<strong>the</strong> motorway at <strong>the</strong> Youpougon banco<br />
station, we pumped water into each compartment<br />
of <strong>the</strong> tank and we poured a<br />
mixture of gresyl, Omo and oil into each<br />
of <strong>the</strong> compartments. Then we shut <strong>the</strong><br />
compartments and went to Maca with<br />
this mixture sloshing around. We dumped<br />
<strong>the</strong> contents on <strong>the</strong> edge of <strong>the</strong> road<br />
after <strong>the</strong> police checkpoint in <strong>the</strong> Banco<br />
Forest before going back to Abobo. (Deposition<br />

33. “We went to a car wash in Abobo but<br />
<strong>the</strong>y wouldn’t let me clean my truck. We<br />
<strong>the</strong>n went to a second car wash on <strong>the</strong><br />

order to tackle <strong>the</strong> smell, we use red<br />
palm oil by soaking a rag in oil to wipe<br />
<strong>the</strong> walls of <strong>the</strong> tanker compartment.”<br />

abbatoir. I did not use a hose to empty<br />
<strong>the</strong> tank; I simply opened <strong>the</strong> hatched.<br />
The liquid poured out onto <strong>the</strong> ground<br />
on <strong>the</strong> right because I had reversed onto<br />
<strong>the</strong> grass so that <strong>the</strong> cab faced <strong>the</strong> road<br />
at <strong>the</strong> top of <strong>the</strong> hill. Some cars did pass<br />

at Abobo Coco Service, <strong>the</strong>re is a place<br />
where people can clean <strong>the</strong>ir trucks<br />

heure pour transférer le contenu de ma<br />
citerne dans les deux conteneurs cylindriques.”<br />

précédente au Garage UTD, nous avons<br />
pompé de l’eau dans chacune des cuves.<br />
Nous nous sommes ensuite dirigés<br />
vers la Maca pour les vider du fait qu’il<br />
ya peu d’habitations le long de la route<br />
et que, juste en bordure, d’épaisses<br />
broussailles s’étendent sur plusieurs<br />
kilometers. En cours de route, j’ai cependant<br />
été arête à un poste de controle du<br />

“Paragraph 44 About one hour later, XXX<br />
called me to tell me that everything had<br />
been arranged. So I went back to where<br />
<strong>the</strong> truck was parked near <strong>the</strong> Maca<br />
checkpoint. I stayed near <strong>the</strong> truck but I<br />
hid because I wanted to know what was<br />
going on. It was while I was waiting that I<br />
noticed that my tank had leaked and that<br />
<strong>the</strong>re was a pool of about 200 to 400<br />
litres of product under <strong>the</strong> truck.<br />
The last sentence should be as follows:<br />
“It was while I was waiting that I noticed<br />
that my tank had leaked and that<br />
<strong>the</strong>re was a pool of about one thousand<br />
(1000) litres of product under <strong>the</strong> truck”.<br />
Para 48 Reluctantly, <strong>the</strong> CECOS squad<br />
let us go after long discussions with <strong>the</strong><br />
ministry representative. XXX and I got<br />
back into <strong>the</strong> truck and drove for about 1<br />
or 2 km before I stopped on <strong>the</strong> edge of<br />
<strong>the</strong> road in <strong>the</strong> Banco Forest. There are<br />
no houses in <strong>the</strong> vicinity and we were a<br />
long way from <strong>the</strong> prison.<br />
What is incorrect in this paragraph is <strong>the</strong><br />
statement that we dumped a long way<br />
from <strong>the</strong> prison, because we dumped<br />
close to <strong>the</strong> prison. The second and<br />
third sentences should read as follows:<br />
“XXX and I got into <strong>the</strong> truck and we went<br />
about 800m before I stopped on <strong>the</strong><br />
edge of <strong>the</strong> road in <strong>the</strong> Banco Forest.<br />
There are no houses in <strong>the</strong> vicinity and<br />
it is not far from <strong>the</strong> prison.” There must<br />
be a reason why Trafigura wanted to have<br />
it stated that we were a long way from<br />
<strong>the</strong> prison, but I don’t know what that<br />
reason is. Trafigura may be trying to undermine<br />
<strong>the</strong> arguments of <strong>the</strong> opposing<br />

42. “We took my truck again to go to <strong>the</strong><br />
Gros-trou car wash in Abobo. We dumped<br />
<strong>the</strong> last 1000 litres or so of product in<br />
a manhole at <strong>the</strong> car wash. The tanker<br />
was <strong>the</strong>n washed with bleach, water<br />
and Omo to try to get rid of <strong>the</strong> smell.<br />
XXX and <strong>the</strong> people doing <strong>the</strong> cleaning<br />
got into <strong>the</strong> tanks to clean <strong>the</strong>m but,<br />
unfortunately, without <strong>the</strong> desired effect;<br />
<strong>the</strong> smell persisted and we were forced<br />
to go and negotiate with a painter to get<br />
him to paint <strong>the</strong> entire truck; that costs<br />
is CFA two hundred thousand (200,000).<br />
Despite all <strong>the</strong>se efforts, <strong>the</strong> smell persisted<br />
and we parked at <strong>the</strong> car park late<br />
at night. We left <strong>the</strong> truck where it was<br />
for <strong>the</strong> disinfection team to tow away and<br />
