had fallen vacant <strong>on</strong> retirement <str<strong>on</strong>g>of</str<strong>on</strong>g> earlier ED,<br />

<strong>Safety</strong>.<br />

16. Representative <str<strong>on</strong>g>of</str<strong>on</strong>g> INTUC Shri G.V.R<br />

Sarma po<strong>in</strong>ted out that the decisi<strong>on</strong> to post M–<br />

2 Grade <str<strong>on</strong>g>of</str<strong>on</strong>g>ficers to head <strong>Safety</strong> Department is<br />

not be<strong>in</strong>g followed <strong>in</strong> some coal companies <str<strong>on</strong>g>of</str<strong>on</strong>g><br />

CIL.<br />

17. CMD, CIL expla<strong>in</strong>ed that some times an<br />

M– 2 <str<strong>on</strong>g>of</str<strong>on</strong>g>ficers are preferred <strong>on</strong> account <str<strong>on</strong>g>of</str<strong>on</strong>g> their<br />

l<strong>on</strong>ger experience <strong>on</strong> the safety related job.<br />

18. Adviser (Projects) op<strong>in</strong>ed that the<br />

pers<strong>on</strong>s posted as In-charge <str<strong>on</strong>g>of</str<strong>on</strong>g> safety <strong>in</strong> coal<br />

companies should have adequate experience <strong>in</strong><br />

the matters related to safety.<br />

Deployment <str<strong>on</strong>g>of</str<strong>on</strong>g> c<strong>on</strong>tractor’s workers.<br />

19. Representative <str<strong>on</strong>g>of</str<strong>on</strong>g> OCMF Shri A.C.<br />

Patra and BMS Shri S.K. Pandey po<strong>in</strong>ted out<br />

that <strong>in</strong> many companies, c<strong>on</strong>tractor workers<br />

are deployed for more than 8 hours <strong>in</strong> a day<br />

and no overtime wages are be<strong>in</strong>g paid and also<br />

wages are not be<strong>in</strong>g paid through banks.<br />

Further <strong>in</strong> some places c<strong>on</strong>tractors are also not<br />

pay<strong>in</strong>g m<strong>in</strong>imum wages to the labour<br />

employed by them.<br />

20. CMD, MCL <strong>in</strong>formed that <strong>in</strong> MCL<br />

c<strong>on</strong>tractor workers are be<strong>in</strong>g paid through<br />

banks.<br />

21. Trade Uni<strong>on</strong> representative Shri R.P.<br />

S<strong>in</strong>gh and Shri Sankar Saha also desired that<br />

the payment <str<strong>on</strong>g>of</str<strong>on</strong>g> m<strong>in</strong>imum wages to c<strong>on</strong>tractor<br />

workers should be complide with and the<br />

payment <str<strong>on</strong>g>of</str<strong>on</strong>g> their wages through bank should<br />

be implemented by all coal companies.<br />

22. Representative <str<strong>on</strong>g>of</str<strong>on</strong>g> CITU Shri M. K.<br />

Mukherjee desired that the m<strong>in</strong>imum wages<br />

should be paid to all c<strong>on</strong>tractor workers as per<br />

circular issued by the M<strong>in</strong>istry <str<strong>on</strong>g>of</str<strong>on</strong>g> Labour and<br />

Employment <strong>in</strong> August, 2008.<br />

23. CMD, CIL desired to know whether the<br />

said circular is applicable to employees<br />

work<strong>in</strong>g <strong>in</strong> coal m<strong>in</strong>es. JS, MOLE clarified<br />

that the said circular is not applicable to coal<br />

m<strong>in</strong>es.<br />

24. Chairman op<strong>in</strong>ed that Trade Uni<strong>on</strong><br />

representatives may directly approach MoLE<br />

regard<strong>in</strong>g mak<strong>in</strong>g relevant provisi<strong>on</strong>s for<br />

m<strong>in</strong>imum wages applicable to coal m<strong>in</strong>es.<br />

NLC<br />

M-3 <str<strong>on</strong>g>of</str<strong>on</strong>g>ficers are posted as <strong>Safety</strong> Officer besides<br />

Board Level Officer <strong>in</strong>-charge <str<strong>on</strong>g>of</str<strong>on</strong>g> Corporate <strong>Safety</strong><br />

(M<strong>in</strong>es & Thermal).<br />

CIL<br />

Work<strong>in</strong>g Hour: Deployment <str<strong>on</strong>g>of</str<strong>on</strong>g> C<strong>on</strong>tractor’s Workers is<br />

restricted up to Eight (8) hours <strong>in</strong> all the subsidiary<br />

companies <str<strong>on</strong>g>of</str<strong>on</strong>g> CIL.<br />

M<strong>in</strong>imum wage: As per State Govt. M<strong>in</strong>imum wage<br />

Act.<br />

Mode <str<strong>on</strong>g>of</str<strong>on</strong>g> payment: Both through bank and cash.<br />

NLC<br />

In NLC, <strong>on</strong>ly Regular Employees carry out producti<strong>on</strong><br />

activities and the C<strong>on</strong>tract Workmen are ma<strong>in</strong>ly engaged<br />

for ma<strong>in</strong>tenance <str<strong>on</strong>g>of</str<strong>on</strong>g> support services for the Specialized<br />

M<strong>in</strong><strong>in</strong>g Equipments, Road formati<strong>on</strong>, clean<strong>in</strong>g works etc.<br />

In NLC, C<strong>on</strong>tract Workmen are permitted to work extra<br />

hours <strong>on</strong>ly if required, after giv<strong>in</strong>g sufficient rest<br />

<strong>in</strong>tervals as per statute.<br />

C<strong>on</strong>tract Workmen are be<strong>in</strong>g paid as per provisi<strong>on</strong>s for<br />

m<strong>in</strong>imum wages applicable and be<strong>in</strong>g ensured by NLC.<br />

SCCL<br />

Work<strong>in</strong>g hours are restricted to 8 hours per day.<br />

Management is ensur<strong>in</strong>g payment <str<strong>on</strong>g>of</str<strong>on</strong>g> M<strong>in</strong>imum<br />

wages and deducti<strong>on</strong> <str<strong>on</strong>g>of</str<strong>on</strong>g> Provident fund from<br />

C<strong>on</strong>tract workmen clause is <strong>in</strong>corporated <strong>in</strong> NITs<br />

while award<strong>in</strong>g <str<strong>on</strong>g>of</str<strong>on</strong>g>fload<strong>in</strong>g works.<br />

Management committees are appo<strong>in</strong>ted to m<strong>on</strong>itor<br />

such payment and all payments are made through<br />

Banks.<br />
