government declares 8% allocation for
the Malaysian Indian for critical areas of interest so that
proportionate participation is achieved at every level. The 8%
allocation for Malaysian Indian such includes areas as follows:
i. Civil Service Employment
www.myniat.com
The Government has to proactively meet the participation
quota of Malaysian Indian in Civil Services at the minimum of
8% across the board.
It is recommended that an additional 60000 employments be
made available in the civil services. Currently, Indian Malaysians
represent less than 4% of civil servant force.
This area was overlooked for a long time and it’s time now to
act fast and effectively.
Almost 56000 government jobs including 1350 “executive” level
jobs that should have been given to Indian Malaysians have
been “diverted”. This must be changed immediately.
3500 Indian Malaysian must be recruited into civil service per
annum to fill the quota. It is interesting to note that even so it
will take 16 years before we can make the population
composition
ii. PTD – Pegawai Tadbir & Diplomatic
We are recommending that at the end of 5 years, the
government achieves a target of 8% of Malaysian Indian
participation for PTD.
The Government must fix the disparity in opportunities in
every government sector to ensure the success in winning the
hearts of the people and moving forward with trust and
respect.
Page59

INDIAN MALAYSIANS’ CALLS FOR GE13 - UNDO the HISTORY and REDO the PLAN
iii. Military/Police/Enforcement
8% of the new recruitment must be filled with Indian
Malaysians and by 2020 these sectors must individually show a
8% participation by Indian Malaysians.
According our meeting with IGP on August 2 nd 2012 – only 3.4%
of the total Police Force are current Indians; the force must
reach out to reduce the gap. Police has to add at least 750
Indian Malaysian officers on various levels annually to the Force
for 5 years to fulfill the racial composition.
Currently Police have shortfall of about 5000 Officers to match
the population composition. By adding 750 officers per year will
take 7 years to fulfill;
Current Statistic example: 4500 Applications: 473 Applications
were from Indian Malaysian, 213 were qualified for interviews
while 54 were offered a job as Inspector. This info was rendered
to NIAT during our meeting with IGP on Aug 2 nd 2012.
iv. GLCs: Employment, Business & Participation
Government has to engage and erase some of the unwritten
and unspoken policies. All GLCs including TNB. Telekom,
PETRONAS and etc must now openly employ Indian Malaysians.
Government must make an affirmative policy to all GLC to meet
the quota. GLCs are seen to be Malay oriented companies based
on public perception.
We need a Government policy stating and requiring 8% Indian
Malaysian employment across the board just like the 30%
www.myniat.com
requirement for private listing company to have Bumiputera
stake. Please amend it to include the minorities including the
Sabah & Sarawak
v. Education, IPT & Matriculation
Intake for Matriculation and IPT must be synchronized with
national policy of 8% and the merit system need to be
discontinued.
JPA Scholarships must be awarded according to the 8% quota,
so the Malaysian Indian student does not get sidelined by the
purported merit requirement which is highly questionable and
not transparent.
The opportunities in Engineering, Biotech, Medicine, Law,
Finance, Oil & Gas, Chemical, Pilot, and etc must be safe
guarded and the Indian Malaysian must be given the 8 % of the
seats in each of the area of studies.
vi. Skill & JPK
We propose that the government allocate RM50Mil as study
loans with “saradiri” of RM350/month allowances through
PTPK for Malaysian Indian’s Skill Training Scheme up to DKM
level.
Budget 2013 – Rm50Mil – 3200 Skill training for Indian
Malaysian.
The FUND is scholarship only for those complete up to DKM
Level. Other level education should be treated as loan as part
deterrence to be dropout in skill education..
Government needs to make policies and ruling for private
MLVK/JPK institutions to offer up to Level 3 in disciplines of
their choice. This means, they should not be allowed to do
Level 1 or level 2 only but, must complete the entire set up to
Page60

INDIAN MALAYSIANS’ CALLS FOR GE13 - UNDO the HISTORY and REDO the PLAN
Level 3. Currently there are great number of private operators
offering only Level 1 and 2 and upon completion the students
are left to find another institution to continue their studies.
This has resulted in only 20% or less pursuing all the way up to
level 3. The 80% of those who have completed Level 1 and 2 are
found to be inadequate for the employment entry level in the
market. Additionally, without sufficient push to Level 3, this
path is less viable as carrier options that will enhance socialeconomic
wellbeing of the Indian Malaysians.
Likewise, we also urge JPK to look hard into MQA accredited
Skill University for those wanting to continue further to diploma
and degree level. These ideas have been bouncing around for a
while at the MOHR because of unresolved coordination
between IPT & MQA. We urge that the Government sets a firm
date on the Skill University issue with 8% allocation for
Malaysian Indian students in various and demanding fields like,
healthcare, oil & gas, aerospace, automobile, green tech, civil &
construction, networking and etc.
vii. Federal Tenders
Malaysia belongs to all Malaysian; so does the government
business. However due to lack of transparency or clear policy
direction the Federal business has been a “jackpot lottery” only
to few Malaysians who fall under the favored category or
extremely limited Indian Malaysians contractors.
All qualified Indian Malaysians should be allowed to register as
Class F Contractors at the Central Works Registry and this
registration should not be reserved for Bumiputra contractors
alone.
www.myniat.com
An Indian contractor should not be forced to obtain only subcontract
jobs from Malay contractors who are registered, as it is
currently practiced.
Most Indian Malaysian contractors do not have the financial
capacity to wrestle jobs from the more established Chinese
contractors and they need assistance at the starting blocks as
Class F contractors.
Besides these factors, currently, there is a requirement for
BUMIPUTERA STATUS for companies to qualify for certain
tenders; requirement of 30% Bumiputera employees or equity
ownerships in public listing company and etc. this is against the
very notion of Malaysianism.
viii. Formation New Status: Unity Company “Status” replacing
“Bumi” Status Company
We recommend a new company composition is created. This
category of company will be called “Unity”, the companies
ought to have a 30-20-10 ratio in respect of ethic participation.
The balance 40% can be held by any one or more of the ethnic
population. This will give a true reflection of a Malaysian
company.
It could be made a requirement that all Government projects
be awarded to these companies as a remedial action instead
of Bumi status companies alone.
ix. APs
We seek 8% APs to be given to Indian Malaysians
accordingly, so that the wealth is distributed equally among
all law abiding citizens of the land. The transparency in AP
Page61

INDIAN MALAYSIANS’ CALLS FOR GE13 - UNDO the HISTORY and REDO the PLAN
awards will reduce the suspicion of “RAKYAT” on the
government.
b. One Malaysia Language
Recognize and declare Mandarin and Tamil as forming part of the
Malaysian Language.
Multi-Lingual Information dissemination is a great and effective
communication mode. The Government should look into additional
choices on Mandarin and Tamil.
“Bahasa Jiwa Bangsa” - it is the best way to imprint, penetrate and
ensure smooth flow of information to all quarters regardless of their
proficiency in English and Malay languages. Singapore has done a
great job in creating a multi-lingual environment and yet they have
a great sense belonging as “Singaporean”.
It is undisputed that the Patriotism is not degenerated due only to
additional languages being recognized as Malaysian Languages
while simultaneously upholding the privileged position of Bahasa
Malaysia as our National Language.
We recognize our National Language’s privileged position but we
also must ensure the information and connectivity through
languages remain strong by all means.
Establishing Multi-Lingual signage in the true spirit of Malaysia
should be a good starting point.
Sign boards will become a constant reminder that we all are
recognized, respected and the diversity of its citizens is being
celebrated under the proud stripes of the “Jalur Gemilang”.
c. Language Unity
www.myniat.com
The Government has to encourage more Malays to learn Mandarin
and Tamil, and vice versa Malays and Indian Malaysians to learn
Mandarin and more Malays and Malaysian Chinese to learn Tamil.
A Chinese that speaks Tamil naturally will be closer to Indians and
accordingly others who understands another language and their
culture would be closer with each other.
Unity by language integration is the fastest approach in reducing the
growing unity gap.
d. Public listed Companies – Additional Requirement
Require all Public Listed Companies to allocate a 8% employment to
the minority Indian Malaysian just as there is current policy on
Bumputera requirement of 30%.
It is only with the government policy to enforce such a requirement
on the corporate sector to join hands with the government to reach
balance economical progress, can such an exercise be a success
e. Estate Relocation Policy
All Malaysians including Indian Malaysian relocated from the
estate for any reason must be awarded the following:-
- Re-Skill program for not less than 6 months before the
relocation take place.
- People Housing Ownership: Offered for those who worked
for more than 10 years or
Page62

INDIAN MALAYSIANS’ CALLS FOR GE13 - UNDO the HISTORY and REDO the PLAN
- People Rental Program for those who have less than 10 years
but more than 5 years to enable them to rent a home
- Compensation for those who have worked for less than 1 year –
a salary or RM3000 per household, whichever higher.
- Medical & Life Insurance for the ex-employees, including for
the 32 critical illnesses
- Education Scholarship for those who makes it to Pre-University
or University programs, locally or abroad
Malaysia has been in the pocket of the MNC companies for decades
and continues to be neglected.
NIAT – interview ( Oct 10 th 2012) with NUPW former President Mr.
Navamugunthan, indicated British was very clear in awarding
independence and not to have their interest in terms of plantation
business to be disturbed by any legislation or enforcement by
incoming Alliance government. It is clear that no permanent plan
was ever in place to defend the poor condition of estate workers.
In the 1970’s, 65% of national wealth were owned by foreign
holdings and during the rapid urbanization, Malaysia has either
forgotten or conveniently neglected the fair share for those chased
out of estates.
One example is Madam K & Mr. S worked in an estate for 3 decades
and exited the estate with nothing in hand, with 9 children on tow.
They were only “gifted” RM2K called service money.
Squartered on a KTM Land for years before their children pulled
them out of poverty through education.
www.myniat.com
While this is a story with a happy ending many were not so lucky
and end up in the iron grip of the new phenomenon called Urban
Poverty.
Situation must end and the Government must take proactive steps
to ensure that when families are uprooted from their home base,
adequate steps are taken to ensure their livelihood and continued
sustainability to ensure all round development – and not a lop-sided
one in the name of urbanization or development.
f. Malaysian Indian Term & Racial Terms
The Indian Malaysian must not be referred as “Indian”. Indian refers
to the citizen of India.
Reference of “Orang India” is an insult and questioning our
Malaysian Citizenship.
We urge the Government to correct this overlooked term of
reference and officially announce the correct use of the reference
as “Indian Malaysian” or Malaysian of Indian roots.
In the same token we strongly recommend the government to
classify a series of words that are deemed to be sensitive, racially
motivated and unity destroyer. Example “Kaum Pendatang”,
“Keling” and etc.
A legislation should be drafted to spell out clearly and in the
strongest way possible to punish those who use such phrases or
terms intentionally or unintentionally, racially and religiously
sensitive words, name callings, race implication and racist terms
to create sensitivity in the country.
Page63

INDIAN MALAYSIANS’ CALLS FOR GE13 - UNDO the HISTORY and REDO the PLAN
We have survived enough race based controversies in the country
before and we cannot afford to let it go on any longer.
The Seditious Act must be amended to include a clear definition of
those acts and make it a mandatory crime to utter such terms and
insinuations, whether intended or otherwise. Intention is irrelevant
when it hurts the very base of humanity.
g. Dasar Pandang Kehadapan
Enough of finger pointing, enough of blaming, enough of hating and
enough of racial based division.
Let us move forward in a friendly and positive manner, putting all
our differences behind and our future in front, we Malaysians can
make it happen.
In the past, it was our courage, unity and trust that moved the
country forward and without a doubt it is going to be the unity and
togetherness regardless of race and religion that will thrust the
economy and country into the next millennium fundamentally
resting on a common interest of living in harmony and mutual
prosperity.
VI INDIAN MALAYSIAN AND THE CALL FOR
CORRECTIVE ACTION
a. Royal Commission of Inquiry on the May 13 th 1969 incident
and Declassification of OSA on all documents related to the
incident
After more than 3 decades the May 13 th seems to be the biggest
mystery while many others argue as to whether it was the biggest
www.myniat.com
conspiracy theory. Whatever it is, the document and report
submitted by the government and amount of contradiction with
other reports and studies do give us reasonable doubts to propose
that it warrants a non-partisan and fair investigation into the
incident.
The reason why a RCI is needed:-
Objectives
- To clear the doubts about one of the biggest (negative)
historical event in Malaysia
- To exonerate the Malaysian history which has been
manipulated by certain individuals or parties.
- Those responsible need to be identified and be brought to
justice
- Identify and recognize those unnecessarily murdered in those
events
- Truth must be revealed as there is a need for the “real lesson”
for the future while all the conspiracy and doubts must be put
to rest once and for all.
Page64

INDIAN MALAYSIANS’ CALLS FOR GE13 - UNDO the HISTORY and REDO the PLAN
b. Kempen Sejarah Malaysia Sebenar (KemSMS)
It is learnt that the Government is planning on implementing the
proposal for History to be made a compulsory pass for the SPM
2013 examination.
Since the government made the announcement for this plan,
KemSMS have had many meetings and discussions with parents and
members of the public throughout the country. Based on these
discussions NIAT proposes that there should be no stipulation for a
Compulsory Pass for the History Subject – 2013
Yet at the same time, there must be a review the History Lesson to
be inclusive of the contribution and role of all races including the
role of east Malaysia.
History must be true reflection of what actually happened and
distinguished from opinion, preaching, non-collaborated legendary
stories, brainwashing, misleading, political tactics, racial division,
religious propagation, government propaganda and other nonhistorical
matters.
c. Remove Anak Lelaki and Anak Perempuan (a/l and a/p)
It is interesting to note that Muslims can use the term “Bin’ and
“Binti”, while the Chinese use the surname without the need to
have an additional “A/L” or “S/O”.
www.myniat.com
It is now proposed that for all others including the Indian
Malaysians – the use of the phrase “A/L” or “S/O” or “A/P” or “D/O”
be dropped or at least be at the discretion of the Parents and not a
mandatory requirement.
Instead the father’s name or family name if any, should be included
at the end of the name; therefore if the father’s name is Ramasamy
and the child is being named Anjali (a girl) the child’s name on the
Birth certificate should read “ANJALI RAMASAMY” instead of
‘ANJALI A/P RAMASAMY”
NIAT believes this gives more credibility to the name and form
rather than the previous style. The use of the phrase “A/L” or “S/O”
or “A/P” or “D/O” is not existent in any of the developed or modern
societies around the world.
As a country aspiring to reach developed nation status Malaysia
must also drop the use of such unnecessary additional phrases etc
which does not in any way improve the or benefit the situation – it
not only looks but sounds odd!
- The usage is single out Indians/minority and leave (AL or AP) as
middle name in international documentation that creates
confusion when we enter foreign countries eg USA, Britain etc
- Cultural and religious believe to use numerical addition which
does not sync well with A/P or A/L.
- In reality, the A/P, A/L is rarely used in public and only in
formal documentation.
Malaysians deserve to have their name they was they want
without having to comply with abbreviations and oblique(s) (“/”)
just for the sake of purported administrative convenience
Page65

INDIAN MALAYSIANS’ CALLS FOR GE13 - UNDO the HISTORY and REDO the PLAN
d. REVIEW Biro Tatanegara (BTN) - CONTENT
Based on its vision and mission – it was to “formed to nurture the
true spirit of Malaysian in a professional and ethical manner”.
To reflect this intention, the Biro needs to uplift its current efforts to
ensure a more wholesome effort is made to uplift the patriotism of
all Malaysians towards Malaysia. All activities carried out by the Biro
must ensure proportionate enrolment and participation by all the
communities esp the minority communities including the Indian
Malaysian
The process of unifying all Malaysians cannot be achieved merely
through mediocre efforts involving primarily the Malays. Unification
by its very intention means uniting all the people of the land –
which necessarily includes the Chinese, the Indians and all other
races in the country. Based on the current effort, the programs are
primarily centered around the Muslims and the Malay Community
only.
Building a “Developed and Happy Nation” cannot be successful if
only one part of the society benefits. It is the aspiration of NIAT that
all communities are involved in the projects organized by BTN. To
this extent, the BTN must engage with the numerous NGOs and
seek assistance and ideas to ensure that it can reach all, irrespective
of race, language and economic standing.
e. Civil Service needs to go Multi Lingual
It is proposed that all documentation at the Civil Service and Public
sector should include columns and explanations in Tamil and
Mandarin.
www.myniat.com
NIAT believes this would be a short term process as we are certain
that in the next 20 years (or less), all Malaysians will be proficient in
both English and Bahasa Malaysia with no doubt.
However, there is no reason why we cannot include Tamil and
Mandarin presently to ensure that all Malaysians irrespective of
educational background have adequate knowledge and
understanding of all public documentations and application / forms
etc.
f. Resurrection of the Rukun Tetangga
The RUKUN Tetangga was implemented to foster togetherness in
eradicating nuisance of petty crimes etc through a communal effort.
This effort saw tremendous support from all walks of life especially
from amongst the older residents in given locations.
It enabled the residents within a specific location to come together
and work as a team to fight against the negative elements – and
given the opportunity, it can serve as a proper forum of solidarity
and unity amongst all residents.
The Government must resurrect this avenue to muster the old and
the young to work together as one irrespective of race or religion.
g. Removal of Race & Religion Column
As an extension of the previous proposal, it is undesirable to have
the columns “Race” and “Religion” / “Bangsa” and “Agama” in all
formal documentation – except for statistics purposes including
NRD, Police and Census and data collection.
The need to verify the race and religion of a person should be
limited to areas that need such information.
Page66

INDIAN MALAYSIANS’ CALLS FOR GE13 - UNDO the HISTORY and REDO the PLAN
For example, for the purposes of making a complaint at a local
municipality, NIAT does not see the reason why RACE and RELIGION
is required.
Does it in any way imply that if the person complaining is of a
certain Race or Religion, his or her complain may or may not be
acted upon. If the answer is “NO” (as it should be) – then the need
for such a column cannot be justified.
Therefore the inclusion of such columns and all public documents or
inquiries including government job inquiries and scholarship
applications must be removed immediately.
This will give more credibility and reliability on all Census
immediately thereafter.
h. Repeal Act 114A
Section 114A is the second of two amendments made to Malaysia’s
Evidence Act 1950.
Law Minister Nazri Aziz tabled the second amendment, formally
known as Evidence (Amendment) (No2) Act 2012, in Dewan Rakyat
on 18 April. James Dawos Mamit supported the motion, and Section
114A was passed after the second and third reading. On 9 May,
Dewan Negara passed the amendment.
The newly-introduced provision, which came into force on July 31
2012, also goes against a fundamental principle of law that a person
is considered innocent until proven guilty. To the contrary this
provision reverses the situation.
Section 114A is problematic for a number of reasons:
www.myniat.com
i) “Section 114A violates the human rights principles of freedom
of expression as enshrined in Article 19 of both the Universal
Declaration of Human Rights (UDHR) and the International
Covenant on Civil and Political Rights (ICCPR).
ii) It disproportionately burdens the average Internet user who
may be accused of publishing seditious or defamatory content
(whether the accusation is substantiated or otherwise).
iii) It makes Internet intermediaries – parties that provide online
community forums, blogging and hosting services liable for the
content that is published through their services.
iv) It allows hackers and cyber criminals to be free by making the
person whose account/computer is hacked liable for any
content/data which might have changed.
v) it is a bad law passed in haste and does not take into account
public interest and participation.
i. Minority Protection Act
The term "minority" is still ambiguously defined in specialized
literature as well as in the political debate.
According to Capotorti's definition for the UN (Pan/Pfeil, 2003, p.
XV) "minority" means a community that is “Compactly or
dispersedly settled on the territory of a state; which is smaller in
number than the rest of the population of a state; whose
members are citizens of that state; which have ethnic, linguistic
or cultural features different from those of the rest of the
majority population; Whose members are guided by the will to
safeguard these features”.
In Malaysia Article 153 of the Malaysian Constitution reads
Page67

INDIAN MALAYSIANS’ CALLS FOR GE13 - UNDO the HISTORY and REDO the PLAN
"Provision should be made in the Constitution for the safeguarding
of the special position of the Malays and the legitimate interests of
the other Communities”.
While the scope of Article 153 is limited by Article 136, which
requires that civil servants be treated impartially regardless of race.
Keeping that constitutional mention in mind ; NIAT on behalf of the
minorities seek a clear and well spelt out “Minority Protection Act”
like many other countries like Australia, United Kingdom to ensure
their future and to build their confidence and erase the anxiety of
the minority against the majority ruling. The laws must specifically
spell out affirmative action on:
Educational opportunities
Economic representation and help
Public Service Opportunities
Social Representation
Political, & Religious Rights
In Conclusion…
NIAT recognized many proposals, memorandums, conferences,
consensus and rhetorical plans have come and gone without traces.
We recognize the issue right from the bottom and we propose the
solutions right from the top.
Without doubt the Indian Malaysians should be and are entitled to
all benefits enshrined in our Federal Constitution.
It is now the political will of the post GE13 Government to make
good on promises and the promises must be based on the needs.
www.myniat.com
NIAT stresses again: DEMA is the mother of all requests and it is
the only fair start in addressing Indian Malaysian issue for long term
sustainability.
To all Muslim leaders and administrators, please bear in mind that
all of us are answerable to Allah SWT in the hereafter on the Day of
Judgment. Any injustice to Non-Muslims under a majority Muslim
