When it is not clear whe<strong>the</strong>r <strong>the</strong> method <strong>for</strong> concluding NOECs is based on growth rate<br />

method, <strong>the</strong> NOECs may be tentatively used.<br />

・O<strong>the</strong>r aquatic plants: Since <strong>the</strong>re is no officially approved test method <strong>for</strong><br />

long-term chronic aquatic toxicity, evidence in List 2 <strong>for</strong> exclusion from chronic aquatic<br />

toxicity requires an expert's judgment.<br />

3) Data on bioaccumulation and rapid degradability<br />

a) Requirements <strong>for</strong> usable data<br />

Data on bioaccumulation (BCF , log Kow), rapid degradability (bio degradability,<br />

hydrolysis, etc.) shall be based on test methods specified by <strong>the</strong> Chemical Substances<br />

Control Law, OECD Test Guidelines, ASTM Standard Test Methods, etc., and <strong>the</strong>y are<br />

deemed as reliable. In principle, data according to GLP shall be used. If, however, it is not<br />

clear whe<strong>the</strong>r a test is according to GLP, if an expert judged that data are reliable based on<br />

test conditions, etc., <strong>the</strong> data shall be adopted.<br />

i) a) Data on bioaccumulation<br />

As <strong>for</strong> data on bioaccumulation, when measured BCF values in fish are available, such<br />

as data <strong>for</strong> degradability of existing chemical substances by microorganisms,<br />

concentration in fish, etc., <strong>the</strong>y should take precedence, but results based on <strong>the</strong> properties<br />

such as low concentration cannot be directly used. If measured BCF values are not<br />

available, measured log Kows values are used as benchmarks. When measured log Kows<br />

values are not available, or <strong>the</strong>y are considered to be not reliable, estimation of log Kows<br />

by established methods such as QSAR may be carried out.<br />

Results from <strong>the</strong> following types of tests or corresponding tests may be accepted.<br />

OECD Test Guideline 305 and <strong>the</strong> <strong>for</strong>mer 305A-D (BCF)<br />

OECD Test Guideline 107 and 117 (Kow)<br />

When test results described above are not available, test results (Kow) from OECD<br />

Test Guideline123 (Draft) and <strong>the</strong> corresponding tests may be adopted under an expert's<br />

judgment.<br />

ii) b)Data on rapid degradability<br />

Both biotic and abiotic degradability (<strong>for</strong> example, hydrolysis) must be taken into<br />

account. When a substance degrades biotically or abiotically in <strong>the</strong> practical aquatic<br />

environment by > 70% in 28 days, or a test result based on oxygen consuming amount or<br />

carbon dioxide production amount exceeds 60%, or a test result based on dissolved<br />

organic carbon exceeds 70%, <strong>the</strong> substance is considered as rapidly degradable. A<br />
