and you agree to prevent unauthorized copying of the Software; (2) you may not reverse engineer, decompile, or<br />

disassemble the Software; and (3) you many not sublicense the Software.<br />

OWNERSHIP OF SOFTWARE AND COPYRIGHTS<br />

Title to all copies of the Software will remain with AMCC or its suppliers. The Software is copyrighted and protected by United<br />

States and Austrian copyright laws and international treaty provisions. You may not remove any copyright, patent, or other<br />

proprietary notices from the Software. AMCC and <strong>Barracuda</strong> Networks or its suppliers may make changes to the Software, or<br />

to items referenced therein, at any time without notice, but is not obligated to support or update the Software. Except as<br />

otherwise expressly provided, AMCC grants no express or implied right under AMCC patents, copyrights, trademarks, or<br />

other intellectual property rights. You may transfer the Software only if the recipient agrees to be fully bound by these terms<br />

and if you retain no copies of the Software.<br />

LIMITATION OF LIABILITY<br />

IN NO EVENT SHALL AMCC AND BARRACUDA NETWORKS OR ITS SUPPLIERS BE LIABLE FOR ANY DAMAGES WHATSOEVER<br />

(INCLUDING, WITHOUT LIMITATION, L<strong>OS</strong>T PROFITS, BUSINESS INTERRUPTION, OR L<strong>OS</strong>T INFORMATION) ARISING OUT OF<br />

THE USE OF OR INABILITY TO USE THE SOFTWARE, EVEN IF AMCC HAS BEEN ADVISED OF THE P<strong>OS</strong>SIBILITY OF SUCH<br />

DAMAGES. SOME JURISDICTIONS PROHIBIT EXCLUSION OR LIMITATION OF LIABILITY FOR IMPLIED WARRANTIES OR<br />

CONSEQUENTIAL OR INCIDENTAL DAMAGES, SO THE ABOVE LIMITATION MAY NOT APPLY TO YOU. YOU MAY ALSO HAVE<br />

TERMINATION<br />

This agreement will be terminated at any time if you violate its terms. Upon termination, you will immediately destroy the<br />

software.<br />

RESTRICTED RIGHTS LEGEND<br />

The AMCC Software Products are “Restricted Computer Software.” If the Software Products are licensed <strong>for</strong> use by the<br />

United States or <strong>for</strong> use in the per<strong>for</strong>mance of a United States government prime contract or subcontract, Customer agrees<br />

that the Software Products are delivered as: (i) “commercial computer software” as defined in DFARS 252.227-7013, Rights<br />

in Technical Data – Noncommercial Items; DFARS 252.227-7014, Rights In Noncommercial Computer Software and<br />

Noncommercial Computer Software Documentation; and DFARS 252.227-7015, Technical Data Commercial Items; (ii) as a<br />

“commercial item” as defined in FAR 2.101; or (iii) as “restricted commercial software” as defined in FAR 52.227-19,<br />

Commercial Computer Software – Restricted Rights; whichever is applicable. The use, duplication, and disclosure of the<br />

Software Products by the Department of Defense shall be subject to the terms and conditions set <strong>for</strong>th in the accompanying<br />

license agreement as provided in DFARS 227.7202. All other use, duplication and disclosure of the Software Products and<br />

Documentation by the United States shall be subject to the terms and conditions set <strong>for</strong>th in the accompanying license<br />

agreement and the restrictions contained in subsection (c) of FAR 52.227-19, Commercial Computer Software – Restricted<br />

Rights, or FAR 52.227-14, Rights in Data. Contractor/licensor is AMCC, 6290 Sequence Drive, San Diego, CA 92121.<br />

<strong>Barracuda</strong> Networks Software may include programs that are covered by the Apache License. The Apache license is<br />

re-printed below <strong>for</strong> you reference. These programs are copyrighted by their authors or other parties, and the authors and<br />

copyright holders disclaim any warranty <strong>for</strong> such programs. Other programs are copyright by <strong>Barracuda</strong> Networks.<br />
