Countering Terrorist Finance: Kuwait is a member of the Middle East North Africa Financial<br />

Acti<strong>on</strong> Task Force, a Financial Acti<strong>on</strong> Task Force-style regi<strong>on</strong>al body. Of particular note,<br />

Kuwait lacked comprehensive legislati<strong>on</strong> that criminalizes terrorist financing. In June <strong>2012</strong>,<br />

Kuwait was publicly identified by the FATF as a jurisdicti<strong>on</strong> with strategic anti-m<strong>on</strong>ey<br />

laundering/combating the financing of terrorism deficiencies, for which it has developed an<br />

acti<strong>on</strong> plan with the FATF to address these weaknesses.<br />

Kuwait had a comprehensive c<strong>on</strong>fiscati<strong>on</strong>, freezing, and seizing framework that applies to all<br />

offenses under Kuwaiti criminal legislati<strong>on</strong>. The lack of specific legislati<strong>on</strong> related to terrorist<br />

finance precluded immediate freezes, although cases prosecuted under other elements of the<br />

criminal code were able to initiate freezing and c<strong>on</strong>fiscati<strong>on</strong> of assets. Kuwait lacked an effective<br />

m<strong>on</strong>itoring framework for transfers outside of the formal sector, and lacked explicit laws and<br />

regulati<strong>on</strong>s requiring due diligence <strong>on</strong> customer data.<br />

The Ministry of Social Affairs and Labor and Ministry of Foreign Affairs c<strong>on</strong>tinued m<strong>on</strong>itoring<br />

and supervising charities, including enforcing the ban <strong>on</strong> cash d<strong>on</strong>ati<strong>on</strong>s, except during<br />

Ramadan; implementing an enhanced receipt system for Ramadan cash d<strong>on</strong>ati<strong>on</strong>s; and<br />

coordinating closely with the Ministry of Islamic Affairs to m<strong>on</strong>itor and prosecute fraudulent<br />

charities. The m<strong>on</strong>itoring of foundati<strong>on</strong>s was not as comprehensive as it was for charities.<br />

Despite these obstacles, competent authorities c<strong>on</strong>tinued efforts to combat financial crimes. The<br />

Central Bank of Kuwait engaged the Internati<strong>on</strong>al M<strong>on</strong>etary Fund in a 12-m<strong>on</strong>th technical<br />

assistance program aimed at addressing weaknesses in Kuwait’s anti-m<strong>on</strong>ey laundering/terrorist<br />

finance regime, and reached out to other partners as well.<br />

Regi<strong>on</strong>al and Internati<strong>on</strong>al Cooperati<strong>on</strong>: On December 25, GCC heads of state signed a<br />

collective security agreement to enable member states to resp<strong>on</strong>d quickly to, and take appropriate<br />

preventive measures to c<strong>on</strong>fr<strong>on</strong>t potential security threats. The pact stipulates full cooperati<strong>on</strong><br />

between the six member states and delineates mutual resp<strong>on</strong>sibilities to preserve collective<br />

security and stability. It also promotes security coordinati<strong>on</strong> and informati<strong>on</strong> exchanges to help<br />

combat transnati<strong>on</strong>al and organized crime and terrorism. To be implemented, the 45-article treaty<br />

must be approved by the GCC countries’ parliaments and Shura councils.<br />

LEBANON<br />

Overview: The Government of Leban<strong>on</strong> – led by a centrist President and Prime Minister, but<br />

with a cabinet dominated by the pro-Syrian regime and the Hizballah-aligned March 8 coaliti<strong>on</strong><br />

– c<strong>on</strong>tinued to make selective progress in building its counterterrorism capacity and cooperati<strong>on</strong><br />

with U.S. counterterrorism efforts. Lebanese authorities c<strong>on</strong>tinued efforts to disrupt suspected<br />

terrorist cells before they could act; arrested suspected al-Qa’ida (AQ)-affiliated militants and<br />

Palestinian violent extremists; and uncovered several weap<strong>on</strong>s caches of varying sizes. The<br />

Lebanese Armed Forces (LAF), in particular, were credited with capturing wanted terrorist<br />

fugitives and c<strong>on</strong>taining sectarian violence. The Internal Security Force (ISF) c<strong>on</strong>tinued to<br />

improve as a law enforcement organizati<strong>on</strong> and has become a viable counterbalance to armed<br />
